<section id="d327006e102" identifier="/us/pl/114/319/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Foreign Cultural Exchange Jurisdictional Immunity Clarification Act</shortTitle>”.</content></section>
<section id="d327006e112" identifier="/us/pl/114/319/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CLARIFICATION OF JURISDICTIONAL IMMUNITY OF FOREIGN STATES.</heading><subsection class="firstIndent0 fontsize10" id="y6cd9d937-e84c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/319/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t28/s1605">Section 1605 of title 28, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y6cda7578-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Jurisdictional Immunity for Certain Art Exhibition Activities</inline>.—</heading><paragraph class="fontsize10" id="y6cda7579-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>If—</chapeau><subparagraph class="fontsize10" id="y6cda757a-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6cda757b-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Exports and imports.</p></sidenote><content>a work is imported into the United States from any foreign state pursuant to an agreement that provides for the temporary exhibition or display of such work entered into between a foreign state that is the owner or custodian of such work and the United States or one or more cultural or educational institutions within the United States;</content></subparagraph>
<subparagraph class="fontsize10" id="y6cda757c-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6cda757d-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="x6cda757e-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the President, or the President’s designee, has determined, in accordance with subsection (a) of <ref href="/us/pl/89/259">Public Law 89–259</ref> (<ref href="/us/usc/t22/s2459/a">22 U.S.C. 2459(a)</ref>), that such work is of cultural significance and the temporary exhibition or display of such work is in the national interest; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6cda757f-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the notice thereof has been published in accordance with subsection (a) of <ref href="/us/pl/89/259">Public Law 89–259</ref> (<ref href="/us/usc/t22/s2459/a">22 U.S.C. 2459(a)</ref>),</content></subparagraph>
<continuation class="firstIndent1 fontsize10" id="x6cda7580-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122">any activity in the United States of such foreign state, or of any carrier, that is associated with the temporary exhibition or display of such work shall not be considered to be commercial activity by such foreign state for purposes of subsection (a)(3).</continuation></paragraph>
<paragraph class="fontsize10" id="y6cda7581-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><subparagraph class="fontsize10" id="y6cda7582-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Nazi-era claims</inline>.—</heading><chapeau>Paragraph (1) shall not apply in any case asserting jurisdiction under subsection (a)(3) in which rights in property taken in violation of international law are in issue within the meaning of that subsection and—</chapeau><clause class="fontsize10" id="y6cda7583-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the property at issue is the work described in paragraph (1);<page identifier="/us/stat/130/1619">130 STAT. 1619</page></content></clause>
<clause class="fontsize10" id="y6cda7584-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the action is based upon a claim that such work was taken in connection with the acts of a covered government during the covered period;</content></clause>
<clause class="fontsize10" id="y6cda7585-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6cda7586-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the court determines that the activity associated with the exhibition or display is commercial activity, as that term is defined in section 1603(d); and</content></clause>
<clause class="fontsize10" id="y6cda7587-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>a determination under clause (iii) is necessary for the court to exercise jurisdiction over the foreign state under subsection (a)(3).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y6cda7588-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Other culturally significant works</inline>.—</heading><chapeau>In addition to cases exempted under subparagraph (A), paragraph (1) shall not apply in any case asserting jurisdiction under subsection (a)(3) in which rights in property taken in violation of international law are in issue within the meaning of that subsection and—</chapeau><clause class="fontsize10" id="y6cda7589-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the property at issue is the work described in paragraph (1);</content></clause>
<clause class="fontsize10" id="y6cda758a-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the action is based upon a claim that such work was taken in connection with the acts of a foreign government as part of a systematic campaign of coercive confiscation or misappropriation of works from members of a targeted and vulnerable group;</content></clause>
<clause class="fontsize10" id="y6cda758b-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the taking occurred after 1900;</content></clause>
<clause class="fontsize10" id="y6cda758c-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6cda758d-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the court determines that the activity associated with the exhibition or display is commercial activity, as that term is defined in section 1603(d); and</content></clause>
<clause class="fontsize10" id="y6cda758e-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>a determination under clause (iv) is necessary for the court to exercise jurisdiction over the foreign state under subsection (a)(3).</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6cda758f-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>For purposes of this subsection—</chapeau><subparagraph class="fontsize10" id="y6cda7590-e84c-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the term ‘<term>work</term>’ means a work of art or other object of cultural significance;</content></subparagraph>
<subparagraph class="fontsize10" id="y6cda7591-e84c-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the term ‘<term>covered government</term>’ means—</chapeau><clause class="fontsize10" id="y6cda7592-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the Government of Germany during the covered period;</content></clause>
<clause class="fontsize10" id="y6cda7593-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any government in any area in Europe that was occupied by the military forces of the Government of Germany during the covered period;</content></clause>
<clause class="fontsize10" id="y6cda7594-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any government in Europe that was established with the assistance or cooperation of the Government of Germany during the covered period; and</content></clause>
<clause class="fontsize10" id="y6cda7595-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>any government in Europe that was an ally of the Government of Germany during the covered period; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y6cda7596-e84c-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6cda7597-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>the term ‘<term>covered period</term>’ means the period beginning on January 30, 1933, and ending on May 8, 1945.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y6cda7598-e84c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/319/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6cda7599-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p><p class="leftAlign firstIndent0 fontsize8" id="x6cda759a-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t28/s1605">28 USC 1605 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendment made by this section shall apply to any civil action commenced on or after the date of the enactment of this Act.<page identifier="/us/stat/130/1620">130 STAT. 1620</page></content></subsection>

<section id="d327006e340" identifier="/us/pl/114/319/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6cda9cab-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t28/s1605">28 USC 1605 note</ref>.</p></sidenote><heading>NOTIFICATION.</heading><content style="-uslm-lc:I658120">  The Secretary of State shall ensure that foreign states that apply for immunity under <ref href="/us/pl/89/259">Public Law 89–259</ref> (<ref href="/us/usc/t22/s2459">22 U.S.C. 2459</ref>) are appropriately notified of the text of this Act.</content></section>
