<section id="d328175e92" identifier="/us/pl/114/29/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Department of Homeland Security Interoperable Communications Act</shortTitle>” or the “<shortTitle role="act">DHS Interoperable Communications Act</shortTitle>”.</content></section>
<section id="d328175e105" identifier="/us/pl/114/29/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x30ce0b79-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act—</chapeau><paragraph class="fontsize10" id="y30ce0b7a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>Department</term>” means the Department of Homeland Security;</content></paragraph>
<paragraph class="fontsize10" id="y30ce0b7b-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the term “<term>interoperable communications</term>” has the meaning given that term in section 701(d) of the Homeland Security Act of 2002, as added by section 3; and</content></paragraph>
<paragraph class="fontsize10" id="y30ce0b7c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the term “<term>Under Secretary for Management</term>” means the Under Secretary for Management of the Department of Homeland Security.</content></paragraph>

<section id="d328175e127" identifier="/us/pl/114/29/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>INCLUSION OF INTEROPERABLE COMMUNICATIONS CAPABILITIES IN RESPONSIBILITIES OF UNDER SECRETARY FOR MANAGEMENT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x30ce328d-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 701 of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s341">6 U.S.C. 341</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y30ce328e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a)(4), by <amendingAction type="insert">inserting</amendingAction> before the period at the end the following: “<quotedText>, including policies and directives to achieve and maintain interoperable communications among the components of the Department</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y30ce328f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y30ce3290-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Interoperable Communications Defined</inline>.—</heading><content>In this section, the term ‘<term>interoperable communications</term>’ has the meaning given that term in section 7303(g) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<ref href="/us/usc/t6/s194/g">6 U.S.C. 194(g)</ref>).”</content></subsection>

<section id="d328175e174" identifier="/us/pl/114/29/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>STRATEGY.</heading><subsection class="firstIndent0 fontsize10" id="y30cea7c1-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x30cea7c2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>later than 180 days after the date of enactment of this Act, the Under Secretary for Management shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a strategy, which shall be updated as necessary, for achieving and maintaining interoperable <page identifier="/us/stat/129/422">129 STAT. 422</page>
communications among the components of the Department, including for daily operations, planned events, and emergencies, with corresponding milestones, that includes the following:</chapeau><paragraph class="fontsize10" id="y30cea7c3-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>An assessment of interoperability gaps in radio communications among the components of the Department, as of the date of enactment of this Act.</content></paragraph>
<paragraph class="fontsize10" id="y30cea7c4-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Information on efforts and activities, including current and planned policies, directives, and training, of the Department since November 1, 2012, to achieve and maintain interoperable communications among the components of the Department, and planned efforts and activities of the Department to achieve and maintain such interoperable communications.</content></paragraph>
<paragraph class="fontsize10" id="y30cea7c5-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>An assessment of obstacles and challenges to achieving and maintaining interoperable communications among the components of the Department.</content></paragraph>
<paragraph class="fontsize10" id="y30cea7c6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Information on, and an assessment of, the adequacy of mechanisms available to the Under Secretary for Management to enforce and compel compliance with interoperable communications policies and directives of the Department.</content></paragraph>
<paragraph class="fontsize10" id="y30cea7c7-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Guidance provided to the components of the Department to implement interoperable communications policies and directives of the Department.</content></paragraph>
<paragraph class="fontsize10" id="y30cea7c8-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>The total amount of funds expended by the Department since November 1, 2012, and projected future expenditures, to achieve interoperable communications, including on equipment, infrastructure, and maintenance.</content></paragraph>
<paragraph class="fontsize10" id="y30cea7c9-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/a/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>Dates upon which Department-wide interoperability is projected to be achieved for voice, data, and video communications, respectively, and interim milestones that correspond to the achievement of each such mode of communication.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y30cea7ca-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Supplementary Material</inline>.—</heading><chapeau>Together with the strategy required under subsection (a), the Under Secretary for Management shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate information on—</chapeau><paragraph class="fontsize10" id="y30cea7cb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>any intra-agency effort or task force that has been delegated certain responsibilities by the Under Secretary for Management relating to achieving and maintaining interoperable communications among the components of the Department by the dates referred to in subsection (a)(7); and</content></paragraph>
<paragraph class="fontsize10" id="y30cea7cc-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>who, within each such component, is responsible for implementing policies and directives issued by the Under Secretary for Management to so achieve and maintain such interoperable communications.</content></paragraph>

<section id="d328175e251" identifier="/us/pl/114/29/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>REPORT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x30cecedd-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Not later than 100 days after the date on which the strategy required under section 4(a) is submitted, and every 2 years thereafter for 6 years, the Under Secretary for Management shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the status of efforts to implement the strategy required under section 4(a), including the following:</chapeau><paragraph class="fontsize10" id="y30cef5ee-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s5/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Progress on each interim milestone referred to in section 4(a)(7) toward achieving and maintaining interoperable communications among the components of the Department.<page identifier="/us/stat/129/423">129 STAT. 423</page></content></paragraph>
<paragraph class="fontsize10" id="y30cef5ef-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s5/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Information on any policies, directives, guidance, and training established by the Under Secretary for Management.</content></paragraph>
<paragraph class="fontsize10" id="y30cef5f0-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s5/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>An assessment of the level of compliance, adoption, and participation among the components of the Department with the policies, directives, guidance, and training established by the Under Secretary for Management to achieve and maintain interoperable communications among the components.</content></paragraph>
<paragraph class="fontsize10" id="y30cef5f1-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/29/s5/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Information on any additional resources or authorities needed by the Under Secretary for Management.</content></paragraph>

<section id="d328175e281" identifier="/us/pl/114/29/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>APPLICABILITY.</heading><content style="-uslm-lc:I658120">  Sections 4 and 5 shall only apply with respect to the interoperable communications capabilities within the Department and components of the Department to communicate within the Department.</content></section>
