<section id="d200124e98" identifier="/us/pl/114/69/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Albuquerque Indian School Land Transfer Act</shortTitle>”.</content></section>
<section id="d200124e108" identifier="/us/pl/114/69/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1156bd21-e845-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y1156bd22-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10 smallCaps">19 pueblos<inline class="noSmallCaps">.—</inline></heading><chapeau>The term “<term>19 Pueblos</term>” means the New Mexico Indian Pueblos of—</chapeau><subparagraph class="fontsize10" id="y1156bd23-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Acoma;</content></subparagraph>
<subparagraph class="fontsize10" id="y1156bd24-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Cochiti;</content></subparagraph>
<subparagraph class="fontsize10" id="y1156bd25-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s2/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Isleta;</content></subparagraph>

<subparagraph class="fontsize10" id="y1156bd35-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s2/1/S" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="S">(S) </num><content>Zuni.</content></subparagraph>

<paragraph class="fontsize10" id="y1156bd36-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>map</term>” means the map entitled “The Town of Albuquerque Grant, Bernalillo County, within Township 10 North, Range 3 East, of the New Mexico Principal Meridian, New Mexico—Metes and Bounds Survey” and dated August 12, 2011.</content></paragraph>
<paragraph class="fontsize10" id="y1156bd37-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means Secretary of the Interior.</content></paragraph>

<section id="d200124e240" identifier="/us/pl/114/69/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>LAND TAKEN INTO TRUST FOR BENEFIT OF 19 PUEBLOS.</heading><subsection class="firstIndent0 fontsize10" id="y11575978-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Action by Secretary</inline>.—</heading><paragraph class="fontsize10" id="y11575979-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1157597a-e845-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall take into trust all right, title, and interest of the United States in and to the <page identifier="/us/stat/129/559">129 STAT. 559</page>
Federal land described in subsection (b) for the benefit of the 19 Pueblos immediately after the Secretary determines that the requirements of the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321/etseq">42 U.S.C. 4321 et seq.</ref>) have been satisfied regarding the trust acquisition of the Federal land.</content></paragraph>
<paragraph class="fontsize10" id="y1157597b-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph class="fontsize10" id="y1157597c-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>take such action as the Secretary determines to be necessary to document the transfer under paragraph (1); and</content></subparagraph>
<subparagraph class="fontsize10" id="y1157597d-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>appropriately assign each applicable private and municipal utility and service right or agreement.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y1157597e-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Description of Land</inline>.—</heading><chapeau>The Federal land referred to in subsection (a)(1) is the 4 tracts of Federal land, the combined acreage of which is approximately 11.11 acres, that were historically part of the Albuquerque Indian School, more particularly described as follows:</chapeau><paragraph class="fontsize10" id="y1157597f-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Abandoned indian school road</inline>.—</heading><content>The approximately 0.83 acres located in sec. 7 and sec. 8 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</content></paragraph>
<paragraph class="fontsize10" id="y11575980-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Southern part tract d</inline>.—</heading><content>The approximately 6.18 acres located in sec. 7 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</content></paragraph>
<paragraph class="fontsize10" id="y11575981-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Tract 1</inline>.—</heading><content>The approximately 0.41 acres located in sec. 7 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</content></paragraph>
<paragraph class="fontsize10" id="y11575982-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Western part tract b</inline>.—</heading><content>The approximately 3.69 acres located in sec. 7 of T. 10 N., R. 3 E., of the New Mexico Principal Meridian in Albuquerque, New Mexico, as identified on the map.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y11575983-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Survey</inline>.—</heading><content>The Secretary shall conduct a survey of the Federal land to be transferred consistent with subsection (b) and may make minor corrections to the survey and legal description of the Federal land described in subsection (b) as the Secretary determines to be necessary to correct clerical, typographical, and surveying errors.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y11575984-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Use of Land</inline>.—</heading><content>The Federal land taken into trust under subsection (a) shall be used for the educational, health, cultural, business, and economic development of the 19 Pueblos.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y11575985-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Limitations and Conditions</inline>.—</heading><content>The Federal land taken into trust under subsection (a) shall remain subject to any private or municipal encumbrance, right-of-way, restriction, easement of record, or utility service agreement in effect on the date of enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y11575986-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Bureau of Indian Affairs Use</inline>.—</heading><paragraph class="fontsize10" id="y11575987-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The 19 Pueblos shall allow the Bureau of Indian Affairs to continue to use the land taken into trust under subsection (a) for the facilities and purposes as in existence on the date of enactment of this Act, in accordance with paragraph (2).</content></paragraph>
<paragraph class="fontsize10" id="y11575988-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>The use by the Bureau of Indian Affairs under paragraph (1) shall—</chapeau><subparagraph class="fontsize10" id="y11575989-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/f/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>be free of any rental charge; and</content></subparagraph>
<subparagraph class="fontsize10" id="y1157598a-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s3/f/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1157598b-e845-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>continue until such time as the Secretary determines there is no further need for the existing Bureau of Indian Affairs facilities.<page identifier="/us/stat/129/560">129 STAT. 560</page></content></subparagraph>

<section id="d200124e407" identifier="/us/pl/114/69/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>EFFECT OF OTHER LAWS.</heading><subsection class="firstIndent0 fontsize10" id="y1157809c-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subject to subsection (b), Federal land taken into trust under section 3(a) shall be subject to Federal laws relating to Indian land.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1157809d-e845-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/69/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Gaming</inline>.—</heading><content>No class I gaming, class II gaming, or class III gaming (as defined in section 4 of the Indian Gaming Regulatory Act (<ref href="/us/usc/t25/s2703">25 U.S.C. 2703</ref>)) shall be carried out on the Federal land taken into trust under section 3(a).</content></subsection>
