<section id="d324339e241" identifier="/us/pl/114/54/tI/s102" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>SWINE REPORTING.</heading><subsection class="firstIndent0 fontsize10" id="y5c0f3de0-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s102/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>Section 231 of the Agricultural Marketing Act of 1946 (<ref href="/us/usc/t7/s1635i">7 U.S.C. 1635i</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y5c0f3de1-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s102/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (9) through (22) as paragraphs (10) through (23), respectively;</content></paragraph>

<subparagraph class="fontsize10" id="y5c0f64f5-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the swine are scheduled for delivery to the packer not later than 14 days after the date on which the formula is negotiated and swine are committed to the packer.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y5c0f64fc-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s102/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Daily Reporting</inline>.—</heading><chapeau>Section 232(c) of the Agricultural Marketing Act of 1946 (<ref href="/us/usc/t7/s1635j/c">7 U.S.C. 1635j(c)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y5c0f64fd-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s102/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1)(D), by <amendingAction type="delete">striking</amendingAction> clause (ii) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><clause class="indentUp2 fontsize10" id="y5c0f64fe-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Price distributions</inline>.—</heading><chapeau>The information published by the Secretary under clause (i) shall include—</chapeau><subclause class="fontsize10" id="y5c0f64ff-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>a distribution of net prices in the range between and including the lowest net price and the highest net price reported;</content></subclause>
<subclause class="fontsize10" id="y5c0f6500-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>a delineation of the number of barrows and gilts at each reported price level or, at the option of the Secretary, the number of barrows and gilts within each of a series of reasonable price bands within the range of prices; and</content></subclause>
<subclause class="fontsize10" id="y5c0f6501-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>the total number and weighted average price of barrows and gilts purchased through negotiated purchases and negotiated formula purchases.”</content></subclause>

<paragraph class="fontsize10" id="y5c0f6502-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s102/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (3), by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="fontsize10" id="y5c0f8c13-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Late in the day report information</inline>.—</heading><content>The Secretary shall include in the morning report and the afternoon report for the following day any information required to be reported under subparagraph (A) that is obtained after the time of the reporting day specified in that subparagraph.”</content></subparagraph>

<section id="d324339e426" identifier="/us/pl/114/54/tI/s103" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5c0f8c14-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t7/s1635m">7 USC 1635m note</ref>.</p></sidenote><heading>LAMB REPORTING.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x5c0fda35-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall revise <ref href="/us/cfr/t7/s59.300">section 59.300 of title 7, Code of Federal Regulations</ref>, so that—</chapeau><paragraph class="fontsize10" id="y5c0fda36-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s103/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5c0fda37-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>the definition of the term “<term>importer</term>”—</chapeau><subparagraph class="fontsize10" id="y5c0fda38-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s103/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>includes only those importers that imported an average of 1,000 metric tons of lamb meat products per year during the immediately preceding 4 calendar years; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5c0fda39-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s103/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>may include any person that does not meet the requirement referred to in subparagraph (A), if the Secretary determines that the person should be considered an importer based on their volume of lamb imports; and</content></subparagraph>

<paragraph class="fontsize10" id="y5c0fda3a-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s103/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>the definition of the term “<term>packer</term>”—<page identifier="/us/stat/129/515">129 STAT. 515</page></chapeau><subparagraph class="fontsize10" id="y5c0fda3b-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s103/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5c0fda3c-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>applies to any entity with 50 percent or more ownership in a facility;</content></subparagraph>
<subparagraph class="fontsize10" id="y5c0fda3d-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s103/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5c0fda3e-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>includes a federally inspected lamb processing plant which slaughtered or processed the equivalent of an average of 35,000 head of lambs per year during the immediately preceding 5 calendar years; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5c0fda3f-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s103/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>may include any other lamb processing plant that does not meet the requirement referred to in subparagraph (B), if the <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5c0fda40-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote>Secretary determines that the processing plant should be considered a packer after considering the capacity of the processing plant.</content></subparagraph>

<section id="d324339e493" identifier="/us/pl/114/54/tI/s104" style="-uslm-lc:I658143"><num class="fontsize12" value="104">SEC. 104. </num><heading>STUDY ON LIVESTOCK MANDATORY REPORTING.</heading><subsection class="firstIndent0 fontsize10" id="y5c102861-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Study Required</inline>.—</heading><paragraph class="fontsize10" id="y5c102862-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5c102863-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of Agriculture, acting through the Agricultural Marketing Service in conjunction with the Office of the Chief Economist and in consultation with cattle, swine, and lamb producers, packers, and other market participants, shall conduct a study on the program of information regarding the marketing of cattle, swine, lambs, and products of such livestock under subtitle B of the Agricultural Marketing Act of 1946 (<ref href="/us/usc/t7/s1635/etseq">7 U.S.C. 1635 et seq.</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y5c102864-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>The study shall—</chapeau><subparagraph class="fontsize10" id="y5c102865-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>analyze current marketing practices in the cattle, swine, and lamb markets;</content></subparagraph>
<subparagraph class="fontsize10" id="y5c102866-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>identify legislative or regulatory recommendations made by cattle, swine, and lamb producers, packers, and other market participants to ensure that information provided under the program—</chapeau><clause class="fontsize10" id="y5c102867-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>can be readily understood by producers, packers, and other market participants;</content></clause>
<clause class="fontsize10" id="y5c102868-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>reflects current marketing practices; and</content></clause>
<clause class="fontsize10" id="y5c102869-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>is relevant and useful to producers, packers, and other market participants;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5c10286a-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>analyze the price and supply information reporting services of the Department of Agriculture related to cattle, swine, and lamb; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5c10286b-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>address any other issues that the Secretary considers appropriate.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y5c10286c-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tI/s104/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than March 1, 2018, the Secretary of Agriculture shall submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report containing the findings of the study conducted under subsection (a).</content></subsection>

<subclause class="fontsize10" id="y5c12c0a6-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>make findings based on the public comments received and investigation conducted; and</content></subclause>

<section id="d324339e1662" identifier="/us/pl/114/54/tIII/s302" style="-uslm-lc:I658143"><num class="fontsize12" value="302">SEC. 302. </num><heading>REPORT ON DISRUPTION IN FEDERAL INSPECTION OF GRAIN EXPORTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x5c138335-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate, the Committee on Agriculture of the House of Representatives, the Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and Related Agencies of the Committee on Appropriations of the Senate, and the Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and Related Agencies of the Committee on Appropriations of the House of Representatives a report that describes—</chapeau><paragraph class="fontsize10" id="y5c138336-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tIII/s302/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the specific factors that led to disruption in Federal inspection of grain exports at the Port of Vancouver in the summer of 2014;</content></paragraph>
<paragraph class="fontsize10" id="y5c138337-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tIII/s302/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any factors that contributed to the disruption referred to in paragraph (1) that were unique to the Port of Vancouver, including a description of the port facility, security needs and available resources for that purpose, and any other significant factors as determined by the Secretary; and</content></paragraph>
<paragraph class="fontsize10" id="y5c138338-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tIII/s302/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>any changes in policy that the Secretary has implemented to ensure that a similar disruption in Federal inspection of grain exports at the Port of Vancouver or any other location does not occur in the future.</content></paragraph>

<section id="d324339e1684" identifier="/us/pl/114/54/tIII/s303" style="-uslm-lc:I658143"><num class="fontsize12" value="303">SEC. 303. </num><heading>REPORT ON POLICY BARRIERS TO GRAIN PRODUCERS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x5c13aa49-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture, in consultation with the United States Trade Representative, shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report that describes—</chapeau><paragraph class="fontsize10" id="y5c13aa4a-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tIII/s303/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the policy barriers to United States grain producers in countries the grain of which receives official grading in the United States but which do not offer official grading for United States grain or provide only the lowest designation for United States grain, including an analysis of possible inconsistencies with trade obligations; and</content></paragraph>
<paragraph class="fontsize10" id="y5c13aa4b-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/54/tIII/s303/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any actions the Executive Branch is taking to remedy the policy barriers so as to put United States grain producers <page identifier="/us/stat/129/521">129 STAT. 521</page>
on equal footing with grain producers in countries imposing the barriers.</content></paragraph>
