<section id="d332474e88" identifier="/us/pl/114/235/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc9013bfd-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s101">40 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">   This Act may be cited as the “<shortTitle role="act">Bathrooms Accessible in Every Situation Act</shortTitle>” or “<shortTitle role="act">BABIES Act</shortTitle>”.</content></section>
<section id="d332474e106" identifier="/us/pl/114/235/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>BABY CHANGING FACILITIES IN RESTROOMS IN PUBLIC BUILDINGS.</heading><subsection class="firstIndent0 fontsize10" id="yc901b12e-e859-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/235/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t40/ch33">Chapter 33 of title 40, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yc901b12f-e859-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/235/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> sections 3314, 3315, and 3316 as sections 3315, 3316, and 3317, respectively; and</content></paragraph>
<paragraph class="fontsize10" id="yc901b130-e859-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/235/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after section 3313 the following new section:<quotedContent><section class="centered fontsize12" id="yc901d841-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658164"><num class="fontsize12" value="3314">“§ 3314.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc901d842-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s3314">40 USC 3314</ref>.</p></sidenote> Baby changing facilities in restrooms</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="yc901d843-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc901d844-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional Requirement for the Construction, Alteration, and Acquisition of Public Buildings</inline>.—</heading><content>Except as provided in subsection (b) and subject to any reasonable accommodations that may be made for individuals in accordance with the Americans with Disabilities Act (<ref href="/us/usc/t42/s12101/etseq">42 U.S.C. 12101 et seq.</ref>) restrooms in a public building shall be equipped with baby changing facilities that the Administrator determines are physically safe, sanitary, and appropriate.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yc901d845-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><chapeau>The requirement under subsection (a) shall not apply—</chapeau><paragraph class="fontsize10" id="yc901d846-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>to a restroom in a public building that is not available or accessible for public use;</content></paragraph>
<paragraph class="fontsize10" id="yc901d847-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>to a restroom in a public building that contains clear and conspicuous signage indicating where a restroom with a baby changing table is located on the same floor of such public building;</content></paragraph>
<paragraph class="fontsize10" id="yc901d848-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>if new construction would be required to install a baby changing facility in the public building and the cost of such construction is unfeasible; or</content></paragraph>
<paragraph class="fontsize10" id="yc901d849-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>to a building not subject to an alteration as set forth in section 3307.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yc901d84a-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yc901d84b-e859-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Baby changing facility</inline>.—</heading><content>The term ‘<term>baby changing facility</term>’ means a table or other device suitable for changing the diaper of a child age 3 or under.<page identifier="/us/stat/130/965">130 STAT. 965</page></content></paragraph>
<paragraph class="fontsize10" id="yc901d84c-e859-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Pubic building</inline>.—</heading><content>The term ‘<term>public building</term>’ means a public building as defined in section 3301 and controlled by the Public Building Service of the General Services Administration.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yc901d850-e859-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/235/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc901d851-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="xc901d852-e859-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s3314">40 USC 3314 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>The requirement under <ref href="/us/usc/t40/s3314/a">section 3314(a) of title 40, United States Code</ref>, shall apply in the case of a public building constructed, altered, or acquired by the Administrator of General Services on or after the date that is 1 year after the date of the enactment of this Act, beginning on that date.</content></subsection>
