<section id="d202892e92" identifier="/us/pl/114/45/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Drinking Water Protection Act</shortTitle>”.</content></section>
<section id="d202892e102" identifier="/us/pl/114/45/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AMENDMENT TO THE SAFE DRINKING WATER ACT.</heading><subsection class="firstIndent0 fontsize10" id="yd35b239b-e848-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/45/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendment</inline>.—</heading><content>Part E of the Safe Drinking Water Act (<ref href="/us/usc/t42/s300j/etseq">42 U.S.C. 300j et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new section:<quotedContent><section class="indentUp2 firstIndent-2" id="yd35bbfdc-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="1459">“SEC. 1459. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd35bbfdd-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s300j–19">42 USC 300j–19</ref>.</p></sidenote><heading class="bold">ALGAL TOXIN RISK ASSESSMENT AND MANAGEMENT.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="yd35bbfde-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Strategic Plan</inline>.—</heading><paragraph class="fontsize10" id="yd35bbfdf-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd35bbfe0-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xd35bbfe1-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Health and health care.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Development</inline>.—</heading><chapeau>Not later than 90 days after the date of enactment of this section, the Administrator shall develop and submit to Congress a strategic plan for assessing and managing risks associated with algal toxins in drinking water provided by public water systems. The strategic plan shall include steps and timelines to—</chapeau><subparagraph class="fontsize10" id="yd35bbfe2-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>evaluate the risk to human health from drinking water provided by public water systems contaminated with algal toxins;</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbfe3-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>establish, publish, and update a comprehensive list of algal toxins which the Administrator determines may have an adverse effect on human health when present in drinking water provided by public water systems, taking into account likely exposure levels;</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbfe4-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>summarize—</chapeau><clause class="fontsize10" id="yd35bbfe5-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the known adverse human health effects of algal toxins included on the list published under subparagraph (B) when present in drinking water provided by public water systems; and</content></clause>
<clause class="fontsize10" id="yd35bbfe6-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>factors that cause toxin-producing cyanobacteria and algae to proliferate and express toxins;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd35bbfe7-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><chapeau>with respect to algal toxins included on the list published under subparagraph (B), determine whether to—</chapeau><clause class="fontsize10" id="yd35bbfe8-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>publish health advisories pursuant to section 1412(b)(1)(F) for such algal toxins in drinking water provided by public water systems;<page identifier="/us/stat/129/474">129 STAT. 474</page></content></clause>
<clause class="fontsize10" id="yd35bbfe9-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>establish guidance regarding feasible analytical methods to quantify the presence of algal toxins; and</content></clause>
<clause class="fontsize10" id="yd35bbfea-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>establish guidance regarding the frequency of monitoring necessary to determine if such algal toxins are present in drinking water provided by public water systems;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd35bbfeb-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>recommend feasible treatment options, including procedures, equipment, and source water protection practices, to mitigate any adverse public health effects of algal toxins included on the list published under subparagraph (B); and</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbfec-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>enter into cooperative agreements with, and provide technical assistance to, affected States and public water systems, as identified by the Administrator, for the purpose of managing risks associated with algal toxins included on the list published under subparagraph (B).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd35bbfed-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Updates</inline>.—</heading><content>The Administrator shall, as appropriate, update and submit to Congress the strategic plan developed under paragraph (1).</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="yd35bbfee-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd35bbfef-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Health and health care.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Information Coordination</inline>.—</heading><chapeau>In carrying out this section the Administrator shall—</chapeau><paragraph class="fontsize10" id="yd35bbff0-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>identify gaps in the Agency’s understanding of algal toxins, including—</chapeau><subparagraph class="fontsize10" id="yd35bbff1-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the human health effects of algal toxins included on the list published under subsection (a)(1)(B); and</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbff2-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>methods and means of testing and monitoring for the presence of harmful algal toxins in source water of, or drinking water provided by, public water systems;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd35bbff3-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>as appropriate, consult with—</chapeau><subparagraph class="fontsize10" id="yd35bbff4-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>other Federal agencies that—</chapeau><clause class="fontsize10" id="yd35bbff5-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>examine or analyze cyanobacteria or algal toxins; or</content></clause>
<clause class="fontsize10" id="yd35bbff6-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>address public health concerns related to harmful algal blooms;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yd35bbff7-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>States;</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbff8-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>operators of public water systems;</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbff9-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>multinational agencies;</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbffa-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>foreign governments;</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbffb-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>research and academic institutions; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbffc-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>companies that provide relevant drinking water treatment options; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd35bbffd-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>assemble and publish information from each Federal agency that has—</chapeau><subparagraph class="fontsize10" id="yd35bbffe-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>examined or analyzed cyanobacteria or algal toxins; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd35bbfff-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>addressed public health concerns related to harmful algal blooms.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="yd35bc000-e848-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Use of Science</inline>.—</heading><content>The Administrator shall carry out this section in accordance with the requirements described in section 1412(b)(3)(A), as applicable.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="yd35bc001-e848-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Feasible</inline>.—</heading><content>For purposes of this section, the term ‘<term>feasible</term>’ has the meaning given such term in section 1412(b)(4)(D).”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="yd35be712-e848-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/45/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline>.—</heading><chapeau>Not later than 90 days after the date of enactment of this Act, the Comptroller General of the United States shall prepare and submit to Congress a report that includes—<page identifier="/us/stat/129/475">129 STAT. 475</page></chapeau><paragraph class="fontsize10" id="yd35be713-e848-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/45/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>an inventory of funds—</chapeau><subparagraph class="fontsize10" id="yd35be714-e848-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/45/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>expended by the United States, for each of fiscal years 2010 through 2014, to examine or analyze toxin-producing cyanobacteria and algae or address public health concerns related to harmful algal blooms; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd35be715-e848-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/45/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>that includes the specific purpose for which the funds were made available, the law under which the funds were authorized, and the Federal agency that received or spent the funds; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd35be716-e848-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/45/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>recommended steps to reduce any duplication, and improve interagency coordination, of such expenditures.</content></paragraph>
