<section id="d324909e92" identifier="/us/pl/114/42/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Notice of Observation Treatment and Implication for Care Eligibility Act</shortTitle>” or the “<shortTitle role="act">NOTICE Act</shortTitle>”.</content></section>
<section id="d324909e105" identifier="/us/pl/114/42/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>MEDICARE REQUIREMENT FOR HOSPITAL NOTIFICATIONS OF OBSERVATION STATUS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x51047a79-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 1866(a)(1) of the Social Security Act (<ref href="/us/usc/t42/s1395cc/a/1">42 U.S.C. 1395cc(a)(1)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y51047a7a-e849-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/42/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (V), by <amendingAction type="delete">striking</amendingAction> at the end “<quotedText>and</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y51047a7b-e849-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/42/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in the first subparagraph (W), by <amendingAction type="delete">striking</amendingAction> at the end the period and <amendingAction type="insert">inserting</amendingAction> a comma;</content></paragraph>
<paragraph class="fontsize10" id="y51047a7c-e849-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/42/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>in the second subparagraph (W)—</chapeau><subparagraph class="fontsize10" id="y51047a7d-e849-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/42/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> such subparagraph as subparagraph (X); and</content></subparagraph>
<subparagraph class="fontsize10" id="y51047a7e-e849-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/42/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> at the end the period and <amendingAction type="insert">inserting</amendingAction> “<quotedText>, and</quotedText>”; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y51047a7f-e849-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/42/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>by <amendingAction type="insert">inserting</amendingAction> after such subparagraph (X) the following new subparagraph:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y5104a190-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="Y">“(Y) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5104a191-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="x5104a192-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><chapeau>beginning 12 months after the date of the enactment of this subparagraph, in the case of a hospital or critical access hospital, with respect to each individual who receives observation services as an outpatient at such hospital or critical access hospital for more than 24 hours, to provide to such individual not later than 36 hours after the time such individual begins receiving such services (or, if sooner, upon release)—</chapeau><clause class="fontsize10" id="y5104a193-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>such oral explanation of the written notification described in clause (ii), and such documentation of the provision of such explanation, as the Secretary determines to be appropriate;</content></clause>
<clause class="fontsize10" id="y5104a194-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5104a195-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Regulations.</p></sidenote><chapeau>a written notification (as specified by the Secretary pursuant to rulemaking and containing such language as the Secretary prescribes consistent with this paragraph) which—</chapeau><subclause class="fontsize10" id="y5104a196-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>explains the status of the individual as an outpatient receiving observation services and not as an inpatient of the hospital or critical access hospital and the reasons for such status of such individual;<page identifier="/us/stat/129/469">129 STAT. 469</page></content></subclause>
<subclause class="fontsize10" id="y5104a197-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>explains the implications of such status on services furnished by the hospital or critical access hospital (including services furnished on an inpatient basis), such as implications for cost-sharing requirements under this title and for subsequent eligibility for coverage under this title for services furnished by a skilled nursing facility;</content></subclause>
<subclause class="fontsize10" id="y5104a198-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>includes such additional information as the Secretary determines appropriate;</content></subclause>
<subclause class="fontsize10" id="y5104a199-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><chapeau>either—</chapeau><item class="fontsize10" id="y5104a19a-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>is signed by such individual or a person acting on such individual’s behalf to acknowledge receipt of such notification; or</content></item>
<item class="fontsize10" id="y5104a19b-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5104a19c-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Certification.</p></sidenote><content>if such individual or person refuses to provide the signature described in item (aa), is signed by the staff member of the hospital or critical access hospital who presented the written notification and includes the name and title of such staff member, a certification that the notification was presented, and the date and time the notification was presented; and</content></item>
</subclause>
<subclause class="fontsize10" id="y5104a19d-e849-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>is written and formatted using plain language and is made available in appropriate languages as determined by the Secretary.”</content></subclause>
