<section id="d328606e88" identifier="/us/pl/114/285/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb4f1a4a-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s101">6 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Federal Law Enforcement Training Centers Reform and Improvement Act of 2015</shortTitle>”.</content></section>
<section id="d328606e103" identifier="/us/pl/114/285/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FEDERAL LAW ENFORCEMENT TRAINING CENTERS.</heading><subsection class="firstIndent0 fontsize10" id="yeb5004ab-e851-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/285/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>Section 884 of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s464">6 U.S.C. 464</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="yeb51d96c-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="884">“SEC. 884. </num><heading class="fontsize12">FEDERAL LAW ENFORCEMENT TRAINING CENTERS.</heading><subsection class="firstIndent0 fontsize10" id="yeb51d96d-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>The Secretary shall maintain in the Department the Federal Law Enforcement Training Centers (FLETC), headed by a Director, who shall report to the Secretary.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yeb51d96e-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Position</inline>.—</heading><content>The Director shall occupy a career-reserved position within the Senior Executive Service.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yeb51d96f-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Functions of the Director</inline>.—</heading><chapeau>The Director shall—</chapeau><paragraph class="fontsize10" id="yeb51d970-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>develop training goals and establish strategic and tactical organizational program plan and priorities;</content></paragraph>
<paragraph class="fontsize10" id="yeb51d971-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>provide direction and management for FLETC’s training facilities, programs, and support activities while ensuring that organizational program goals and priorities are executed in an effective and efficient manner;</content></paragraph>
<paragraph class="fontsize10" id="yeb51d972-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>develop homeland security and law enforcement training curricula, including curricula related to domestic preparedness and response to threats or acts of terrorism, for Federal, State, local, tribal, territorial, and international law enforcement and security agencies and private sector security agencies;</content></paragraph>
<paragraph class="fontsize10" id="yeb51d973-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>monitor progress toward strategic and tactical FLETC plans regarding training curricula, including curricula related to domestic preparedness and response to threats or acts of terrorism, and facilities;</content></paragraph>
<paragraph class="fontsize10" id="yeb51d974-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>ensure the timely dissemination of homeland security information as necessary to Federal, State, local, tribal, territorial, and international law enforcement and security agencies and the private sector to achieve the training goals for such entities, in accordance with paragraph (1);</content></paragraph>
<paragraph class="fontsize10" id="yeb51d975-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><chapeau>carry out delegated acquisition responsibilities in a manner that—<page identifier="/us/stat/130/1454">130 STAT. 1454</page></chapeau><subparagraph class="fontsize10" id="yeb51d976-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>fully complies with—</chapeau><clause class="fontsize10" id="yeb51d977-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>Federal law;</content></clause>
<clause class="fontsize10" id="yeb51d978-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the Federal Acquisition Regulation, including requirements regarding agency obligations to contract only with responsible prospective contractors; and</content></clause>
<clause class="fontsize10" id="yeb520089-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>Department acquisition management directives; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yeb52008a-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>maximizes opportunities for small business participation;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb52008b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>coordinate and share information with the heads of relevant components and offices on digital learning and training resources, as appropriate;</content></paragraph>
<paragraph class="fontsize10" id="yeb52008c-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>advise the Secretary on matters relating to executive level policy and program administration of Federal, State, local, tribal, territorial, and international law enforcement and security training activities and private sector security agency training activities, including training activities related to domestic preparedness and response to threats or acts of terrorism;</content></paragraph>
<paragraph class="fontsize10" id="yeb52008d-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><content>collaborate with the Secretary and relevant officials at other Federal departments and agencies, as appropriate, to improve international instructional development, training, and technical assistance provided by the Federal Government to foreign law enforcement; and</content></paragraph>
<paragraph class="fontsize10" id="yeb52008e-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><content>carry out such other functions as the Secretary determines are appropriate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yeb52008f-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Training Responsibilities</inline>.—</heading><paragraph class="fontsize10" id="yeb520090-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Director is authorized to provide training to employees of Federal agencies who are engaged, directly or indirectly, in homeland security operations or Federal law enforcement activities, including such operations or activities related to domestic preparedness and response to threats or acts of terrorism. In carrying out such training, the Director shall—</chapeau><subparagraph class="fontsize10" id="yeb520091-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>evaluate best practices of law enforcement training methods and curriculum content to maintain state-of-the-art expertise in adult learning methodology;</content></subparagraph>
<subparagraph class="fontsize10" id="yeb520092-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provide expertise and technical assistance, including on domestic preparedness and response to threats or acts of terrorism, to Federal, State, local, tribal, territorial, and international law enforcement and security agencies and private sector security agencies; and</content></subparagraph>
<subparagraph class="fontsize10" id="yeb520093-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>maintain a performance evaluation process for students.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb520094-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb520095-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Relationship with law enforcement agencies</inline>.—</heading><content>The Director shall consult with relevant law enforcement and security agencies in the development and delivery of FLETC’s training programs.</content></paragraph>
<paragraph class="fontsize10" id="yeb520096-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Training delivery locations</inline>.—</heading><content>The training required under paragraph (1) may be conducted at FLETC facilities, at appropriate off-site locations, or by distributed learning.</content></paragraph>
<paragraph class="fontsize10" id="yeb520097-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Strategic partnerships</inline>.—</heading><subparagraph class="fontsize10" id="yeb520098-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Director may—</chapeau><clause class="fontsize10" id="yeb520099-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>execute strategic partnerships with State and local law enforcement to provide such law enforcement with specific training, including maritime law enforcement training; and<page identifier="/us/stat/130/1455">130 STAT. 1455</page></content></clause>
<clause class="fontsize10" id="yeb52009a-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>coordinate with the Under Secretary responsible for overseeing critical infrastructure protection, cybersecurity, and other related programs of the Department and with private sector stakeholders, including critical infrastructure owners and operators, to provide training pertinent to improving coordination, security, and resiliency of critical infrastructure.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yeb52009b-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Provision of information</inline>.—</heading><content>The Director shall provide to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate, upon request, information on activities undertaken in the previous year pursuant to subparagraph (A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb52009c-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">FLETC details to dhs</inline>.—</heading><content>The Director may detail employees of FLETC to positions throughout the Department in furtherance of improving the effectiveness and quality of training provided by the Department and, as appropriate, the development of critical departmental programs and initiatives.</content></paragraph>
<paragraph class="fontsize10" id="yeb52009d-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Detail of instructors to fletc</inline>.—</heading><content>Partner organizations that wish to participate in FLETC training programs shall assign non-reimbursable detailed instructors to FLETC for designated time periods to support all training programs at FLETC, as appropriate. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb52009e-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote>The Director shall determine the number of detailed instructors that is proportional to the number of training hours requested by each partner organization scheduled by FLETC for each fiscal year. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb52009f-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reimbursement.</p></sidenote>If a partner organization is unable to provide a proportional number of detailed instructors, such partner organization shall reimburse FLETC for the salary equivalent for such detailed instructors, as appropriate.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200a0-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Partner organization expenses requirements</inline>.—</heading><subparagraph class="fontsize10" id="yeb5200a1-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Partner organizations shall be responsible for the following expenses:</chapeau><clause class="fontsize10" id="yeb5200a2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>Salaries, travel expenses, lodging expenses, and miscellaneous per diem allowances of their personnel attending training courses at FLETC.</content></clause>
<clause class="fontsize10" id="yeb5200a3-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Salaries and travel expenses of instructors and support personnel involved in conducting advanced training at FLETC for partner organization personnel and the cost of expendable supplies and special equipment for such training, unless such supplies and equipment are common to FLETC-conducted training and have been included in FLETC’s budget for the applicable fiscal year.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yeb5200a4-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb5200a5-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reimbursement.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Excess basic and advanced federal training</inline>.—</heading><content>All hours of advanced training and hours of basic training provided in excess of the training for which appropriations were made available shall be paid by the partner organizations and provided to FLETC on a reimbursable basis in accordance with <ref href="/us/usc/t5/s4104">section 4104 of title 5, United States Code</ref>.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb5200a6-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Provision of non-federal training</inline>.—</heading><subparagraph class="fontsize10" id="yeb5200a7-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb5200a8-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Fees.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Director is authorized to charge and retain fees that would pay for its actual costs of the training for the following:</chapeau><clause class="fontsize10" id="yeb5200a9-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>State, local, tribal, and territorial law enforcement personnel.<page identifier="/us/stat/130/1456">130 STAT. 1456</page></content></clause>
<clause class="fontsize10" id="yeb5200aa-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Foreign law enforcement officials, including provision of such training at the International Law Enforcement Academies wherever established.</content></clause>
<clause class="fontsize10" id="yeb5200ab-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>Private sector security officers, participants in the Federal Flight Deck Officer program under <ref href="/us/usc/t49/s44921">section 44921 of title 49, United States Code</ref>, and other appropriate private sector individuals.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yeb5200ac-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb5200ad-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Records.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Waiver</inline>.—</heading><content>The Director may waive the requirement for reimbursement of any cost under this section and shall maintain records regarding the reasons for any requirements so waived.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb5200ae-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Reimbursement</inline>.—</heading><content>The Director is authorized to reimburse travel or other expenses for non-Federal personnel who attend activities related to training sponsored by FLETC, at travel and per diem rates established by the General Services Administration.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200af-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><heading class="fontsize10"><inline class="smallCaps">Student support</inline>.—</heading><chapeau>In furtherance of its training mission, the Director is authorized to provide the following support to students:</chapeau><subparagraph class="fontsize10" id="yeb5200b0-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Athletic and related activities.</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200b1-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>Short-term medical services.</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200b2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Chaplain services.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb5200b3-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><heading class="fontsize10"><inline class="smallCaps">Authority to hire federal annuitants</inline>.—</heading><subparagraph class="fontsize10" id="yeb5200b4-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, the Director is authorized to appoint and maintain, as necessary, Federal annuitants who have expert knowledge and experience to meet the training responsibilities under this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200b5-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">No reduction in retirement pay</inline>.—</heading><content>A Federal annuitant employed pursuant to this paragraph shall not be subject to any reduction in pay for annuity allocable to the period of actual employment under the provisions of section 8344 or 8468 of <ref href="/us/usc/t5">title 5, United States Code</ref>, or similar provision of any other retirement system for employees.</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200b6-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Re-employed annuitants</inline>.—</heading><content>A Federal annuitant employed pursuant to this paragraph shall not be considered an employee for purposes of subchapter III of chapter 83 or <ref href="/us/usc/t5/ch84">chapter 84 of title 5, United States Code</ref>, or such other retirement system (referred to in subparagraph (B)) as may apply.</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200b7-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Counting</inline>.—</heading><content>Federal annuitants shall be counted on a full time equivalent basis.</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200b8-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>No appointment under this paragraph may be made which would result in the displacement of any employee.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb5200b9-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">“(12) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb5200ba-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reimbursement.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Travel for intermittent employees</inline>.—</heading><content>The Director is authorized to reimburse intermittent Federal employees traveling from outside a commuting distance (to be predetermined by the Director) for travel expenses.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yeb5200bb-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">On-FLETC Housing</inline>.—</heading><content>Notwithstanding any other provision of law, individuals attending training at any FLETC facility shall, to the extent practicable and in accordance with FLETC policy, reside in on-FLETC or FLETC-provided housing.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yeb5200bc-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Additional Fiscal Authorities</inline>.—</heading><chapeau>In order to further the goals and objectives of FLETC, the Director is authorized to—<page identifier="/us/stat/130/1457">130 STAT. 1457</page></chapeau><paragraph class="fontsize10" id="yeb5200bd-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>expend funds for public awareness and to enhance community support of law enforcement training, including the advertisement of available law enforcement training programs;</content></paragraph>
<paragraph class="fontsize10" id="yeb5200be-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>accept and use gifts of property, both real and personal, and to accept gifts of services, for purposes that promote the functions of the Director pursuant to subsection (c) and the training responsibilities of the Director under subsection (d);</content></paragraph>
<paragraph class="fontsize10" id="yeb5200bf-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xeb5200c0-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reimbursement.</p></sidenote><content>accept reimbursement from other Federal agencies for the construction or renovation of training and support facilities and the use of equipment and technology on government owned-property;</content></paragraph>
<paragraph class="fontsize10" id="yeb5200c1-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>obligate funds in anticipation of reimbursements from agencies receiving training at FLETC, except that total obligations at the end of a fiscal year may not exceed total budgetary resources available at the end of such fiscal year;</content></paragraph>
<paragraph class="fontsize10" id="yeb5200c2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><chapeau>in accordance with the purchasing authority provided under section 505 of the Department of Homeland Security Appropriations Act, 2004 (<ref href="/us/pl/108/90">Public Law 108–90</ref>; <ref href="/us/usc/t6/s453a">6 U.S.C. 453a</ref>)—</chapeau><subparagraph class="fontsize10" id="yeb5200c3-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>purchase employee and student uniforms; and</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200c4-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>purchase and lease passenger motor vehicles, including vehicles for police-type use;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb5200c5-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>provide room and board for student interns; and</content></paragraph>
<paragraph class="fontsize10" id="yeb5200c6-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>expend funds each fiscal year to honor and memorialize FLETC graduates who have died in the line of duty.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yeb5200c7-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yeb5200c8-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Basic training</inline>.—</heading><content>The term ‘<term>basic training</term>’ means the entry-level training required to instill in new Federal law enforcement personnel fundamental knowledge of criminal laws, law enforcement and investigative techniques, laws and rules of evidence, rules of criminal procedure, constitutional rights, search and seizure, and related issues.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200c9-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Detailed instructors</inline>.—</heading><content>The term ‘<term>detailed instructors</term>’ means personnel who are assigned to the Federal Law Enforcement Training Centers for a period of time to serve as instructors for the purpose of conducting basic and advanced training.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200ca-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term ‘<term>Director</term>’ means the Director of the Federal Law Enforcement Training Centers.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200cb-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Distributed learning</inline>.—</heading><content>The term ‘<term>distributed learning</term>’ means education in which students take academic courses by accessing information and communicating with the instructor, from various locations, on an individual basis, over a computer network or via other technologies.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200cc-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Employee</inline>.—</heading><content>The term ‘<term>employee</term>’ has the meaning given such term in <ref href="/us/usc/t5/s2105">section 2105 of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200cd-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Federal agency</inline>.—</heading><chapeau>The term ‘<term>Federal agency</term>’ means—</chapeau><subparagraph class="fontsize10" id="yeb5200ce-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>an Executive Department as defined in <ref href="/us/usc/t5/s101">section 101 of title 5, United States Code</ref>;</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200cf-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>an independent establishment as defined in <ref href="/us/usc/t5/s104">section 104 of title 5, United States Code</ref>;</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200d0-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a Government corporation as defined in <ref href="/us/usc/t31/s9101">section 9101 of title 31, United States Code</ref>;</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200d1-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>the Government Printing Office;</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200d2-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>the United States Capitol Police;</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200d3-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>the United States Supreme Court Police; and</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200d4-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>Government agencies with law enforcement related duties.<page identifier="/us/stat/130/1458">130 STAT. 1458</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb5200d5-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Law enforcement personnel</inline>.—</heading><content>The term ‘<term>law enforcement personnel</term>’ means an individual, including criminal investigators (commonly known as ‘agents’) and uniformed police (commonly known as ‘officers’), who has statutory authority to search, seize, make arrests, or to carry firearms.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200d6-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Local</inline>.—</heading><chapeau>The term ‘<term>local</term>’ means—</chapeau><subparagraph class="fontsize10" id="yeb5200d7-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>of or pertaining to any county, parish, municipality, city, town, township, rural community, unincorporated town or village, local public authority, educational institution, special district, intrastate district, council of governments (regardless of whether the council of governments is incorporated as a nonprofit corporation under State law), regional or interstate government entity, any agency or instrumentality of a local government, or any other political subdivision of a State; and</content></subparagraph>
<subparagraph class="fontsize10" id="yeb5200d8-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>an Indian tribe or authorized tribal organization, or in Alaska a Native village or Alaska Regional Native Corporation.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yeb5200d9-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Partner organization</inline>.—</heading><content>The term ‘<term>partner organization</term>’ means any Federal agency participating in FLETC’s training programs under a formal memorandum of understanding.</content></paragraph>
<paragraph class="fontsize10" id="yeb5200da-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term ‘<term>State</term>’ means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any possession of the United States.</content></paragraph>
<paragraph class="fontsize10" id="yeb5226eb-e851-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">“(11) </num><heading class="fontsize10"><inline class="smallCaps">Student intern</inline>.—</heading><content>The term ‘<term>student intern</term>’ means any eligible baccalaureate or graduate degree student participating in FLETC’s College Intern Program.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yeb5226ec-e851-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on New Funding</inline>.—</heading><content>No funds are authorized to carry out this section. This section shall be carried out using amounts otherwise appropriated or made available for such purpose.”</content></subsection>
