<section id="d233235e171" identifier="/us/pl/114/245/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b02e83-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s583k">16 USC 583k</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x35b05594-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds as follows:</chapeau><paragraph class="fontsize10" id="y35b05595-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The National Forest System features a world-class trail system with over 157,000 miles of trails that provide world-class opportunities for hiking, horseback riding, hunting, mountain bicycling, motorized vehicles, and other outdoor activities.</content></paragraph>
<paragraph class="fontsize10" id="y35b05596-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>According to the Government Accountability Office, the Forest Service is only able to maintain about one-quarter of National Forest System trails to the agency standard, and the agency faces a trail maintenance backlog of $314 million, and an additional backlog of $210 million in annual maintenance, capital improvements, and operations.</content></paragraph>
<paragraph class="fontsize10" id="y35b05597-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The lack of maintenance on National Forest System trails threatens access to public lands, and may cause increased environmental damage, threaten public safety, and increase future maintenance costs.</content></paragraph>
<paragraph class="fontsize10" id="y35b05598-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Federal budget limitations require solutions to National Forest System trail maintenance issues that make more efficient use of existing resources.</content></paragraph>
<paragraph class="fontsize10" id="y35b05599-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Volunteers, partners, and outfitters and guides play an important role in maintaining National Forest System trails, and a comprehensive strategy is needed to ensure that volunteers and partners are used as effectively as possible.</content></paragraph>
</section>
<section id="d233235e209" identifier="/us/pl/114/245/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b07caa-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s583k–1">16 USC 583k–1</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x35b0cacb-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:<page identifier="/us/stat/130/991">130 STAT. 991</page></chapeau><paragraph class="fontsize10" id="y35b0cacc-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrative unit</inline>.—</heading><content>The term “<term>Administrative Unit</term>” means a national forest or national grassland.</content></paragraph>
<paragraph class="fontsize10" id="y35b0cacd-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Outfitter or guide</inline>.—</heading><content>The term “<term>outfitter or guide</term>” means an individual, organization, or business who provides outfitting or guiding services, as defined in <ref href="/us/cfr/t36/s251.51">section 251.51 of title 36, Code of Federal Regulations</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y35b0f1de-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Partner</inline>.—</heading><content>The term “<term>partner</term>” means a non-Federal entity that engages in a partnership.</content></paragraph>
<paragraph class="fontsize10" id="y35b0f1df-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Partnership</inline>.—</heading><content>The term “<term>partnership</term>” means arrangements between the Department of Agriculture or the Forest Service and a non-Federal entity that are voluntary, mutually beneficial, and entered into for the purpose of mutually agreed-upon objectives.</content></paragraph>
<paragraph class="fontsize10" id="y35b0f1e0-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Priority area</inline>.—</heading><content>The term “<term>priority area</term>” means a well-defined region on National Forest System land selected by the Secretary under section 5(a).</content></paragraph>
<paragraph class="fontsize10" id="y35b0f1e1-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Agriculture.</content></paragraph>
<paragraph class="fontsize10" id="y35b0f1e2-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Strategy</inline>.—</heading><content>The term “<term>strategy</term>” means the National Forest System Trails Volunteer and Partnership Strategy authorized by section 4(a).</content></paragraph>
<paragraph class="fontsize10" id="y35b0f1e3-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Trail maintenance</inline>.—</heading><chapeau>The term “<term>trail maintenance</term>” means any activity to maintain the usability and sustainability of trails within the National Forest System, including—</chapeau><subparagraph class="fontsize10" id="y35b0f1e4-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/8/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>ensuring trails are passable by the users for which they are managed;</content></subparagraph>
<subparagraph class="fontsize10" id="y35b0f1e5-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/8/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>preventing environmental damage resulting from trail deterioration;</content></subparagraph>
<subparagraph class="fontsize10" id="y35b0f1e6-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/8/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>protecting public safety; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35b0f1e7-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/8/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>averting future deferred maintenance costs.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y35b0f1e8-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s3/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Volunteer</inline>.—</heading><content>The term “<term>volunteer</term>” means an individual whose services are accepted by the Secretary without compensation under the Volunteers in the National Forests Act of 1972 (<ref href="/us/usc/t16/s558a/etseq">16 U.S.C. 558a et seq.</ref>).</content></paragraph>

<section id="d233235e334" identifier="/us/pl/114/245/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b0f1e9-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s583k–2">16 USC 583k–2</ref>.</p></sidenote><heading>NATIONAL FOREST SYSTEM TRAILS VOLUNTEER AND PARTNERSHIP STRATEGY.</heading><subsection class="firstIndent0 fontsize10" id="y35b1dc4a-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b1dc4b-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 2 years after the date of the enactment of this Act, the Secretary shall publish in the Federal Register a strategy to significantly increase the role of volunteers and partners in trail maintenance.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y35b1dc4c-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Required Elements</inline>.—</heading><chapeau>The strategy required by subsection (a) shall—</chapeau><paragraph class="fontsize10" id="y35b1dc4d-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>augment and support the capabilities of Federal employees to carry out or contribute to trail maintenance;</content></paragraph>
<paragraph class="fontsize10" id="y35b1dc4e-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>provide meaningful opportunities for volunteers and partners to carry out trail maintenance in each region of the Forest Service;</content></paragraph>
<paragraph class="fontsize10" id="y35b1dc4f-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>address the barriers to increased volunteerism and partnerships in trail maintenance identified by volunteers, partners, and others;</content></paragraph>
<paragraph class="fontsize10" id="y35b1dc50-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>prioritize increased volunteerism and partnerships in trail maintenance in those regions with the most severe trail maintenance needs, and where trail maintenance backlogs are jeopardizing access to National Forest lands; and<page identifier="/us/stat/130/992">130 STAT. 992</page></content></paragraph>
<paragraph class="fontsize10" id="y35b1dc51-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b1dc52-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>aim to increase trail maintenance by volunteers and partners by 100 percent by the date that is 5 years after the date of the enactment of this Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y35b1dc53-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b1dc54-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Study.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional Requirement</inline>.—</heading><content>As a component of the strategy, the Secretary shall study opportunities to improve trail maintenance by addressing opportunities to use fire crews in trail maintenance activities in a manner that does not jeopardize firefighting capabilities, public safety, or resource protection.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b1dc55-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x35b1dc56-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Incorporation.</p></sidenote> Upon a determination that trail maintenance would be advanced by use of fire crews in trail maintenance, the Secretary shall incorporate these proposals into the strategy, subject to such terms and conditions as the Secretary determines to be necessary.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y35b1dc57-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Volunteer Liability</inline>.—</heading><paragraph class="fontsize10" id="y35b1dc58-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/d/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Section 3 of the Volunteers in the National Forests Act of 1972 (<ref href="/us/usc/t16/s558c">16 U.S.C. 558c</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y35b20369-e858-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b2036a-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>For the purposes of subsections (b), (c), and (d), the term ‘<term>volunteer</term>’ includes a person providing volunteer services to the Secretary who—</chapeau><paragraph class="fontsize10" id="y35b2036b-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>is recruited, trained, and supported by a cooperator under a mutual benefit agreement with the Secretary; and</content></paragraph>
<paragraph class="fontsize10" id="y35b2036c-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>performs such volunteer services under the supervision of the cooperator as directed by the Secretary in the mutual benefit agreement, including direction that specifies—</chapeau><subparagraph class="fontsize10" id="y35b2036d-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the volunteer services to be performed by the volunteers and the supervision to be provided by the cooperator;</content></subparagraph>
<subparagraph class="fontsize10" id="y35b2036e-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the applicable project safety standards and protocols to be adhered to by the volunteers and enforced by the cooperator; and</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y35b20374-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b20375-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Implementation</p><p class="leftAlign firstIndent0 fontsize8" id="x35b20376-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">plan.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Volunteer and Partnership Coordination</inline>.—</heading><content>The Secretary shall require each administrative unit to develop a volunteer and partner coordination implementation plan for the strategy which clearly defines roles and responsibilities for the administrative unit and district staff, and includes strategies to ensure sufficient coordination, assistance, and support for volunteers and partners to improve trail maintenance.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y35b20377-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><paragraph class="fontsize10" id="y35b20378-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The Secretary shall prepare a report on—</chapeau><subparagraph class="fontsize10" id="y35b20379-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the effectiveness of the strategy in addressing the trail maintenance backlog;</content></subparagraph>
<subparagraph class="fontsize10" id="y35b2037a-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the increase in volunteerism and partnership efforts on trail maintenance as a result of the strategy;<page identifier="/us/stat/130/993">130 STAT. 993</page></content></subparagraph>
<subparagraph class="fontsize10" id="y35b2037b-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/g/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the miles of National Forest System trails maintained by volunteers and partners, and the approximate value of the volunteer and partnership efforts;</content></subparagraph>
<subparagraph class="fontsize10" id="y35b2037c-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/g/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the status of the stewardship credits for outfitters and guides pilot program described in section 7 that includes the number of participating sites, total amount of the credits offered, estimated value of trail maintenance performed, and suggestions for revising the program; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35b2037d-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s4/g/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b2037e-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x35b2037f-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>recommendations for further increasing volunteerism and partnerships in trail maintenance.</content></subparagraph>

<section id="d233235e586" identifier="/us/pl/114/245/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b20383-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s583k–3">16 USC 583k–3</ref>.</p></sidenote><heading>PRIORITY TRAIL MAINTENANCE PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y35b29fc4-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b29fc5-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Selection</inline>.—</heading><content>In accordance with subsections (b) and (c), not later than 6 months after the date of the enactment of this Act, the Secretary of Agriculture shall select no fewer than 9 and no more than 15 priority areas for increased trail maintenance accomplishments.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y35b314f6-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Criteria</inline>.—</heading><chapeau>Priority areas shall include a well-defined region on National Forest System land where the lack of trail maintenance has—</chapeau><paragraph class="fontsize10" id="y35b314f7-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>reduced access to public land;</content></paragraph>
<paragraph class="fontsize10" id="y35b314f8-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>led to an increase, or risk of increase, in harm to natural resources;</content></paragraph>
<paragraph class="fontsize10" id="y35b314f9-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>jeopardized public safety;</content></paragraph>
<paragraph class="fontsize10" id="y35b314fa-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>resulted in trails being impassible by the intended managed users; or</content></paragraph>
<paragraph class="fontsize10" id="y35b314fb-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>increased future deferred trail maintenance costs.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y35b314fc-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>In selecting priority areas, the Secretary shall—</chapeau><paragraph class="fontsize10" id="y35b314fd-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b314fe-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>consider any public input on priority areas received within 3 months of the date of enactment of this Act;</content></paragraph>
<paragraph class="fontsize10" id="y35b314ff-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>consider the range of trail users (including motorized and non-motorized trail users); and</content></paragraph>
<paragraph class="fontsize10" id="y35b31500-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>include at least one priority area in each region of the United States Forest Service.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y35b31501-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Increased Trail Maintenance</inline>.—</heading><paragraph class="fontsize10" id="y35b31502-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b31503-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Within 6 months of the selection of priority areas under subsection (a), and in accordance with paragraph (2), the Secretary shall develop an approach to substantially increase trail maintenance accomplishments within each priority area.</content></paragraph>
<paragraph class="fontsize10" id="y35b31504-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>In developing the approach under paragraph (1), the Secretary shall—</chapeau><subparagraph class="fontsize10" id="y35b31505-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>consider any public input on trail maintenance priorities and needs within any priority area;</content></subparagraph>
<subparagraph class="fontsize10" id="y35b31506-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>consider the costs and benefits of increased trail maintenance within each priority area; and</content></subparagraph>
<subparagraph class="fontsize10" id="y35b31507-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/d/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>incorporate partners and volunteers in the trail maintenance.<page identifier="/us/stat/130/994">130 STAT. 994</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y35b31508-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Required trail maintenance</inline>.—</heading><content>Utilizing the approach developed under paragraph (1), the Secretary shall substantially increase trail maintenance within each priority area.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y35b31509-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><content>The regional volunteer and partnership coordinators may be responsible for assisting partner organizations in developing and implementing volunteer and partnership projects to increase trail maintenance within priority areas.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y35b3150a-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s5/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b3150b-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Revision</inline>.—</heading><content>The Secretary shall periodically review the priority areas to determine whether revisions are necessary and may revise the priority areas, including the selection of new priority areas or removal of existing priority areas, at his sole discretion.</content></subsection>

<section id="d233235e748" identifier="/us/pl/114/245/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b3150c-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s583k–4">16 USC 583k–4</ref>.</p></sidenote><heading>COOPERATIVE AGREEMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y35b33c1d-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary may enter into a cooperative agreement with any State, tribal, local governmental, and private entity to carry out this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y35b33c1e-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Cooperative agreements authorized under this section may—</chapeau><paragraph class="fontsize10" id="y35b33c1f-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>improve trail maintenance in a priority area;</content></paragraph>
<paragraph class="fontsize10" id="y35b33c20-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>implement the strategy; or</content></paragraph>
<paragraph class="fontsize10" id="y35b33c21-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s6/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>advance trail maintenance in a manner deemed appropriate by the Secretary.</content></paragraph>

<section id="d233235e791" identifier="/us/pl/114/245/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b33c22-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s583k–5">16 USC 583k–5</ref>.</p></sidenote><heading>STEWARDSHIP CREDITS FOR OUTFITTERS AND GUIDES.</heading><subsection class="firstIndent0 fontsize10" id="y35b38a43-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x35b38a44-e858-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Pilot Program</inline>.—</heading><content>Within 1 year after the date of enactment of this Act, in accordance with this section, the Secretary shall establish a pilot program on not less than 20 administrative units to offset all or part of the land use fee for an outfitting and guiding permit by the cost of the work performed by the permit holder to construct, improve, or maintain National Forest System trails, trailheads, or developed sites that support public use under terms established by the Secretary.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y35b38a45-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Additional Requirements</inline>.—</heading><chapeau>In establishing the pilot program authorized by subsection (a), the Secretary shall—</chapeau><paragraph class="fontsize10" id="y35b38a46-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s7/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>select administrative units where the pilot program will improve trail maintenance; and</content></paragraph>
<paragraph class="fontsize10" id="y35b38a47-e858-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/245/s7/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>establish appropriate terms and conditions, including meeting National Quality Standards for Trails and the Trail Management Objectives identified for the trail.</content></paragraph>
