<section id="d331219e88" identifier="/us/pl/114/256/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcc55e6-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Veterans Mobility Safety Act of 2016</shortTitle>”.</content></section>
<section id="d331219e103" identifier="/us/pl/114/256/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PERSONAL SELECTIONS OF AUTOMOBILES AND ADAPTIVE EQUIPMENT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7dcc7cf7-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <ref href="/us/usc/t38/s3903/b">Section 3903(b) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y7dcc7cf8-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>Except</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(1) Except</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y7dcc7cf9-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentDown1 firstIndent0 fontsize10" id="y7dcc7cfa-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>The Secretary shall ensure that to the extent practicable an eligible person who is provided an automobile or other conveyance under this chapter is given the opportunity to make personal selections relating to such automobile or other conveyance.”</content></paragraph>

<section id="d331219e144" identifier="/us/pl/114/256/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcca40b-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3902">38 USC 3902 note</ref>.</p></sidenote><heading>COMPREHENSIVE POLICY FOR THE AUTOMOBILES ADAPTIVE EQUIPMENT PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y7dcddc8c-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Comprehensive Policy</inline>.—</heading><content>The Secretary of Veterans Affairs shall develop a comprehensive policy regarding quality standards for providers who provide modification services to veterans under the automobile adaptive equipment program.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcddc8d-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Scope</inline>.—</heading><chapeau>The policy developed under subsection (a) shall cover each of the following:</chapeau><paragraph class="fontsize10" id="y7dcddc8e-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Department of Veterans Affairs-wide management of the automobile adaptive equipment program.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc8f-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The development of standards for safety and quality of equipment and installation of equipment through the automobile adaptive equipment program, including with respect to the defined differentiations in levels of modification complexity.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc90-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The consistent application of standards for safety and quality of both equipment and installation throughout the Department.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc91-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>In accordance with subsection (c)(1), the certification of a provider by a manufacturer if the Secretary designates the quality standards of such manufacturer as meeting or exceeding the standards developed under this section.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc92-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>In accordance with subsection (c)(2), the certification of a provider by a third party, nonprofit organization if the <page identifier="/us/stat/130/1346">130 STAT. 1346</page>
Secretary designates the quality standards of such organization as meeting or exceeding the standards developed under this section.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc93-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>The education and training of personnel of the Department who administer the automobile adaptive equipment program.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc94-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>The compliance of the provider with the Americans with Disabilities Act of 1990 (<ref href="/us/usc/t42/s12101/etseq">42 U.S.C. 12101 et seq.</ref>) when furnishing automobile adaptive equipment at the facility of the provider.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc95-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/b/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>The allowance, where technically appropriate, for veterans to receive modifications at their residence or location of choice, including standards that ensure such receipt and notification to veterans of the availability of such receipt.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcddc96-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Certification of Manufacturers and Third Party, Nonprofit Organizations</inline>.—</heading><paragraph class="fontsize10" id="y7dcddc97-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Certification of manufacturers</inline>.—</heading><content>The Secretary shall approve a manufacturer as a certifying manufacturer for purposes of subsection (b)(4), if the manufacturer demonstrates that its certification standards meet or exceed the quality standards developed under this section.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc98-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Certification of third party, nonprofit organizations</inline>.—</heading><subparagraph class="fontsize10" id="y7dcddc99-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary may approve two or more private, nonprofit organizations as third party, nonprofit certifying organizations for purposes of subsection (b)(5).</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcddc9a-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>If at any time there is only one third party, nonprofit certifying organization approved by the Secretary for purposes of subsection (b)(5), such organization shall not be permitted to provide certifications under such subsection until such time as the Secretary approves a second third party, nonprofit certifying organization for purposes of such subsection.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcddc9b-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcddc9c-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Updates</inline>.—</heading><paragraph class="fontsize10" id="y7dcddc9d-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Initial updates</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Secretary shall update Veterans Health Administration Handbook 1173.4, or any successor handbook or directive, in accordance with the policy developed under subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y7dcddc9e-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Subsequent updates</inline>.—</heading><content>Not less frequently than once every 6 years thereafter, the Secretary shall update such handbook, or any successor handbook or directive.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcddc9f-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/e" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>The Secretary shall develop the policy under subsection (a), and revise such policy under subsection (d), in consultation with veterans service organizations, the National Highway Transportation Administration, industry representatives, manufacturers of automobile adaptive equipment, and other entities with expertise in installing, repairing, <amendingAction type="substitute">replacing</amendingAction>, or manufacturing mobility equipment or developing mobility accreditation standards for automobile adaptive equipment.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcddca0-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Conflicts</inline>.—</heading><chapeau>In developing and implementing the policy under subsection (a), the Secretary shall—</chapeau><paragraph class="fontsize10" id="y7dcddca1-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>minimize the possibility of conflicts of interest, to the extent practicable; and</content></paragraph>
<paragraph class="fontsize10" id="y7dcddca2-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcddca3-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote><content>establish procedures that ensure against the use of a certifying organization referred to in subsection (b)(5) that <page identifier="/us/stat/130/1347">130 STAT. 1347</page>
has a financial conflict of interest regarding the certification of an eligible provider.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcddca4-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Biennial Report</inline>.—</heading><paragraph class="fontsize10" id="y7dcddca5-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 1 year after the date on which the Secretary updates Veterans Health Administration Handbook 1173.4, or any successor handbook or directive, under subsection (d), and not less frequently than once every other year thereafter through 2022, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the implementation and facility compliance with the policy developed under subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y7dcddca6-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcddca7-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The report required by paragraph (1) shall include the following:</chapeau><subparagraph class="fontsize10" id="y7dcddca8-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcddca9-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Plan.</p></sidenote><content>A description of the implementation plan for the policy developed under subsection (a) and any revisions to such policy under subsection (d).</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcddcaa-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>A description of the performance measures used to determine the effectiveness of such policy in ensuring the safety of veterans enrolled in the automobile adaptive equipment program.</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcddcab-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>An assessment of safety issues due to improper installations based on a survey of recipients of adaptive equipment from the Department.</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcddcac-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>An assessment of the adequacy of the adaptive equipment services of the Department based on a survey of recipients of adaptive equipment from the Department.</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcddcad-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>An assessment of the training provided to the personnel of the Department with respect to administering the program.</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcddcae-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/g/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>An assessment of the certified providers of the Department of adaptive equipment with respect to meeting the minimum standards developed under subsection (b)(2).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcddcaf-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y7dcddcb0-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/h/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Automobile adaptive equipment program</inline>.—</heading><content>The term “<term>automobile adaptive equipment program</term>” means the program administered by the Secretary of Veterans Affairs pursuant to <ref href="/us/usc/t38/ch39">chapter 39 of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y7dcddcb1-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s3/h/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Veterans service organization</inline>.—</heading><content>The term “<term>veterans service organization</term>” means any organization recognized by the Secretary for the representation of veterans under <ref href="/us/usc/t38/s5902">section 5902 of title 38, United States Code</ref>.</content></paragraph>

<section id="d331219e432" identifier="/us/pl/114/256/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>APPOINTMENT OF LICENSED HEARING AID SPECIALISTS IN VETERANS HEALTH ADMINISTRATION.</heading><subsection class="firstIndent0 fontsize10" id="y7dcec712-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Licensed Hearing Aid Specialists</inline>.—</heading><paragraph class="fontsize10" id="y7dcec713-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appointment</inline>.—</heading><content><ref href="/us/usc/t38/s7401/3">Section 7401(3) of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>licensed hearing aid specialists,</quotedText>” after “<quotedText>Audiologists,</quotedText>”.</content></paragraph>
<paragraph class="fontsize10" id="y7dcec714-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/a/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Qualifications</inline>.—</heading><content>Section 7402(b)(14) of such title <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, hearing aid specialist</quotedText>” after “<quotedText>dental technologist</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcec715-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcec716-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7401">38 USC 7401 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>With respect to appointing hearing aid specialists under sections 7401 and 7402 of <ref href="/us/usc/t38">title 38, United States Code</ref>, as amended by subsection (a), and providing services furnished by such specialists, the Secretary shall ensure that—</chapeau><page identifier="/us/stat/130/1348">130 STAT. 1348</page>
<paragraph class="fontsize10" id="y7dcec717-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a hearing aid specialist may only perform hearing services consistent with the hearing aid specialist’s State license related to the practice of fitting and dispensing hearing aids without excluding other qualified professionals, including audiologists, from rendering services in overlapping practice areas;</content></paragraph>
<paragraph class="fontsize10" id="y7dcec718-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>services provided to veterans by hearing aid specialists shall be provided as part of the non-medical treatment plan developed by an audiologist; and</content></paragraph>
<paragraph class="fontsize10" id="y7dcec719-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the medical facilities of the Department of Veterans Affairs provide to veterans access to the full range of professional services provided by an audiologist.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcec71a-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcec71b-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7401">38 USC 7401 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>In determining the qualifications required for hearing aid specialists and in carrying out subsection (b), the Secretary shall consult with veterans service organizations, audiologists, otolaryngologists, hearing aid specialists, and other stakeholder and industry groups as the Secretary determines appropriate.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7dcec71c-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcec71d-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Annual Report</inline>.—</heading><paragraph class="fontsize10" id="y7dcec71e-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7dcec71f-e856-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of the enactment of this Act, and annually thereafter during the 5-year period beginning on the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to Congress a report on the following:</chapeau><subparagraph class="fontsize10" id="y7dcec720-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Timely access of veterans to hearing health services through the Department of Veterans Affairs.</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcec721-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Contracting policies of the Department with respect to providing hearing health services to veterans in facilities that are not facilities of the Department.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7dcec722-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Timely access to services</inline>.—</heading><chapeau>Each report shall, with respect to the matter specified in paragraph (1)(A) for the 1-year period preceding the submittal of such report, include the following:</chapeau><subparagraph class="fontsize10" id="y7dcec723-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The staffing levels of audiologists, hearing aid specialists, and health technicians in audiology in the Veterans Health Administration.</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcec724-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>A description of the metrics used by the Secretary in measuring performance with respect to appointments and care relating to hearing health.</content></subparagraph>
<subparagraph class="fontsize10" id="y7dcec725-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>The average time that a veteran waits to receive an appointment, beginning on the date on which the veteran makes the request, for the following:</chapeau><clause class="fontsize10" id="y7dcec726-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>A disability rating evaluation for a hearing-related disability.</content></clause>
<clause class="fontsize10" id="y7dcec727-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>A hearing aid evaluation.</content></clause>
<clause class="fontsize10" id="y7dcec728-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>Dispensing of hearing aids.</content></clause>
<clause class="fontsize10" id="y7dcec729-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>Any follow-up hearing health appointment.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y7dcec72a-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The percentage of veterans whose total wait time for appointments described in subparagraph (C), including an initial and follow-up appointment, if applicable, is more than 30 days.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7dcec72b-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Contracting policies</inline>.—</heading><chapeau>Each report shall, with respect to the matter specified in paragraph (1)(B) for the 1-year period preceding the submittal of such report, include the following:</chapeau><subparagraph class="fontsize10" id="y7dcec72c-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The number of veterans that the Secretary refers to non-Department audiologists for hearing health care appointments.<page identifier="/us/stat/130/1349">130 STAT. 1349</page></content></subparagraph>
<subparagraph class="fontsize10" id="y7dcec72d-e856-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/256/s4/d/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The number of veterans that the Secretary refers to non-Department hearing aid specialists for follow-up appointments for a hearing aid evaluation, the dispensing of hearing aids, or any other purpose relating to hearing health.</content></subparagraph>
