<section id="d331986e88" identifier="/us/pl/114/244/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Alyce Spotted Bear and Walter Soboleff Commission on Native Children Act</shortTitle>”.</content></section>
<section id="d331986e98" identifier="/us/pl/114/244/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x5ae357f2-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y5ae357f3-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Commission</inline>.—</heading><content>The term “<term>Commission</term>” means the Alyce Spotted Bear and Walter Soboleff Commission on Native Children established by section 3.</content></paragraph>
<paragraph class="fontsize10" id="y5ae357f4-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Indian</inline>.—</heading><content>The term “<term>Indian</term>” has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s450b">25 U.S.C. 450b</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y5ae357f5-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe</inline>.—</heading><content>The term “<term>Indian tribe</term>” has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s450b">25 U.S.C. 450b</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y5ae357f6-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Native child</inline>.—</heading><chapeau>The term “<term>Native child</term>” means—</chapeau><subparagraph class="fontsize10" id="y5ae357f7-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an Indian child, as that term is defined in section 4 of the Indian Child Welfare Act of 1978 (<ref href="/us/usc/t25/s1903">25 U.S.C. 1903</ref>);</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae357f8-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>an Indian who is between the ages of 18 and 24 years old; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae357f9-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>a Native Hawaiian who is not older than 24 years old.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae357fa-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Native hawaiian</inline>.—</heading><content>The term “<term>Native Hawaiian</term>” has the meaning given the term in section 7207 of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s7517">20 U.S.C. 7517</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y5ae357fb-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>
<paragraph class="fontsize10" id="y5ae357fc-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s2/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Tribal college or university</inline>.—</heading><content>The term “<term>Tribal College or University</term>” has the meaning given the term in section 316(b) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1059c/b">20 U.S.C. 1059c(b)</ref>).</content></paragraph>

<section id="d331986e204" identifier="/us/pl/114/244/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>COMMISSION ON NATIVE CHILDREN.</heading><subsection class="firstIndent0 fontsize10" id="y5ae7ebdd-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ebde-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>There is established a commission in the Office of Tribal Justice of the Department of Justice, to be known as the “Alyce Spotted Bear and Walter Soboleff Commission on Native Children”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae7ebdf-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ebe0-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><paragraph class="fontsize10" id="y5ae7ebe1-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Commission shall be composed of 11 members, of whom—</chapeau><page identifier="/us/stat/130/982">130 STAT. 982</page>
<subparagraph class="fontsize10" id="y5ae7ebe2-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ebe3-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><chapeau>3 shall be appointed by the President, in consultation with—</chapeau><clause class="fontsize10" id="y5ae7ebe4-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Attorney General;</content></clause>
<clause class="fontsize10" id="y5ae7ebe5-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Secretary;</content></clause>
<clause class="fontsize10" id="y5ae7ebe6-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the Secretary of Education; and</content></clause>
<clause class="fontsize10" id="y5ae7ebe7-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the Secretary of Health and Human Services;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ae7ebe8-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>3 shall be appointed by the Majority Leader of the Senate, in consultation with the Chairperson of the Committee on Indian Affairs of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ebe9-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>1 shall be appointed by the Minority Leader of the Senate, in consultation with the Vice Chairperson of the Committee on Indian Affairs of the Senate;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ebea-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>3 shall be appointed by the Speaker of the House of Representatives, in consultation with the Chairperson of the Committee on Natural Resources of the House of Representatives; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ebeb-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>1 shall be appointed by the Minority Leader of the House of Representatives, in consultation with the Ranking Member of the Committee on Natural Resources of the House of Representatives.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae7ebec-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements for eligibility</inline>.—</heading><subparagraph class="fontsize10" id="y5ae7ebed-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Subject to subparagraph (B), each member of the Commission shall have significant experience and expertise in—</chapeau><clause class="fontsize10" id="y5ae7ebee-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>Indian affairs; and</content></clause>
<clause class="fontsize10" id="y5ae7ebef-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>matters to be studied by the Commission, including—</chapeau><subclause class="fontsize10" id="y5ae7ebf0-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>health care issues facing Native children, including mental health, physical health, and nutrition;</content></subclause>
<subclause class="fontsize10" id="y5ae7ebf1-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>Indian education, including experience with Bureau of Indian Education schools and public schools, tribally operated schools, tribal colleges or universities, early childhood education programs, and the development of extracurricular programs;</content></subclause>
<subclause class="fontsize10" id="y5ae7ebf2-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/A/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>juvenile justice programs relating to prevention and reducing incarceration and rates of recidivism; and</content></subclause>
<subclause class="fontsize10" id="y5ae7ebf3-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/A/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>social service programs that are used by Native children and designed to address basic needs, such as food, shelter, and safety, including child protective services, group homes, and shelters.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ae7ebf4-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Experts</inline>.—</heading><clause class="fontsize10" id="y5ae7ebf5-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Native children</inline>.—</heading><chapeau>1 member of the Commission shall—</chapeau><subclause class="fontsize10" id="y5ae7ebf6-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/B/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>meet the requirements of subparagraph (A); and</content></subclause>
<subclause class="fontsize10" id="y5ae7ebf7-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/B/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>be responsible for providing the Commission with insight into and input from Native children on the matters studied by the Commission.</content></subclause>
</clause>
<clause class="fontsize10" id="y5ae7ebf8-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Research</inline>.—</heading><chapeau>1 member of the Commission shall—</chapeau><subclause class="fontsize10" id="y5ae7ebf9-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>meet the requirements of subparagraph (A); and<page identifier="/us/stat/130/983">130 STAT. 983</page></content></subclause>
<subclause class="fontsize10" id="y5ae7ebfa-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/2/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>have extensive experience in statistics or social science research.</content></subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae7ebfb-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Terms</inline>.—</heading><subparagraph class="fontsize10" id="y5ae7ebfc-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Each member of the Commission shall be appointed for the life of the Commission.</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ebfd-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Vacancies</inline>.—</heading><content>A vacancy in the Commission shall be filled in the manner in which the original appointment was made.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae7ebfe-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Operation</inline>.—</heading><paragraph class="fontsize10" id="y5ae7ebff-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec00-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Chairperson</inline>.—</heading><content>Not later than 15 days after the date on which all members of the Commission have been appointed, the Commission shall select 1 member to serve as Chairperson of the Commission.</content></paragraph>
<paragraph class="fontsize10" id="y5ae7ec01-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><subparagraph class="fontsize10" id="y5ae7ec02-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Commission shall meet at the call of the Chairperson.</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec03-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec04-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Initial meeting</inline>.—</heading><content>The initial meeting of the Commission shall take place not later than 30 days after the date described in paragraph (1).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae7ec05-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Quorum</inline>.—</heading><content>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</content></paragraph>
<paragraph class="fontsize10" id="y5ae7ec06-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Rules</inline>.—</heading><content>The Commission may establish, by majority vote, any rules for the conduct of Commission business, in accordance with this Act and other applicable law.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae7ec07-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Native Advisory Committee</inline>.—</heading><paragraph class="fontsize10" id="y5ae7ec08-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>The Commission shall establish a committee, to be known as the “Native Advisory Committee”.</content></paragraph>
<paragraph class="fontsize10" id="y5ae7ec09-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><subparagraph class="fontsize10" id="y5ae7ec0a-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Composition</inline>.—</heading><chapeau>The Native Advisory Committee shall consist of—</chapeau><clause class="fontsize10" id="y5ae7ec0b-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>1 representative of Indian tribes from each region of the Bureau of Indian Affairs who is 25 years of age or older; and</content></clause>
<clause class="fontsize10" id="y5ae7ec0c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>1 Native Hawaiian who is 25 years of age or older.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec0d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Qualifications</inline>.—</heading><content>Each member of the Native Advisory Committee shall have experience relating to matters to be studied by the Commission.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae7ec0e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau>The Native Advisory Committee shall—</chapeau><subparagraph class="fontsize10" id="y5ae7ec0f-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>serve as an advisory body to the Commission; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec10-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec11-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec12-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec13-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>provide to the Commission advice and recommendations, submit materials, documents, testimony, and such other information as the Commission determines to be necessary to carry out the duties of the Commission under this section.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae7ec14-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec15-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Native children subcommittee</inline>.—</heading><content>The Native Advisory Committee shall establish a subcommittee that shall consist of at least 1 member from each region of the Bureau of Indian Affairs and 1 Native Hawaiian, each of whom shall be a Native child, and have experience serving on the council of a tribal, regional, or national youth organization.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae7ec16-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Comprehensive Study of Native Children Issues</inline>.—</heading><paragraph class="fontsize10" id="y5ae7ec17-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec18-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Commission shall conduct a comprehensive study of Federal, State, local, and tribal programs that serve Native children, including an evaluation of—</chapeau><page identifier="/us/stat/130/984">130 STAT. 984</page>
<subparagraph class="fontsize10" id="y5ae7ec19-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the impact of concurrent jurisdiction on child welfare systems;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec1a-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the barriers Indian tribes and Native Hawaiians face in applying, reporting on, and using existing public and private grant resources, including identification of any Federal cost-sharing requirements;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec1b-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the obstacles to nongovernmental financial support, such as from private foundations and corporate charities, for programs benefitting Native children;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec1c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the issues relating to data collection, such as small sample sizes, large margins of error, or other issues related to the validity and statistical significance of data on Native children;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec1d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>the barriers to the development of sustainable, multidisciplinary programs designed to assist high-risk Native children and families of those high-risk Native children;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec1e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>cultural or socioeconomic challenges in communities of Native children;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec1f-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>any examples of successful program models and use of best practices in programs that serve children and families;</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec20-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>the barriers to interagency coordination on programs benefitting Native children; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec21-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/1/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the use of memoranda of agreement or interagency agreements to facilitate or improve agency coordination, including the effects of existing memoranda or interagency agreements on program service delivery and efficiency.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae7ec22-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><chapeau>In conducting the study under paragraph (1), the Commission shall, to the maximum extent practicable—</chapeau><subparagraph class="fontsize10" id="y5ae7ec23-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to avoid duplication of efforts, collaborate with other workgroups focused on similar issues, such as the Task Force on American Indian/Alaska Native Children Exposed to Violence of the Attorney General; and</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec24-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to improve coordination and reduce travel costs, use available technology.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae7ec25-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Recommendations</inline>.—</heading><chapeau>Taking into consideration the results of the study under paragraph (1) and the analysis of any existing data relating to Native children received from Federal agencies, the Commission shall—</chapeau><subparagraph class="fontsize10" id="y5ae7ec26-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec27-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Plans.</p></sidenote><chapeau>develop recommendations for goals, and plans for achieving those goals, for Federal policy relating to Native children in the short-, mid-, and long-term, which shall be informed by the development of accurate child well-being measures, except that the Commission shall not consider or recommend the recognition or the establishment of a government-to-government relationship with—</chapeau><clause class="fontsize10" id="y5ae7ec28-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>any entity not recognized on or before the date of enactment of this Act by the Federal Government through an Act of Congress, Executive action, judicial decree, or any other action; or</content></clause>
<clause class="fontsize10" id="y5ae7ec29-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any entity not included in the list authorized pursuant to the Federally Recognized Indian Tribe List Act of 1994 (<ref href="/us/usc/t25/s479a/etseq">25 U.S.C. 479a et seq.</ref>);</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ae7ec2a-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>make recommendations on necessary modifications and improvements to programs that serve Native children <page identifier="/us/stat/130/985">130 STAT. 985</page>
at the Federal, State, and tribal levels, on the condition that the recommendations recognize the diversity in cultural values, integrate the cultural strengths of the communities of the Native children, and will result in—</chapeau><clause class="fontsize10" id="y5ae7ec2b-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>improvements to the child welfare system that—</chapeau><subclause class="fontsize10" id="y5ae7ec2c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>reduce the disproportionate rate at which Native children enter child protective services and the period of time spent in the foster system;</content></subclause>
<subclause class="fontsize10" id="y5ae7ec2d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>increase coordination among social workers, police, and foster families assisting Native children while in the foster system to result in the increased safety of Native children while in the foster system;</content></subclause>
<subclause class="fontsize10" id="y5ae7ec2e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/i/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>encourage the hiring and retention of licensed social workers in Native communities;</content></subclause>
<subclause class="fontsize10" id="y5ae7ec2f-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/i/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>address the lack of available foster homes in Native communities; and</content></subclause>
<subclause class="fontsize10" id="y5ae7ec30-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/i/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><content>reduce truancy and improve the academic proficiency and graduation rates of Native children in the foster system;</content></subclause>
</clause>
<clause class="fontsize10" id="y5ae7ec31-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>improvements to the mental and physical health of Native children, taking into consideration the rates of suicide, substance abuse, and access to nutrition and health care, including—</chapeau><subclause class="fontsize10" id="y5ae7ec32-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec33-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>an analysis of the increased access of Native children to Medicaid under the Patient Protection and Affordable Care Act (<ref href="/us/pl/111/148">Public Law 111–148</ref>) and the effect of that increase on the ability of Indian tribes and Native Hawaiians to develop sustainable health programs; and</content></subclause>
<subclause class="fontsize10" id="y5ae7ec34-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae7ec35-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>an evaluation of the effects of a lack of public sanitation infrastructure, including in-home sewer and water, on the health status of Native children;</content></subclause>
</clause>
<clause class="fontsize10" id="y5ae7ec36-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><chapeau>improvements to educational and vocational opportunities for Native children that will lead to—</chapeau><subclause class="fontsize10" id="y5ae7ec37-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>increased school attendance, performance, and graduation rates for Native children across all educational levels, including early education, post-secondary, and graduate school;</content></subclause>
<subclause class="fontsize10" id="y5ae7ec38-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>localized strategies developed by educators, tribal and community leaders, and law enforcement to prevent and reduce truancy among Native children;</content></subclause>
<subclause class="fontsize10" id="y5ae81349-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>scholarship opportunities at a Tribal College or University and other public and private postsecondary institutions;</content></subclause>
<subclause class="fontsize10" id="y5ae8134a-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>increased participation of the immediate families of Native children;</content></subclause>
<subclause class="fontsize10" id="y5ae8134b-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><content>coordination among schools and Indian tribes that serve Native children, including in the areas of data sharing and student tracking;</content></subclause>
<subclause class="fontsize10" id="y5ae8134c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii/VI" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">(VI) </num><content>accurate identification of students as Native children; and</content></subclause>
<subclause class="fontsize10" id="y5ae8134d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iii/VII" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VII">(VII) </num><content>increased school counseling services, improved access to quality nutrition at school, and safe student transportation;<page identifier="/us/stat/130/986">130 STAT. 986</page></content></subclause>
</clause>
<clause class="fontsize10" id="y5ae8134e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>improved policies and practices by local school districts that would result in improved academic proficiency for Native children;</content></clause>
<clause class="fontsize10" id="y5ae8134f-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>increased access to extracurricular activities for Native children that are designed to increase self-esteem, promote community engagement, and support academic excellence while also serving to prevent unplanned pregnancy, membership in gangs, drug and alcohol abuse, and suicide, including activities that incorporate traditional language and cultural practices of Indians and Native Hawaiians;</content></clause>
<clause class="fontsize10" id="y5ae81350-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><chapeau>taking into consideration the report of the Indian Law and Order Commission issued pursuant to section 15(f) of the Indian Law Enforcement Reform Act (<ref href="/us/usc/t25/s2812/f">25 U.S.C. 2812(f)</ref>), improvements to Federal, State, and tribal juvenile justice systems and detention programs—</chapeau><subclause class="fontsize10" id="y5ae81351-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vi/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>to provide greater access to educational opportunities and social services for incarcerated Native children;</content></subclause>
<subclause class="fontsize10" id="y5ae81352-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vi/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>to promote prevention and reduce incarceration and recidivism rates among Native children;</content></subclause>
<subclause class="fontsize10" id="y5ae81353-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vi/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>to identify intervention approaches and alternatives to incarceration of Native children;</content></subclause>
<subclause class="fontsize10" id="y5ae81354-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vi/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>to incorporate families and the traditional cultures of Indians and Native Hawaiians in the juvenile justice process, including through the development of a family court for juvenile offenses; and</content></subclause>
<subclause class="fontsize10" id="y5ae81355-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vi/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><content>to prevent unnecessary detentions and identify successful reentry programs;</content></subclause>
</clause>
<clause class="fontsize10" id="y5ae81356-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><chapeau>expanded access to a continuum of early development and learning services for Native children from prenatal to age 5 that are culturally competent, support Native language preservation, and comprehensively promote the health, well-being, learning, and development of Native children, such as—</chapeau><subclause class="fontsize10" id="y5ae81357-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>high quality early care and learning programs for children starting from birth, including Early Head Start, Head Start, child care, and preschool programs;</content></subclause>
<subclause class="fontsize10" id="y5ae81358-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>programs, including home visiting and family resource and support programs, that increase the capacity of parents to support the learning and development of the children of the parents, beginning prenatally, and connect the parents with necessary resources;</content></subclause>
<subclause class="fontsize10" id="y5ae81359-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>early intervention and preschool services for infants, toddlers, and preschool-aged children with developmental delays or disabilities; and</content></subclause>
<subclause class="fontsize10" id="y5ae8135a-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/vii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>professional development opportunities for Native providers of early development and learning services;</content></subclause>
</clause>
<clause class="fontsize10" id="y5ae8135b-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>the development of a system that delivers wrap-around services to Native children in a way that is comprehensive and sustainable, including through increased coordination among Indian tribes, schools, <page identifier="/us/stat/130/987">130 STAT. 987</page>
law enforcement, health care providers, social workers, and families;</content></clause>
<clause class="fontsize10" id="y5ae8135c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ix" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">(ix) </num><chapeau>more flexible use of existing Federal programs, such as by—</chapeau><subclause class="fontsize10" id="y5ae8135d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ix/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>providing Indians and Native Hawaiians with more flexibility to carry out programs, while maintaining accountability, minimizing administrative time, cost, and expense and reducing the burden of Federal paperwork requirements; and</content></subclause>
<subclause class="fontsize10" id="y5ae8135e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ix/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><chapeau>allowing unexpended Federal funds to be used flexibly to support programs benefitting Native children, while taking into account—</chapeau><item class="fontsize10" id="y5ae8135f-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ix/II/aa" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">(aa) </num><content>the Indian Employment, Training and Related Services Demonstration Act of 1992 (<ref href="/us/usc/t25/s3401">25 U.S.C. 3401 note</ref>; <ref href="/us/stat/106/2302">106 Stat. 2302</ref>);</content></item>
<item class="fontsize10" id="y5ae81360-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ix/II/bb" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">(bb) </num><content>the Coordinated Tribal Assistance Solicitation program of the Department of Justice;</content></item>
<item class="fontsize10" id="y5ae81361-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ix/II/cc" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">(cc) </num><content>the Federal policy of self-determination; and</content></item>
<item class="fontsize10" id="y5ae81362-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/ix/II/dd" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="dd">(dd) </num><content>any consolidated grant programs; and</content></item>
</subclause>
</clause>
<clause class="fontsize10" id="y5ae81363-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/B/x" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="x">(x) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae81364-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>solutions to other issues that, as determined by the Commission, would improve the health, safety, and well-being of Native children;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ae81365-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae81366-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Records.</p></sidenote><chapeau>make recommendations for improving data collection methods that consider—</chapeau><clause class="fontsize10" id="y5ae81367-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the adoption of standard definitions and compatible systems platforms to allow for greater linkage of data sets across Federal agencies;</content></clause>
<clause class="fontsize10" id="y5ae81368-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the appropriateness of existing data categories for comparative purposes;</content></clause>
<clause class="fontsize10" id="y5ae81369-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the development of quality data and measures, such as by ensuring sufficient sample sizes and frequency of sampling, for Federal, State, and tribal programs that serve Native children;</content></clause>
<clause class="fontsize10" id="y5ae8136a-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the collection and measurement of data that are useful to Indian tribes and Native Hawaiians;</content></clause>
<clause class="fontsize10" id="y5ae8136b-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/C/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>the inclusion of Native children in longitudinal studies; and</content></clause>
<clause class="fontsize10" id="y5ae8136c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/C/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>tribal access to data gathered by Federal, State, and local governmental agencies; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ae8136d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/e/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>identify models of successful Federal, State, and tribal programs in the areas studied by the Commission.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae8136e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 3 years after the date on which all members of the Commission are appointed and amounts are made available to carry out this Act, the Commission shall submit to the President, the Committee on Natural Resources of the House of Representatives, the Committee on Indian Affairs of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate, a report that contains—</chapeau><paragraph class="fontsize10" id="y5ae8136f-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a detailed statement of the findings and conclusions of the Commission; and</content></paragraph>
<paragraph class="fontsize10" id="y5ae81370-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5ae81371-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x5ae81372-e858-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>the recommendations of the Commission for such legislative and administrative actions as the Commission considers to be appropriate.</content></paragraph>

<subparagraph class="fontsize10" id="y5ae81376-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Public requirement</inline>.—</heading><content>The hearings of the Commission under this paragraph shall be open to the public.</content></subparagraph>

<paragraph class="fontsize10" id="y5ae81377-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Witness expenses</inline>.—</heading><subparagraph class="fontsize10" id="y5ae81378-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/g/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A witness requested to appear before the Commission shall be paid the same fees and allowances as are paid to witnesses under <ref href="/us/usc/t28/s1821">section 1821 of title 28, United States Code</ref>.</content></subparagraph>

<subparagraph class="fontsize10" id="y5ae8137c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/g/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Tribal and state agencies</inline>.—</heading><content>The Commission may request the head of any tribal or State agency to provide to the Commission such information as the Commission considers to be necessary to carry out this Act.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae8137d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/g/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Postal services</inline>.—</heading><content>The Commission may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</content></paragraph>
<paragraph class="fontsize10" id="y5ae83a8e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/g/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Gifts</inline>.—</heading><content>The Commission may accept, use, and dispose of gifts or donations of services or property related to the purpose of the Commission.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae83a8f-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Commission Personnel Matters</inline>.—</heading><paragraph class="fontsize10" id="y5ae83a90-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Travel expenses</inline>.—</heading><content>A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under <ref href="/us/usc/t5/ch57/schI">subchapter I of chapter 57 of title 5, United States Code</ref>, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</content></paragraph>
<paragraph class="fontsize10" id="y5ae83a91-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Detail of federal employees</inline>.—</heading><subparagraph class="fontsize10" id="y5ae83a92-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>On the affirmative vote of ⅔ of the members of the Commission—</chapeau><clause class="fontsize10" id="y5ae83a93-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Attorney General, the Secretary, the Secretary of Education, and the Secretary of the Health and Human Services shall each detail, without reimbursement, 1 or more employees of the Department of Justice, the Department of the Interior, the Department of Education, and the Department of Health and Human Services; and</content></clause>
<clause class="fontsize10" id="y5ae83a94-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>with the approval of the appropriate Federal agency head, an employee of any other Federal agency may be, without reimbursement, detailed to the Commission.<page identifier="/us/stat/130/989">130 STAT. 989</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y5ae83a95-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Effect on detailees</inline>.—</heading><content>Detail under this paragraph shall be without interruption or loss of civil service status, benefits, or privileges.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y5ae83a96-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Procurement of temporary and intermittent services</inline>.—</heading><subparagraph class="fontsize10" id="y5ae83a97-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>On request of the Commission, the Attorney General shall provide to the Commission, on a reimbursable basis, reasonable and appropriate office space, supplies, and administrative assistance.</content></subparagraph>
<subparagraph class="fontsize10" id="y5ae83a98-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">No requirement for physical facilities</inline>.—</heading><content>The Administrator of General Services shall not be required to locate a permanent, physical office space for the operation of the Commission.</content></subparagraph>

<paragraph class="fontsize10" id="y5ae83a99-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/h/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Members not federal employees</inline>.—</heading><content>No member of the Commission, the Native Advisory Committee, or the Native Children Subcommittee shall be considered to be a Federal employee.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y5ae83a9a-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/i" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">Termination of Commission</inline>.—</heading><content>The Commission shall terminate 90 days after the date on which the Commission submits the report under subsection (f).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae83a9b-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/j" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="j">(j) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplicability of FACA</inline>.—</heading><content>The Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) shall not apply to the Commission, the Native Advisory Committee, or the Native Children Subcommittee.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5ae83a9c-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/k" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="k">(k) </num><heading class="fontsize10"><inline class="smallCaps">Effect</inline>.—</heading><chapeau>This Act shall not be construed to recognize or establish a government-to-government relationship with—</chapeau><paragraph class="fontsize10" id="y5ae83a9d-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/k/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>any entity not recognized on or before the date of enactment of this Act by the Federal Government through an Act of Congress, Executive action, judicial decree, or any other action; or</content></paragraph>
<paragraph class="fontsize10" id="y5ae83a9e-e858-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/244/s3/k/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>any entity not included in the list authorized pursuant to the Federally Recognized Indian Tribe List Act of 1994 (<ref href="/us/usc/t25/s479a/etseq">25 U.S.C. 479a et seq.</ref>).</content></paragraph>
