<section id="d324788e92" identifier="/us/pl/114/47/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Land Management Workforce Flexibility Act</shortTitle>”.</content></section>
<section id="d324788e102" identifier="/us/pl/114/47/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PERSONNEL FLEXIBILITIES RELATING TO LAND MANAGEMENT AGENCIES.</heading><subsection class="firstIndent0 fontsize10" id="y88912c90-e848-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/47/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subpart I of part III of <ref href="/us/usc/t5">title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after chapter 95 the following:<quotedContent><chapter id="y8891a1c1-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658174"><num class="fontsize10 bold" value="96">“CHAPTER 96—</num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8891a1c2-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s9601">5 USC 9601</ref> prec.</p></sidenote><heading class="fontsize10 smallCaps">PERSONNEL FLEXIBILITIES RELATING TO LAND MANAGEMENT AGENCIES</heading><toc>

<section class="centered fontsize12" id="y8891a1c3-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="9601">“§ 9601.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8891a1c4-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s9601">5 USC 9601</ref>.</p></sidenote> Definitions</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x8891a1c5-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  “For purposes of this chapter—</chapeau><paragraph class="fontsize10" id="y8891a1c6-e848-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>the term ‘<term>land management agency</term>’ means—</chapeau><subparagraph class="fontsize10" id="y8891a1c7-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Forest Service of the Department of Agriculture;</content></subparagraph>
<subparagraph class="fontsize10" id="y8891a1c8-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Bureau of Land Management of the Department of the Interior;</content></subparagraph>
<subparagraph class="fontsize10" id="y8891a1c9-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the National Park Service of the Department of the Interior;</content></subparagraph>
<subparagraph class="fontsize10" id="y8891a1ca-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>the Fish and Wildlife Service of the Department of the Interior;</content></subparagraph>
<subparagraph class="fontsize10" id="y8891a1cb-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>the Bureau of Indian Affairs of the Department of the Interior; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8891a1cc-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>the Bureau of Reclamation of the Department of the Interior; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8891a1cd-e848-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the term ‘<term>time-limited appointment</term>’ includes a temporary appointment and a term appointment, as defined by the Office of Personnel Management.</content></paragraph>

<section class="centered fontsize12" id="y8891a1ce-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="9602">“§ 9602.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8891a1cf-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s9602">5 USC 9602</ref>.</p></sidenote> Competitive service; time-limited appointments</heading><subsection class="firstIndent0 fontsize10" id="y8891a1d0-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><chapeau>Notwithstanding chapter 33 or any other provision of law relating to the examination, certification, and appointment of individuals in the competitive service, an employee of a land <page identifier="/us/stat/129/486">129 STAT. 486</page>
management agency serving under a time-limited appointment in the competitive service is eligible to compete for a permanent appointment in the competitive service at any land management agency or any other agency (as defined in section 101 of title 31) under the internal merit promotion procedures of the applicable agency if—</chapeau><paragraph class="fontsize10" id="y8891a1d1-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the employee was appointed initially under open, competitive examination under subchapter I of chapter 33 to the time-limited appointment;</content></paragraph>
<paragraph class="fontsize10" id="y8891a1d2-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the employee has served under 1 or more time-limited appointments by a land management agency for a period or periods totaling more than 24 months without a break of 2 or more years; and</content></paragraph>
<paragraph class="fontsize10" id="y8891a1d3-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the employee’s performance has been at an acceptable level of performance throughout the period or periods (as the case may be) referred to in paragraph (2).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8891a1d4-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8891a1d5-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Waiver authority.</p></sidenote><content>In determining the eligibility of a time-limited employee under this section to be examined for or appointed in the competitive service, the Office of Personnel Management or other examining agency shall waive requirements as to age, unless the requirement is essential to the performance of the duties of the position.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8891a1d6-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><chapeau>An individual appointed under this section—</chapeau><paragraph class="fontsize10" id="y8891a1d7-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>becomes a career-conditional employee, unless the employee has otherwise completed the service requirements for career tenure; and</content></paragraph>
<paragraph class="fontsize10" id="y8891a1d8-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>acquires competitive status upon appointment.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8891a1d9-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><chapeau>A former employee of a land management agency who served under a time-limited appointment and who otherwise meets the requirements of this section shall be deemed a time-limited employee for purposes of this section if—</chapeau><paragraph class="fontsize10" id="y8891a1da-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8891a1db-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x8891a1dc-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>such employee applies for a position covered by this section within the period of 2 years after the most recent date of separation; and</content></paragraph>
<paragraph class="fontsize10" id="y8891a1dd-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>such employee’s most recent separation was for reasons other than misconduct or performance.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8891a1de-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8891a1df-e848-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Regulations.</p></sidenote><content>The Office of Personnel Management shall prescribe such regulations as may be necessary to carry out this section.”</content></subsection>
