<section id="d328399e252" identifier="/us/pl/114/287/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PURPOSES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa0cefd0b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The purpose of this Act is to reduce the costs of Federal real estate by—</chapeau><paragraph class="fontsize10" id="ya0cefd0c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>consolidating the footprint of Federal buildings and facilities;</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd0d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>maximizing the utilization rate of Federal buildings and facilities;</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd0e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>reducing the reliance on leased space;</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd0f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>selling or redeveloping high value assets that are underutilized to obtain the highest and best value for the taxpayer and maximize the return to the taxpayer;</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd10-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>reducing the operating and maintenance costs of Federal civilian real properties; <page identifier="/us/stat/130/1464">130 STAT. 1464</page></content></paragraph>
<paragraph class="fontsize10" id="ya0cefd11-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>reducing redundancy, overlap, and costs associated with field offices;</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd12-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>creating incentives for Federal agencies to achieve greater efficiency in their inventories of civilian real property;</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd13-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>facilitating and expediting the sale or disposal of unneeded Federal civilian real properties;</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd14-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>improving the efficiency of real property transfers for the provision of services to the homeless; and</content></paragraph>
<paragraph class="fontsize10" id="ya0cefd15-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s2/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>assisting Federal agencies in achieving the Government’s sustainability goals by reducing excess space, inventory, and energy consumption, as well as by leveraging new technologies.</content></paragraph>

<section id="d328399e313" identifier="/us/pl/114/287/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa0cfc066-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0cfc067-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote> this Act, unless otherwise expressly stated, the following definitions apply:</chapeau><paragraph class="fontsize10" id="ya0cfc068-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrator</inline>.—</heading><content>The term “<term>Administrator</term>” means the Administrator of General Services.</content></paragraph>
<paragraph class="fontsize10" id="ya0cfc069-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Board</inline>.—</heading><content>The term “<term>Board</term>” means the Public Buildings Reform Board established by section 4.</content></paragraph>
<paragraph class="fontsize10" id="ya0cfc06a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">CERCLA</inline>.—</heading><content>The term “<term>CERCLA</term>” means the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<ref href="/us/usc/t42/s9601/etseq">42 U.S.C. 9601 et seq.</ref>).</content></paragraph>
<paragraph class="fontsize10" id="ya0cfc06b-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Federal agency</inline>.—</heading><content>The term “<term>Federal agency</term>” means an executive department or independent establishment in the executive branch of the Government, and a wholly owned Government corporation.</content></paragraph>
<paragraph class="fontsize10" id="ya0cfc06c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Federal civilian real property and civilian real property</inline>.—</heading><subparagraph class="fontsize10" id="ya0cfe77d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The terms “Federal civilian real property” and “civilian real property” refer to Federal real property assets, including public buildings as defined in <ref href="/us/usc/t40/s3301/a">section 3301(a) of title 40, United States Code</ref>, occupied and improved grounds, leased space, or other physical structures under the custody and control of any Federal agency.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0cfe77e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusions</inline>.—</heading><chapeau>Subparagraph (A) shall not be construed as including any of the following types of property:</chapeau><clause class="fontsize10" id="ya0cfe77f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>Properties that are on military installations (including any fort, camp, post, naval training station, airfield proving ground, military supply depot, military school, or any similar facility of the Department of Defense).</content></clause>
<clause class="fontsize10" id="ya0cfe780-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>A base, camp, post, station, yard, center, or homeport facility for any ship or activity under the jurisdiction of the Coast Guard.</content></clause>
<clause class="fontsize10" id="ya0cfe781-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>Properties that are excluded for reasons of national security by the Director of the Office of Management and Budget.</content></clause>
<clause class="fontsize10" id="ya0cfe782-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/iv" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>Properties that are excepted from the definition of the term “<term>property</term>” under <ref href="/us/usc/t40/s102">section 102 of title 40, United States Code</ref>.</content></clause>
<clause class="fontsize10" id="ya0cfe783-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><chapeau>Indian and Native Alaskan properties, including—</chapeau><subclause class="fontsize10" id="ya0cfe784-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/v/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>any property within the limits of an Indian reservation to which the United States owns title for the benefit of an Indian tribe; and <page identifier="/us/stat/130/1465">130 STAT. 1465</page></content></subclause>
<subclause class="fontsize10" id="ya0cfe785-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/v/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>any property title that is held in trust by the United States for the benefit of an Indian tribe or individual or held by an Indian tribe or individual subject to restriction by the United States against alienation.</content></subclause>
</clause>
<clause class="fontsize10" id="ya0cfe786-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>Properties operated and maintained by the Tennessee Valley Authority pursuant to the Tennessee Valley Authority Act of 1933 (<ref href="/us/usc/t16/s831/etseq">16 U.S.C. 831 et seq.</ref>).</content></clause>
<clause class="fontsize10" id="ya0cfe787-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>Postal properties owned by the United States Postal Service.</content></clause>
<clause class="fontsize10" id="ya0cfe788-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>Properties used in connection with Federal programs for agricultural, recreational, or conservation purposes, including research in connection with the programs.</content></clause>
<clause class="fontsize10" id="ya0cfe789-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/ix" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">(ix) </num><content>Properties used in connection with river, harbor, flood control, reclamation, or power projects.</content></clause>
<clause class="fontsize10" id="ya0cfe78a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/5/B/x" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="x">(x) </num><content>Properties located outside the United States operated or maintained by the Department of State or the United States Agency for International Development.</content></clause>

<paragraph class="fontsize10" id="ya0cfe78b-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Field office</inline>.—</heading><content>The term “<term>field office</term>” means any Federal office that is not the headquarters office location for the Federal agency.</content></paragraph>
<paragraph class="fontsize10" id="ya0cfe78c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">HUD</inline>.—</heading><content>The term “<term>HUD</term>” means the Department of Housing and Urban Development.</content></paragraph>
<paragraph class="fontsize10" id="ya0cfe78d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">OMB</inline>.—</heading><content>The term “<term>OMB</term>” means the Office of Management and Budget.</content></paragraph>
<paragraph class="fontsize10" id="ya0cfe78e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s3/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Value of transactions</inline>.—</heading><content>The term “<term>value of transactions</term>” means the sum of the estimated proceeds and estimated costs, based on the accounting system developed or identified under section 12(e), associated with the transactions included in Board recommendations.</content></paragraph>

<section id="d328399e504" identifier="/us/pl/114/287/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>BOARD.</heading><subsection class="firstIndent0 fontsize10" id="ya0d05cbf-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established an independent board to be known as the Public Buildings Reform Board.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d05cc0-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><content>The Board shall carry out the duties as specified in this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d05cc1-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d05cc2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><paragraph class="fontsize10" id="ya0d05cc3-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Board shall be composed of a Chairperson appointed by the President, by and with the advice and consent of the Senate, and six members appointed by the President.</content></paragraph>
<paragraph class="fontsize10" id="ya0d05cc4-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d05cc5-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Appointments</inline>.—</heading><chapeau>In selecting individuals for appointments to the Board, the President shall consult with—</chapeau><subparagraph class="fontsize10" id="ya0d05cc6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Speaker of the House of Representatives concerning the appointment of two members;</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d05cc7-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the majority leader of the Senate concerning the appointment of two members;</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d05cc8-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the minority leader of the House of Representatives concerning the appointment of one member; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d05cc9-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the minority leader of the Senate concerning the appointment of one member.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d05cca-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Terms</inline>.—</heading><content>The term for each member of the Board shall be 6 years.</content></paragraph>
<paragraph class="fontsize10" id="ya0d05ccb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Vacancies</inline>.—</heading><content>Vacancies shall be filled in the same manner as the original appointment. <page identifier="/us/stat/130/1466">130 STAT. 1466</page></content></paragraph>
<paragraph class="fontsize10" id="ya0d05ccc-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Qualifications</inline>.—</heading><chapeau>In selecting individuals for appointment to the Board, the President shall ensure that the Board contains individuals with expertise representative of the following:</chapeau><subparagraph class="fontsize10" id="ya0d05ccd-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Commercial real estate and redevelopment.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d05cce-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Space optimization and utilization.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d05ccf-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s4/c/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Community development, including transportation and planning.</content></subparagraph>

<section id="d328399e625" identifier="/us/pl/114/287/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>BOARD MEETINGS.</heading><subsection class="firstIndent0 fontsize10" id="ya0d0aaf0-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d0aaf1-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Open Meetings</inline>.—</heading><content>Each meeting of the Board, other than meetings in which classified information is to be discussed, shall be open to the public.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d0aaf2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Federal Register, publication.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d0aaf3-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d0aaf4-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote> Any open meeting shall be announced in the Federal Register and the Federal Web site established by the Board at least 14 calendar days in advance of a meeting. For all public meetings, the Board shall release an agenda and a listing of materials relevant to the topics to be discussed.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d0aaf5-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Quorum and Meetings</inline>.—</heading><content>Five Board members shall constitute a quorum for the purposes of conducting business and three or more Board members shall constitute a meeting of the Board.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d0aaf6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Transparency of Information</inline>.—</heading><chapeau>All the proceedings, information, and deliberations of the Board shall be open, upon request, to the Chairperson and ranking minority party member, and their respective subcommittee Chairperson and subcommittee ranking minority party member, of—</chapeau><paragraph class="fontsize10" id="ya0d0aaf7-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Transportation and Infrastructure of the House of Representatives;</content></paragraph>
<paragraph class="fontsize10" id="ya0d0aaf8-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Oversight and Government Reform of the House of Representatives;</content></paragraph>
<paragraph class="fontsize10" id="ya0d0aaf9-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate;</content></paragraph>
<paragraph class="fontsize10" id="ya0d0aafa-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the Committee on Environment and Public Works of the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="ya0d0aafb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the Committees on Appropriations of the House of Representatives and the Senate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d0aafc-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Government Accountability Office</inline>.—</heading><content>All proceedings, information, and deliberations of the Board shall be open, upon request, to the Comptroller General of the United States.</content></subsection>

<section id="d328399e704" identifier="/us/pl/114/287/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>COMPENSATION AND TRAVEL EXPENSES.</heading><subsection class="firstIndent0 fontsize10" id="ya0d0f91d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Compensation</inline>.—</heading><paragraph class="fontsize10" id="ya0d0f91e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Rate of pay for members</inline>.—</heading><content>Each member, other than the Chairperson, shall be paid at a rate equal to the daily equivalent of the minimum annual rate of basic pay payable for level IV of the Executive Schedule under <ref href="/us/usc/t5/s5315">section 5315 of title 5, United States Code</ref>, for each day (including travel time) during which the member is engaged in the actual performance of duties vested in the Board.</content></paragraph>
<paragraph class="fontsize10" id="ya0d0f91f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Rate of pay for chairperson</inline>.—</heading><content>The Chairperson shall be paid for each day referred to in paragraph (1) at a rate equal to the daily equivalent of the minimum annual rate of basic pay payable for level III of the Executive Schedule under <ref href="/us/usc/t5/s5314">section 5314 of title 5, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d0f920-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Travel</inline>.—</heading><content>Members shall receive travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of <ref href="/us/usc/t5">title 5, United States Code</ref>. <page identifier="/us/stat/130/1467">130 STAT. 1467</page></content></subsection>

<section id="d328399e758" identifier="/us/pl/114/287/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>EXECUTIVE DIRECTOR.</heading><subsection class="firstIndent0 fontsize10" id="ya0d12031-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Appointment</inline>.—</heading><content>The Board shall appoint an Executive Director, who may be appointed without regard to the provisions of <ref href="/us/usc/t5">title 5, United States Code</ref>, governing appointments in the competitive service.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d12032-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Rate of Pay</inline>.—</heading><content>The Executive Director shall be paid at the rate of basic pay payable for level IV of the Executive Schedule under <ref href="/us/usc/t5/s5315">section 5315 of title 5, United States Code</ref>.</content></subsection>

<section id="d328399e789" identifier="/us/pl/114/287/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>STAFF.</heading><subsection class="firstIndent0 fontsize10" id="ya0d14743-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s8/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Additional Personnel</inline>.—</heading><content>Subject to subsection (b), the Executive Director may request additional personnel detailed from Federal agencies.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d14744-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Requests for Detail Employees</inline>.—</heading><content>Upon request of the Executive Director and approval of the Board and the Director of OMB, the head of any Federal agency shall detail the requested personnel of that agency to the Board to assist the Board in carrying out its duties under this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d14745-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s8/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Qualifications</inline>.—</heading><content>Appointments shall be made with consideration of a balance of expertise consistent with the qualifications of representatives described in section 4(c)(5).</content></subsection>

<section id="d328399e821" identifier="/us/pl/114/287/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>CONTRACTING AUTHORITY.</heading><subsection class="firstIndent0 fontsize10" id="ya0d16e56-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s9/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Experts and Consultants</inline>.—</heading><content>The Board, to the extent practicable and subject to appropriations Acts, shall use contracts, including nonappropriated contracts, entered into by the Administrator for services necessary to carry out the duties of the Board.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d16e57-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s9/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d16e58-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Office Space</inline>.—</heading><content>The Administrator, in consultation with the Board, shall identify and provide, without charge, suitable office space within the existing Federal space inventory to house the operations of the Board.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d16e59-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s9/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Personal Property</inline>.—</heading><content>The Board shall use personal property already in the custody and control of the Administrator.</content></subsection>

<section id="d328399e857" identifier="/us/pl/114/287/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d16e5a-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading>TERMINATION.</heading><content style="-uslm-lc:I658120">  The Board shall cease operations and terminate 6 years after the date of enactment of this Act.</content></section>
<section id="d328399e867" identifier="/us/pl/114/287/s11" style="-uslm-lc:I658142"><num class="fontsize12" value="11">SEC. 11. </num><heading>DEVELOPMENT OF RECOMMENDATIONS TO BOARD.</heading><subsection class="firstIndent0 fontsize10" id="ya0d258bb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Submissions of Agency Information and Recommendations</inline>.—</heading><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d258bc-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote>Not later than 120 days after the date of enactment of this Act, and not later than 120 days after the first day of each fiscal year thereafter until the termination of the Board, the head of each Federal agency shall submit to the Administrator and the Director of OMB the following:</chapeau><paragraph class="fontsize10" id="ya0d258bd-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Current data</inline>.—</heading><content>Current data of all Federal civilian real properties owned, leased, or controlled by the agency, including all relevant information prescribed by the Administrator and the Director of OMB, including data related to the age and condition of the property, operating costs, history of capital expenditures, sustainability metrics, number of Federal employees and functions housed in the respective property, and square footage (including gross, rentable, and usable).</content></paragraph>
<paragraph class="fontsize10" id="ya0d258be-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Agency recommendations</inline>.—</heading><chapeau>Recommendations of the agency on the following:</chapeau><subparagraph class="fontsize10" id="ya0d27fcf-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Federal civilian real properties that can be sold for proceeds or otherwise disposed of, reported as excess, declared surplus, outleased, or otherwise no longer meeting <page identifier="/us/stat/130/1468">130 STAT. 1468</page>
the needs of the agency, excluding leasebacks or other such exchange agreements where the property continues to be used by the agency.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fd0-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Federal civilian real properties that can be transferred, exchanged, consolidated, co-located, reconfigured, or redeveloped, so as to reduce the civilian real property inventory, reduce the operating costs of the Government, and create the highest value and return for the taxpayer.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fd1-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Operational efficiencies that the Government can realize in its operation and maintenance of Federal civilian real properties.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="ya0d27fd2-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Standards and Criteria</inline>.—</heading><paragraph class="fontsize10" id="ya0d27fd3-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d27fd4-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d27fd5-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Development of standards and criteria</inline>.—</heading><chapeau>Not later than 60 days after the deadline for submissions of agency recommendations under subsection (a), the Director of OMB, in consultation with the Administrator, shall—</chapeau><subparagraph class="fontsize10" id="ya0d27fd6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d27fd7-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Review.</p></sidenote><content>review the agency recommendations;</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fd8-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>develop consistent standards and criteria against which the agency recommendations will be reviewed; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fd9-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>submit to the Board the recommendations developed pursuant to paragraph (2).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d27fda-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Recommendations to board</inline>.—</heading><content>The Director of OMB and the Administrator shall jointly develop recommendations to the Board based on the standards and criteria developed under paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="ya0d27fdb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d27fdc-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Factors</inline>.—</heading><chapeau>In developing the standards and criteria under paragraph (1), the Director of OMB, in consultation with the Administrator, shall incorporate the following factors:</chapeau><subparagraph class="fontsize10" id="ya0d27fdd-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The extent to which the civilian real property could be sold (including property that is no longer meeting the needs of the Government), redeveloped, outleased, or otherwise used to produce the highest and best value and return for the taxpayer.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fde-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The extent to which the operating and maintenance costs are reduced through consolidating, co-locating, and reconfiguring space, and through realizing other operational efficiencies.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fdf-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>The extent to which the utilization rate is being maximized and is consistent with non-governmental industry standards for the given function or operation.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fe0-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The extent and timing of potential costs and savings, including the number of years, beginning with the date of completion of the proposed recommendation.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fe1-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>The extent to which reliance on leasing for long-term space needs is reduced.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fe2-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>The extent to which a civilian real property aligns with the current mission of the Federal agency.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fe3-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>The extent to which there are opportunities to consolidate similar operations across multiple agencies or within agencies.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fe4-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>The economic impact on existing communities in the vicinity of the civilian real property.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fe5-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>The extent to which energy consumption is reduced.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d27fe6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/b/3/J" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">(J) </num><content>The extent to which public access to agency services is maintained or enhanced.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d27fe7-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Special Rule for Utilization Rates</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d27fe8-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote>Standards developed by the Director of OMB pursuant to subsection (b) shall <page identifier="/us/stat/130/1469">130 STAT. 1469</page>
incorporate and apply clear standard utilization rates to the extent that such standard rates increase efficiency and provide performance data. The utilization rates shall be consistent throughout each applicable category of space and with nongovernment space utilization rates. To the extent the space utilization rate of a given agency exceeds the utilization rates to be applied under this subsection, the Director of OMB may recommend realignment, co-location, consolidation, or other type of action to improve space utilization.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d27fe9-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Submission to Board</inline>.—</heading><paragraph class="fontsize10" id="ya0d27fea-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Director of OMB shall submit the standards, criteria, and recommendations developed pursuant to subsection (b) to the Board with all supporting information, data, analyses, and documentation.</content></paragraph>
<paragraph class="fontsize10" id="ya0d27feb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d27fec-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Federal Register, publication.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Publication</inline>.—</heading><content>The standards, criteria, and recommendations developed pursuant to subsection (b) shall be published in the Federal Register and transmitted to the committees listed in section 5(c) and to the Comptroller General of the United States.</content></paragraph>
<paragraph class="fontsize10" id="ya0d27fed-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s11/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Access to information</inline>.—</heading><content>The Board shall also have access to all information pertaining to the recommendations developed pursuant to subsection (b), including supporting information, data, analyses, and documentation submitted pursuant to subsection (a). Upon request, a Federal agency shall provide to the Board any additional information pertaining to the civilian real properties under the custody, control, or administrative jurisdiction of the Federal agency.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d27fee-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p></sidenote> The Board shall notify the committees listed in section 5(c) of any failure by an agency to comply with a request of the Board.</content></paragraph>

<section id="d328399e1093" identifier="/us/pl/114/287/s12" style="-uslm-lc:I658142"><num class="fontsize12" value="12">SEC. 12. </num><heading>BOARD DUTIES.</heading><subsection class="firstIndent0 fontsize10" id="ya0d3915f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Identification of Property Reduction Opportunities</inline>.—</heading><content>The Board shall identify opportunities for the Government to reduce significantly its inventory of civilian real property and reduce costs to the Government.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d39160-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Identification of High Value Assets</inline>.—</heading><paragraph class="fontsize10" id="ya0d39161-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d39162-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Identification of certain properties</inline>.—</heading><chapeau>Not later than 180 days after Board members are appointed pursuant to section 4, the Board shall—</chapeau><subparagraph class="fontsize10" id="ya0d39163-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>identify not fewer than five Federal civilian real properties that are not on the list of surplus or excess as of such date with a total fair market value of not less than $500,000,000 and not more than $750,000,000; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d39164-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>transmit the list of the Federal civilian real properties to the Director of OMB and Congress as Board recommendations and subject to the approval process described in section 13.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d39165-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Information and data</inline>.—</heading><content>In order to meet the goal established under paragraph (1), each Federal agency shall provide, upon request, any and all information and data regarding its civilian real properties to the Board.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d39166-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p></sidenote> The Board shall notify the committees listed in section 5(c) of any failure by an agency to comply with a request of the Board.</content></paragraph>
<paragraph class="fontsize10" id="ya0d39167-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Factors</inline>.—</heading><content>In identifying properties pursuant to paragraph (1), the Board shall consider the factors listed in section 11(b)(3). <page identifier="/us/stat/130/1470">130 STAT. 1470</page></content></paragraph>
<paragraph class="fontsize10" id="ya0d39168-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Leaseback restrictions</inline>.—</heading><content>None of the existing improvements on properties sold under this subsection may be leased back to the Government.</content></paragraph>
<paragraph class="fontsize10" id="ya0d39169-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Report of excess</inline>.—</heading><content>Not later than 60 days after the approval of Board recommendations pursuant to paragraph (1), Federal agencies with custody, control, or administrative jurisdiction over the identified properties shall submit a Report of Excess to the General Services Administration.</content></paragraph>
<paragraph class="fontsize10" id="ya0d3916a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d3916b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Sale</inline>.—</heading><subparagraph class="fontsize10" id="ya0d3916c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Initiation of sale</inline>.—</heading><content>Not later than 120 days after the acceptance by the Administrator of the Report of Excess and notwithstanding any other provision of law (including section 501 of the McKinney-Vento Homeless Assistance Act (<ref href="/us/usc/t42/s11411">42 U.S.C. 11411</ref>), but except as provided in section 14(g)), the General Services Administration shall initiate the sale of the civilian real properties described in paragraph (1).</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d3916d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/b/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d3916e-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Completion of sale</inline>.—</heading><content>Not later than 1 year after the acceptance of the Report of Excess, the Administrator shall sell the civilian real properties at fair market value at highest and best use, unless the Director of OMB determines it is in the financial interest of the Government to execute a sale more than a year after the acceptance of the Report of Excess, but not greater than 2 years after the acceptance of the Report of Excess.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d3916f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d39170-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d39171-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Analysis of Inventory</inline>.—</heading><content>The Board shall perform an independent analysis of the inventory of Federal civilian real property and the recommendations submitted pursuant to section 11. The Board shall not be bound or limited by the recommendations submitted pursuant to section 11. If, in the opinion of the Board, an agency fails to provide needed information, data, or adequate recommendations that meet the standards and criteria, the Board shall develop such recommendations as the Board considers appropriate based on existing data contained in the Federal Real Property Profile or other relevant information.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d39172-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Information and Proposals</inline>.—</heading><paragraph class="fontsize10" id="ya0d39173-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Receipt</inline>.—</heading><content>Notwithstanding any other provision of law, the Board may receive and consider proposals, information, and other data submitted by State and local officials and the private sector.</content></paragraph>
<paragraph class="fontsize10" id="ya0d39174-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>The Board shall consult with State and local officials on information, proposals, and other data that the officials submit to the Board.</content></paragraph>
<paragraph class="fontsize10" id="ya0d39175-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Availability</inline>.—</heading><content>Information submitted to the Board shall be made publicly available.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d39176-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d39177-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d39178-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Accounting System</inline>.—</heading><content>Not later than 120 days after the date of enactment of this Act, the Board shall identify or develop and implement a system of accounting to be used to independently evaluate the costs of and returns on the recommendations.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d39179-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d3917a-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d3917b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions. </p><p class="leftAlign firstIndent0 fontsize8" id="xa0d3917c-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote> Such accounting system shall be applied in developing the Board’s recommendations and determining the highest return to the taxpayer. In<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d3917d-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote> applying the accounting system, the Board shall set a standard performance period of not less than 15 years.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d3917e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Public Hearing</inline>.—</heading><content>The Board shall conduct public hearings. All testimony before the Board at a public hearing under this subsection shall be presented under oath.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d3b78f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Reporting of Information and Recommendations</inline>.—</heading><chapeau> <page identifier="/us/stat/130/1471">130 STAT. 1471</page></chapeau><paragraph class="fontsize10" id="ya0d3b790-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d3b791-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Subject to the schedule and limitations specified in paragraph (2), the Board shall transmit to the Director of OMB, and publicly post on a Federal Web site maintained by the Board, reports containing the Board’s findings, conclusions, and recommendations for—</chapeau><subparagraph class="fontsize10" id="ya0d3b792-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the consolidation, exchange, co-location, reconfiguration, lease reductions, sale, outlease, and redevelopment of Federal civilian real properties; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d3b793-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>other operational efficiencies that can be realized in the Government’s operation and maintenance of such properties.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d3b794-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d3b795-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Schedule and limitations</inline>.—</heading><subparagraph class="fontsize10" id="ya0d3b796-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">First round</inline>.—</heading><content>Not later than 2 years after the date of transmittal of the list of properties recommended pursuant to subsection (b), the Board shall transmit to the Director of OMB the first report required under paragraph (1). The total value of transactions contained in the first report may not exceed $2,500,000,000.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d3b797-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Second round</inline>.—</heading><content>Not earlier than 3 years after the date of transmittal of the first report, the Board shall transmit to the Director of OMB the second report required under paragraph (1). The total value of transactions contained in the second report may not exceed $4,750,000,000.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d3b798-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Consensus in majority</inline>.—</heading><content>The Board shall seek to develop consensus recommendations, but if a consensus cannot be obtained, the Board may include in the reports required under this subsection recommendations that are supported by a majority of the Board.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d3b799-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d3b79a-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Federal Web Site</inline>.—</heading><content>The Board shall establish and maintain a Federal Web site for the purposes of making relevant information publicly available.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d3b79b-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s12/i" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Review by GAO</inline>.—</heading><content>The Comptroller General of the United States shall transmit to Congress and the Board a report containing a detailed analysis of the recommendations and selection process.</content></subsection>
</section>
<section id="d328399e1399" identifier="/us/pl/114/287/s13" style="-uslm-lc:I658142"><num class="fontsize12" value="13">SEC. 13. </num><heading>REVIEW BY OMB.</heading><subsection class="firstIndent0 fontsize10" id="ya0d405bc-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s13/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Review of Recommendations</inline>.—</heading><content>Upon receipt of the Board’s recommendations pursuant to subsections (b) and (g) of section 12, the Director of OMB shall conduct a review of the recommendations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d405bd-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s13/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report to Board and Congress</inline>.—</heading><content>Not later than 30 days after the receipt of the Board’s recommendations, the Director of OMB shall transmit to the Board and Congress a report that sets forth the Director of OMB’s approval or disapproval of the Board’s recommendations.</content></subsection>

<paragraph class="fontsize10" id="ya0d405c4-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s13/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d405c5-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Revised recommendations</inline>.—</heading><content>Not later than 30 days after the receipt of reasons for disapproval under paragraph <page identifier="/us/stat/130/1472">130 STAT. 1472</page>
(2), the Board shall transmit to the Director of OMB revised recommendations for approval.</content></paragraph>
<paragraph class="fontsize10" id="ya0d405c6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s13/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d405c7-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Certification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Approval of revised recommendations</inline>.—</heading><content>If the Director of OMB approves the revised recommendations received under paragraph (3), the Director of OMB shall transmit a copy of the revised recommendations to Congress, together with a certification of such approval.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d405c8-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s13/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Termination of Process for Given Round</inline>.—</heading><content>If the Director of OMB does not transmit to Congress an approval and certification described in paragraph (1) or (4) of subsection (c) on or before the 30th day following the receipt of the Board’s recommendations or revised recommendations, as the case may be, the process shall terminate until the following round, as described in section 12.</content></subsection>
</section>
<section id="d328399e1493" identifier="/us/pl/114/287/s14" style="-uslm-lc:I658142"><num class="fontsize12" value="14">SEC. 14. </num><heading>IMPLEMENTATION OF BOARD RECOMMENDATIONS.</heading><subsection class="firstIndent0 fontsize10" id="ya0d5b379-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Deadlines</inline>.—</heading><paragraph class="fontsize10" id="ya0d5b37a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Preparation</inline>.—</heading><chapeau>Federal agencies shall—</chapeau><subparagraph class="fontsize10" id="ya0d5b37b-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>not later than 60 days after the Director of OMB transmits the Board’s recommendations to Congress pursuant to paragraph (1) or (4) of section 13(c), immediately begin preparations to carry out the Board’s recommendations; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d5b37c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>not later than 2 years after such transmittal, initiate all activities necessary to carry out the Board’s recommendations.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d5b37d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Completion</inline>.—</heading><content>Not later than 6 years after the Director of OMB transmits the Board’s recommendations to Congress pursuant to paragraph (1) or (4) of section 13(c), Federal agencies shall complete all recommended actions. All actions shall be economically beneficial, cost neutral, or otherwise favorable to the Government.</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b37e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Extenuating circumstances</inline>.—</heading><content>For actions that will take longer than the 6-year period described in paragraph (2) due to extenuating circumstances, Federal agencies shall notify the Director of OMB and Congress, as soon as the extenuating circumstance presents itself, with an estimated time to complete the relevant action.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d5b37f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Actions of Federal Agencies Related to Civilian Real Properties</inline>.—</heading><chapeau>In taking actions related to any civilian real property under this Act, Federal agencies may take, pursuant to subsection (c), all such necessary and proper actions, including—</chapeau><paragraph class="fontsize10" id="ya0d5b380-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>acquiring land, constructing replacement facilities, performing such other activities, and conducting advance planning and design as may be required to transfer functions from a Federal asset or property to another Federal civilian property;</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b381-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>reimbursing other Federal agencies for actions performed at the request of the Board; and</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b382-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>taking such actions as are practicable to maximize the value of Federal civilian real property to be sold by clarifying zoning and other limitations on use of such property.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d5b383-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Actions of Federal Agencies To Implement Board Recommendations</inline>.—</heading><paragraph class="fontsize10" id="ya0d5b384-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Use of existing legal authorities</inline>.—</heading><subparagraph class="fontsize10" id="ya0d5b385-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (2), when acting on a recommendation of the Board, a Federal agency shall— <page identifier="/us/stat/130/1473">130 STAT. 1473</page></chapeau><clause class="fontsize10" id="ya0d5b386-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/c/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d5b387-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>in consultation with the Administrator, continue to act within the Federal agency’s existing legal authorities, including legal authorities delegated to the Federal agency by the Administrator; or</content></clause>
<clause class="fontsize10" id="ya0d5b388-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/c/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d5b389-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Partnership.</p></sidenote><content>work in partnership with the Administrator to carry out such actions.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya0d5b38a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Necessary and proper actions</inline>.—</heading><content>The Administrator may take such necessary and proper actions, including the sale, conveyance, or exchange of civilian real property, as required to implement the Board’s recommendations in the time period required under subsection (a).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d5b38b-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Experts</inline>.—</heading><content>A Federal agency may enter into no cost, nonappropriated contracts for expert commercial real estate services to carry out the Federal agency’s responsibilities pursuant to the recommendations.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d5b38c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Discretion of Administrator Regarding Transactions</inline>.—</heading><content>For any transaction identified, recommended, or commenced as a result of this Act, any otherwise required legal priority given to, or requirement to enter into, a transaction to convey a Federal civilian real property for less than fair market value, for no consideration at all, or in a transaction that mandates the exclusion of other market participants, shall be at the discretion of the Administrator.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d5b38d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Relationship to Other Laws</inline>.—</heading><chapeau>Any recommendation or commencement of a sale, disposal, consolidation, reconfiguration, co-location, or realignment of civilian real property under this Act shall not be subject to—</chapeau><paragraph class="fontsize10" id="ya0d5b38e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content><ref href="/us/usc/t40/s545/b/8">section 545(b)(8) of title 40, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b38f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>sections 550, 553, and 554 of <ref href="/us/usc/t40">title 40, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b390-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>any section of the Act entitled “An Act Authorizing the transfer of certain real property for wildlife, or other purposes” (<ref href="/us/usc/t16/s667b">16 U.S.C. 667b</ref>);</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b391-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content><ref href="/us/usc/t49/s47151">section 47151 of title 49, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b392-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>sections 107 and 317 of <ref href="/us/usc/t23">title 23, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b393-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content><ref href="/us/usc/t40/s1304/b">section 1304(b) of title 40, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b394-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>section 13(d) of the Surplus Property Act of 1944 (<ref href="/us/usc/t50/app1622">50 U.S.C. App. 1622</ref>(d));</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b395-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>any other provision of law authorizing the conveyance of real property owned by the Government for no consideration; and</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b396-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/e/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>any congressional notification requirement other than that in <ref href="/us/usc/t40/s545">section 545 of title 40, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d5b397-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Public Benefit</inline>.—</heading><paragraph class="fontsize10" id="ya0d5b398-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Submission of information to hud</inline>.—</heading><content>The Director of OMB shall submit to the Secretary of HUD, on the same day the Director of OMB submits the Board’s recommendations to Congress pursuant to paragraphs (1) and (4) of section 13(c), all known information on Federal civilian real properties that are included in the recommendations (except those recommended under section 12(b)).</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b399-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">HUD to report to board</inline>.—</heading><content>Not later than 30 days after the submission of information on Federal properties under paragraph (1), the Secretary shall identify any suitable civilian real properties for use as a property benefiting the mission of assistance to the homeless for the purposes of further <page identifier="/us/stat/130/1474">130 STAT. 1474</page>
screening pursuant to section 501 of the McKinney-Vento Homeless Assistance Act (<ref href="/us/usc/t42/s11411">42 U.S.C. 11411</ref>).</content></paragraph>
<paragraph class="fontsize10" id="ya0d5b39a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/f/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d5b39b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional authority</inline>.—</heading><content>Following the review under paragraph (2), with respect to a civilian real property that is not identified by the Secretary as suitable for use as a property benefiting the mission of assistance to the homeless and that has been recommended for sale by the Board, the Director of OMB may exclude the property from the Board’s recommendations if the Director determines that the property is suitable for use as a public park or recreation area by a State or local government and it is in the best interest of taxpayers.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d5b39c-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Environmental Considerations</inline>.—</heading><paragraph class="fontsize10" id="ya0d5b39d-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Transfers of real property</inline>.—</heading><subparagraph class="fontsize10" id="ya0d5b39e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>When implementing the recommended actions for civilian real properties that have been identified in the Board’s report, as specified in section 12(g), and subject to paragraph (2) and in compliance with CERCLA, including section 120(h) of CERCLA (<ref href="/us/usc/t42/s9620/h">42 U.S.C. 9620(h)</ref>), Federal agencies may enter into an agreement to transfer by deed, pursuant to section 120(h)(3) of that Act (<ref href="/us/usc/t42/s9620/h/3">42 U.S.C. 9620(h)(3)</ref>), civilian real property with any person.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d5b39f-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Additional terms and conditions</inline>.—</heading><content>The head of the disposing agency may require any additional terms and conditions in connection with an agreement authorized by subparagraph (A) as the head of the disposing agency considers appropriate to protect the interests of the United States. Such additional terms and conditions shall not affect or diminish any rights or obligations of the Federal agencies under section 120(h) of CERCLA (including, without limitation, the requirements of subsections (h)(3)(A) and (h)(3)(C)(iv) of that section).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d5b3a0-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Certification concerning costs</inline>.—</heading><chapeau>A transfer of Federal civilian real property may be made under paragraph (1) only if the head of the disposing agency certifies to the Board and Congress that—</chapeau><subparagraph class="fontsize10" id="ya0d5b3a1-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the costs of all environmental restoration, waste management, and environmental compliance activities otherwise to be paid by the disposing agency with respect to the property are equal to or greater than the fair market value of the property to be transferred, as determined by the head of the disposing agency; or</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d5b3a2-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>if such costs are lower than the fair market value of the property, the recipient of the property agrees to pay the difference between the fair market value and such costs.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d5b3a3-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Payments to recipients</inline>.—</heading><chapeau>In the case of a civilian real property covered by a certification under paragraph (2)(A), the disposing agency may pay the recipient of such property an amount equal to the lesser of—</chapeau><subparagraph class="fontsize10" id="ya0d5b3a4-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the amount by which the costs incurred by the recipient of such property for all environmental restoration, waste management, and environmental compliance activities with respect to such property exceed the fair market value of such property as specified in such certification; or <page identifier="/us/stat/130/1475">130 STAT. 1475</page></content></subparagraph>
<subparagraph class="fontsize10" id="ya0d5dab5-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the amount by which the costs (as determined by the head of the disposing agency) that would otherwise have been incurred by the Secretary for such restoration, waste management, and environmental compliance activities with respect to such property exceed the fair market value of such property as so specified.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d5dab6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Information to be provided to recipients</inline>.—</heading><content>As part of an agreement under paragraph (1), the head of the disposing agency shall disclose, in accordance with applicable law, to the person to whom the civilian real property will be transferred information possessed by the disposing agency regarding the environmental restoration, waste management, and environmental compliance activities that relate to the property. The head of the disposing agency shall provide such information before entering into the agreement.</content></paragraph>
<paragraph class="fontsize10" id="ya0d5dab7-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Consideration of environmental remediation in granting time extensions</inline>.—</heading><content>For the purposes of granting time extensions under subsection (a), the Director of OMB shall give the need for significant environmental remediation to a civilian real property more weight than any other factor in determining whether to grant an extension to implement a Board recommendation.</content></paragraph>
<paragraph class="fontsize10" id="ya0d5dab8-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s14/g/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on statutory construction</inline>.—</heading><content>Nothing in this Act may be construed to modify, alter, or amend CERCLA, the National Environmental Policy Act of 1969, or the Solid Waste Disposal Act (<ref href="/us/usc/t42/s6901/etseq">42 U.S.C. 6901 et seq.</ref>).</content></paragraph>
</subsection>
</section>
<section id="d328399e1882" identifier="/us/pl/114/287/s15" style="-uslm-lc:I658142"><num class="fontsize12" value="15">SEC. 15. </num><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa0d5dab9-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  There is authorized to be appropriated to carry out this Act an initial appropriation of—</chapeau><paragraph class="fontsize10" id="ya0d5daba-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s15/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>$2,000,000 for salaries and expenses of the Board; and</content></paragraph>
<paragraph class="fontsize10" id="ya0d5dabb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s15/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>$40,000,000 to be deposited into the Asset Proceeds and Space Management Fund for activities related to the implementation of the Board’s recommendations.</content></paragraph>

<section id="d328399e1900" identifier="/us/pl/114/287/s16" style="-uslm-lc:I658142"><num class="fontsize12" value="16">SEC. 16. </num><heading>FUNDING.</heading><subsection class="firstIndent0 fontsize10" id="ya0d676fc-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Salaries and Expenses Account</inline>.—</heading><paragraph class="fontsize10" id="ya0d676fd-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established in the Treasury of the United States an account to be known as the “Public Buildings Reform Board Salaries and Expenses Account” (in this subsection referred to as the “Account”).</content></paragraph>
<paragraph class="fontsize10" id="ya0d676fe-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Necessary payments</inline>.—</heading><content>There shall be deposited into the Account such amounts, as are provided in appropriations Acts, for those necessary payments for salaries and expenses to accomplish the administrative needs of the Board.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d676ff-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Asset Proceeds and Space Management Fund</inline>.—</heading><paragraph class="fontsize10" id="ya0d67700-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>There is established within the Federal Buildings Fund established under <ref href="/us/usc/t40/s592">section 592 of title 40, United States Code</ref>, an account to be known as the Public Buildings Reform Board—Asset Proceeds and Space Management Fund (in this subsection referred to as the “Fund”).</content></paragraph>
<paragraph class="fontsize10" id="ya0d67701-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Use of amounts</inline>.—</heading><content>Amounts in the Fund shall be used solely for the purposes of carrying out actions pursuant to the Board recommendations approved under section 13.</content></paragraph>
<paragraph class="fontsize10" id="ya0d67702-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Deposits</inline>.—</heading><chapeau>The following amounts shall be deposited into the Fund and made available for obligation or expenditure only as provided in advance in appropriations Acts (subject to <ref href="/us/usc/t40/s3307">section 3307 of title 40, United States Code</ref>, to the extent <page identifier="/us/stat/130/1476">130 STAT. 1476</page>
an appropriation normally covered by that section exceeds $20,000,000) for the purposes specified:</chapeau><subparagraph class="fontsize10" id="ya0d67703-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Such amounts as are provided in appropriations Acts, to remain available until expended, for the consolidation, co-location, exchange, redevelopment, reconfiguration of space, disposal, and other actions recommended by the Board for Federal agencies.</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d67704-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Amounts received from the sale of any civilian real property action taken pursuant to a recommendation of the Board.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya0d67705-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Use of amounts to cover costs</inline>.—</heading><chapeau>As provided in appropriations Acts, amounts in the Fund may be made available to cover necessary costs associated with implementing the recommendations pursuant to section 14, including costs associated with—</chapeau><subparagraph class="fontsize10" id="ya0d67706-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>sales transactions;</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d67707-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>acquiring land, construction, constructing replacement facilities, and conducting advance planning and design as may be required to transfer functions from a Federal asset or property to another Federal civilian property;</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d67708-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>co-location, redevelopment, disposal, and reconfiguration of space; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya0d67709-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/b/4/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>other actions recommended by the Board for Federal agencies.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d6770a-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s16/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d6770b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d6770c-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Estimate.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional Requirement for Budget Contents</inline>.—</heading><content>The President shall transmit along with the President’s budget submitted pursuant to <ref href="/us/usc/t31/s1105">section 1105 of title 31, United States Code</ref>, an estimate of proceeds that are the result of the Board’s recommendations and the obligations and expenditures needed to support such recommendations.</content></subsection>

<section id="d328399e2034" identifier="/us/pl/114/287/s17" role="instruction" style="-uslm-lc:I658142"><num class="fontsize12" value="17">SEC. 17. </num><heading>CONGRESSIONAL APPROVAL OF PROPOSED PROJECTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa0d69e1d-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <ref href="/us/usc/t40/s3307/b">Section 3307(b) of title 40, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ya0d69e1e-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s17/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end of paragraph (6);</content></paragraph>

<section id="d328399e2084" identifier="/us/pl/114/287/s18" style="-uslm-lc:I658142"><num class="fontsize12" value="18">SEC. 18. </num><heading>PRECLUSION OF JUDICIAL REVIEW.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa0d6c532-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The following actions shall not be subject to judicial review:</chapeau><paragraph class="fontsize10" id="ya0d6c533-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s18/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Actions taken pursuant to sections 12 and 13.</content></paragraph>
<paragraph class="fontsize10" id="ya0d6c534-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s18/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Actions of the Board.</content></paragraph>

<section id="d328399e2101" identifier="/us/pl/114/287/s19" style="-uslm-lc:I658142"><num class="fontsize12" value="19">SEC. 19. </num><heading>IMPLEMENTATION REVIEW BY GAO.</heading><content class="firstIndent0 fontsize10" id="xa0d6c535-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Upon<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d6c536-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline. </p></sidenote> transmittal of the Board’s recommendations from the Director of OMB to Congress under section 13, the Comptroller General of the United States at least annually shall monitor and review the implementation activities of Federal agencies pursuant to section 14, and report to Congress any findings and recommendations.<page identifier="/us/stat/130/1477">130 STAT. 1477</page></content></section>
<section id="d328399e2115" identifier="/us/pl/114/287/s20" style="-uslm-lc:I658142"><num class="fontsize12" value="20">SEC. 20. </num><heading>AGENCY RETENTION OF PROCEEDS.</heading><subsection class="firstIndent0 fontsize10" id="ya0d6ec47-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s20/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t40/s571">Section 571 of title 40, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> subsections (a) and (b) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="ya0d71358-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Proceeds From Transfer or Sale of Real Property</inline>.—</heading><paragraph class="fontsize10" id="ya0d71359-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Deposit of net proceeds</inline>.—</heading><content>Net proceeds described in subsection (c) shall be deposited into the appropriate real property account of the agency that had custody and accountability for the real property at the time the real property is determined to be excess.</content></paragraph>
<paragraph class="fontsize10" id="ya0d7135a-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Expenditure of net proceeds</inline>.—</heading><content>The net proceeds deposited pursuant to paragraph (1) may only be expended, as authorized in annual appropriations Acts, for activities described in sections 543 and 545, including paying costs incurred by the General Services Administration for any disposal-related activity authorized by this chapter.</content></paragraph>
<paragraph class="fontsize10" id="ya0d73a6b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Deficit reduction</inline>.—</heading><content>Any net proceeds described in subsection (c) from the sale, lease, or other disposition of surplus real property that are not expended<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d73a6c-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote> under paragraph (2) shall be used for deficit reduction. Any net proceeds not obligated within 3 years after the date of deposit and not expended within 5 years after such date shall be deposited as miscellaneous receipts in the Treasury.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d73a6d-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Effect on Other Sections</inline>.—</heading><content>Nothing in this section is intended to affect section 572(b), 573, or 574.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d73a6e-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Net Proceeds</inline>.—</heading><chapeau>The net proceeds described in this subsection are proceeds under this chapter, less expenses of the transfer or disposition as provided in section 572(a), from a—</chapeau><paragraph class="fontsize10" id="ya0d73a6f-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>transfer of excess real property to a Federal agency for agency use; or</content></paragraph>
<paragraph class="fontsize10" id="ya0d73a70-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>sale, lease, or other disposition of surplus real property.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="ya0d73a71-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s20/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The provisions of this section, including the amendments made by this section, shall take effect upon the termination of the Board pursuant to section 10 and shall not apply to proceeds from transactions conducted under section 14.</content></subsection>

<section id="d328399e2220" identifier="/us/pl/114/287/s21" style="-uslm-lc:I658142"><num class="fontsize12" value="21">SEC. 21. </num><heading>FEDERAL REAL PROPERTY DATABASE.</heading><subsection class="firstIndent0 fontsize10" id="ya0d7afa2-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d7afa3-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d7afa4-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Publication. </p></sidenote><heading class="fontsize10"><inline class="smallCaps">Database Required</inline>.—</heading><content>Not later than 1 year after the date of enactment of this section, the Administrator of General Services shall publish a single, comprehensive, and descriptive database of all Federal real property under the custody and control of all executive agencies, other than Federal real property excluded for reasons of national security, in accordance with subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d7afa5-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Required Information for Database</inline>.—</heading><chapeau>The Administrator shall collect from the head of each executive agency descriptive information, except for classified information, of the nature, use, and extent of the Federal real property of each such agency, including the following:</chapeau><paragraph class="fontsize10" id="ya0d7afa6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The geographic location of each Federal real property of each such agency, including the address and description for each such property.</content></paragraph>
<paragraph class="fontsize10" id="ya0d7afa7-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The total size of each Federal real property of each such agency, including square footage and acreage of each such property.</content></paragraph>
<paragraph class="fontsize10" id="ya0d7afa8-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Whether the Federal real property is currently, or will in the future be, needed to support agency’s mission or function. <page identifier="/us/stat/130/1478">130 STAT. 1478</page></content></paragraph>
<paragraph class="fontsize10" id="ya0d7afa9-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The utilization of each Federal real property for each such agency, including whether such property is excess, surplus, underutilized, or unutilized.</content></paragraph>
<paragraph class="fontsize10" id="ya0d7afaa-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>The number of days each Federal real property is designated as excess, surplus, underutilized, or unutilized.</content></paragraph>
<paragraph class="fontsize10" id="ya0d7d6bb-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>The annual operating costs of each Federal real property.</content></paragraph>
<paragraph class="fontsize10" id="ya0d7d6bc-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>The replacement value of each Federal real property.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d7d6bd-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Access to Database</inline>.—</heading><paragraph class="fontsize10" id="ya0d7d6be-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d7d6bf-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Federal agencies</inline>.—</heading><content>The Administrator, in consultation with the Director of OMB, shall make the database established and maintained under this section available to other Federal agencies.</content></paragraph>
<paragraph class="fontsize10" id="ya0d7d6c0-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa0d7d6c1-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xa0d7d6c2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Website.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Public access</inline>.—</heading><content>To the extent consistent with national security and procurement laws, the database shall be accessible by the public at no cost through the Web site of the General Services Administration.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d7d6c3-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Transparency of Database</inline>.—</heading><chapeau>To the extent practicable, the Administrator shall ensure that the database—</chapeau><paragraph class="fontsize10" id="ya0d7d6c4-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>uses an open, machine-readable format;</content></paragraph>
<paragraph class="fontsize10" id="ya0d7d6c5-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>permits users to search and sort Federal real property data; and</content></paragraph>
<paragraph class="fontsize10" id="ya0d7d6c6-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>includes a means to download a large amount of Federal real property data and a selection of such data retrieved using a search.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya0d7d6c7-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/287/s21/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>Nothing in this section may be construed to require an agency to make available to the public information that is exempt from disclosure pursuant to <ref href="/us/usc/t5/s552/b">section 552(b) of title 5, United States Code</ref>.</content></subsection>
