<section id="d327113e92" identifier="/us/pl/114/316/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Promoting Travel, Commerce, and National Security Act of 2016</shortTitle>”.</content></section>
<section id="d327113e102" identifier="/us/pl/114/316/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>JURISDICTION OVER OFFENSES COMMITTED BY CERTAIN UNITED STATES PERSONNEL STATIONED IN CANADA.</heading><subsection class="firstIndent0 fontsize10" id="ydcab2f52-e84c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/316/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendment</inline>.—</heading><chapeau>Chapter 212A of title 18,<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdcab2f53-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">18 USC</p><p class="leftAlign firstIndent0 fontsize8" id="xdcab2f54-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">prec. 3271.</p></sidenote> United States Code, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ydcab2f55-e84c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/316/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in the chapter heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><b>TRAFFICKING IN PERSONS</b></quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="ydcab2f56-e84c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/316/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> after section 3272 the following:<quotedContent><section class="centered fontsize12" id="ydcab5667-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="3273">“§ 3273.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdcab5668-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s3273">18 USC 3273</ref>.</p></sidenote> Offenses committed by certain United States personnel stationed in Canada in furtherance of border security initiatives</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="ydcab5669-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdcab566a-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Penalties.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Whoever, while employed by the Department of Homeland Security or the Department of Justice and stationed or deployed in Canada pursuant to a treaty, executive agreement, or bilateral memorandum in furtherance of a border security initiative, engages in conduct (or conspires or attempts to engage in conduct) in Canada that would constitute an offense for which a person may be prosecuted in a court of the United States had the conduct been engaged in within the United States or within the special maritime and territorial jurisdiction of the United States shall be fined or imprisoned, or both, as provided for that offense.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ydcab566b-e84c-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this section, the term ‘<term>employed by the Department of Homeland Security or the Department of Justice</term>’ means—</chapeau><paragraph class="fontsize10" id="ydcab566c-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>being employed as a civilian employee, a contractor (including a subcontractor at any tier), or an employee of a contractor (or a subcontractor at any tier) of the Department of Homeland Security or the Department of Justice;</content></paragraph>
<paragraph class="fontsize10" id="ydcab566d-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>being present or residing in Canada in connection with such employment; and</content></paragraph>
<paragraph class="fontsize10" id="ydcab566e-e84c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>not being a national of or ordinarily resident in Canada.”</content></paragraph>
