<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x070936a6-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Federal Bureau of Investigation Whistleblower Protection Enhancement Act of 2016.</p><p class="leftAlign firstIndent0 fontsize8" id="x070936a7-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s101">5 USC 101 note</ref>.</p></sidenote>
<section id="d223809e92" identifier="/us/pl/114/302/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Federal Bureau of Investigation Whistleblower Protection Enhancement Act of 2016</shortTitle>”.</content></section>
<section id="d223809e102" identifier="/us/pl/114/302/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROHIBITED PERSONNEL PRACTICES IN THE FEDERAL BUREAU OF INVESTIGATION.</heading><content class="firstIndent0 fontsize10" id="x07095db8-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t5/s2303/a">Section 2303(a) of title 5, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>any employee of the Bureau</quotedText>” and all that follows through “<quotedText>health or safety</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“an employee in, or applicant for, a position in the Bureau as a reprisal for a disclosure of information—<paragraph class="fontsize10" id="y070984c9-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>made—</chapeau><subparagraph class="fontsize10" id="y070984ca-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>in the case of an employee, to a supervisor in the direct chain of command of the employee, up to and including the head of the employing agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y070984cb-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>to the Inspector General;</content></subparagraph>
<subparagraph class="fontsize10" id="y070984cc-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>to the Office of Professional Responsibility of the Department of Justice;</content></subparagraph>
<subparagraph class="fontsize10" id="y070984cd-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>to the Office of Professional Responsibility of the Federal Bureau of Investigation;</content></subparagraph>
<subparagraph class="fontsize10" id="y070984ce-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>to the Inspection Division of the Federal Bureau of Investigation;</content></subparagraph>
<subparagraph class="fontsize10" id="y070984cf-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>as described in section 7211;</content></subparagraph>
<subparagraph class="fontsize10" id="y070984d0-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>to the Office of Special Counsel; or</content></subparagraph>
<subparagraph class="fontsize10" id="y070984d1-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>to an employee designated by any officer, employee, office, or division described in subparagraphs (A) through (G) for the purpose of receiving such disclosures; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y070984d2-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>which the employee or applicant reasonably believes evidences—</chapeau><subparagraph class="fontsize10" id="y070984d3-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>any violation of any law, rule, or regulation; or<page identifier="/us/stat/130/1517">130 STAT. 1517</page></content></subparagraph>
<subparagraph class="fontsize10" id="y070984d4-e84f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety”</content></subparagraph>
