<section id="d198029e101" identifier="/us/pl/114/80/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2fe0cda2-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s101">6 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">DHS Social Media Improvement Act of 2015</shortTitle>”.</content></section>
<section id="d198029e116" identifier="/us/pl/114/80/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SOCIAL MEDIA WORKING GROUP.</heading><subsection class="firstIndent0 fontsize10" id="y2fe169e3-e843-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/80/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Title III of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s181/etseq">6 U.S.C. 181 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y2fe31794-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="318">“SEC. 318. </num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2fe31795-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s195d">6 USC 195d</ref>.</p></sidenote>SOCIAL MEDIA WORKING GROUP.</heading><subsection class="firstIndent0 fontsize10" id="y2fe31796-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>The Secretary shall establish within the Department a social media working group (in this section referred to as the ‘Group’).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2fe31797-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><content>In order to enhance the dissemination of information through social media technologies between the Department and appropriate stakeholders and to improve use of social media technologies in support of preparedness, response, and recovery, the Group shall identify, and provide guidance and best practices to the emergency preparedness and response community on, the use of social media technologies before, during, and after a natural disaster or an act of terrorism or other man-made disaster.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2fe33ea8-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><paragraph class="fontsize10" id="y2fe33ea9-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Membership of the Group shall be composed of a cross section of subject matter experts from Federal, State, local, tribal, territorial, and nongovernmental organization practitioners, including representatives from the following entities:</chapeau><subparagraph class="fontsize10" id="y2fe33eaa-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The Office of Public Affairs of the Department.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eab-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The Office of the Chief Information Officer of the Department.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eac-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>The Privacy Office of the Department.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33ead-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>The Federal Emergency Management Agency.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eae-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>The Office of Disability Integration and Coordination of the Federal Emergency Management Agency.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eaf-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>The American Red Cross.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eb0-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>The Forest Service.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eb1-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>The Centers for Disease Control and Prevention.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eb2-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>The United States Geological Survey.<page identifier="/us/stat/129/647">129 STAT. 647</page></content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eb3-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">“(J) </num><content>The National Oceanic and Atmospheric Administration.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2fe33eb4-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Chairperson; co-chairperson</inline>.—</heading><subparagraph class="fontsize10" id="y2fe33eb5-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Chairperson</inline>.—</heading><content>The Secretary, or a designee of the Secretary, shall serve as the chairperson of the Group.</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eb6-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Co-chairperson</inline>.—</heading><content>The chairperson shall designate, on a rotating basis, a representative from a State or local government who is a member of the Group to serve as the co-chairperson of the Group.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2fe33eb7-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Additional members</inline>.—</heading><chapeau>The chairperson shall appoint, on a rotating basis, qualified individuals to the Group. The total number of such additional members shall—</chapeau><subparagraph class="fontsize10" id="y2fe33eb8-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>be equal to or greater than the total number of regular members under paragraph (1); and</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eb9-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>include—</chapeau><clause class="fontsize10" id="y2fe33eba-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>not fewer than 3 representatives from the private sector; and</content></clause>
<clause class="fontsize10" id="y2fe33ebb-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>representatives from—</chapeau><subclause class="fontsize10" id="y2fe33ebc-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><chapeau>State, local, tribal, and territorial entities, including from—</chapeau><item class="fontsize10" id="y2fe33ebd-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>law enforcement;</content></item>
<item class="fontsize10" id="y2fe33ebe-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>fire services;</content></item>
<item class="fontsize10" id="y2fe33ebf-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>emergency management; and</content></item>
<item class="fontsize10" id="y2fe33ec0-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="dd">“(dd) </num><content>public health entities;</content></item>
</subclause>
<subclause class="fontsize10" id="y2fe33ec1-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>universities and academia; and</content></subclause>
<subclause class="fontsize10" id="y2fe33ec2-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>nonprofit disaster relief organizations.</content></subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2fe33ec3-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Term limits</inline>.—</heading><content>The chairperson shall establish term limits for individuals appointed to the Group under paragraph (3).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2fe33ec4-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Consultation With Non-members</inline>.—</heading><content>To the extent practicable, the Group shall work with entities in the public and private sectors to carry out subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2fe33ec5-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><paragraph class="fontsize10" id="y2fe33ec6-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2fe33ec7-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><inline class="smallCaps">Initial meeting</inline>.—</heading><content>Not later than 90 days after the date of enactment of this section, the Group shall hold its initial meeting.</content></paragraph>
<paragraph class="fontsize10" id="y2fe33ec8-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Subsequent meetings</inline>.—</heading><chapeau>After the initial meeting under paragraph (1), the Group shall meet—</chapeau><subparagraph class="fontsize10" id="y2fe33ec9-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>at the call of the chairperson; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2fe33eca-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>not less frequently than twice each year.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2fe33ecb-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Virtual meetings</inline>.—</heading><content>Each meeting of the Group may be held virtually.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2fe33ecc-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><chapeau>During each year in which the Group meets, the Group shall submit to the appropriate congressional committees a report that includes the following:</chapeau><paragraph class="fontsize10" id="y2fe33ecd-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>A review and analysis of current and emerging social media technologies being used to support preparedness and response activities related to natural disasters and acts of terrorism and other man-made disasters.</content></paragraph>
<paragraph class="fontsize10" id="y2fe33ece-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>A review of best practices and lessons learned on the use of social media technologies during the response to natural disasters and acts of terrorism and other man-made disasters that occurred during the period covered by the report at issue.</content></paragraph>
<paragraph class="fontsize10" id="y2fe33ecf-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>Recommendations to improve the Department’s use of social media technologies for emergency management purposes.<page identifier="/us/stat/129/648">129 STAT. 648</page></content></paragraph>
<paragraph class="fontsize10" id="y2fe33ed0-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>Recommendations to improve public awareness of the type of information disseminated through social media technologies, and how to access such information, during a natural disaster or an act of terrorism or other man-made disaster.</content></paragraph>
<paragraph class="fontsize10" id="y2fe33ed1-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>A review of available training for Federal, State, local, tribal, and territorial officials on the use of social media technologies in response to a natural disaster or an act of terrorism or other man-made disaster.</content></paragraph>
<paragraph class="fontsize10" id="y2fe33ed2-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>A review of coordination efforts with the private sector to discuss and resolve legal, operational, technical, privacy, and security concerns.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2fe33ed3-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Duration of Group</inline>.—</heading><paragraph class="fontsize10" id="y2fe33ed4-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2fe33ed5-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>The Group shall terminate on the date that is 5 years after the date of enactment of this section unless the chairperson renews the Group for a successive 5-year period, prior to the date on which the Group would otherwise terminate, by submitting to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a certification that the continued existence of the Group is necessary to fulfill the purpose described in subsection (b).</content></paragraph>
<paragraph class="fontsize10" id="y2fe33ed6-e843-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Continued renewal</inline>.—</heading><content>The chairperson may continue to renew the Group for successive 5-year periods by submitting a certification in accordance with paragraph (1) prior to the date on which the Group would otherwise terminate.”</content></paragraph>
