<section id="d197113e336" identifier="/us/pl/114/90/tI/s102" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>INTERNATIONAL LAUNCH COMPETITIVENESS.</heading><subsection class="firstIndent0 fontsize10" id="y98c830e7-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><content>It is the sense of Congress that it is in the public interest to update the methodology used to calculate the maximum probable loss from claims under <ref href="/us/usc/t51/s50914">section 50914 of title 51, United States Code</ref>, with a validated risk profile approach in order to consistently compute valid and reasonable maximum probable loss values.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y98c830e8-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98c830e9-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x98c830ea-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x98c830eb-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p><p class="leftAlign firstIndent0 fontsize8" id="x98c830ec-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Plans.</p></sidenote>Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation, in consultation with the commercial space sector and insurance providers, shall—</chapeau><paragraph class="fontsize10" id="y98c830ed-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>evaluate the methodology used to calculate the maximum probable loss from claims under <ref href="/us/usc/t51/s50914">section 50914 of title 51, United States Code</ref>, and, if necessary, develop a plan to update that methodology;</content></paragraph>
<paragraph class="fontsize10" id="y98c830ee-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in evaluating or developing a plan under paragraph (1)—</chapeau><subparagraph class="fontsize10" id="y98c830ef-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>ensure that the Federal Government is not exposed to greater costs than intended and that launch companies are not required to purchase more insurance coverage than necessary; and</content></subparagraph>
<subparagraph class="fontsize10" id="y98c830f0-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>consider the impact of the cost to both the industry and the Government of implementing an updated methodology; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y98c830f1-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>submit the evaluation, and any plan, to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y98c830f2-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Independent Assessment</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98c830f3-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 270 days after the date the evaluation is submitted under subsection (b)(3), the Comptroller General shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives an assessment of—</chapeau><paragraph class="fontsize10" id="y98c830f4-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the analysis and conclusions provided by the Secretary of Transportation in the evaluation, and any plan, under subsection (b);</content></paragraph>
<paragraph class="fontsize10" id="y98c830f5-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the implementation schedule proposed by the Secretary in the plan described in paragraph (1);</content></paragraph>
<paragraph class="fontsize10" id="y98c830f6-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the suitability of the plan described in paragraph (1) for implementation; and <page identifier="/us/stat/129/706">129 STAT. 706</page></content></paragraph>
<paragraph class="fontsize10" id="y98c830f7-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>any further actions needed to implement the plan described in paragraph (1) or otherwise accomplish the purpose of this section.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y98c830f8-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s102/d" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Launch Liability Extension</inline>.—</heading><content>Section 50915(f)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98c830f9-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t51/s50915">51 USC 50915</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>December 31, 2016</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>September 30, 2025</quotedText>”.</content></subsection>

<section id="d197113e714" identifier="/us/pl/114/90/tI/s105" style="-uslm-lc:I658143"><num class="fontsize12" value="105">SEC. 105. </num><heading>LICENSING REPORT.</heading><content style="-uslm-lc:I658120">  Not later than 120 days after the date of enactment of this Act, the Secretary of Transportation shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report on approaches for streamlining the licensing and permitting process of launch vehicles, reentry vehicles, or components of launch or reentry vehicles, to enable non-launch flight operations related to space transportation. The report shall include approaches to improve efficiency, reduce unnecessary costs, resolve inconsistencies, remove duplication, and minimize unwarranted constraints. The <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98c91b7b-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote>report shall also include an assessment of existing private and government infrastructure, as appropriate, in future licensing activities.</content></section>

<section id="d197113e756" identifier="/us/pl/114/90/tI/s107" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="107">SEC. 107. </num><heading>CROSS WAIVERS.</heading><content class="firstIndent0 fontsize10" id="x98c9428f-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 50914(b)(1) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><paragraph class="fontsize10" id="y98c968a0-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1)</num><subparagraph class="inline" id="y98c968a1-e841-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><content>A launch or reentry license issued or transferred under this chapter shall contain a provision requiring the licensee or transferee to make a reciprocal waiver of claims with applicable parties involved in launch services or reentry services under which each party to the waiver agrees to be responsible for personal injury to, death of, or property damage or loss sustained by it or its own employees resulting from an activity carried out under the applicable license.</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y98c968a2-e841-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98c968a3-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>In this paragraph, the term ‘<term>applicable parties</term>’ means—</chapeau><clause class="fontsize10" id="y98c968a4-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>contractors, subcontractors, and customers of the licensee or transferee;</content></clause>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y98c9b6d4-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s108/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>Nothing in this section shall apply to the activities of the ISS national laboratory as described in section 504 of the National Aeronautics and Space Administration Authorization Act of 2010 (<ref href="/us/usc/t42/s18354">42 U.S.C. 18354</ref>), including any research or development projects utilizing the ISS national laboratory.</content></subsection>
</section>
<section id="d197113e876" identifier="/us/pl/114/90/tI/s109" style="-uslm-lc:I658143"><num class="fontsize12" value="109">SEC. 109. </num><heading>ORBITAL TRAFFIC MANAGEMENT.</heading><subsection class="firstIndent0 fontsize10" id="y98ca5315-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><content>It is the sense of the Congress that an improved framework may be necessary for space traffic management of United States Government assets and United States private sector assets in outer space and orbital debris mitigation.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y98ca5316-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Study</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98ca5317-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x98ca5318-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>Not later than 90 days after the date of enactment of this Act, the Administrator of the National Aeronautics and Space Administration, in consultation with the Secretary of Transportation, the Chair of the Federal Communications Commission, the Secretary of Commerce, and the Secretary of Defense, shall enter into an arrangement with an independent systems engineering and technical assistance organization to study alternate frameworks for the management of space traffic and orbital activities.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y98ca5319-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98ca531a-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The study shall include the following:</chapeau><paragraph class="fontsize10" id="y98ca531b-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>An assessment of current regulations, best practices, and industry standards that apply to space traffic management and orbital debris mitigation.</content></paragraph>
<paragraph class="fontsize10" id="y98ca531c-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>An assessment of current statutory authorities granted to the Federal Communications Commission, the Department of Transportation, and the Department of Commerce that apply to space traffic management and orbital debris mitigation and how those agencies utilize and coordinate those authorities.</content></paragraph>
<paragraph class="fontsize10" id="y98ca531d-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98ca531e-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><content>A review of all space traffic management and orbital debris requirements under treaties and other international agreements to which the United States is a signatory, and other nonbinding international arrangements in which the United States participates, and the manner and extent to which the Federal Government complies with those requirements and arrangements.</content></paragraph>
<paragraph class="fontsize10" id="y98ca531f-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>An assessment of existing Federal Government assets used to conduct space traffic management and space situational awareness.</content></paragraph>
<paragraph class="fontsize10" id="y98ca5320-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>An assessment of the risk to space traffic management associated with smallsats and any necessary Government coordination for their launch and utilization to avoid congestion of the orbital environment and improve space situational awareness.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y98ca5326-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Department of Defense Authorities</inline>.—</heading><paragraph class="fontsize10" id="y98ca5327-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Sense of congress</inline>.—</heading><content>It is the sense of Congress that the Department of Defense plays a vital and unique role in protecting national security assets in space.</content></paragraph>
<paragraph class="fontsize10" id="y98ca5328-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s109/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in this section may be construed to affect the authority of the Secretary of Defense as it relates to safeguarding the national security.</content></paragraph>

<section id="d197113e999" identifier="/us/pl/114/90/tI/s110" style="-uslm-lc:I658143"><num class="fontsize12" value="110">SEC. 110. </num><heading>SPACE SURVEILLANCE AND SITUATIONAL AWARENESS DATA.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x98ca7a39-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98ca7a3a-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 120 days after the date of enactment of this Act, the Secretary of Transportation in concurrence with the Secretary of Defense shall—</chapeau><paragraph class="fontsize10" id="y98ca7a3b-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s110/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98ca7a3c-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>in consultation with the heads of other relevant Federal agencies, study the feasibility of processing and releasing safety-related space situational awareness data and information to any entity consistent with national security interests and public safety obligations of the United States; and</content></paragraph>

<paragraph class="indentUp0 fontsize10" id="y98cb64a7-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Communication and transparency</inline>.—</heading><content>Nothing in this subsection shall be construed to limit the authority of the Secretary to discuss potential regulatory approaches, potential performance standards, or any other topic related to this subsection with the commercial space industry, including observations, findings, and recommendations from the Commercial Space Transportation Advisory Committee, or its successor organization, prior to the issuance of a notice of proposed rulemaking. Such discussions shall not be construed to permit <page identifier="/us/stat/129/710">129 STAT. 710</page>
the Secretary to promulgate industry regulations except as otherwise provided in this section.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y98cb64a8-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Interim voluntary industry consensus standards reports</inline>.—</heading><subparagraph class="fontsize10" id="y98cb64a9-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb64aa-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x98cb64ab-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>Not later than December 31, 2016, and every 30 months thereafter until December 31, 2021, the Secretary, in consultation and coordination with the commercial space sector, including the Commercial Space Transportation Advisory Committee, or its successor organization, shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report on the progress of the commercial space transportation industry in developing voluntary industry consensus standards that promote best practices to improve industry safety.</content></subparagraph>
<subparagraph class="fontsize10" id="y98cb64ac-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The report shall include, at a minimum—</chapeau><clause class="fontsize10" id="y98cb64ad-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>any voluntary industry consensus standards that have been accepted by the industry at large;</content></clause>
<clause class="fontsize10" id="y98cb64ae-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the identification of areas that have the potential to become voluntary industry consensus standards that are currently under consideration by the industry at large;</content></clause>
<clause class="fontsize10" id="y98cb64af-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb64b0-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>an assessment from the Secretary on the general progress of the industry in adopting voluntary industry consensus standards;</content></clause>
<clause class="fontsize10" id="y98cb64b1-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>any lessons learned about voluntary industry consensus standards, best practices, and commercial space launch operations;</content></clause>
<clause class="fontsize10" id="y98cb64b2-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>any lessons learned associated with the development, potential application, and acceptance of voluntary industry consensus standards, best practices, and commercial space launch operations; and</content></clause>
<clause class="fontsize10" id="y98cb64b3-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb64b4-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x98cb64b5-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>recommendations, findings, or observations from the Commercial Space Transportation Advisory Committee, or its successor organization, on the progress of the industry in developing voluntary industry consensus standards that promote best practices to improve industry safety.</content></clause>

</paragraph>
<paragraph class="indentUp0 fontsize10" id="y98cb8bc6-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb8bc7-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>Not later than 270 days after the date of enactment of the SPACE Act of 2015, the Secretary, in consultation and coordination with the commercial space sector, including the Commercial Space Transportation Advisory Committee, or its successor organization, shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report specifying key industry metrics that might indicate readiness of the commercial space sector and the Department of Transportation to transition to a safety framework that may include regulations under paragraph (9) that considers space flight participant, government astronaut, and crew safety.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y98cb8bc8-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb8bc9-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><content>Not later than March 31 of each of 2018 and 2022, the Secretary, in consultation and coordination with the commercial space sector, including the Commercial Space <page identifier="/us/stat/129/711">129 STAT. 711</page>
Transportation Advisory Committee, or its successor organization, shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report that identifies the activities, described in this subsection and subsection (d) most appropriate for a new safety framework that may include regulatory action, if any, and a proposed transition plan for such safety framework.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y98cb8bca-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Independent review</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb8bcb-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x98cb8bcc-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p><p class="leftAlign firstIndent0 fontsize8" id="x98cb8bcd-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote>Not later than December 31, 2022, an independent systems engineering and technical assistance organization or standards development organization contracted by the Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives an assessment of the readiness of the commercial space industry and the Federal Government to transition to a safety framework that may include regulations. As<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb8bce-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote> part of the review, the contracted organization shall evaluate—</chapeau><subparagraph class="fontsize10" id="y98cb8bcf-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the progress of the commercial space industry in adopting voluntary industry consensus standards as reported by the Secretary in the interim assessments included in the reports under paragraph (5);</content></subparagraph>
<subparagraph class="fontsize10" id="y98cb8bd0-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the progress of the commercial space industry toward meeting the key industry metrics identified by the report under paragraph (6), including the knowledge and operational experience obtained by the commercial space industry while providing services for compensation or hire; and</content></subparagraph>
<subparagraph class="fontsize10" id="y98cb8bd1-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>whether the areas identified in the reports under paragraph (5) are appropriate for regulatory action, or further development of voluntary industry consensus standards, considering the progress evaluated in subparagraphs (A) and (B) of this paragraph.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="y98cb8bd2-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Learning period</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cb8bd3-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote>Beginning on October 1, 2023, the Secretary may propose regulations under this subsection without regard to subparagraphs (C) and (D) of paragraph (2). The development of any such regulations shall take into consideration the evolving standards of the commercial space flight industry as identified in the reports published under paragraphs (5), (6), and (7).”</content></paragraph>

This need was identified by the Secretary of Transportation and the Administrator of the National Aeronautics and Space Administration due to the intended use of commercial launch vehicles and reentry vehicles developed under the Commercial Crew Development Program, authorized in section <page identifier="/us/stat/129/712">129 STAT. 712</page>
402 of the National Aeronautics and Space Administration Authorization Act of 2010 (<ref href="/us/stat/124/2820">124 Stat. 2820</ref>; <ref href="/us/pl/111/267">Public Law 111–267</ref>). It is the sense of Congress that the authority delegated to the Administration by the amendment made by subsection (d) of this section should be used for that purpose.</content></subsection>

<subparagraph class="fontsize10" id="y98ccc45e-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is carried within a launch vehicle or reentry vehicle in the course of his or her employment, which may include performance of activities directly relating to the launch, reentry, or other operation of the launch vehicle or reentry vehicle; and</content></subparagraph>
<subparagraph class="fontsize10" id="y98ccc45f-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>is either—</chapeau><clause class="fontsize10" id="y98ccc460-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>an employee of the United States Government, including the uniformed services, engaged in the performance of a Federal function under authority of law or an Executive act; or</content></clause>
<clause class="fontsize10" id="y98ccc461-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an international partner astronaut.</content></clause>

<paragraph class="indentUp0 fontsize10" id="y98ccc462-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>‘international partner astronaut’ means an individual designated under Article 11 of the International Space Station Intergovernmental Agreement, by a partner to that agreement other than the United States, as qualified to serve as an International Space Station crew member.</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y98ccc463-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>‘International Space Station Intergovernmental Agreement’ means the Agreement Concerning Cooperation on the International Space Station, signed at Washington January 29, 1998 (TIAS 12927).”</content></paragraph>

<section id="d197113e1790" identifier="/us/pl/114/90/tI/s113" style="-uslm-lc:I658143"><num class="fontsize12" value="113">SEC. 113. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cd12a7-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t51/s50918">51 USC 50918 note</ref>.</p></sidenote><heading>STREAMLINE COMMERCIAL SPACE LAUNCH ACTIVITIES.</heading><subsection class="firstIndent0 fontsize10" id="y98cdfd08-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><content>It is the sense of Congress that eliminating duplicative requirements and approvals for commercial launch and reentry operations will promote and encourage the development of the commercial space sector.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y98cdfd09-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Reaffirmation of Policy</inline>.—</heading><chapeau>Congress reaffirms that the Secretary of Transportation, in overseeing and coordinating commercial launch and reentry operations, should—</chapeau><paragraph class="fontsize10" id="y98cdfd0a-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>promote commercial space launches and reentries by the private sector;</content></paragraph>
<paragraph class="fontsize10" id="y98cdfd0b-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>facilitate Government, State, and private sector involvement in enhancing U.S. launch sites and facilities;</content></paragraph>
<paragraph class="fontsize10" id="y98cdfd0c-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>protect public health and safety, safety of property, national security interests, and foreign policy interests of the United States; and</content></paragraph>
<paragraph class="fontsize10" id="y98cdfd0d-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>consult with the head of another executive agency, including the Secretary of Defense or the Administrator of the National Aeronautics and Space Administration, as necessary to provide consistent application of licensing requirements under <ref href="/us/usc/t51/ch509">chapter 509 of title 51, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y98cdfd0e-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><paragraph class="fontsize10" id="y98cdfd0f-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cdfd10-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>The Secretary of Transportation under <ref href="/us/usc/t51/s50918">section 50918 of title 51, United States Code</ref>, and subject to section 50905(b)(2)(C) of that title, shall consult with the Secretary of Defense, the Administrator of the National Aeronautics and Space Administration, and the heads of other executive agencies, as appropriate—</chapeau><subparagraph class="fontsize10" id="y98cdfd11-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to identify all requirements that are imposed to protect the public health and safety, safety of property, national security interests, and foreign policy interests of the United States relevant to any commercial launch of a launch vehicle or commercial reentry of a reentry vehicle; and</content></subparagraph>
<subparagraph class="fontsize10" id="y98cdfd12-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cdfd13-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><chapeau>to evaluate the requirements identified in subparagraph (A) and, in coordination with the licensee or transferee and the heads of the relevant executive agencies—</chapeau><clause class="fontsize10" id="y98cdfd14-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>determine whether the satisfaction of a requirement of one agency could result in the satisfaction of a requirement of another agency; and</content></clause>

<paragraph class="fontsize10" id="y98cdfd16-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x98cdfd17-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x98cdfd18-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>Not later than 180 days after the date of enactment of this Act, and annually thereafter until the Secretary of Transportation determines no outmoded or duplicative requirements or approvals of the Federal Government exist, the Secretary of Transportation, in consultation with the Secretary of Defense, the Administrator of the National Aeronautics and Space Administration, the commercial space sector, <page identifier="/us/stat/129/715">129 STAT. 715</page>
and the heads of other executive agencies, as appropriate, shall submit to the Committee on Commerce, Science, and Transportation of the Senate, the Committee on Science, Space, and Technology of the House of Representatives, and the congressional defense committees a report that includes the following:</chapeau><subparagraph class="fontsize10" id="y98cdfd19-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>A description of the process for the application for and approval of a permit or license under <ref href="/us/usc/t51/ch509">chapter 509 of title 51, United States Code</ref>, for the commercial launch of a launch vehicle or commercial reentry of a reentry vehicle, including the identification of—</chapeau><clause class="fontsize10" id="y98cdfd1a-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>any unique requirements for operating on a United States Government launch site, reentry site, or launch property; and</content></clause>
<clause class="fontsize10" id="y98cdfd1b-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any inconsistent, outmoded, or duplicative requirements or approvals.</content></clause>

<subparagraph class="fontsize10" id="y98cdfd1c-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s113/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>A description of current efforts, if any, to coordinate and work across executive agencies to define interagency processes and procedures for sharing information, avoiding duplication of effort, and resolving common agency requirements.</content></subparagraph>

<section id="d197113e1982" identifier="/us/pl/114/90/tI/s114" style="-uslm-lc:I658143"><num class="fontsize12" value="114">SEC. 114. </num><heading>OPERATION AND UTILIZATION OF THE ISS.</heading><subsection class="firstIndent0 fontsize10" id="y98ce9967-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s114/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress</inline>.—</heading><chapeau>It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y98ce9968-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s114/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>maximum utilization of partnerships, scientific research, commercial applications, and exploration test bed capabilities of the ISS is essential to ensuring the greatest return on investments made by the United States and its international partners in the development, assembly, and operations of that unique facility; and</content></paragraph>
<paragraph class="fontsize10" id="y98ce9969-e841-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/90/tI/s114/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>every effort should be made to ensure that decisions regarding the service life of the ISS are based on the station’s projected capability to continue providing effective and productive research and exploration test bed capabilities.</content></paragraph>

<paragraph class="fontsize10" id="y98d04749-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>On a space available basis, Federal Government or educational payloads that are consistent with NASA’s mission for exploration beyond low-Earth orbit.</content></paragraph>

<paragraph class="fontsize10" id="y98d1f44c-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>discourage government barriers to the development in the United States of economically viable, safe, and stable industries for commercial exploration for and commercial recovery of space resources in manners consistent with the international obligations of the United States; and</content></paragraph>
<paragraph class="fontsize10" id="y98d21b5d-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>promote the right of United States citizens to engage in commercial exploration for and commercial recovery of space resources free from harmful interference, in accordance with the international obligations of the United States and subject to authorization and continuing supervision by the Federal Government.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y98d21b5e-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this section, the President shall submit to Congress a report on commercial exploration for and commercial recovery of space resources by United States citizens that specifies—</chapeau><paragraph class="fontsize10" id="y98d21b5f-e841-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the authorities necessary to meet the international obligations of the United States, including authorization and continuing supervision by the Federal Government; and</content></paragraph>
