<section id="d202399e102" identifier="/us/pl/114/50/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Gerardo Hernandez Airport Security Act of 2015</shortTitle>”.</content></section>
<section id="d202399e112" identifier="/us/pl/114/50/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xf20521c7-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="yf20521c8-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Assistant secretary</inline>.—</heading><content>The term “<term>Assistant Secretary</term>” means the Assistant Secretary of Homeland Security (Transportation Security) of the Department of Homeland Security.</content></paragraph>
<paragraph class="fontsize10" id="yf20521c9-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><content>The term “<term>Administration</term>” means the Transportation Security Administration.</content></paragraph>

<section id="d202399e137" identifier="/us/pl/114/50/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>SECURITY INCIDENT RESPONSE AT AIRPORTS.</heading><subsection class="firstIndent0 fontsize10" id="yf20596fa-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf20596fb-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Assistant Secretary shall, in consultation with other Federal agencies as appropriate, conduct outreach to all airports in the United States at which the Administration performs, or oversees the implementation and performance of, security measures, and provide technical assistance as necessary, to verify such airports have in place individualized working plans for responding to security incidents inside the perimeter of the airport, including active shooters, acts of terrorism, and incidents that target passenger-screening checkpoints.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf20596fc-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Types of Plans</inline>.—</heading><chapeau>Such plans may include, but may not be limited to, the following:</chapeau><paragraph class="fontsize10" id="yf20596fd-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>A strategy for evacuating and providing care to persons inside the perimeter of the airport, with consideration given to the needs of persons with disabilities.</content></paragraph>
<paragraph class="fontsize10" id="yf20596fe-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>A plan for establishing a unified command, including identification of staging areas for non-airport-specific law enforcement and fire response.</content></paragraph>
<paragraph class="fontsize10" id="yf20596ff-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>A schedule for regular testing of communications equipment used to receive emergency calls.</content></paragraph>
<paragraph class="fontsize10" id="yf2059700-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>An evaluation of how emergency calls placed by persons inside the perimeter of the airport will reach airport police in an expeditious manner.</content></paragraph>
<paragraph class="fontsize10" id="yf2059701-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>A practiced method and plan to communicate with travelers and all other persons inside the perimeter of the airport.<page identifier="/us/stat/129/491">129 STAT. 491</page></content></paragraph>
<paragraph class="fontsize10" id="yf2059702-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>To the extent practicable, a projected maximum timeframe for law enforcement response to active shooters, acts of terrorism, and incidents that target passenger security-screening checkpoints.</content></paragraph>
<paragraph class="fontsize10" id="yf2059703-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>A schedule of joint exercises and training to be conducted by the airport, the Administration, other stakeholders such as airport and airline tenants, and any relevant law enforcement, airport police, fire, and medical personnel.</content></paragraph>
<paragraph class="fontsize10" id="yf2059704-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>A schedule for producing after-action joint exercise reports to identify and determine how to improve security incident response capabilities.</content></paragraph>
<paragraph class="fontsize10" id="yf2059705-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/b/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>A strategy, where feasible, for providing airport law enforcement with access to airport security video surveillance systems at category X airports where those systems were purchased and installed using Administration funds.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf2059706-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Assistant Secretary shall report to the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the findings from its outreach to airports under subsection (a), including an analysis of the level of preparedness such airports have to respond to security incidents, including active shooters, acts of terrorism, and incidents that target passenger-screening checkpoints.</content></subsection>

<section id="d202399e222" identifier="/us/pl/114/50/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DISSEMINATING INFORMATION ON BEST PRACTICES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xf205be17-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Assistant Secretary shall—</chapeau><paragraph class="fontsize10" id="yf205be18-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>identify best practices that exist across airports for security incident planning, management, and training; and</content></paragraph>
<paragraph class="fontsize10" id="yf205be19-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>establish a mechanism through which to share such best practices with other airport operators nationwide.</content></paragraph>

<section id="d202399e239" identifier="/us/pl/114/50/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>CERTIFICATION.</heading><content style="-uslm-lc:I658120">  Not<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf205be1a-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote> later than 90 days after the date of enactment of this Act, and annually thereafter, the Assistant Secretary shall certify in writing to the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate that all screening personnel have participated in practical training exercises for active shooter scenarios.</content></section>
<section id="d202399e250" identifier="/us/pl/114/50/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>REIMBURSABLE AGREEMENTS.</heading><content style="-uslm-lc:I658120">  Not<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf205e52b-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xf205e52c-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote> later than 90 days after the enactment of this Act, the Assistant Secretary shall provide to the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an analysis of how the Administration can use cost savings achieved through efficiencies to increase over the next 5 fiscal years the funding available for checkpoint screening law enforcement support reimbursable agreements.</content></section>
<section id="d202399e263" identifier="/us/pl/114/50/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>SECURITY INCIDENT RESPONSE FOR SURFACE TRANSPORTATION SYSTEMS.</heading><subsection class="firstIndent0 fontsize10" id="yf206334d-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf206334e-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Assistant Secretary shall, in consultation with the Secretary of Transportation, and other relevant agencies, conduct outreach to all passenger transportation agencies and providers with high-risk facilities, as identified by the Assistant Secretary, to verify such agencies and providers have in place plans <page identifier="/us/stat/129/492">129 STAT. 492</page>
to respond to active shooters, acts of terrorism, or other security-related incidents that target passengers.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf206334f-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Types of Plans</inline>.—</heading><chapeau>As applicable, such plans may include, but may not be limited to, the following:</chapeau><paragraph class="fontsize10" id="yf2063350-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>A strategy for evacuating and providing care to individuals, with consideration given to the needs of persons with disabilities.</content></paragraph>
<paragraph class="fontsize10" id="yf2063351-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>A plan for establishing a unified command.</content></paragraph>
<paragraph class="fontsize10" id="yf2063352-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>A plan for frontline employees to receive active shooter training.</content></paragraph>
<paragraph class="fontsize10" id="yf2063353-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>A schedule for regular testing of communications equipment used to receive emergency calls.</content></paragraph>
<paragraph class="fontsize10" id="yf2063354-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>An evaluation of how emergency calls placed by individuals using the transportation system will reach police in an expeditious manner.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yf2063356-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Assistant Secretary shall report to the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the findings from its outreach to the agencies and providers under subsection (a), including an analysis of the level of preparedness such transportation systems have to respond to security incidents.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf2063357-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s7/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Dissemination of Best Practices</inline>.—</heading><content>The Assistant Secretary shall identify best practices for security incident planning, management, and training and establish a mechanism through which to share such practices with passenger transportation agencies nationwide.</content></subsection>

<section id="d202399e342" identifier="/us/pl/114/50/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>NO ADDITIONAL AUTHORIZATION OF APPROPRIATIONS.</heading><content style="-uslm-lc:I658120">  No additional funds are authorized to be appropriated to carry out this Act, and this Act shall be carried out using amounts otherwise available for such purpose.</content></section>
<section id="d202399e349" identifier="/us/pl/114/50/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>INTEROPERABILITY REVIEW.</heading><subsection class="firstIndent0 fontsize10" id="yf2065a68-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s9/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf2065a69-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xf2065a6a-e847-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 90 days after the date of enactment of this Act, the Assistant Secretary shall, in consultation with the Assistant Secretary of the Office of Cybersecurity and Communications, conduct a review of the interoperable communications capabilities of the law enforcement, fire, and medical personnel responsible for responding to a security incident, including active shooter events, acts of terrorism, and incidents that target passenger-screening checkpoints, at all airports in the United States at which the Administration performs, or oversees the implementation and performance of, security measures.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yf2065a6b-e847-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/50/s9/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 30 days after the completion of the review, the Assistant Secretary shall report the findings of the review to the Committee on Homeland Security of the House <page identifier="/us/stat/129/493">129 STAT. 493</page>
of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</content></subsection>
