<section id="d226301e88" identifier="/us/pl/114/274/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dfba6b4-e853-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s58">15 USC 58 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Better Online Ticket Sales Act of 2016</shortTitle>” or the “<shortTitle role="act">BOTS Act of 2016</shortTitle>”.</content></section>
<section id="d226301e106" identifier="/us/pl/114/274/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dfba6b5-e853-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s45c">15 USC 45c</ref>.</p></sidenote><heading>UNFAIR AND DECEPTIVE ACTS AND PRACTICES RELATING TO CIRCUMVENTION OF TICKET ACCESS CONTROL MEASURES.</heading><subsection class="firstIndent0 fontsize10" id="y9dfd0646-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Conduct Prohibited</inline>.—</heading><paragraph class="fontsize10" id="y9dfd0647-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (2), it shall be unlawful for any person—</chapeau><subparagraph class="fontsize10" id="y9dfd0648-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to circumvent a security measure, access control system, or other technological control or measure on an Internet website or online service that is used by the ticket issuer to enforce posted event ticket purchasing limits or to maintain the integrity of posted online ticket purchasing order rules; or</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd0649-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>to sell or offer to sell any event ticket in interstate commerce obtained in violation of subparagraph (A) if the person selling or offering to sell the ticket either—</chapeau><clause class="fontsize10" id="y9dfd064a-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>participated directly in or had the ability to control the conduct in violation of subparagraph (A); or</content></clause>
<clause class="fontsize10" id="y9dfd064b-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>knew or should have known that the event ticket was acquired in violation of subparagraph (A).</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9dfd064c-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><chapeau>It shall not be unlawful under this section for a person to create or use any computer software or system—</chapeau><subparagraph class="fontsize10" id="y9dfd064d-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to investigate, or further the enforcement or defense, of any alleged violation of this section or other statute or regulation; or</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd064e-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to engage in research necessary to identify and analyze flaws and vulnerabilities of measures, systems, or controls described in paragraph (1)(A), if these research activities are conducted to advance the state of knowledge in the field of computer system security or to assist in the development of computer security product.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9dfd064f-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Enforcement by the Federal Trade Commission</inline>.—</heading><paragraph class="fontsize10" id="y9dfd0650-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Unfair or deceptive acts or practices</inline>.—</heading><content>A violation of subsection (a) shall be treated as a violation of a rule defining <page identifier="/us/stat/130/1402">130 STAT. 1402</page>
an unfair or a deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<ref href="/us/usc/t15/s57a/a/1/B">15 U.S.C. 57a(a)(1)(B)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y9dfd0651-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Powers of commission</inline>.—</heading><subparagraph class="fontsize10" id="y9dfd0652-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<ref href="/us/usc/t15/s41/etseq">15 U.S.C. 41 et seq.</ref>) were incorporated into and made a part of this section.</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd0653-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Privileges and immunities</inline>.—</heading><content>Any person who violates subsection (a) shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<ref href="/us/usc/t15/s41/etseq">15 U.S.C. 41 et seq.</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd0654-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Authority preserved</inline>.—</heading><content>Nothing in this section shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9dfd0655-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Enforcement by States</inline>.—</heading><paragraph class="fontsize10" id="y9dfd0656-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of any person subject to subsection (a) in a practice that violates such subsection, the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States—</chapeau><subparagraph class="fontsize10" id="y9dfd0657-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to enjoin further violation of such subsection by such person;</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd0658-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to compel compliance with such subsection; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd0659-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to obtain damages, restitution, or other compensation on behalf of such residents.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9dfd065a-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Rights of federal trade commission</inline>.—</heading><subparagraph class="fontsize10" id="y9dfd065b-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Notice to federal trade commission</inline>.—</heading><clause class="fontsize10" id="y9dfd065c-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dfd065d-e853-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in clause (iii), the attorney general of a State shall notify the Commission in writing that the attorney general intends to bring a civil action under paragraph (1) not later than 10 days before initiating the civil action.</content></clause>
<clause class="fontsize10" id="y9dfd065e-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dfd065f-e853-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Records.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><content>The notification required by clause (i) with respect to a civil action shall include a copy of the complaint to be filed to initiate the civil action.</content></clause>
<clause class="fontsize10" id="y9dfd0660-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>If it is not feasible for the attorney general of a State to provide the notification required by clause (i) before initiating a civil action under paragraph (1), the attorney general shall notify the Commission immediately upon instituting the civil action.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9dfd0661-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Intervention by federal trade commission</inline>.—</heading><chapeau>The Commission may—</chapeau><clause class="fontsize10" id="y9dfd0662-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>intervene in any civil action brought by the attorney general of a State under paragraph (1); and</content></clause>
<clause class="fontsize10" id="y9dfd0663-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>upon intervening—</chapeau><subclause class="fontsize10" id="y9dfd0664-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>be heard on all matters arising in the civil action; and</content></subclause>
<subclause class="fontsize10" id="y9dfd0665-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/2/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>file petitions for appeal of a decision in the civil action.</content></subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9dfd0666-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Investigatory powers</inline>.—</heading><content>Nothing in this subsection may be construed to prevent the attorney general of a State <page identifier="/us/stat/130/1403">130 STAT. 1403</page>
from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence.</content></paragraph>
<paragraph class="fontsize10" id="y9dfd0667-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Preemptive action by federal trade commission</inline>.—</heading><content>If the Commission institutes a civil action or an administrative action with respect to a violation of subsection (a), the attorney general of a State may not, during the pendency of such action, bring a civil action under paragraph (1) against any defendant named in the complaint of the Commission for the violation with respect to which the Commission instituted such action.</content></paragraph>
<paragraph class="fontsize10" id="y9dfd0668-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Venue; service of process</inline>.—</heading><subparagraph class="fontsize10" id="y9dfd0669-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Venue</inline>.—</heading><chapeau>Any action brought under paragraph (1) may be brought in—</chapeau><clause class="fontsize10" id="y9dfd066a-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/5/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the district court of the United States that meets applicable requirements relating to venue under <ref href="/us/usc/t28/s1391">section 1391 of title 28, United States Code</ref>; or</content></clause>
<clause class="fontsize10" id="y9dfd2d7b-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/5/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>another court of competent jurisdiction.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9dfd2d7c-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Service of process</inline>.—</heading><chapeau>In an action brought under paragraph (1), process may be served in any district in which the defendant—</chapeau><clause class="fontsize10" id="y9dfd2d7d-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/5/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>is an inhabitant; or</content></clause>
<clause class="fontsize10" id="y9dfd2d7e-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/5/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>may be found.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9dfd2d7f-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Actions by other state officials</inline>.—</heading><subparagraph class="fontsize10" id="y9dfd2d80-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In addition to civil actions brought by attorneys general under paragraph (1), any other consumer protection officer of a State who is authorized by the State to do so may bring a civil action under paragraph (1), subject to the same requirements and limitations that apply under this subsection to civil actions brought by attorneys general.</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd2d81-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s2/c/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Savings provision</inline>.—</heading><content>Nothing in this subsection may be construed to prohibit an authorized official of a State from initiating or continuing any proceeding in a court of the State for a violation of any civil or criminal law of the State.</content></subparagraph>

<section id="d226301e448" identifier="/us/pl/114/274/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9dfd2d82-e853-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s45c">15 USC 45c note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x9dfd7ba3-e853-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y9dfd7ba4-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Commission</inline>.—</heading><content>The term “<term>Commission</term>” means the Federal Trade Commission.</content></paragraph>
<paragraph class="fontsize10" id="y9dfd7ba5-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Event</inline>.—</heading><chapeau>The term “<term>event</term>” means any concert, theatrical performance, sporting event, show, or similarly scheduled activity, taking place in a venue with a seating or attendance capacity exceeding 200 persons that—</chapeau><subparagraph class="fontsize10" id="y9dfd7ba6-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is open to the general public; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfd7ba7-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is promoted, advertised, or marketed in interstate commerce or for which event tickets are generally sold or distributed in interstate commerce.</content></subparagraph>

<paragraph class="fontsize10" id="y9dfd7ba8-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Event ticket</inline>.—</heading><chapeau>The term “<term>event ticket</term>” means any physical, electronic, or other form of a certificate, document, voucher, token, or other evidence indicating that the bearer, possessor, or person entitled to possession through purchase or otherwise has—</chapeau><subparagraph class="fontsize10" id="y9dfd7ba9-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a right, privilege, or license to enter an event venue or occupy a particular seat or area in an event venue with respect to one or more events; or<page identifier="/us/stat/130/1404">130 STAT. 1404</page></content></subparagraph>
<subparagraph class="fontsize10" id="y9dfda2ba-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an entitlement to purchase such a right, privilege, or license with respect to one or more future events.</content></subparagraph>

<paragraph class="fontsize10" id="y9dfda2bb-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Ticket issuer</inline>.—</heading><chapeau>The term “<term>ticket issuer</term>” means any person who makes event tickets available, directly or indirectly, to the general public, and may include—</chapeau><subparagraph class="fontsize10" id="y9dfda2bc-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the operator of the venue;</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfda2bd-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the sponsor or promoter of an event;</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfda2be-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>a sports team participating in an event or a league whose teams are participating in an event;</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfda2bf-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/4/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>a theater company, musical group, or similar participant in an event; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9dfda2c0-e853-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/274/s3/4/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>an agent for any such person.</content></subparagraph>
