<section id="d324554e108" identifier="/us/pl/114/52/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">National Windstorm Impact Reduction Act Reauthorization of 2015</shortTitle>”.</content></section>
<section id="d324554e118" identifier="/us/pl/114/52/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><subsection class="firstIndent0 fontsize10" id="ya73adcb6-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>Section 203(1) of the National Windstorm Impact Reduction Act of 2004 (<ref href="/us/usc/t42/s15702/1">42 U.S.C. 15702(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>Director of the Office of Science and Technology Policy</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Director of the National Institute of Standards and Technology</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya73adcb7-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Lifelines</inline>.—</heading><chapeau>Section 203 of the National Windstorm Impact Reduction Act of 2004 (<ref href="/us/usc/t42/s15702">42 U.S.C. 15702</ref>) is further amended—</chapeau><paragraph class="fontsize10" id="ya73adcb8-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s2/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (2) through (4) as paragraphs (3) through (5), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="ya73adcb9-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s2/b/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (1) the following new paragraph:<quotedContent><paragraph class="indentUp0 fontsize10" id="ya73adcba-e847-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Lifelines</inline>.—</heading><content>The term ‘<term>lifelines</term>’ means public works and utilities, including transportation facilities and infrastructure, oil and gas pipelines, electrical power and communication facilities and infrastructure, and water supply and sewage treatment facilities.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ya73adcbb-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Windstorm</inline>.—</heading><content>Paragraph (5) of such section, as redesignated by subsection (b), <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>northeaster,</quotedText>” after “<quotedText>tropical storm,</quotedText>”.</content></subsection>
</section>
<section id="d324554e203" identifier="/us/pl/114/52/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>NATIONAL WINDSTORM IMPACT REDUCTION PROGRAM.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa73b78fc-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 204 of the National Windstorm Impact Reduction Act of 2004 (<ref href="/us/usc/t42/s15703">42 U.S.C. 15703</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya73b78fd-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> subsections (a), (b), and (c) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="ya73bc71e-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established the National Windstorm Impact Reduction Program, the purpose of which is to achieve major measurable reductions in the losses of life and property from windstorms through a coordinated Federal effort, in cooperation with other levels of government, academia, and the private sector, aimed at improving the understanding of windstorms and their impacts and developing and encouraging the implementation of cost-effective mitigation measures to reduce those impacts.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ya73bee2f-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Responsibilities of Program Agencies</inline>.—</heading><page identifier="/us/stat/129/497">129 STAT. 497</page>
<paragraph class="fontsize10" id="ya73bee30-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Lead agency</inline>.—</heading><chapeau>The National Institute of Standards and Technology shall have the primary responsibility for planning and coordinating the Program. In carrying out this paragraph, the Director shall—</chapeau><subparagraph class="fontsize10" id="ya73bee31-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>ensure that the Program includes the necessary components to promote the implementation of windstorm risk reduction measures by Federal, State, and local governments, national standards and model building code organizations, architects and engineers, and others with a role in planning and constructing buildings and lifelines;</content></subparagraph>
<subparagraph class="fontsize10" id="ya73bee32-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>support the development of performance-based engineering tools, and work with appropriate groups to promote the commercial application of such tools, including through wind-related model building codes, voluntary standards, and construction best practices;</content></subparagraph>
<subparagraph class="fontsize10" id="ya73bee33-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>request the assistance of Federal agencies other than the Program agencies, as necessary to assist in carrying out this Act;</content></subparagraph>
<subparagraph class="fontsize10" id="ya73bee34-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>coordinate all Federal post-windstorm investigations to the extent practicable; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya73bee35-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa73bee36-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa73bee37-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>when warranted by research or investigative findings, issue recommendations to assist in informing the development of model codes, and provide information to Congress on the use of such recommendations.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya73bee38-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">National institute of standards and technology</inline>.—</heading><content>In addition to the lead agency responsibilities described under paragraph (1), the National Institute of Standards and Technology shall be responsible for carrying out research and development to improve model building codes, voluntary standards, and best practices for the design, construction, and retrofit of buildings, structures, and lifelines.</content></paragraph>
<paragraph class="fontsize10" id="ya73bee39-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">National science foundation</inline>.—</heading><chapeau>The National Science Foundation shall support research in—</chapeau><subparagraph class="fontsize10" id="ya73bee3a-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>engineering and the atmospheric sciences to improve the understanding of the behavior of windstorms and their impact on buildings, structures, and lifelines; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya73bee3b-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>economic and social factors influencing windstorm risk reduction measures.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya73bee3c-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">National oceanic and atmospheric administration</inline>.—</heading><content>The National Oceanic and Atmospheric Administration shall support atmospheric sciences research to improve the understanding of the behavior of windstorms and their impact on buildings, structures, and lifelines.</content></paragraph>
<paragraph class="fontsize10" id="ya73bee3d-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Federal emergency management agency</inline>.—</heading><chapeau>The Federal Emergency Management Agency shall—</chapeau><subparagraph class="fontsize10" id="ya73bee3e-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>support—</chapeau><clause class="fontsize10" id="ya73bee3f-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the development of risk assessment tools and effective mitigation techniques;</content></clause>
<clause class="fontsize10" id="ya73bee40-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>windstorm-related data collection and analysis;</content></clause>
<clause class="fontsize10" id="ya73bee41-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>public outreach and information dissemination; and</content></clause>
<clause class="fontsize10" id="ya73bee42-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>promotion of the adoption of windstorm preparedness and mitigation measures, including for households, businesses, and communities, consistent with the Agency’s all-hazards approach; and<page identifier="/us/stat/129/498">129 STAT. 498</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya73bee43-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>work closely with national standards and model building code organizations, in conjunction with the National Institute of Standards and Technology, to promote the implementation of research results and promote better building practices within the building design and construction industry, including architects, engineers, contractors, builders, and inspectors.”</content></subparagraph>
</paragraph>
</subsection>

<paragraph class="fontsize10" id="ya73bee44-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (d) as subsection (c), and by <amendingAction type="delete">striking</amendingAction> subsections (e) and (f); and</content></paragraph>
<paragraph class="fontsize10" id="ya73bee45-e847-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/52/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (c), as so redesignated, the following new subsections:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="ya73c6376-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa73c6377-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Budget Activities</inline>.—</heading><content>The Director of the National Institute of Standards and Technology, the Director of the National Science Foundation, the Director of the National Oceanic and Atmospheric Administration, and the Director of the Federal Emergency Management Agency shall each include in their agency’s annual budget request to Congress a description of their agency’s projected activities under the Program for the fiscal year covered by the budget request, along with an assessment of what they plan to spend on those activities for that fiscal year.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ya73c6378-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Interagency Coordinating Committee on Windstorm Impact Reduction</inline>.—</heading><paragraph class="fontsize10" id="ya73c6379-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established an Interagency Coordinating Committee on Windstorm Impact Reduction, chaired by the Director or the Director’s designee.</content></paragraph>
<paragraph class="fontsize10" id="ya73c637a-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>In addition to the chair, the Committee shall be composed of—</chapeau><subparagraph class="fontsize10" id="ya73c637b-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the heads or such designees of—</chapeau><clause class="fontsize10" id="ya73c637c-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the Federal Emergency Management Agency;</content></clause>
<clause class="fontsize10" id="ya73c637d-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the National Oceanic and Atmospheric Administration;</content></clause>
<clause class="fontsize10" id="ya73c637e-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the National Science Foundation;</content></clause>
<clause class="fontsize10" id="ya73c637f-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>the Office of Science and Technology Policy; and</content></clause>
<clause class="fontsize10" id="ya73c6380-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>the Office of Management and Budget; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya73c6381-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the head of any other Federal agency, or such designee, the chair considers appropriate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya73c6382-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><content>The Committee shall meet not less than once a year at the call of the Director of the National Institute of Standards and Technology.</content></paragraph>
<paragraph class="fontsize10" id="ya73c6383-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">General purpose and duties</inline>.—</heading><content>The Committee shall oversee the planning and coordination of the Program.</content></paragraph>
<paragraph class="fontsize10" id="ya73c6384-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa73c6385-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Strategic plan</inline>.—</heading><chapeau>The Committee shall develop and submit to Congress, not later than 1 year after the date of enactment of the National Windstorm Impact Reduction Act Reauthorization of 2015, a Strategic Plan for the Program that includes—</chapeau><subparagraph class="fontsize10" id="ya73c6386-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>prioritized goals for the Program that will mitigate against the loss of life and property from future windstorms;<page identifier="/us/stat/129/499">129 STAT. 499</page></content></subparagraph>
<subparagraph class="fontsize10" id="ya73c6387-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>short-term, mid-term, and long-term research objectives to achieve those goals;</content></subparagraph>
<subparagraph class="fontsize10" id="ya73c6388-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a description of the role of each Program agency in achieving the prioritized goals;</content></subparagraph>
<subparagraph class="fontsize10" id="ya73c6389-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>the methods by which progress towards the goals will be assessed; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya73c638a-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>an explanation of how the Program will foster the transfer of research results into outcomes, such as improved model building codes.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya73c638b-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Progress report</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of the National Windstorm Impact Reduction Act Reauthorization of 2015, the Committee shall submit to the Congress a report on the progress of the Program that includes—</chapeau><subparagraph class="fontsize10" id="ya73c638c-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a description of the activities funded under the Program, a description of how these activities align with the prioritized goals and research objectives established in the Strategic Plan, and the budgets, per agency, for these activities;</content></subparagraph>
<subparagraph class="fontsize10" id="ya73c638d-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the outcomes achieved by the Program for each of the goals identified in the Strategic Plan;</content></subparagraph>
<subparagraph class="fontsize10" id="ya73c638e-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a description of any recommendations made to change existing building codes that were the result of Program activities; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya73c638f-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>a description of the extent to which the Program has incorporated recommendations from the Advisory Committee on Windstorm Impact Reduction.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya73c6390-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa73c6391-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Coordinated budget</inline>.—</heading><content>The Committee shall develop a coordinated budget for the Program, which shall be submitted to the Congress not later than 60 days after the date of the President’s budget submission for each fiscal year.”</content></paragraph>

<section id="d324554e568" identifier="/us/pl/114/52/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>NATIONAL ADVISORY COMMITTEE ON WINDSTORM IMPACT REDUCTION.</heading><content class="firstIndent0 fontsize10" id="xa73cb1b2-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 205 of the National Windstorm Impact Reduction Act of 2004 (<ref href="/us/usc/t42/s15704">42 U.S.C. 15704</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="ya73cffd3-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="205">“SEC. 205. </num><heading class="fontsize12">NATIONAL ADVISORY COMMITTEE ON WINDSTORM IMPACT REDUCTION.</heading><subsection class="firstIndent0 fontsize10" id="ya73cffd4-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Director of the National Institute of Standards and Technology shall establish an Advisory Committee on Windstorm Impact Reduction, which shall be composed of at least 7 and not more than 15 members who are qualified to provide advice on windstorm impact reduction and represent related scientific, architectural, and engineering disciplines, none of whom may be employees of the Federal Government, including—</chapeau><paragraph class="fontsize10" id="ya73cffd5-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>representatives of research and academic institutions;</content></paragraph>
<paragraph class="fontsize10" id="ya73cffd6-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>industry standards development organizations;</content></paragraph>
<paragraph class="fontsize10" id="ya73cffd7-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>emergency management agencies;</content></paragraph>
<paragraph class="fontsize10" id="ya73cffd8-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>State and local government; and</content></paragraph>
<paragraph class="fontsize10" id="ya73cffd9-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>business communities, including the insurance industry.<page identifier="/us/stat/129/500">129 STAT. 500</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya73cffda-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa73cffdb-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa73cffdc-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Assessments</inline>.—</heading><chapeau>The Advisory Committee on Windstorm Impact Reduction shall offer assessments and recommendations on—</chapeau><paragraph class="fontsize10" id="ya73cffdd-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>trends and developments in the natural, engineering, and social sciences and practices of windstorm impact mitigation;</content></paragraph>
<paragraph class="fontsize10" id="ya73cffde-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the priorities of the Program’s Strategic Plan;</content></paragraph>
<paragraph class="fontsize10" id="ya73cffdf-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the coordination of the Program;</content></paragraph>
<paragraph class="fontsize10" id="ya73cffe0-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>the effectiveness of the Program in meeting its purposes; and</content></paragraph>
<paragraph class="fontsize10" id="ya73cffe1-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>any revisions to the Program which may be necessary.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya73cffe2-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Compensation</inline>.—</heading><content>The members of the Advisory Committee established under this section shall serve without compensation.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya73cffe3-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><content>At least every 2 years, the Advisory Committee shall report to the Director on the assessments carried out under subsection (b) and its recommendations for ways to improve the Program.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya73cffe4-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Charter</inline>.—</heading><content>Notwithstanding section 14(b)(2) of the Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>), the Advisory Committee shall not be required to file a charter subsequent to its initial charter, filed under section 9(c) of such Act, before the termination date specified in subsection (f) of this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya73cffe5-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>The Advisory Committee shall terminate on September 30, 2017.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya73cffe6-e847-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Conflict of Interest</inline>.—</heading><content>An Advisory Committee member shall recuse himself from any Advisory Committee activity in which he has an actual pecuniary interest.”</content></subsection>
