<section id="d203953e88" identifier="/us/pl/114/40/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8a60ede0-e849-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1305">42 USC 1305 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Steve Gleason Act of 2015</shortTitle>”.</content></section>
<section id="d203953e103" identifier="/us/pl/114/40/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROVIDING MEDICARE BENEFICIARY ACCESS TO EYE TRACKING ACCESSORIES FOR SPEECH GENERATING DEVICES.</heading><subsection class="firstIndent0 fontsize10" id="y8a6114f1-e849-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/40/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 1861(n) of the Social Security Act (<ref href="/us/usc/t42/s1395x/n">42 U.S.C. 1395x(n)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>and eye tracking and gaze interaction accessories for speech generating devices furnished to individuals with a demonstrated medical need for such accessories</quotedText>” after “<quotedText>appropriate organizations)</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8a6114f2-e849-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/40/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8a6114f3-e849-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1395x">42 USC 1395x note</ref>.</p></sidenote><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendment made by subsection (a) shall apply with respect to devices furnished on or after January 1, 2016.</content></subsection>

<section id="d203953e141" identifier="/us/pl/114/40/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REMOVING THE RENTAL CAP FOR DURABLE MEDICAL EQUIPMENT UNDER MEDICARE WITH RESPECT TO SPEECH GENERATING DEVICES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x8a613c04-e849-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1834(a)(2)(A) of the Social Security Act (<ref href="/us/usc/t42/s1395m/a/2/A">42 U.S.C. 1395m(a)(2)(A)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y8a613c05-e849-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/40/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in clause (ii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>or</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="y8a613c06-e849-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/40/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in clause (iii), by <amendingAction type="add">adding</amendingAction> “<quotedText>or</quotedText>” at the end; and</content></paragraph>
<paragraph class="fontsize10" id="y8a613c07-e849-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/40/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> after clause (iii) the following new clause:<quotedContent><clause class="indentUp2 fontsize10" id="y8a613c08-e849-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8a613c09-e849-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>in the case of devices furnished on or after October 1, 2015, and before October 1, 2018, which serves as a speech generating device or which is an <page identifier="/us/stat/129/442">129 STAT. 442</page>
accessory that is needed for the individual to effectively utilize such a device,”</content></clause>
