<section id="d227890e98" identifier="/us/pl/114/257/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">District of Columbia Judicial Financial Transparency Act</shortTitle>”.</content></section>
<section id="d227890e108" identifier="/us/pl/114/257/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINANCIAL DISCLOSURE REQUIREMENTS FOR JUDGES OF DISTRICT OF COLUMBIA COURTS.</heading><subsection class="firstIndent0 fontsize10" id="y58a07ee7-e856-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/257/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Requirements Described</inline>.—</heading><content>Section 11–1530, D.C. Official Code, <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="y58a14238-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658166"><num class="fontsize12" value="11–1530">“§ 11–1530.</num><heading class="fontsize12"> Financial statements</heading><subsection class="firstIndent0 fontsize10" id="y58a14239-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><chapeau>Pursuant to such rules as the Commission shall promulgate, each judge of the District of Columbia courts shall, within 1 year following the date of enactment of the District of Columbia Court Reorganization Act of 1970 and at least annually thereafter, file with the Commission a report containing the following information:</chapeau><paragraph class="fontsize10" id="y58a1423a-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1)</num><subparagraph class="inline" id="y58a1423b-e856-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><content>The source, type and amount of the judge’s income which exceeds $200 (other than income from the United States government and income referred to in subparagraph (C)) for the period covered by the report.</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y58a1423c-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The source and type of the judge’s spouse’s income which exceeds $1,000 (other than income from the United States government and income referred to in subparagraph (C)) for the period covered by the report.</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y58a1423d-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>The source and type of income which consists of dividends, rents, interest, and capital gains received by the judge and the judge’s spouse during such period which exceeds $200 in amount or value, and an indication of which of the following categories the amount or value of such item of income is within—</chapeau><clause class="fontsize10" id="y58a1423e-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>not more than $1,000;</content></clause>
<clause class="fontsize10" id="y58a1423f-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>greater than 1,000 but not more than $2,500;</content></clause>
<clause class="fontsize10" id="y58a14240-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>greater than $2,500 but not more than $5,000;</content></clause>
<clause class="fontsize10" id="y58a14241-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>greater than $5,000 but not more than $15,000;</content></clause>
<clause class="fontsize10" id="y58a14242-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>greater than $15,000 but not more than $50,000;</content></clause>
<clause class="fontsize10" id="y58a14243-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>greater than $50,000 but not more than $100,000;</content></clause>
<clause class="fontsize10" id="y58a14244-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>greater than $100,000 but not more than $1,000,000;<page identifier="/us/stat/130/1351">130 STAT. 1351</page></content></clause>
<clause class="fontsize10" id="y58a14245-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">“(viii) </num><content>greater than $1,000,000 but not more than $5,000,000; or</content></clause>
<clause class="fontsize10" id="y58a14246-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">“(ix) </num><content>greater than $5,000,000.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y58a14247-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>The name and address of each private foundation or eleemosynary institution, and of each business or professional corporation, firm, or enterprise in which the judge was an officer, director, proprietor, or partner during such period.</content></paragraph>
<paragraph class="fontsize10" id="y58a14248-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>The identity and category of value (as set forth in subsection (b)) of each liability of $10,000 or more owed by the judge or by the judge and the judge’s spouse jointly at any time during such period.</content></paragraph>
<paragraph class="fontsize10" id="y58a14249-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>The source and value of all gifts in the aggregate amount or value of $250 or more from any single source received by the judge during such period, except gifts from the judge’s spouse or any of the judge’s children or parents.</content></paragraph>
<paragraph class="fontsize10" id="y58a1424a-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>The identity of each trust in which the judge held a beneficial interest having a value of $10,000 or more at any time during such period, and in the case of any trust in which the judge held any beneficial interest during such period, the identity, if known, of each interest in real or personal property in which the trust held a beneficial interest having a value of $10,000 or more at any time during such period. If the judge cannot obtain the identity of the trust interest, the judge shall request the trustee to report that information to the Commission.</content></paragraph>
<paragraph class="fontsize10" id="y58a1424b-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>The identity and category of value (as set forth in subsection (b)) of each interest in real or personal property having a value of $10,000 or more which the judge owned at any time during such period.</content></paragraph>
<paragraph class="fontsize10" id="y58a1424c-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>The amount or value and source of each honorarium of $250 or more received by the judge and the judge’s spouse during such period.</content></paragraph>
<paragraph class="fontsize10" id="y58a1424d-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>The source and amount of all money, other than that received from the United States government, received in the form of an expense account or as reimbursement for expenditures from any source aggregating more than $250 during such period.</content></paragraph>
<paragraph class="fontsize10" id="y58a1424e-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><content>The source and amount of all waivers or partial waivers of fees or charges accepted by the judge on behalf of the judge or the judge’s spouse, domestic partner, or guest during such period.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y58a1424f-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><chapeau>For purposes of paragraphs (3) and (6) of subsection (a), the categories of value set forth in this subsection are—</chapeau><paragraph class="fontsize10" id="y58a14250-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>not more than $15,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14251-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>greater than $15,000 but not more than $50,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14252-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>greater than $50,000 but not more than $100,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14253-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>greater than $100,000 but not more than $250,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14254-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>greater than $250,000 but not more than $500,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14255-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>greater than $500,000 but not more than $1,000,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14256-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>greater than $1,000,000 but not more than $5,000,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14257-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>greater than $5,000,000 but not more than $25,000,000;</content></paragraph>
<paragraph class="fontsize10" id="y58a14258-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><content>greater than $25,000,000 but not more than $50,000,000; and</content></paragraph>
<paragraph class="fontsize10" id="y58a14259-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">“(10) </num><content>greater than $50,000,000.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y58a1425a-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline" id="y58a1425b-e856-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>Reports filed pursuant to this section shall, upon written request, and notice to the reporting judge for purposes of making <page identifier="/us/stat/130/1352">130 STAT. 1352</page>
an application to the Commission for a redaction pursuant to paragraph (2), be made available for public inspection and copying within a reasonable time after filing and during the period they are kept by the Commission (in accordance with rules promulgated by the Commission), and shall be kept by the Commission for not less than 3 years.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y58a1425c-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>This section does not require the public availability of reports filed by a judge if upon application by the reporting judge, a finding is made by the Commission that revealing personal and sensitive information could endanger that judge or a family member of that judge, except that a report may be redacted pursuant to this paragraph only—</chapeau><subparagraph class="fontsize10" id="y58a1425d-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to the extent necessary to protect the individual who filed the report or a family member of that individual; and</content></subparagraph>
<subparagraph class="fontsize10" id="y58a1425e-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>for as long as the danger to such individual exists.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y58a1425f-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><content>The intentional failure by a judge of a District of Columbia court to file a report required by this section, or the filing of a fraudulent report, shall constitute willful misconduct in office and shall be grounds for removal from office under section 11–1526(a)(2).”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y58a14260-e856-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/257/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendment made by subsection (a) shall apply with respect to reports filed under section 11–1530, D.C. Official Code, that cover periods beginning during or after 2016.</content></subsection>

<section id="d227890e346" identifier="/us/pl/114/257/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>AUTHORITY OF PROBATE DIVISION TO USE MAGISTRATE JUDGES.</heading><subsection class="firstIndent0 fontsize10" id="y58a16971-e856-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/257/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 11–1732(j)(5), District of Columbia Official Code, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>Family Divisions</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Probate Divisions, and the Family Court,</quotedText>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y58a16972-e856-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/257/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Technical and Conforming Amendment</inline>.—</heading><content>Section 11–1732(j)(4)(A), District of Columbia Official Code, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>Family Division</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Family Court</quotedText>”.</content></subsection>
</section>
<section id="d227890e390" identifier="/us/pl/114/257/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>AUTHORITY OF DISTRICT OF COLUMBIA COURTS TO ACCEPT CERTAIN TYPES OF PAYMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y58a1b793-e856-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/257/s4/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subchapter III of chapter 17 of title 11, District of Columbia Code, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y58a22cc4-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658166"><num class="fontsize12" value="11–1748">“§ 11–1748.</num><heading class="fontsize12"> Authority of courts to accept certain types of payments</heading><subsection class="firstIndent0 fontsize10" id="y58a22cc5-e856-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section, the term ‘<term>electronic funds transfer</term>’—</chapeau><paragraph class="fontsize10" id="y58a22cc6-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>means a transfer of funds, other than a transaction by check, draft, or similar paper instrument, that is initiated through an electronic terminal, telephone, or computer or magnetic tape for the purpose of ordering, instructing, or authorizing a financial institution to debit or credit an account; and</content></paragraph>
<paragraph class="fontsize10" id="y58a22cc7-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>includes point of sale transfers, automated teller machine transfers, direct deposit or withdrawal of funds, transfers initiated by telephone, and transfers resulting from debit card transactions.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y58a22cc8-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Authority To Accept Credit Card Payments and Electronic Funds Transfers</inline>.—</heading><paragraph class="fontsize10" id="y58a22cc9-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The District of Columbia courts may accept payment of fines, fees, escrow payments, restitution,<page identifier="/us/stat/130/1353">130 STAT. 1353</page>
 bonds, and other payments to the courts by credit card or electronic funds transfer.</content></paragraph>
<paragraph class="fontsize10" id="y58a22cca-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Use of vendors and third party providers</inline>.—</heading><chapeau>The Executive officer—</chapeau><subparagraph class="fontsize10" id="y58a22ccb-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>may contract with a bank or credit card vendor, or other third party provider, for purposes of accepting payments by credit card or electronic funds transfer; and</content></subparagraph>
<subparagraph class="fontsize10" id="y58a22ccc-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>shall make every effort to find the lowest cost vendor for purposes of accepting such payments.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y58a22ccd-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Responsibility for paying fees</inline>.—</heading><content>Under any contract entered into under paragraph (2), the person making the payment shall be responsible for covering any fee or charge associated or imposed with respect to the method of payment.</content></paragraph>
<paragraph class="fontsize10" id="y58a22cce-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Completion of payment</inline>.—</heading><content>If a person elects to make a payment to the District of Columbia courts by a method authorized under paragraph (1), the payment shall not be deemed to be made until the courts receive the funds.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y58a22ccf-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Authority To Accept Checks</inline>.—</heading><paragraph class="fontsize10" id="y58a22cd0-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The District of Columbia courts may accept payment of fines, fees, escrow payments, restitution, bonds, and other payments to the courts by check.</content></paragraph>
<paragraph class="fontsize10" id="y58a22cd1-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Use of check guarantee vendor</inline>.—</heading><chapeau>The Executive Officer—</chapeau><subparagraph class="fontsize10" id="y58a22cd2-e856-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>may contract with a check guarantee vendor for purposes of accepting payments by check; and</content></subparagraph>
