<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdbbc4143-e854-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Northern Border Security Review Act.</p></sidenote>
<section id="d226842e88" identifier="/us/pl/114/267/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Northern Border Security Review Act</shortTitle>”.</content></section>
<section id="d226842e98" identifier="/us/pl/114/267/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xdbbc8f64-e854-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="ydbbc8f65-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="ydbbc8f66-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="ydbbc8f67-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Appropriations of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="ydbbc8f68-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Committee on the Judiciary of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="ydbbc8f69-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the Committee on Homeland Security of the House of Representatives;</content></subparagraph>
<subparagraph class="fontsize10" id="ydbbc8f6a-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the Committee on Appropriations of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydbbc8f6b-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>the Committee on the Judiciary of the House of Representatives.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydbbc8f6c-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Northern border</inline>.—</heading><content>The term “<term>Northern Border</term>” means the land and maritime borders between the United States and Canada.</content></paragraph>

<section id="d226842e154" identifier="/us/pl/114/267/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>NORTHERN BORDER THREAT ANALYSIS.</heading><subsection class="firstIndent0 fontsize10" id="ydbbd049d-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdbbd049e-e854-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall submit a Northern Border threat analysis to the appropriate congressional committees that includes—</chapeau><paragraph class="fontsize10" id="ydbbd049f-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>current and potential terrorism and criminal threats posed by individuals and organized groups seeking—</chapeau><subparagraph class="fontsize10" id="ydbbd04a0-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to enter the United States through the Northern Border; or</content></subparagraph>
<subparagraph class="fontsize10" id="ydbbd04a1-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to exploit border vulnerabilities on the Northern Border;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydbbd04a2-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>improvements needed at and between ports of entry along the Northern Border—</chapeau><subparagraph class="fontsize10" id="ydbbd04a3-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to prevent terrorists and instruments of terrorism from entering the United States; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydbbd04a4-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to reduce criminal activity, as measured by the total flow of illegal goods, illicit drugs, and smuggled and <page identifier="/us/stat/130/1386">130 STAT. 1386</page>
trafficked persons moved in either direction across to the Northern Border;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ydbbd04a5-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>gaps in law, policy, cooperation between State, tribal, and local law enforcement, international agreements, or tribal agreements that hinder effective and efficient border security, counter-terrorism, anti-human smuggling and trafficking efforts, and the flow of legitimate trade along the Northern Border; and</content></paragraph>
<paragraph class="fontsize10" id="ydbbd04a6-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>whether additional U.S. Customs and Border Protection preclearance and preinspection operations at ports of entry along the Northern Border could help prevent terrorists and instruments of terror from entering the United States.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydbbd04a7-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdbbd04a8-e854-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Examination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Analysis Requirements</inline>.—</heading><chapeau>For the threat analysis required under subsection (a), the Secretary of Homeland Security shall consider and examine—</chapeau><paragraph class="fontsize10" id="ydbbd2bb9-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>technology needs and challenges;</content></paragraph>
<paragraph class="fontsize10" id="ydbbd2bba-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>personnel needs and challenges;</content></paragraph>
<paragraph class="fontsize10" id="ydbbd2bbb-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the role of State, tribal, and local law enforcement in general border security activities;</content></paragraph>
<paragraph class="fontsize10" id="ydbbd2bbc-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the need for cooperation among Federal, State, tribal, local, and Canadian law enforcement entities relating to border security;</content></paragraph>
<paragraph class="fontsize10" id="ydbbd2bbd-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the terrain, population density, and climate along the Northern Border; and</content></paragraph>
<paragraph class="fontsize10" id="ydbbd2bbe-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>the needs and challenges of Department facilities, including the physical approaches to such facilities.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ydbbd2bbf-e854-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/267/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Classified Threat Analysis</inline>.—</heading><content>To the extent possible, the Secretary of Homeland Security shall submit the threat analysis required under subsection (a) in unclassified form. The Secretary may submit a portion of the threat analysis in classified form if the Secretary determines that such form is appropriate for that portion.</content></subsection>
