<section id="d217191e98" identifier="/us/pl/114/327/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206beae8-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7701">16 USC 7701 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Ensuring Access to Pacific Fisheries Act</shortTitle>”.</content></section>
<title id="d217191e113" identifier="/us/pl/114/327/tI" style="-uslm-lc:I658178"><num value="I">TITLE I—</num><heading>NORTH PACIFIC FISHERIES</heading>
<subtitle id="d217191e118" identifier="/us/pl/114/327/tI/stA" style="-uslm-lc:I658178"><num value="A">Subtitle A—</num><heading>North Pacific Fisheries Convention Implementation</heading>
<section id="d217191e123" identifier="/us/pl/114/327/tI/stA/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206beae9-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7701">16 USC 7701</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x206cfc5a-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this subtitle:</chapeau><paragraph class="fontsize10" id="y206cfc5b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Commission</inline>.—</heading><content>The term “<term>Commission</term>” means the North Pacific Fisheries Commission established in accordance with the North Pacific Fisheries Convention.</content></paragraph>
<paragraph class="fontsize10" id="y206cfc5c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Commissioner</inline>.—</heading><content>The term “<term>Commissioner</term>” means a United States Commissioner appointed under section 102(a).</content></paragraph>
<paragraph class="fontsize10" id="y206cfc5d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Convention area</inline>.—</heading><content>The term “<term>Convention Area</term>” means the area to which the Convention on the Conservation and Management of High Seas Fisheries Resources in the North Pacific Ocean applies under Article 4 of such Convention.</content></paragraph>
<paragraph class="fontsize10" id="y206cfc5e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Council</inline>.—</heading><content>The term “<term>Council</term>” means the North Pacific Fishery Management Council, the Pacific Fishery Management Council, or the Western Pacific Fishery Management Council established under section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1852">16 U.S.C. 1852</ref>), as the context requires.</content></paragraph>
<paragraph class="fontsize10" id="y206cfc5f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Exclusive economic zone</inline>.—</heading><chapeau>The term “<term>exclusive economic zone</term>” means—</chapeau><subparagraph class="fontsize10" id="y206cfc60-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>with respect to the United States, the zone established by Presidential Proclamation Numbered 5030 of March 10, 1983 (<ref href="/us/usc/t16/s1453">16 U.S.C. 1453 note</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y206cfc61-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>with respect to a foreign country, a designated zone similar to the zone referred to in subparagraph (A) for that country, consistent with international law.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y206cfc62-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Fisheries resources</inline>.—</heading><page identifier="/us/stat/130/1975">130 STAT. 1975</page>
<subparagraph class="fontsize10" id="y206cfc63-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/6/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in subparagraph (B), the term “<term>fisheries resources</term>” means all fish, mollusks, crustaceans, and other marine species caught by a fishing vessel within the Convention Area, as well as any products thereof.</content></subparagraph>
<subparagraph class="fontsize10" id="y206cfc64-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/6/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusions</inline>.—</heading><chapeau>The term “<term>fisheries resources</term>” does not include—</chapeau><clause class="fontsize10" id="y206cfc65-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/6/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>sedentary species insofar as they are subject to the sovereign rights of coastal nations consistent with Article 77, paragraph 4 of the 1982 Convention and indicator species of vulnerable marine ecosystems as listed in, or adopted pursuant to, Article 13, paragraph 5 of the North Pacific Fisheries Convention;</content></clause>
<clause class="fontsize10" id="y206cfc66-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/6/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>catadromous species;</content></clause>
<clause class="fontsize10" id="y206cfc67-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/6/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>marine mammals, marine reptiles, or seabirds; or</content></clause>
<clause class="fontsize10" id="y206cfc68-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/6/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>other marine species already covered by preexisting international fisheries management instruments within the area of competence of such instruments.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y206cfc69-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Fishing activities</inline>.—</heading><subparagraph class="fontsize10" id="y206cfc6a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The term “<term>fishing activities</term>” means—</chapeau><clause class="fontsize10" id="y206cfc6b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the actual or attempted searching for, catching, taking, or harvesting of fisheries resources;</content></clause>
<clause class="fontsize10" id="y206cfc6c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>engaging in any activity that can reasonably be expected to result in the locating, catching, taking, or harvesting of fisheries resources for any purpose;</content></clause>
<clause class="fontsize10" id="y206d237d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the processing of fisheries resources at sea;</content></clause>
<clause class="fontsize10" id="y206d237e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the transshipment of fisheries resources at sea or in port; or</content></clause>
<clause class="fontsize10" id="y206d237f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>any operation at sea in direct support of, or in preparation for, any activity described in clauses (i) through (iv), including transshipment.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y206d2380-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/7/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusions</inline>.—</heading><content>The term “<term>fishing activities</term>” does not include any operation related to an emergency involving the health or safety of a crew member or the safety of a fishing vessel.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y206d2381-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Fishing vessel</inline>.—</heading><content>The term “<term>fishing vessel</term>” means any vessel used or intended for use for the purpose of engaging in fishing activities, including a processing vessel, a support ship, a carrier vessel, or any other vessel directly engaged in such fishing activities.</content></paragraph>
<paragraph class="fontsize10" id="y206d2382-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">High seas</inline>.—</heading><content>The term “<term>high seas</term>” does not include an area that is within the exclusive economic zone of the United States or of any other country.</content></paragraph>
<paragraph class="fontsize10" id="y206d2383-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/10" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><heading class="fontsize10"><inline class="smallCaps">North pacific fisheries convention</inline>.—</heading><content>The term “<term>North Pacific Fisheries Convention</term>” means the Convention on the Conservation and Management of the High Seas Fisheries Resources in the North Pacific Ocean (including any annexes, amendments, or protocols that are in force, or have come into force) for the United States, which was adopted at Tokyo on February 24, 2012.</content></paragraph>
<paragraph class="fontsize10" id="y206d2384-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/11" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><heading class="fontsize10"><inline class="smallCaps">Person</inline>.—</heading><chapeau>The term “<term>person</term>” means—</chapeau><subparagraph class="fontsize10" id="y206d2385-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/11/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any individual, whether or not a citizen or national of the United States;<page identifier="/us/stat/130/1976">130 STAT. 1976</page></content></subparagraph>
<subparagraph class="fontsize10" id="y206d2386-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/11/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any corporation, partnership, association, or other entity, whether or not organized or existing under the laws of any State; or</content></subparagraph>
<subparagraph class="fontsize10" id="y206d2387-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/11/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>any Federal, State, local, tribal, or foreign government or any entity of such government.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y206d2388-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/12" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>Except as otherwise specifically provided, the term “<term>Secretary</term>” means the Secretary of Commerce.</content></paragraph>
<paragraph class="fontsize10" id="y206d2389-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/13" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term “<term>State</term>” means each of the several States of the United States, the District of Columbia, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, and any other commonwealth, territory, or possession of the United States.</content></paragraph>
<paragraph class="fontsize10" id="y206d238a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/14" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><heading class="fontsize10"><inline class="smallCaps">Straddling stock</inline>.—</heading><content>The term “<term>straddling stock</term>” means a stock of fisheries resources that migrates between, or occurs in, the economic exclusion zone of one or more parties to the Convention and the Convention Area.</content></paragraph>
<paragraph class="fontsize10" id="y206d238b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/15" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">(15) </num><heading class="fontsize10"><inline class="smallCaps">Transshipment</inline>.—</heading><content>The term “<term>transshipment</term>” means the unloading of any fisheries resources taken in the Convention Area from one fishing vessel to another fishing vessel either at sea or in port.</content></paragraph>
<paragraph class="fontsize10" id="y206d238c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s101/16" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">(16) </num><heading class="fontsize10 smallCaps">1982 convention<inline class="noSmallCaps">.—</inline></heading><content>The term “<term>1982 Convention</term>” means the United Nations Convention on the Law of the Sea of 10 December 1982.</content></paragraph>

<section id="d217191e400" identifier="/us/pl/114/327/tI/stA/s102" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206d238d-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7702">16 USC 7702</ref>.</p></sidenote><heading>UNITED STATES PARTICIPATION IN THE NORTH PACIFIC FISHERIES CONVENTION.</heading><subsection class="firstIndent0 fontsize10" id="y206eaa2e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">United States Commissioners</inline>.—</heading><paragraph class="fontsize10" id="y206eaa2f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Number of commissioners</inline>.—</heading><content>The United States shall be represented on the Commission by five United States Commissioners.</content></paragraph>
<paragraph class="fontsize10" id="y206eaa30-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Selection of commissioners</inline>.—</heading><chapeau>The Commissioners shall be as follows:</chapeau><subparagraph class="fontsize10" id="y206eaa31-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Appointment by the president</inline>.—</heading><clause class="fontsize10" id="y206eaa32-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Two of the Commissioners shall be appointed by the President and shall be an officer or employee of—</chapeau><subclause class="fontsize10" id="y206eaa33-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/A/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the Department of Commerce;</content></subclause>
<subclause class="fontsize10" id="y206eaa34-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/A/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the Department of State; or</content></subclause>
<subclause class="fontsize10" id="y206eaa35-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/A/i/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>the Coast Guard.</content></subclause>
</clause>
<clause class="fontsize10" id="y206eaa36-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Selection criteria</inline>.—</heading><content>In making each appointment under clause (i), the President shall select a Commissioner from among individuals who are knowledgeable or experienced concerning fisheries resources in the North Pacific Ocean.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y206eaa37-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">North pacific fishery management council</inline>.—</heading><content>One Commissioner shall be the chairman of the North Pacific Fishery Management Council or a designee of such chairman.</content></subparagraph>
<subparagraph class="fontsize10" id="y206eaa38-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Pacific fishery management council</inline>.—</heading><content>One Commissioner shall be the chairman of the Pacific Fishery Management Council or a designee of such chairperson.</content></subparagraph>
<subparagraph class="fontsize10" id="y206eaa39-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Western pacific fishery management council</inline>.—</heading><content>One Commissioner shall be the chairman of the Western Pacific Fishery Management Council or a designee of such chairperson.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y206eaa3a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206eaa3b-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><inline class="smallCaps">Alternate Commissioners</inline>.—</heading><content>In the event of a vacancy in a position as a Commissioner appointed under subsection (a), <page identifier="/us/stat/130/1977">130 STAT. 1977</page>
the Secretary of State, in consultation with the Secretary, may designate from time to time and for periods of time considered appropriate an alternate Commissioner to the Commission. An alternate Commissioner may exercise all powers and duties of a Commissioner in the absence of a Commissioner appointed under subsection (a), and shall serve the remainder of the term of the absent Commissioner for which designated.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y206eaa3c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Administrative Matters</inline>.—</heading><paragraph class="fontsize10" id="y206eaa3d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Employment status</inline>.—</heading><content>An individual serving as a Commissioner, or an alternative Commissioner, other than an officer or employee of the United States Government, shall not be considered a Federal employee, except for the purposes of injury compensation or tort claims liability as provided in <ref href="/us/usc/t5/ch81">chapter 81 of title 5, United States Code</ref>, and <ref href="/us/usc/t28/ch171">chapter 171 of title 28, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y206eaa3e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Compensation</inline>.—</heading><content>An individual serving as a Commissioner or an alternate Commissioner, although an officer of the United States while so serving, shall receive no compensation for the individual’s services as such Commissioner or alternate Commissioner.</content></paragraph>
<paragraph class="fontsize10" id="y206eaa3f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Travel expenses</inline>.—</heading><subparagraph class="fontsize10" id="y206eaa40-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of State shall pay the necessary travel expenses of a Commissioner or an alternate Commissioner in accordance with the Federal Travel Regulations and sections 5701, 5702, 5704 through 5708, and 5731 of <ref href="/us/usc/t5">title 5, United States Code</ref>.</content></subparagraph>
<subparagraph class="fontsize10" id="y206eaa41-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Reimbursement</inline>.—</heading><content>The Secretary may reimburse the Secretary of State for amounts expended by the Secretary of State under this paragraph.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y206eaa42-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Advisory Committee</inline>.—</heading><paragraph class="fontsize10" id="y206eaa43-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Establishment of permanent advisory committee</inline>.—</heading><subparagraph class="fontsize10" id="y206eaa44-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>There is established an advisory committee which shall be composed of 11 members appointed by the Secretary as follows:</chapeau><clause class="fontsize10" id="y206eaa45-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>A member engaging in commercial fishing activities in the management area of the North Pacific Fishery Management Council.</content></clause>
<clause class="fontsize10" id="y206eaa46-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>A member engaging in commercial fishing activities in the management area of the Pacific Fishery Management Council.</content></clause>
<clause class="fontsize10" id="y206eaa47-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>A member engaging in commercial fishing activities in the management area of the Western Pacific Fishery Management Council.</content></clause>
<clause class="fontsize10" id="y206eaa48-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>Three members from the indigenous population of the North Pacific, including an Alaska Native, Native Hawaiian, or a native-born inhabitant of any State of the United States in the Pacific, and an individual from a Pacific Coast tribe.</content></clause>
<clause class="fontsize10" id="y206eaa49-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>A member that is a marine fisheries scientist that is a resident of a State the adjacent exclusive economic zone for which is bounded by the Convention Area.</content></clause>
<clause class="fontsize10" id="y206eaa4a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>A member nominated by the Governor of the State of Alaska.</content></clause>
<clause class="fontsize10" id="y206eaa4b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>A member nominated by the Governor of the State of Hawaii.<page identifier="/us/stat/130/1978">130 STAT. 1978</page></content></clause>
<clause class="fontsize10" id="y206eaa4c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>A member nominated by the Governor of the State of Washington.</content></clause>
<clause class="fontsize10" id="y206eaa4d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/A/ix" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">(ix) </num><content>A member nominated by the Governor of the State of California.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y206eaa4e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Terms and privileges</inline>.—</heading><content>Each member of the Advisory Committee shall serve for a term of 2 years and shall be eligible for reappointment for not more than 3 consecutive terms. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206eaa4f-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notification.</p></sidenote>The Commissioners shall notify the Advisory Committee in advance of each meeting of the Commissioners. The Advisory Committee shall attend each meeting and shall examine and be heard on all proposed programs, investigations, reports, recommendations, and regulations of the Commissioners.</content></subparagraph>
<subparagraph class="fontsize10" id="y206eaa50-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Procedures</inline>.—</heading><clause class="fontsize10" id="y206eaa51-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206eaa52-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>The Advisory Committee shall determine its organization and prescribe its practices and procedures for carrying out its functions under this subtitle, the North Pacific Fisheries Convention, and the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1801/etseq">16 U.S.C. 1801 et seq.</ref>).</content></clause>
<clause class="fontsize10" id="y206eaa53-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206eaa54-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Publication.</p></sidenote><inline class="smallCaps">Public availability of procedures</inline>.—</heading><content>The Advisory Committee shall publish and make available to the public a statement of its organization, practices, and procedures.</content></clause>
<clause class="fontsize10" id="y206eaa55-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><heading class="fontsize10"><inline class="smallCaps">Quorum</inline>.—</heading><content>A majority of the members of the Advisory Committee shall constitute a quorum to conduct business.</content></clause>
<clause class="fontsize10" id="y206eaa56-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><heading class="fontsize10"><inline class="smallCaps">Public meetings</inline>.—</heading><content>Meetings of the Advisory Committee, except when in executive session, shall be open to the public. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206eaa57-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notifications.</p></sidenote>Prior notice of each non-executive meeting shall be made public in a timely fashion. The Advisory Committee shall not be subject to the Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>).</content></clause>
<clause class="fontsize10" id="y206eaa58-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/C/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><heading class="fontsize10"><inline class="smallCaps">Cost savings</inline>.—</heading><content>In order to reduce the cost of Advisory Committee meetings, the Advisory Committee shall, to the extent practicable, utilize teleconferences and webinars for that purpose.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y206eaa59-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Provision of information</inline>.—</heading><content>The Secretary and the Secretary of State shall furnish the Advisory Committee with relevant information concerning fisheries resources and international fishery agreements.</content></subparagraph>

<paragraph class="fontsize10" id="y206eaa5a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Administrative matters</inline>.—</heading><subparagraph class="fontsize10" id="y206eaa5b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Support services</inline>.—</heading><content>The Secretary shall provide to the Advisory Committee in a timely manner such administrative and technical support services as are necessary to function effectively.</content></subparagraph>
<subparagraph class="fontsize10" id="y206eaa5c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Compensation; status</inline>.—</heading><chapeau>An individual appointed to serve as a member of the Advisory Committee—</chapeau><clause class="fontsize10" id="y206eaa5d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>shall serve without pay; and</content></clause>

<clause class="fontsize10" id="y206eaa61-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s102/d/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Reimbursement</inline>.—</heading><content>The Secretary may reimburse the Secretary of State for amounts expended by the Secretary of State under this subparagraph.</content></clause>

<section id="d217191e827" identifier="/us/pl/114/327/tI/stA/s103" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206eaa62-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7703">16 USC 7703</ref>.</p></sidenote><heading>AUTHORITY AND RESPONSIBILITY OF THE SECRETARY OF STATE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x206ed173-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Secretary of State may—</chapeau><paragraph class="fontsize10" id="y206ed174-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s103/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>receive and transmit, on behalf of the United States, reports, requests, recommendations, proposals, decisions, and other communications of and to the Commission;</content></paragraph>
<paragraph class="fontsize10" id="y206ef885-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s103/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206ef886-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>in consultation with the Secretary, act upon, or refer to another appropriate authority, any communication received pursuant to paragraph (1);</content></paragraph>
<paragraph class="fontsize10" id="y206ef887-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s103/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>with the concurrence of the Secretary, and in accordance with the Convention, object to the decisions of the Commission; and</content></paragraph>
<paragraph class="fontsize10" id="y206ef888-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s103/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>request and utilize on a reimbursed or non-reimbursed basis the assistance, services, personnel, equipment, and facilities of other Federal departments and agencies, foreign governments or agencies, or international intergovernmental organizations, in the conduct of scientific research and other programs under this subtitle.</content></paragraph>
</section>
<section id="d217191e863" identifier="/us/pl/114/327/tI/stA/s104" style="-uslm-lc:I658143"><num class="fontsize12" value="104">SEC. 104. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206ef889-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7704">16 USC 7704</ref>.</p></sidenote><heading>AUTHORITY OF THE SECRETARY OF COMMERCE.</heading><subsection class="firstIndent0 fontsize10" id="y206f94ca-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Promulgation of Regulations</inline>.—</heading><paragraph class="fontsize10" id="y206f94cb-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206f94cc-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><inline class="smallCaps">Authority</inline>.—</heading><content>The Secretary, in consultation with the Secretary of State and, with respect to enforcement measures, the Secretary of the department in which the Coast Guard is operating, may promulgate such regulations as may be necessary to carry out the United States international obligations under the North Pacific Fisheries Convention and this subtitle, including recommendations and decisions adopted by the Commission.</content></paragraph>
<paragraph class="fontsize10" id="y206f94cd-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Regulations of straddling stocks</inline>.—</heading><content>In the implementation of a measure adopted by the Commission that would govern a straddling stock under the authority of a Council, any regulation promulgated by the Secretary to implement such measure within the exclusive economic zone shall be approved by such Council.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y206f94ce-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206f94cf-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Regulations promulgated under subsection (a) shall be applicable only to a person or a fishing vessel that is or has engaged in fishing activities, or fisheries resources covered by the North Pacific Fisheries Convention under this subtitle.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y206f94d0-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Additional Authority</inline>.—</heading><chapeau>The Secretary may conduct, and may request and utilize on a reimbursed or nonreimbursed basis the assistance, services, personnel, equipment, and facilities of other Federal departments and agencies in—</chapeau><paragraph class="fontsize10" id="y206f94d1-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>scientific, research, and other programs under this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y206f94d2-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>fishing operations and biological experiments for purposes of scientific investigation or other purposes necessary to implement the North Pacific Fisheries Convention;<page identifier="/us/stat/130/1980">130 STAT. 1980</page></content></paragraph>
<paragraph class="fontsize10" id="y206f94d3-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the collection, utilization, and disclosure of such information as may be necessary to implement the North Pacific Fisheries Convention, subject to sections 552 and 552a of <ref href="/us/usc/t5">title 5, United States Code</ref>, and section 402(b) of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1881a/b">16 U.S.C. 1881a(b)</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y206f94d4-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the issuance of permits to owners and operators of United States vessels to engage in fishing activities in the Convention Area seaward of the exclusive economic zone of the United States, under such terms and conditions as the Secretary may prescribe, including the period of time that a permit is valid; and</content></paragraph>
<paragraph class="fontsize10" id="y206f94d5-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>if recommended by the United States Commissioners, the assessment and collection of fees, not to exceed 3 percent of the ex-vessel value of fisheries resources harvested by vessels of the United States in fisheries conducted in the Convention Area, to recover the actual costs to the United States to carry out the functions of the Secretary under this subtitle.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y206f94d6-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Consistency With Other Laws</inline>.—</heading><content>The Secretary shall ensure the consistency, to the extent practicable, of fishery management programs administered under this subtitle, the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1801/etseq">16 U.S.C. 1801 et seq.</ref>), the Tuna Conventions Act of 1950 (<ref href="/us/usc/t16/s951/etseq">16 U.S.C. 951 et seq.</ref>), the South Pacific Tuna Act of 1988 (<ref href="/us/usc/t16/s973/etseq">16 U.S.C. 973 et seq.</ref>), <ref href="/us/pl/108/219/s401">section 401 of Public Law 108–219</ref> (<ref href="/us/usc/t16/s1821">16 U.S.C. 1821 note</ref>) (relating to Pacific albacore tuna), the Western and Central Pacific Fisheries Convention Implementation Act (<ref href="/us/usc/t16/s6901/etseq">16 U.S.C. 6901 et seq.</ref>), the National Oceanic and Atmospheric Administration Authorization Act of 1992 (<ref href="/us/pl/102/567">Public Law 102–567</ref>) and the amendments made by that Act, and <ref href="/us/pl/100/629">Public Law 100–629</ref> (<ref href="/us/stat/102/3286">102 Stat. 3286</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y206f94d7-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206fbbe8-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><inline class="smallCaps">Judicial Review of Regulations</inline>.—</heading><paragraph class="fontsize10" id="y206fbbe9-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Regulations promulgated by the Secretary under this subtitle shall be subject to judicial review to the extent authorized by, and in accordance with, <ref href="/us/usc/t5/ch7">chapter 7 of title 5, United States Code</ref>, if a petition for such review is filed not later than 30 days after the date on which the regulations are promulgated.</content></paragraph>
<paragraph class="fontsize10" id="y206fbbea-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Responses</inline>.—</heading><content>Notwithstanding any other provision of law, the Secretary shall file a response to any petition filed in accordance with paragraph (1), not later than 30 days after the date the Secretary is served with that petition, except that the appropriate court may extend the period for filing such a response upon a showing by the Secretary of good cause for that extension.</content></paragraph>
<paragraph class="fontsize10" id="y206fbbeb-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Copies of administrative record</inline>.—</heading><content>A response of the Secretary under paragraph (2) shall include a copy of the administrative record for the regulations that are the subject of the petition.</content></paragraph>
<paragraph class="fontsize10" id="y206fbbec-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s104/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Expedited hearings</inline>.—</heading><content>Upon a motion by the person who files a petition under this subsection, the appropriate court shall assign the matter for hearing at the earliest possible date.</content></paragraph>

<section id="d217191e1050" identifier="/us/pl/114/327/tI/stA/s105" style="-uslm-lc:I658143"><num class="fontsize12" value="105">SEC. 105. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x206fbbed-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7705">16 USC 7705</ref>.</p></sidenote><heading>ENFORCEMENT.</heading><subsection class="firstIndent0 fontsize10" id="y2070a64e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Secretary and the Secretary of the department in which the Coast Guard is operating—<page identifier="/us/stat/130/1981">130 STAT. 1981</page></chapeau><paragraph class="fontsize10" id="y2070a64f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>shall administer and enforce this subtitle and any regulations issued under this subtitle; and</content></paragraph>
<paragraph class="fontsize10" id="y2070a650-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>may request and utilize on a reimbursed or nonreimbursed basis the assistance, services, personnel, equipment, and facilities of other Federal departments and agencies in the administration and enforcement of this subtitle.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2070a651-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Secretarial Actions</inline>.—</heading><content>The Secretary and the Secretary of the department in which the Coast Guard is operating shall prevent any person from violating this subtitle with respect to fishing activities or the conservation of fisheries resources in the Convention Area in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though sections 308 through 311 of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1858">16 U.S.C. 1858</ref>, 1859, 1860, and 1861) were incorporated into and made a part of this subtitle. Any person that violates this subtitle is subject to the penalties and entitled to the privileges and immunities provided in the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1801/etseq">16 U.S.C. 1801 et seq.</ref>) in the same manner, by the same means, and with the same jurisdiction, power, and duties as though sections 308 through 311 of that Act (<ref href="/us/usc/t16/s1858">16 U.S.C. 1858</ref>, 1859, 1860, and 1861) were incorporated into and made a part of this subtitle.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2070a652-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Jurisdiction of the Courts</inline>.—</heading><paragraph class="fontsize10" id="y2070a653-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Subject to paragraphs (2) and (3), the district courts of the United States shall have jurisdiction over any case or controversy arising under this subtitle, and any such court may at any time—</chapeau><subparagraph class="fontsize10" id="y2070a654-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>enter restraining orders or prohibitions;</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a655-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>issue warrants, process in rem, or other process;</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a656-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>prescribe and accept satisfactory bonds or other security; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a657-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>take such other actions as are in the interest of justice.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2070a658-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Hawaii and pacific insular areas</inline>.—</heading><chapeau>In the case of Hawaii or any possession of the United States in the Pacific Ocean, the appropriate court is the United States District Court for the District of Hawaii, except that—</chapeau><subparagraph class="fontsize10" id="y2070a659-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the case of Guam and Wake Island, the appropriate court is the United States District Court for the District of Guam; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a65a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in the case of the Northern Mariana Islands, the appropriate court is the United States District Court for the District of the Northern Mariana Islands.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2070a65b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Construction</inline>.—</heading><content>Each violation shall be a separate offense and the offense is deemed to have been committed not only in the district where the violation first occurred, but also in any other district authorized by law. Any offense not committed in any district is subject to the venue provisions of <ref href="/us/usc/t18/s3238">section 3238 of title 18, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2070a65c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Confidentiality</inline>.—</heading><paragraph class="fontsize10" id="y2070a65d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Any information submitted to the Secretary in compliance with any requirement under this subtitle, and information submitted under any requirement of this subtitle that may be necessary to implement the Convention, including information submitted before the date of the enactment of this Act, shall be confidential and may not be disclosed, except—<page identifier="/us/stat/130/1982">130 STAT. 1982</page></chapeau><subparagraph class="fontsize10" id="y2070a65e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to a Federal employee who is responsible for administering, implementing, or enforcing this subtitle;</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a65f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to the Commission, in accordance with requirements in the North Pacific Fisheries Convention and decisions of the Commission, and, insofar as possible, in accordance with an agreement with the Commission that prevents public disclosure of the identity or business of any person;</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a660-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to State, Council, or marine fisheries commission employees pursuant to an agreement with the Secretary that prevents public disclosure of the identity or business of any person;</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a661-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>when required by court order; or</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a662-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>when the Secretary has obtained written authorization from the person submitting such information to release such information to another person for a reason not otherwise provided for in this paragraph, and such release does not violate other requirements of this subtitle.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2070a663-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Use of information</inline>.—</heading><subparagraph class="fontsize10" id="y2070a664-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2070a665-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Regulations.</p><p class="leftAlign firstIndent0 fontsize8" id="x2070a666-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in subparagraph (B), the Secretary shall promulgate regulations regarding the procedures the Secretary considers necessary to preserve the confidentiality of information submitted under this subtitle.</content></subparagraph>
<subparagraph class="fontsize10" id="y2070a667-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>The Secretary may release or make public information submitted under this subtitle if the information is in any aggregate or summary form that does not directly or indirectly disclose the identity or business of any person.</content></subparagraph>

<paragraph class="fontsize10" id="y2070a668-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s105/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in this subsection shall be interpreted or construed to prevent the use for conservation and management purposes by the Secretary of any information submitted under this subtitle.</content></paragraph>

</section>
<section id="d217191e1256" identifier="/us/pl/114/327/tI/stA/s106" style="-uslm-lc:I658143"><num class="fontsize12" value="106">SEC. 106. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2070a669-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7706">16 USC 7706</ref>.</p></sidenote><heading>PROHIBITED ACTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x207142aa-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is unlawful for any person—</chapeau><paragraph class="fontsize10" id="y207142ab-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to violate this subtitle or any regulation or permit issued under this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y207142ac-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to use any fishing vessel to engage in fishing activities without, or after the revocation or during the period of suspension of, an applicable permit issued pursuant to this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y207142ad-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to refuse to permit any officer authorized to enforce this subtitle to board a fishing vessel subject to such person’s control for the purposes of conducting any search, investigation, or inspection in connection with the enforcement of this subtitle or any regulation, permit, or the North Pacific Fisheries Convention;</content></paragraph>
<paragraph class="fontsize10" id="y207142ae-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to assault, resist, oppose, impede, intimidate, or interfere with any such authorized officer in the conduct of any search, investigation, or inspection in connection with the enforcement of this subtitle or any regulation, permit, or the North Pacific Fisheries Convention;</content></paragraph>
<paragraph class="fontsize10" id="y207142af-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to resist a lawful arrest for any act prohibited by this subtitle or any regulation promulgated or permit issued under this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y207142b0-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>to ship, transport, offer for sale, sell, purchase, import, export, or have custody, control, or possession of, any fisheries <page identifier="/us/stat/130/1983">130 STAT. 1983</page>
resources taken or retained in violation of this subtitle or any regulation or permit referred to in paragraph (1) or (2);</content></paragraph>
<paragraph class="fontsize10" id="y207142b1-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>to interfere with, delay, or prevent, by any means, the apprehension or arrest of another person, knowing that such other person has committed any act prohibited by this section;</content></paragraph>
<paragraph class="fontsize10" id="y207142b2-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>to submit to the Secretary false information (including false information regarding the capacity and extent to which a United States fish processor, on an annual basis, will process a portion of the optimum yield of a fishery that will be harvested by fishing vessels of the United States), regarding any matter that the Secretary is considering in the course of carrying out this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y207142b3-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>to assault, resist, oppose, impede, intimidate, sexually harass, bribe, or interfere with any observer on a vessel under this subtitle, or any data collector employed by or under contract to any person to carry out responsibilities under this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y207142b4-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>to engage in fishing activities in violation of any regulation adopted pursuant to this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y207142b5-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>to fail to make, keep, or furnish any catch returns, statistical records, or other reports required by regulations adopted pursuant to this subtitle to be made, kept, or furnished;</content></paragraph>
<paragraph class="fontsize10" id="y207142b6-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>to fail to stop a vessel upon being hailed and instructed to stop by a duly authorized official of the United States;</content></paragraph>
<paragraph class="fontsize10" id="y207142b7-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/13" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><content>to import, in violation of any regulation adopted pursuant to this subtitle, any fisheries resources in any form of those species subject to regulation pursuant to a recommendation, resolution, or decision of the Commission, or any fisheries resources in any form not under regulation but under investigation by the Commission, during the period such fisheries resources have been denied entry in accordance with this subtitle;</content></paragraph>
<paragraph class="fontsize10" id="y207142b8-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/14" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><content>to make or submit any false record, account, or label for, or any false identification of, any fisheries resources that have been, or are intended to be imported, exported, transported, sold, offered for sale, purchased, or received in interstate or foreign commerce; or</content></paragraph>
<paragraph class="fontsize10" id="y207142b9-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s106/15" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">(15) </num><content>to refuse to authorize and accept boarding by a duly authorized inspector pursuant to procedures adopted by the Commission for the boarding and inspection of fishing vessels in the Convention Area.</content></paragraph>
</section>
<section id="d217191e1349" identifier="/us/pl/114/327/tI/stA/s107" style="-uslm-lc:I658143"><num class="fontsize12" value="107">SEC. 107. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x207142ba-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7707">16 USC 7707</ref>.</p></sidenote><heading>COOPERATION IN CARRYING OUT CONVENTION.</heading><subsection class="firstIndent0 fontsize10" id="y207190db-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s107/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Federal and State Agencies; Private Institutions and Organizations</inline>.—</heading><content>The Secretary may cooperate with any Federal agency, any public or private institution or organization within the United States or abroad, and, through the Secretary of State, a duly authorized official of the government of any party to the North Pacific Fisheries Convention, in carrying out responsibilities under this subtitle.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y207190dc-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s107/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Scientific and Other Programs; Facilities and Personnel</inline>.—</heading><content>Each Federal agency may, upon the request of the Secretary, cooperate in the conduct of scientific and other programs and furnish facilities and personnel for the purpose of assisting the Commission in carrying out its duties under the North Pacific Fisheries Convention.<page identifier="/us/stat/130/1984">130 STAT. 1984</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y207190dd-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s107/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Sanctioned Fishing Operations and Biological Experiments</inline>.—</heading><chapeau>Nothing in this subtitle, or in the laws of any State, prevents the Secretary or the Commission from—</chapeau><paragraph class="fontsize10" id="y207190de-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s107/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>conducting or authorizing the conduct of fishing operations and biological experiments at any time for purposes of scientific investigation; or</content></paragraph>
<paragraph class="fontsize10" id="y207190df-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s107/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>discharging any other duties prescribed by the North Pacific Fisheries Convention.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y207190e0-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tI/stA/s107/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">State Jurisdiction Not Affected</inline>.—</heading><content>Nothing in this subtitle shall be construed to diminish or to increase the jurisdiction of any State in the territorial sea of the United States.</content></subsection>
</section>
<section id="d217191e1408" identifier="/us/pl/114/327/tI/stA/s108" style="-uslm-lc:I658143"><num class="fontsize12" value="108">SEC. 108. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x207190e1-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7708">16 USC 7708</ref>.</p></sidenote><heading>TERRITORIAL PARTICIPATION.</heading><content style="-uslm-lc:I658120">  The Secretary of State shall ensure participation in the Commission and its subsidiary bodies by the Commonwealth of the Northern Mariana Islands, American Samoa, and Guam to the extent allowed under United States law.</content></section>
<section id="d217191e1420" identifier="/us/pl/114/327/tI/stA/s109" style="-uslm-lc:I658143"><num class="fontsize12" value="109">SEC. 109. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2071b7f2-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7709">16 USC 7709</ref>.</p></sidenote><heading>EXCLUSIVE ECONOMIC ZONE NOTIFICATION.</heading><content style="-uslm-lc:I658120">  Masters of commercial fishing vessels of countries fishing under the management authority of the North Pacific Fisheries Convention that do not carry vessel monitoring systems capable of communicating with United States enforcement authorities shall, prior to or as soon as reasonably possible after, entering and transiting the exclusive economic zone bounded by the Convention Area, ensure that all fishing gear on board the vessel is stowed below deck or otherwise removed from the place it is normally used for fishing activities and placed where it is not readily available for fishing activities.</content></section>
<section id="d217191e1432" identifier="/us/pl/114/327/tI/stA/s110" style="-uslm-lc:I658143"><num class="fontsize12" value="110">SEC. 110. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2071b7f3-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7710">16 USC 7710</ref>.</p></sidenote><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><content style="-uslm-lc:I658120">  There is authorized to be appropriated out of funds made available to the Secretary and the Secretary of State $300,000 for each of fiscal years 2017 through 2021 to carry out this subtitle and to pay the United States contribution to the Commission under Article 12 of the North Pacific Fisheries Convention.</content></section>

<section id="d217191e1660" identifier="/us/pl/114/327/tII/s201" style="-uslm-lc:I658143"><num class="fontsize12" value="201">SEC. 201. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20727b52-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7801">16 USC 7801</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x20733ea3-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this title:</chapeau><paragraph class="fontsize10" id="y20733ea4-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10 smallCaps">1982 convention<inline class="noSmallCaps">.—</inline></heading><content>The term “<term>1982 Convention</term>” means the United Nations Convention on the Law of the Sea of 10 December 1982.</content></paragraph>
<paragraph class="fontsize10" id="y20733ea5-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Commission</inline>.—</heading><content>The term “<term>Commission</term>” means the Commission of the South Pacific Regional Fisheries Management Organization established in accordance with the South Pacific Fishery Resources Convention.</content></paragraph>
<paragraph class="fontsize10" id="y20733ea6-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Convention area</inline>.—</heading><content>The term “<term>Convention Area</term>” means the area to which the Convention on the Conservation and Management of High Seas Fishery Resources in the South Pacific Ocean applies under Article 5 of such Convention.<page identifier="/us/stat/130/1986">130 STAT. 1986</page></content></paragraph>
<paragraph class="fontsize10" id="y20733ea7-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Council</inline>.—</heading><content>The term “<term>Council</term>” means the Western Pacific Regional Fishery Management Council.</content></paragraph>
<paragraph class="fontsize10" id="y20733ea8-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Exclusive economic zone</inline>.—</heading><chapeau>The term “<term>exclusive economic zone</term>” means—</chapeau><subparagraph class="fontsize10" id="y20733ea9-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>with respect to the United States, the zone established by Presidential Proclamation Numbered 5030 of March 10, 1983 (<ref href="/us/usc/t16/s1453">16 U.S.C. 1453 note</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y20733eaa-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>with respect to a foreign country, a designated zone similar to the zone referred to in subparagraph (A) for that country, consistent with international law.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y20733eab-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Fishery resources</inline>.—</heading><chapeau>The term “<term>fishery resources</term>” means all fish, mollusks, crustaceans, and other marine species, and any products thereof, caught by a fishing vessel within the Convention Area, but excluding—</chapeau><subparagraph class="fontsize10" id="y20733eac-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>sedentary species insofar as they are subject to the national jurisdiction of coastal States pursuant to Article 77 paragraph 4 of the 1982 Convention;</content></subparagraph>
<subparagraph class="fontsize10" id="y20733ead-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>highly migratory species listed in Annex I of the 1982 Convention;</content></subparagraph>
<subparagraph class="fontsize10" id="y20733eae-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/6/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>anadromous and catadromous species; and</content></subparagraph>
<subparagraph class="fontsize10" id="y20733eaf-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/6/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>marine mammals, marine reptiles and sea birds.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y20733eb0-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Fishing</inline>.—</heading><chapeau>The term “<term>fishing</term>”—</chapeau><subparagraph class="fontsize10" id="y20733eb1-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>except as provided in subparagraph (B), means—</chapeau><clause class="fontsize10" id="y207365c2-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/7/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the actual or attempted searching for, catching, taking, or harvesting of fishery resources;</content></clause>
<clause class="fontsize10" id="y207365c3-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/7/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>engaging in any activity that can reasonably be expected to result in the locating, catching, taking or harvesting of fishery resources for any purpose;</content></clause>
<clause class="fontsize10" id="y207365c4-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/7/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>transshipment and any operation at sea, in support of, or in preparation for, any activity described in this subparagraph; and</content></clause>
<clause class="fontsize10" id="y207365c5-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/7/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the use of any vessel, vehicle, aircraft, or hovercraft in relation to any activity described in this subparagraph; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y207365c6-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>does not include any operation related to emergencies involving the health and safety of crew members or the safety of a fishing vessel.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y207365c7-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Fishing vessel</inline>.—</heading><content>The term “<term>fishing vessel</term>” means any vessel used or intended to be used for fishing, including any fish processing vessel support ship, carrier vessel, or any other vessel directly engaged in fishing operations.</content></paragraph>
<paragraph class="fontsize10" id="y207365c8-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Person</inline>.—</heading><content>The term “<term>person</term>” means any individual (whether or not a citizen or national of the United States); any corporation, partnership, association, or other entity (whether or not organized or existing under the laws of any State); and any Federal, State, local, or foreign government or any entity of any such government.</content></paragraph>
<paragraph class="fontsize10" id="y207365c9-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/10" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Commerce.</content></paragraph>
<paragraph class="fontsize10" id="y207365ca-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/11" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><heading class="fontsize10"><inline class="smallCaps">South pacific fishery resources convention</inline>.—</heading><content>The term “<term>South Pacific Fishery Resources Convention</term>” means the Convention on the Conservation and Management of the High Seas Fishery Resources in the South Pacific Ocean (including any annexes, amendments, or protocols that are in force, or have come into force, for the United States), which was adopted at Auckland, New Zealand, on November 14, 2009, by the <page identifier="/us/stat/130/1987">130 STAT. 1987</page>
International Consultations on the Proposed South Pacific Regional Fisheries Management Organization.</content></paragraph>
<paragraph class="fontsize10" id="y207365cb-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s201/12" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term “<term>State</term>” means each of the several States of the United States, the District of Columbia, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, and any other commonwealth, territory, or possession of the United States.</content></paragraph>

<section id="d217191e1853" identifier="/us/pl/114/327/tII/s202" style="-uslm-lc:I658143"><num class="fontsize12" value="202">SEC. 202. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x207365cc-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7802">16 USC 7802</ref>.</p></sidenote><heading>APPOINTMENT OR DESIGNATION OF UNITED STATES COMMISSIONERS.</heading><subsection class="firstIndent0 fontsize10" id="y20749e4d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Appointment</inline>.—</heading><paragraph class="fontsize10" id="y20749e4e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The United States shall be represented on the Commission by not more than 3 Commissioners. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20749e4f-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote>In making each appointment, the President shall select a Commissioner from among individuals who are knowledgeable or experienced concerning fishery resources in the South Pacific Ocean.</content></paragraph>
<paragraph class="fontsize10" id="y20749e50-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Representation</inline>.—</heading><chapeau>At least 1 of the Commissioners shall be—</chapeau><subparagraph class="fontsize10" id="y20749e51-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>serving at the pleasure of the President, an officer or employee of—</chapeau><clause class="fontsize10" id="y20749e52-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Department of Commerce;</content></clause>
<clause class="fontsize10" id="y20749e53-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Department of State; or</content></clause>
<clause class="fontsize10" id="y20749e54-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the Coast Guard; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y20749e55-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the chairperson or designee of the Council.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y20749e56-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20749e57-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><inline class="smallCaps">Alternate Commissioners</inline>.—</heading><content>The Secretary of State, in consultation with the Secretary, may designate from time to time and for periods of time considered appropriate an alternate Commissioner to the Commission. An alternate Commissioner may exercise all powers and duties of a Commissioner in the absence of a Commissioner appointed under subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y20749e58-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Administrative Matters</inline>.—</heading><paragraph class="fontsize10" id="y20749e59-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Employment status</inline>.—</heading><content>An individual serving as a Commissioner, or as an alternate Commissioner, other than an officer or employee of the United States Government, shall not be considered a Federal employee, except for the purposes of injury compensation or tort claims liability as provided in <ref href="/us/usc/t5/ch81">chapter 81 of title 5, United States Code</ref>, and <ref href="/us/usc/t28/ch171">chapter 171 of title 28, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y20749e5a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Compensation</inline>.—</heading><content>An individual serving as a Commissioner or an alternate Commissioner, although an officer of the United States while so serving, shall receive no compensation for the individual’s services as such Commissioner or alternate Commissioner.</content></paragraph>
<paragraph class="fontsize10" id="y20749e5b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Travel expenses</inline>.—</heading><subparagraph class="fontsize10" id="y20749e5c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/c/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of State shall pay the necessary travel expenses of a Commissioner or an alternate Commissioner in accordance with the Federal Travel Regulations and sections 5701, 5702, 5704 through 5708, and 5731 of <ref href="/us/usc/t5">title 5, United States Code</ref>.</content></subparagraph>
<subparagraph class="fontsize10" id="y20749e5d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/c/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Reimbursement</inline>.—</heading><content>The Secretary may reimburse the Secretary of State for amounts expended by the Secretary of State under this paragraph.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y20749e5e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Advisory Committee</inline>.—</heading><paragraph class="fontsize10" id="y20749e5f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Establishment of permanent advisory committee</inline>.—</heading><page identifier="/us/stat/130/1988">130 STAT. 1988</page>
<subparagraph class="fontsize10" id="y20749e60-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>There is established an advisory committee which shall be composed of 7 members appointed by the Secretary as follows:</chapeau><clause class="fontsize10" id="y20749e61-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>A member engaging in commercial fishing in the management area of the Council.</content></clause>
<clause class="fontsize10" id="y20749e62-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>Two members from the indigenous population of the Pacific, including a Native Hawaiian and a native-born inhabitant of any State in the Pacific.</content></clause>
<clause class="fontsize10" id="y20749e63-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>A member that is a marine fisheries scientist and a member of the Council’s Scientific and Statistical Committee.</content></clause>
<clause class="fontsize10" id="y20749e64-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>A member representing a non-governmental organization active in fishery issues in the Pacific.</content></clause>
<clause class="fontsize10" id="y20749e65-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>A member nominated by the Governor of the State of Hawaii.</content></clause>
<clause class="fontsize10" id="y20749e66-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/A/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>A member designated by the Council.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y20749e67-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Terms and privileges</inline>.—</heading><content>Each member of the Advisory Committee shall serve for a term of 2 years and shall be eligible for reappointment for not more than 3 consecutive terms. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20749e68-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notification.</p></sidenote>The Commissioners shall notify the Advisory Committee in advance of each meeting of the Commissioners. The Advisory Committee may attend each meeting and may examine and be heard on all proposed programs, investigations, reports, recommendations, and regulations of the Commissioners.</content></subparagraph>
<subparagraph class="fontsize10" id="y20749e69-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Procedures</inline>.—</heading><clause class="fontsize10" id="y20749e6a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20749e6b-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>The Advisory Committee shall determine its organization and prescribe its practices and procedures for carrying out its functions under this title, the South Pacific Fisheries Convention, and the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1801/etseq">16 U.S.C. 1801 et seq.</ref>).</content></clause>
<clause class="fontsize10" id="y20749e6c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20749e6d-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Publication.</p></sidenote><inline class="smallCaps">Public availability of procedures</inline>.—</heading><content>The Advisory Committee shall publish and make available to the public a statement of its organization, practices, and procedures.</content></clause>
<clause class="fontsize10" id="y20749e6e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><heading class="fontsize10"><inline class="smallCaps">Quorum</inline>.—</heading><content>A majority of the members of the Advisory Committee shall constitute a quorum to conduct business.</content></clause>
<clause class="fontsize10" id="y20749e6f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><heading class="fontsize10"><inline class="smallCaps">Public meetings</inline>.—</heading><content>Meetings of the Advisory Committee, except when in executive session, shall be open to the public. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20749e70-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notifications.</p></sidenote>Prior notice of each non-executive meeting shall be made public in a timely fashion. The Advisory Committee shall not be subject to the Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>).</content></clause>
<clause class="fontsize10" id="y20749e71-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/C/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><heading class="fontsize10"><inline class="smallCaps">Cost savings</inline>.—</heading><content>In order to reduce the cost of Advisory Committee meetings, the Advisory Committee shall, to the extent practicable, utilize teleconferences and webinars for that purpose.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y20749e72-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Provision of information</inline>.—</heading><content>The Secretary and the Secretary of State shall furnish the Advisory Committee with relevant information concerning fishery resources and international fishery agreements.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y20749e73-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Administrative matters</inline>.—</heading><subparagraph class="fontsize10" id="y20749e74-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Support services</inline>.—</heading><content>The Secretary shall provide to the Advisory Committee in a timely manner such <page identifier="/us/stat/130/1989">130 STAT. 1989</page>
administrative and technical support services as are necessary to function effectively.</content></subparagraph>
<subparagraph class="fontsize10" id="y20749e75-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Compensation; status; expenses</inline>.—</heading><chapeau>An individual appointed to serve as a member of the Advisory Committee—</chapeau><clause class="fontsize10" id="y20749e76-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>shall serve without pay; and</content></clause>
<clause class="fontsize10" id="y20749e77-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s202/d/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>shall not be considered a Federal employee, except for the purposes of injury compensation or tort claims liability as provided in <ref href="/us/usc/t5/ch81">chapter 81 of title 5, United States Code</ref>, and <ref href="/us/usc/t28/ch171">chapter 171 of title 28, United States Code</ref>.</content></clause>

<section id="d217191e2194" identifier="/us/pl/114/327/tII/s203" style="-uslm-lc:I658143"><num class="fontsize12" value="203">SEC. 203. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20749e78-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7803">16 USC 7803</ref>.</p></sidenote><heading>AUTHORITY AND RESPONSIBILITY OF THE SECRETARY OF STATE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x2074c489-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Secretary of State may—</chapeau><paragraph class="fontsize10" id="y2074c48a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s203/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>receive and transmit, on behalf of the United States, reports, requests, recommendations, proposals, decisions, and other communications of and to the Commission;</content></paragraph>
<paragraph class="fontsize10" id="y2074c48b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s203/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2074c48c-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote>in consultation with the Secretary, act upon, or refer to other appropriate authority, any communication pursuant to paragraph (1); and</content></paragraph>
<paragraph class="fontsize10" id="y2074c48d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s203/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>with the concurrence of the Secretary, and in accordance with the South Pacific Fishery Resources Convention, object to decisions of the Commission.</content></paragraph>

<section id="d217191e2225" identifier="/us/pl/114/327/tII/s204" style="-uslm-lc:I658143"><num class="fontsize12" value="204">SEC. 204. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2074c48e-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7804">16 USC 7804</ref>.</p></sidenote><heading>RESPONSIBILITY OF THE SECRETARY AND RULEMAKING AUTHORITY.</heading><subsection class="firstIndent0 fontsize10" id="y207560cf-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Responsibilities</inline>.—</heading><chapeau>The Secretary may—</chapeau><paragraph class="fontsize10" id="y207560d0-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>administer this title and any regulations issued under this title, except to the extent otherwise provided for in this title;</content></paragraph>
<paragraph class="fontsize10" id="y207560d1-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>issue permits to vessels subject to the jurisdiction of the United States, and to owners and operators of such vessels, to fish in the Convention Area, under such terms and conditions as the Secretary may prescribe; and</content></paragraph>
<paragraph class="fontsize10" id="y207560d2-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>if recommended by the United States Commissioners, assess and collect fees, not to exceed 3 percent of the ex-vessel value of fisheries resources harvested by vessels of the United States in fisheries conducted in the Convention Area, to recover the actual costs to the United States to carry out the functions of the Secretary under this title.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y207560d3-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Promulgation of Regulations</inline>.—</heading><paragraph class="fontsize10" id="y207560d4-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x207560d5-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary, in consultation with the Secretary of State and the Secretary of the department in which the Coast Guard is operating, may promulgate such regulations as may be necessary and appropriate to carry out the international obligations of the United States under the South Pacific Fishery Resources Convention and this title, including decisions adopted by the Commission.</content></paragraph>
<paragraph class="fontsize10" id="y207560d6-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>Regulations promulgated under this subsection shall be applicable only to a person or fishing vessel that is or has engaged in fishing, and fishery resources covered by the Convention on the Conservation and Management of High Seas Fishery Resources in the South Pacific Ocean under this title.<page identifier="/us/stat/130/1990">130 STAT. 1990</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y207560d7-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Consistency With Other Laws</inline>.—</heading><content>The Secretary shall ensure the consistency, to the extent practicable, of fishery management programs administered under this title, the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1801/etseq">16 U.S.C. 1801 et seq.</ref>), the Tuna Conventions Act of 1950 (<ref href="/us/usc/t16/s951/etseq">16 U.S.C. 951 et seq.</ref>), the South Pacific Tuna Act of 1988 (<ref href="/us/usc/t16/s973/etseq">16 U.S.C. 973 et seq.</ref>), <ref href="/us/pl/108/219/s401">section 401 of Public Law 108–219</ref> (<ref href="/us/usc/t16/s1821">16 U.S.C. 1821 note</ref>) (relating to Pacific albacore tuna), the Western and Central Pacific Fisheries Convention Implementation Act (<ref href="/us/usc/t16/s6901/etseq">16 U.S.C. 6901 et seq.</ref>), the National Oceanic and Atmospheric Administration Authorization Act of 1992 (<ref href="/us/pl/102/567">Public Law 102–567</ref>) and the amendments made by that Act, and <ref href="/us/pl/100/629">Public Law 100–629</ref> (<ref href="/us/stat/102/3286">102 Stat. 3286</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y207560d8-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x207560d9-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><inline class="smallCaps">Judicial Review of Regulations</inline>.—</heading><paragraph class="fontsize10" id="y207560da-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Regulations promulgated by the Secretary under this title shall be subject to judicial review to the extent authorized by, and in accordance with, <ref href="/us/usc/t5/ch7">chapter 7 of title 5, United States Code</ref>, if a petition for such review is filed not later than 30 days after the date on which the regulations are promulgated or the action is published in the Federal Register, as applicable.</content></paragraph>
<paragraph class="fontsize10" id="y207560db-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Responses</inline>.—</heading><content>Notwithstanding any other provision of law, the Secretary shall file a response to any petition filed in accordance with paragraph (1) not later than 30 days after the date the Secretary is served with that petition, except that the appropriate court may extend the period for filing such a response upon a showing by the Secretary of good cause for that extension.</content></paragraph>
<paragraph class="fontsize10" id="y207560dc-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Copies of administrative record</inline>.—</heading><content>A response of the Secretary under paragraph (2) shall include a copy of the administrative record for the regulations that are the subject of the petition.</content></paragraph>
<paragraph class="fontsize10" id="y207560dd-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s204/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Expedited hearings</inline>.—</heading><content>Upon a motion by the person who files a petition under this subsection, the appropriate court shall assign the matter for hearing at the earliest possible date.</content></paragraph>
</subsection>

<section id="d217191e2381" identifier="/us/pl/114/327/tII/s205" style="-uslm-lc:I658143"><num class="fontsize12" value="205">SEC. 205. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x207560de-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7805">16 USC 7805</ref>.</p></sidenote><heading>ENFORCEMENT.</heading><subsection class="firstIndent0 fontsize10" id="y2075aeff-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Responsibility</inline>.—</heading><content>This title, and any regulations or permits issued under this title, shall be enforced by the Secretary and the Secretary of the department in which the Coast Guard is operating. Such Secretaries shall, and the head of any Federal or State agency that has entered into an agreement with either such Secretary under this section may (if the agreement so provides), authorize officers to enforce this title or any regulation promulgated under this title. Any officer so authorized may enforce this title in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though section 311 of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1861">16 U.S.C. 1861</ref>) were incorporated into and made a part of this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2075d610-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Administration and Enforcement</inline>.—</heading><content>The Secretary and the Secretary of the department in which the Coast Guard is operating shall prevent any person from violating this title in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though sections 308 through 311 of the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1858">16 U.S.C. 1858</ref> through 1861) were incorporated into and made <page identifier="/us/stat/130/1991">130 STAT. 1991</page>
a part of this title. Any person that violates this title shall be subject to the penalties, and entitled to the privileges and immunities, provided in the Magnuson-Stevens Fishery Conservation and Management Act (<ref href="/us/usc/t16/s1801/etseq">16 U.S.C. 1801 et seq.</ref>) in the same manner and by the same means as though sections 308 through 311 of that Act (<ref href="/us/usc/t16/s1858">16 U.S.C. 1858</ref> through 1861) were incorporated into and made a part of this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2075d611-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">District Court Jurisdiction</inline>.—</heading><paragraph class="fontsize10" id="y2075d612-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The district courts of the United States shall have jurisdiction over any actions arising under this section.</content></paragraph>
<paragraph class="fontsize10" id="y2075d613-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Hawaii and pacific insular areas</inline>.—</heading><chapeau>Notwithstanding subsection (b), for the purpose of this section, for Hawaii or any possession of the United States in the Pacific Ocean, the appropriate court is the United States District Court for the District of Hawaii, except that—</chapeau><subparagraph class="fontsize10" id="y2075d614-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the case of Guam and Wake Island, the appropriate court is the United States District Court for the District of Guam; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2075d615-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in the case of the Northern Mariana Islands, the appropriate court is the United States District Court for the District of the Northern Mariana Islands.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2075d616-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s205/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Construction</inline>.—</heading><content>Each violation shall be a separate offense and the offense is deemed to have been committed not only in the district where the violation first occurred, but also in any other district as authorized by law. <section id="d217191e2475" identifier="/us/pl/114/327/tII/s206" style="-uslm-lc:I658143"><num class="fontsize12" value="206">SEC. 206. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2075d617-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7806">16 USC 7806</ref>.</p></sidenote><heading>PROHIBITED ACTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x20764b48-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  It is unlawful for any person—</chapeau><paragraph class="fontsize10" id="y20764b49-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to violate any provision of this title or of any regulation promulgated or permit issued under this title;</content></paragraph>
<paragraph class="fontsize10" id="y20764b4a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to use any fishing vessel to engage in fishing without a valid permit or after the revocation, or during the period of suspension, of an applicable permit pursuant to this title;</content></paragraph>
<paragraph class="fontsize10" id="y20764b4b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to refuse to permit any officer authorized to enforce this title to board a fishing vessel subject to such person’s control for the purposes of conducting any investigation or inspection in connection with the enforcement of this title;</content></paragraph>
<paragraph class="fontsize10" id="y20764b4c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to assault, resist, oppose, impede, intimidate, or interfere with any such authorized officer in the conduct of any search, investigation, or inspection in connection with the enforcement of this title or any regulation promulgated or permit issued under this title;</content></paragraph>
<paragraph class="fontsize10" id="y20764b4d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to resist a lawful arrest for any act prohibited by this title or any regulation promulgated or permit issued under this title;</content></paragraph>
<paragraph class="fontsize10" id="y20764b4e-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>to ship, transport, offer for sale, sell, purchase, import, export, or have custody, control, or possession of, any fishery resources taken or retained in violation of this title or any regulation or permit referred to in paragraph (1) or (2);</content></paragraph>
<paragraph class="fontsize10" id="y20764b4f-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>to interfere with, delay, or prevent, by any means, the apprehension or arrest of another person, knowing that such other person has committed any act prohibited by this title;<page identifier="/us/stat/130/1992">130 STAT. 1992</page></content></paragraph>
<paragraph class="fontsize10" id="y20764b50-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>to submit to the Secretary false information, regarding any matter that the Secretary is considering in the course of carrying out this title;</content></paragraph>
<paragraph class="fontsize10" id="y20764b51-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>to assault, resist, oppose, impede, intimidate, sexually harass, bribe, or interfere with any observer on a vessel pursuant to the requirements of this title, or any data collector employed by the National Oceanic and Atmospheric Administration or under contract to any person to carry out responsibilities under this title;</content></paragraph>
<paragraph class="fontsize10" id="y20764b52-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>to fail to make, keep, or furnish any catch returns, statistical records, or other reports as are required by regulations adopted pursuant to this title to be made, kept, or furnished;</content></paragraph>
<paragraph class="fontsize10" id="y20764b53-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>to fail to stop a vessel upon being hailed and instructed to stop by a duly authorized official of the United States;</content></paragraph>
<paragraph class="fontsize10" id="y20764b54-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>to import, in violation of any regulation promulgated under this title, any fishery resources in any form of those species subject to regulation pursuant to a decision of the Commission;</content></paragraph>
<paragraph class="fontsize10" id="y20764b55-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/13" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><content>to make or submit any false record, account, or label for, or any false identification of, any fishery resources that have been or are intended to be imported, exported, transported, sold, offered for sale, purchased, or received in interstate or foreign commerce; or</content></paragraph>
<paragraph class="fontsize10" id="y20764b56-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s206/14" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><content>to refuse to authorize and accept boarding by a duly authorized inspector pursuant to procedures adopted by the Commission for the boarding and inspection of fishing vessels in the Convention Area.</content></paragraph>

<section id="d217191e2562" identifier="/us/pl/114/327/tII/s207" style="-uslm-lc:I658143"><num class="fontsize12" value="207">SEC. 207. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x20767267-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7807">16 USC 7807</ref>.</p></sidenote><heading>COOPERATION IN CARRYING OUT THE CONVENTION.</heading><subsection class="firstIndent0 fontsize10" id="y20769978-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s207/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Federal and State Agencies; Private Institutions and Organizations</inline>.—</heading><content>The Secretary may cooperate with agencies of the United States Government, any public or private institutions or organizations within the United States or abroad, and, through the Secretary of State, the duly authorized officials of the government of any party to the South Pacific Fishery Resources Convention, in carrying out responsibilities under this title.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y20769979-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s207/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Scientific and Other Programs; Facilities and Personnel</inline>.—</heading><content>All Federal agencies may, upon the request of the Secretary, cooperate in the conduct of scientific and other programs and to furnish facilities and personnel for the purpose of assisting the Commission in carrying out its duties under the South Pacific Fishery Resources Convention.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2076997a-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s207/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Sanctioned Fishing Operations and Biological Experiments</inline>.—</heading><chapeau>Nothing in this title, or in the laws or regulations of any State, prevents the Secretary or the Commission from—</chapeau><paragraph class="fontsize10" id="y2076997b-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s207/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>conducting or authorizing the conduct of fishing operations and biological experiments at any time for purposes of scientific investigation; or</content></paragraph>
<paragraph class="fontsize10" id="y2076997c-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s207/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>discharging any other duties prescribed by the South Pacific Fishery Resources Convention.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2076997d-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s207/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">State Jurisdiction Not Affected</inline>.—</heading><content>Nothing in this title shall be construed to diminish or to increase the jurisdiction of any State in the territorial sea of the United States.</content></subsection>

<section id="d217191e2618" identifier="/us/pl/114/327/tII/s208" style="-uslm-lc:I658143"><num class="fontsize12" value="208">SEC. 208. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2076997e-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7808">16 USC 7808</ref>.</p></sidenote><heading>TERRITORIAL PARTICIPATION.</heading><content style="-uslm-lc:I658120">  The Secretary of State shall ensure participation in the Commission and its subsidiary bodies by American Samoa, Guam, <page identifier="/us/stat/130/1993">130 STAT. 1993</page>
and the Commonwealth of the Northern Mariana Islands to the extent allowed under United States law.</content></section>
<section id="d217191e2633" identifier="/us/pl/114/327/tII/s209" style="-uslm-lc:I658143"><num class="fontsize12" value="209">SEC. 209. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2076c08f-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7809">16 USC 7809</ref>.</p></sidenote><heading>EXCLUSIVE ECONOMIC ZONE NOTIFICATION.</heading><content style="-uslm-lc:I658120">  Masters of commercial fishing vessels of countries fishing under the management authority of the South Pacific Fisheries Convention that do not carry vessel monitoring systems capable of communicating with United States enforcement authorities shall, before or as soon as reasonably possible after, entering and transiting the exclusive economic zone bounded by the Convention Area, ensure that all fishing gear on board the vessel is stowed below deck or otherwise removed from the place it is normally used for fishing activities and placed where it is not readily available for fishing activities.</content></section>
<section id="d217191e2645" identifier="/us/pl/114/327/tII/s210" style="-uslm-lc:I658143"><num class="fontsize12" value="210">SEC. 210. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2076c090-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s7810">16 USC 7810</ref>.</p></sidenote><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><subsection class="firstIndent0 fontsize10" id="y2076e7a1-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s210/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>There is authorized to be appropriated out of funds made available to the Secretary and the Secretary of State $300,000 for each of fiscal years 2017 through 2021 to carry out this title and to pay the United States contribution to the Commission under Article 15 of the South Pacific Fisheries Convention.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2076e7a2-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s210/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">International Cooperation and Assistance</inline>.—</heading><paragraph class="fontsize10" id="y2076e7a3-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s210/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to the limits of available appropriations and consistent with applicable law, the Secretary or the Secretary of State may provide appropriate assistance, including grants, to developing nations and international organizations of which such nations are members to assist those nations in meeting their obligations under the South Pacific Fisheries Convention.</content></paragraph>
<paragraph class="fontsize10" id="y2076e7a4-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/327/tII/s210/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Transfer of funds</inline>.—</heading><content>Subject to the limits of available appropriations and consistent with other applicable law, the Secretary and the Secretary of State are authorized to transfer funds to any foreign government and any international, non-governmental, or international organization, including the Commission, for purposes of carrying out the international responsibilities under paragraph (1).</content></paragraph>

<paragraph class="indentUp0 fontsize10" id="y207783f3-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>to prevent any requirement for the transfer to other nations or foreign entities of the fishing capacity, fishing capacity rights, or fishing vessels of the United States or its territories, unless any such requirement is voluntary and market-based; and</content></paragraph>

<paragraph class="fontsize10" id="y2079ce10-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Convention area</inline>.—</heading><content>The term ‘<term>Convention Area</term>’ means the waters of the Northwest Atlantic Ocean north of 35°00′ N and west of a line extending due north from 35°00′ N and 42°00′ W to 59°00′ N, thence due west to 44°00′ W, and thence due north to the coast of Greenland, and the waters of the Gulf of St. Lawrence, Davis Strait and Baffin Bay south of 78°10′ N.</content></paragraph>
<paragraph class="fontsize10" id="y2079ce11-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Council</inline>.—</heading><content>The term ‘<term>Council</term>’ means the New England Fishery Management Council or the Mid-Atlantic Fishery Management Council.</content></paragraph>
<paragraph class="fontsize10" id="y2079ce12-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Fishery resources</inline>.—</heading><subparagraph class="fontsize10" id="y2079ce13-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term ‘<term>fishery resources</term>’ means all fish, mollusks, and crustaceans, including any products thereof, within the Convention Area.</content></subparagraph>
<subparagraph class="fontsize10" id="y2079ce14-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusions</inline>.—</heading><chapeau>The term ‘<term>fishery resources</term>’ does not include—</chapeau><clause class="fontsize10" id="y2079ce15-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>sedentary species over which coastal States may exercise sovereign rights consistent with Article 77 of the 1982 Convention; or</content></clause>
<clause class="fontsize10" id="y2079ce16-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>insofar as they are managed under other international treaties, anadromous and catadromous stocks and highly migratory species listed in Annex I of the 1982 Convention.</content></clause>

<paragraph class="fontsize10" id="y2079ce17-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Fishing activities</inline>.—</heading><subparagraph class="fontsize10" id="y2079ce18-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term ‘<term>fishing activities</term>’ means harvesting or processing fishery resources, or transhipping of fishery resources or products derived from fishery resources, or any other activity in preparation for, in support of, or related to the harvesting of fishery resources.</content></subparagraph>
<subparagraph class="fontsize10" id="y2079ce19-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Inclusions</inline>.—</heading><chapeau>The term ‘<term>fishing activities</term>’ includes—</chapeau><clause class="fontsize10" id="y2079ce1a-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the actual or attempted searching for or catching or taking of fishery resources;</content></clause>
<clause class="fontsize10" id="y2079ce1b-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any activity that can reasonably be expected to result in locating, catching, taking, or harvesting of fishery resources for any purpose; and</content></clause>
<clause class="fontsize10" id="y2079ce1c-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any operation at sea in support of, or in preparation for, any activity described in this paragraph.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y2079ce1d-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Exclusions</inline>.—</heading><content>The term ‘<term>fishing activities</term>’ does not include any operation related to emergencies involving the health and safety of crew members or the safety of a vessel.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2079ce1e-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><heading class="fontsize10"><inline class="smallCaps">Fishing vessel</inline>.—</heading><subparagraph class="fontsize10" id="y2079ce1f-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term ‘<term>fishing vessel</term>’ means a vessel that is or has been engaged in fishing activities.</content></subparagraph>
<subparagraph class="fontsize10" id="y2079ce20-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Inclusions</inline>.—</heading><content>The term ‘<term>fishing vessel</term>’ includes a fish processing vessel or a vessel engaged in transshipment or any other activity in preparation for or related to fishing activities, or in experimental or exploratory fishing activities.</content></subparagraph>

<paragraph class="fontsize10" id="y2079ce21-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><heading class="fontsize10"><inline class="smallCaps">Organization</inline>.—</heading><content>The term ‘<term>Organization</term>’ means the Northwest Atlantic Fisheries Organization provided for by Article V of the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y2079ce22-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><heading class="fontsize10"><inline class="smallCaps">Person</inline>.—</heading><content>The term ‘<term>person</term>’ means any individual (whether or not a citizen or national of the United States), and any corporation, partnership, association, or other entity <page identifier="/us/stat/130/1998">130 STAT. 1998</page>
(whether or not organized or existing under the laws of any State).</content></paragraph>
<paragraph class="fontsize10" id="y2079ce23-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">“(13) </num><heading class="fontsize10"><inline class="smallCaps">Representative</inline>.—</heading><content>The term ‘<term>Representative</term>’ means a United States Representative to the Northwest Atlantic Fisheries Scientific Council appointed under section 202.</content></paragraph>
<paragraph class="fontsize10" id="y2079ce24-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">“(14) </num><heading class="fontsize10"><inline class="smallCaps">Scientific council</inline>.—</heading><content>The term ‘<term>Scientific Council</term>’ means the Scientific Council provided for by Articles V, VI, and VII of the Convention.</content></paragraph>
<paragraph class="fontsize10" id="y2079ce25-e84b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">“(15) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term ‘<term>Secretary</term>’ means the Secretary of Commerce.</content></paragraph>
