<section id="d221333e92" identifier="/us/pl/114/321/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">RESPONSE Act of 2016</shortTitle>”.</content></section>
<section id="d221333e102" identifier="/us/pl/114/321/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>RAILROAD EMERGENCY SERVICES PREPAREDNESS, OPERATIONAL NEEDS, AND SAFETY EVALUATION SUBCOMMITTEE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xfaf226c0-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 508 of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s318">6 U.S.C. 318</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yfaf226c1-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/321/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (d) as subsection (e); and</content></paragraph>
<paragraph class="fontsize10" id="yfaf226c2-e84b-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/321/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (c) the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yfaf38653-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">RESPONSE Subcommittee</inline>.—</heading><paragraph class="fontsize10" id="yfaf38654-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfaf38655-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>Not later than 30 days after the date of the enactment of the RESPONSE Act of 2016, the Administrator shall establish, as a subcommittee of the National Advisory Council, the Railroad Emergency Services Preparedness, Operational Needs, and Safety Evaluation Subcommittee (referred to in this subsection as the ‘RESPONSE Subcommittee’).</content></paragraph>
<paragraph class="fontsize10" id="yfaf38656-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>Notwithstanding subsection (c), the RESPONSE Subcommittee shall be composed of the following:</chapeau><subparagraph class="fontsize10" id="yfaf38657-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The Deputy Administrator, Protection and National Preparedness of the Federal Emergency Management Agency, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf38658-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The Chief Safety Officer of the Pipeline and Hazardous Materials Safety Administration, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf38659-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>The Associate Administrator for Hazardous Materials Safety of the Pipeline and Hazardous Materials Safety Administration, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3865a-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>The Director of the Office of Emergency Communications of the Department of Homeland Security, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3865b-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>The Director for the Office of Railroad, Pipeline and Hazardous Materials Investigations of the National Transportation Safety Board, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3865c-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>The Chief Safety Officer and Associate Administrator for Railroad Safety of the Federal Railroad Administration, or designee.<page identifier="/us/stat/130/1624">130 STAT. 1624</page></content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3865d-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>The Assistant Administrator for Security Policy and Industry Engagement of the Transportation Security Administration, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3865e-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>The Assistant Commandant for Response Policy of the Coast Guard, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3ad6f-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>The Assistant Administrator for the Office of Solid Waste and Emergency Response of the Environmental Protection Agency, or designee.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3ad70-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">“(J) </num><chapeau>Such other qualified individuals as the co-chairpersons shall jointly appoint as soon as practicable after the date of the enactment of the RESPONSE Act of 2016 from among the following:</chapeau><clause class="fontsize10" id="yfaf3ad71-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>Members of the National Advisory Council that have the requisite technical knowledge and expertise to address rail emergency response issues, including members from the following disciplines:</chapeau><subclause class="fontsize10" id="yfaf3ad72-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>Emergency management and emergency response providers, including fire service, law enforcement, hazardous materials response, and emergency medical services.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad73-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>State, local, and tribal government officials.</content></subclause>
</clause>
<clause class="fontsize10" id="yfaf3ad74-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>Individuals who have the requisite technical knowledge and expertise to serve on the RESPONSE Subcommittee, including at least 1 representative from each of the following:</chapeau><subclause class="fontsize10" id="yfaf3ad75-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>The rail industry.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad76-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>Rail labor.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad77-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>Persons who offer oil for transportation by rail.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad78-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>The communications industry.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad79-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>Emergency response providers, including individuals nominated by national organizations representing State and local governments and emergency responders.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad7a-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">“(VI) </num><content>Emergency response training providers.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad7b-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VII">“(VII) </num><content>Representatives from tribal organizations.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad7c-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VIII">“(VIII) </num><content>Technical experts.</content></subclause>
<subclause class="fontsize10" id="yfaf3ad7d-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IX">“(IX) </num><content>Vendors, developers, and manufacturers of systems, facilities, equipment, and capabilities for emergency responder services.</content></subclause>
</clause>
<clause class="fontsize10" id="yfaf3ad7e-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>Representatives of such other stakeholders and interested and affected parties as the co-chairpersons consider appropriate.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfaf3ad7f-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Co-chairpersons</inline>.—</heading><content>The members described in subparagraphs (A) and (B) of paragraph (2) shall serve as the co-chairpersons of the RESPONSE Subcommittee.</content></paragraph>
<paragraph class="fontsize10" id="yfaf3ad80-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfaf3ad81-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Initial meeting</inline>.—</heading><content>The initial meeting of the RESPONSE Subcommittee shall take place not later than 90 days after the date of enactment of the RESPONSE Act of 2016.</content></paragraph>
<paragraph class="fontsize10" id="yfaf3ad82-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Consultation with nonmembers</inline>.—</heading><content>The RESPONSE Subcommittee and the program offices for emergency responder training and resources shall consult with other relevant agencies and groups, including entities engaged in federally funded research and academic institutions engaged in relevant work <page identifier="/us/stat/130/1625">130 STAT. 1625</page>
and research, which are not represented on the RESPONSE Subcommittee to consider new and developing technologies and methods that may be beneficial to preparedness and response to rail hazardous materials incidents.</content></paragraph>
<paragraph class="fontsize10" id="yfaf3ad83-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfaf3ad84-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Recommendations</inline>.—</heading><chapeau>The RESPONSE Subcommittee shall develop recommendations, as appropriate, for improving emergency responder training and resource allocation for hazardous materials incidents involving railroads after evaluating the following topics:</chapeau><subparagraph class="fontsize10" id="yfaf3ad85-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>The quality and application of training for State and local emergency responders related to rail hazardous materials incidents, including training for emergency responders serving small communities near railroads, including the following:</chapeau><clause class="fontsize10" id="yfaf3ad86-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>Ease of access to relevant training for State and local emergency responders, including an analysis of—</chapeau><subclause class="fontsize10" id="yfaf3ad87-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the number of individuals being trained;</content></subclause>
<subclause class="fontsize10" id="yfaf3ad88-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the number of individuals who are applying;</content></subclause>
<subclause class="fontsize10" id="yfaf3ad89-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>whether current demand is being met;</content></subclause>
<subclause class="fontsize10" id="yfaf3ad8a-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>current challenges; and</content></subclause>
<subclause class="fontsize10" id="yfaf3ad8b-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><content>projected needs.</content></subclause>
</clause>
<clause class="fontsize10" id="yfaf3ad8c-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Modernization of training course content related to rail hazardous materials incidents, with a particular focus on fluctuations in oil shipments by rail, including regular and ongoing evaluation of course opportunities, adaptation to emerging trends, agency and private sector outreach, effectiveness and ease of access for State and local emergency responders.</content></clause>
<clause class="fontsize10" id="yfaf3ad8d-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>Identification of overlap in training content and identification of opportunities to develop complementary courses and materials among governmental and nongovernmental entities.</content></clause>
<clause class="fontsize10" id="yfaf3ad8e-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>Online training platforms, train-the-trainer, and mobile training options.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yfaf3ad8f-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>The availability and effectiveness of Federal, State, local, and nongovernmental funding levels related to training emergency responders for rail hazardous materials incidents, including emergency responders serving small communities near railroads, including—</chapeau><clause class="fontsize10" id="yfaf3ad90-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>identifying overlap in resource allocations;</content></clause>
<clause class="fontsize10" id="yfaf3ad91-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>identifying cost savings measures that can be implemented to increase training opportunities;</content></clause>
<clause class="fontsize10" id="yfaf3ad92-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>leveraging government funding with nongovernmental funding to enhance training opportunities and fill existing training gaps;</content></clause>
<clause class="fontsize10" id="yfaf3ad93-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>adaptation of priority settings for agency funding allocations in response to emerging trends;</content></clause>
<clause class="fontsize10" id="yfaf3ad94-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>historic levels of funding across Federal agencies for rail hazardous materials incident response and training, including funding provided by the private sector to public entities or in conjunction with Federal programs; and</content></clause>
<clause class="fontsize10" id="yfaf3ad95-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>current funding resources across agencies.<page identifier="/us/stat/130/1626">130 STAT. 1626</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yfaf3ad96-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>The strategy for integrating commodity flow studies, mapping, and rail and hazardous materials databases for State and local emergency responders and increasing the rate of access to the individual responder in existing or emerging communications technology.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yfaf3ad97-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><subparagraph class="fontsize10" id="yfaf3ad98-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of the enactment of the RESPONSE Act of 2016, the RESPONSE Subcommittee shall submit a report to the National Advisory Council that—</chapeau><clause class="fontsize10" id="yfaf3ad99-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>includes the recommendations developed under paragraph (6);</content></clause>
<clause class="fontsize10" id="yfaf3ad9a-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>specifies the timeframes for implementing any such recommendations that do not require congressional action; and</content></clause>
<clause class="fontsize10" id="yfaf3ad9b-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>identifies any such recommendations that do require congressional action.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yfaf3ad9c-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Review</inline>.—</heading><content>Not later than 30 days after receiving the report under subparagraph (A), the National Advisory Council shall begin a review of the report. The National Advisory Council may ask for additional clarification, changes, or other information from the RESPONSE Subcommittee to assist in the approval of the recommendations.</content></subparagraph>
<subparagraph class="fontsize10" id="yfaf3ad9d-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Recommendation</inline>.—</heading><chapeau>Once the National Advisory Council approves the recommendations of the RESPONSE Subcommittee, the National Advisory Council shall submit the report to—</chapeau><clause class="fontsize10" id="yfaf3ad9e-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the co-chairpersons of the RESPONSE Subcommittee;</content></clause>
<clause class="fontsize10" id="yfaf3ad9f-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the head of each other agency represented on the RESPONSE Subcommittee;</content></clause>
<clause class="fontsize10" id="yfaf3ada0-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate;</content></clause>
<clause class="fontsize10" id="yfaf3ada1-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>the Committee on Commerce, Science, and Transportation of the Senate;</content></clause>
<clause class="fontsize10" id="yfaf3ada2-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>the Committee on Homeland Security of the House of Representatives; and</content></clause>
<clause class="fontsize10" id="yfaf3ada3-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>the Committee on Transportation and Infrastructure of the House of Representatives.</content></clause>

<paragraph class="fontsize10" id="yfaf3ada4-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Interim activity</inline>.—</heading><subparagraph class="fontsize10" id="yfaf3ada5-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Updates and oversight</inline>.—</heading><chapeau>After the submission of the report by the National Advisory Council under paragraph (7), the Administrator shall—</chapeau><clause class="fontsize10" id="yfaf3ada6-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>provide annual updates to the congressional committees referred to in paragraph (7)(C) regarding the status of the implementation of the recommendations developed under paragraph (6); and</content></clause>
<clause class="fontsize10" id="yfaf3ada7-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xfaf3ada8-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>coordinate the implementation of the recommendations described in paragraph (6)(G)(i), as appropriate.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yfaf3ada9-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>The requirements of subparagraph (A) shall terminate on the date that is 2 years after the date of the submission of the report required under paragraph (7)(A).<page identifier="/us/stat/130/1627">130 STAT. 1627</page></content></subparagraph>

<paragraph class="fontsize10" id="yfaf3adaa-e84b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>The RESPONSE Subcommittee shall terminate not later than 90 days after the submission of the report required under paragraph (7)(C).”</content></paragraph>
