<section id="d202291e88" identifier="/us/pl/114/51/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcc9fec7c-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s2301">15 USC 2301 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">E-Warranty Act of 2015</shortTitle>”.</content></section>
<section id="d202291e103" identifier="/us/pl/114/51/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcc9fec7d-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s2302">15 USC 2302 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xcca0138e-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress makes the following findings:</chapeau><paragraph class="fontsize10" id="ycca0138f-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/51/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Many manufacturers and consumers prefer to have the option to provide or receive warranty information online.</content></paragraph>
<paragraph class="fontsize10" id="ycca01390-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/51/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Modernizing warranty notification rules is necessary to allow the United States to continue to compete globally in manufacturing, trade, and the development of consumer products connected to the Internet.</content></paragraph>
<paragraph class="fontsize10" id="ycca01391-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/51/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Allowing an electronic warranty option would expand consumer access to relevant consumer information in an environmentally friendly way, and would provide additional flexibility to manufacturers to meet their labeling and warranty requirements.</content></paragraph>

<section id="d202291e130" identifier="/us/pl/114/51/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>ELECTRONIC DISPLAY OF TERMS OF WRITTEN WARRANTY FOR CONSUMER PRODUCTS.</heading><subsection class="firstIndent0 fontsize10" id="ycca060b2-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/51/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 102(b) of the Magnuson-Moss Warranty—Federal Trade Commission Improvement Act (<ref href="/us/usc/t15/s2302/b">15 U.S.C. 2302(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 firstIndent0 fontsize10" id="ycca087c3-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4)</num><subparagraph class="inline" id="ycca087c4-e847-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><chapeau>Except as provided in subparagraph (B), the rules prescribed under this subsection shall allow for the satisfaction of all requirements concerning the availability of terms of a written warranty on a consumer product under this subsection by—</chapeau><clause class="fontsize10" id="ycca087c5-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>making available such terms in an accessible digital format on the Internet website of the manufacturer of the consumer product in a clear and conspicuous manner; and</content></clause>
<clause class="fontsize10" id="ycca087c6-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>providing to the consumer (or prospective consumer) information with respect to how to obtain and review such terms by indicating on the product or product packaging or in the product manual—</chapeau><subclause class="fontsize10" id="ycca087c7-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the Internet website of the manufacturer where such terms can be obtained and reviewed; and</content></subclause>
<subclause class="fontsize10" id="ycca087c8-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the phone number of the manufacturer, the postal mailing address of the manufacturer, or another reasonable <page identifier="/us/stat/129/495">129 STAT. 495</page>
non-Internet based means of contacting the manufacturer to obtain and review such terms.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="ycca087c9-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcca087ca-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><content>With respect to any requirement that the terms of any written warranty for a consumer product be made available to the consumer (or prospective consumer) prior to sale of the product, in a case in which a consumer product is offered for sale in a retail location, by catalog, or through door-to-door sales, subparagraph (A) shall only apply if the seller makes available, through electronic or other means, at the location of the sale to the consumer purchasing the consumer product the terms of the warranty for the consumer product before the purchase.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="ycca087cb-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/51/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcca087cc-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s2302">15 USC 2302</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Revision of Rules</inline>.—</heading><paragraph class="fontsize10" id="ycca087cd-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/51/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcca087ce-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Federal Trade Commission shall revise the rules prescribed under such section to comply with the requirements of paragraph (4) of such section, as added by subsection (a) of this section.</content></paragraph>
<paragraph class="fontsize10" id="ycca087cf-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/51/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Authority to waive requirement for oral presentation</inline>.—</heading><content>In revising rules<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xcca087d0-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote> under paragraph (1), the Federal Trade Commission may waive the requirement of section 109(a) of such Act (<ref href="/us/usc/t15/s2309/a">15 U.S.C. 2309(a)</ref>) to give interested persons an opportunity for oral presentation if the Commission determines that giving interested persons such opportunity would interfere with the ability of the Commission to revise rules under paragraph (1) in a timely manner.</content></paragraph>
