<section id="d223218e94" identifier="/us/pl/114/311/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Overtime Pay for Protective Services Act of 2016</shortTitle>”.</content></section>
<section id="d223218e104" identifier="/us/pl/114/311/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PREMIUM PAY EXCEPTION IN 2016 FOR PROTECTIVE SERVICES.</heading><subsection class="firstIndent0 fontsize10" id="y92074164-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>In this section, the term “<term>covered employee</term>” means any officer, employee, or agent employed by the United States Secret Service who performs protective services for an individual or event protected by the United States Secret Service during 2016.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y92074165-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Exception to the Limitation on Premium Pay for Protective Services</inline>.—</heading><paragraph class="fontsize10" id="y92074166-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, during 2016, <ref href="/us/usc/t5/s5547/a">section 5547(a) of title 5, United States Code</ref>, shall not apply to any covered employee to the extent that its application would prevent a covered employee from receiving premium pay, as provided under the amendment made by paragraph (2).</content></paragraph>
<paragraph class="fontsize10" id="y92074167-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/b/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Technical and conforming amendment</inline>.—</heading><content>Section 118 of the Treasury and General Government Appropriations Act, 2001 (as enacted into law by <ref href="/us/pl/106/554/s1/3">section 1(3) of Public Law 106–554</ref>; <ref href="/us/stat/114/2763A–134">114 Stat. 2763A–134</ref>)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92074168-e84d-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s5547">5 USC 5547 note</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>, in the first sentence, by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or, if the employee qualifies for an exception to such limitation under section 2(b)(1) of the Overtime Pay for Protective Services Act of 2016, to the extent that such aggregate amount would exceed the rate of basic pay payable for a position at level II of the Executive Schedule under <ref href="/us/usc/t5/s5313">section 5313 of title 5, United States Code</ref></quotedText>” after “<quotedText>of that limitation</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y92074169-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Treatment of Additional Pay</inline>.—</heading><chapeau>If subsection (b) results in the payment of additional premium pay to a covered employee of a type that is normally creditable as basic pay for retirement or any other purpose, that additional pay shall not—</chapeau><paragraph class="fontsize10" id="y9207416a-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>be considered to be basic pay of the covered employee for any purpose; or</content></paragraph>
<paragraph class="fontsize10" id="y9207416b-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>be used in computing a lump-sum payment to the covered employee for accumulated and accrued annual leave under section 5551 or <ref href="/us/usc/t5/s5552">section 5552 of title 5, United States Code</ref>.<page identifier="/us/stat/130/1532">130 STAT. 1532</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9207416c-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Aggregate Limit</inline>.—</heading><content>With respect to the application of <ref href="/us/usc/t5/s5307">section 5307 of title 5, United States Code</ref>, the payment of any additional premium pay to a covered employee as a result of subsection (b) shall not be counted as part of the aggregate compensation of the covered employee.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9207416d-e84d-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/311/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>This section and the amendments made by this section shall take effect as if enacted on December 31, 2015.</content></subsection>
