<section id="d237453e95" identifier="/us/pl/114/216/s1" role="instruction" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>NATIONAL BIOENGINEERED FOOD DISCLOSURE STANDARD.</heading><content class="firstIndent0 fontsize10" id="xce976a0b-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Agricultural Marketing Act of 1946 (<ref href="/us/usc/t7/s1621/etseq">7 U.S.C. 1621 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subtitle id="yce98f0ac-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658178"><num class="fontsize14 bold" value="E">“Subtitle E—</num><heading class="fontsize14 bold">National Bioengineered Food Disclosure Standard</heading><section class="centered fontsize12" id="yce98f0ad-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="291">“SEC. 291. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0ae-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t7/s1639">7 USC 1639</ref>.</p></sidenote><heading class="fontsize12">DEFINITIONS.</heading><chapeau class=" fontsize10" style="-uslm-lc:I658120">  “In this subtitle:</chapeau><paragraph class="fontsize10" id="yce98f0af-e85c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Bioengineering</inline>.—</heading><chapeau>The term ‘<term>bioengineering</term>’, and any similar term, as determined by the Secretary, with respect to a food, refers to a food—</chapeau><subparagraph class="fontsize10" id="yce98f0b0-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>that contains genetic material that has been modified through in vitro recombinant deoxyribonucleic acid (DNA) techniques; and</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0b1-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>for which the modification could not otherwise be obtained through conventional breeding or found in nature.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yce98f0b2-e85c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Food</inline>.—</heading><content>The term ‘<term>food</term>’ means a food (as defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s321">21 U.S.C. 321</ref>)) that is intended for human consumption.</content></paragraph>
<paragraph class="fontsize10" id="yce98f0b3-e85c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term ‘<term>Secretary</term>’ means the Secretary of Agriculture.</content></paragraph>
</section>
<section class="centered fontsize12" id="yce98f0b4-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="292">“SEC. 292. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0b5-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t7/s1639a">7 USC 1639a</ref>.</p></sidenote><heading class="fontsize12">APPLICABILITY.</heading><subsection class="firstIndent0 fontsize10" id="yce98f0b6-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>This subtitle shall apply to any claim in a disclosure that a food bears that indicates that the food is a bioengineered food.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yce98f0b7-e85c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Application of Definition</inline>.—</heading><content>The definition of the term ‘<term>bioengineering</term>’ under section 291 shall not affect any other definition, program, rule, or regulation of the Federal Government.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yce98f0b8-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Application to Foods</inline>.—</heading><chapeau>This subtitle shall apply only to a food subject to—</chapeau><paragraph class="fontsize10" id="yce98f0b9-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the labeling requirements under the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s301/etseq">21 U.S.C. 301 et seq.</ref>); or</content></paragraph>
<paragraph class="fontsize10" id="yce98f0ba-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>the labeling requirements under the Federal Meat Inspection Act (<ref href="/us/usc/t21/s601/etseq">21 U.S.C. 601 et seq.</ref>), the Poultry Products <page identifier="/us/stat/130/835">130 STAT. 835</page>
Inspection Act (<ref href="/us/usc/t21/s451/etseq">21 U.S.C. 451 et seq.</ref>), or the Egg Products Inspection Act (<ref href="/us/usc/t21/s1031/etseq">21 U.S.C. 1031 et seq.</ref>) only if—</chapeau><subparagraph class="fontsize10" id="yce98f0bb-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the most predominant ingredient of the food would independently be subject to the labeling requirements under the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s301/etseq">21 U.S.C. 301 et seq.</ref>); or</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0bc-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline" id="yce98f0bd-e85c-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><content>the most predominant ingredient of the food is broth, stock, water, or a similar solution; and</content></clause>
<clause class="indentUp0 fontsize10" id="yce98f0be-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the second-most predominant ingredient of the food would independently be subject to the labeling requirements under the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s301/etseq">21 U.S.C. 301 et seq.</ref>).</content></clause>
</subparagraph>
</paragraph>
</subsection>
</section>
<section class="centered fontsize12" id="yce98f0bf-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="293">“SEC. 293. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0c0-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t7/s1639b">7 USC 1639b</ref>.</p></sidenote><heading class="fontsize12">ESTABLISHMENT OF NATIONAL BIOENGINEERED FOOD DISCLOSURE STANDARD.</heading><subsection class="firstIndent0 fontsize10" id="yce98f0c1-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0c2-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment of Mandatory Standard</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this subtitle, the Secretary shall—</chapeau><paragraph class="fontsize10" id="yce98f0c3-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>establish a national mandatory bioengineered food disclosure standard with respect to any bioengineered food and any food that may be bioengineered; and</content></paragraph>
<paragraph class="fontsize10" id="yce98f0c4-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0c5-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Requirements.</p><p class="leftAlign firstIndent0 fontsize8" id="xce98f0c6-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><content>establish such requirements and procedures as the Secretary determines necessary to carry out the standard.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yce98f0c7-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><paragraph class="fontsize10" id="yce98f0c8-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A food may bear a disclosure that the food is bioengineered only in accordance with regulations promulgated by the Secretary in accordance with this subtitle.</content></paragraph>
<paragraph class="fontsize10" id="yce98f0c9-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>A regulation promulgated by the Secretary in carrying out this subtitle shall—</chapeau><subparagraph class="fontsize10" id="yce98f0ca-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>prohibit a food derived from an animal to be considered a bioengineered food solely because the animal consumed feed produced from, containing, or consisting of a bioengineered substance;</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0cb-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0cc-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determine the amounts of a bioengineered substance that may be present in food, as appropriate, in order for the food to be a bioengineered food;</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0cd-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>establish a process for requesting and granting a determination by the Secretary regarding other factors and conditions under which a food is considered a bioengineered food;</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0ce-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>in accordance with subsection (d), require that the form of a food disclosure under this section be a text, symbol, or electronic or digital link, but excluding Internet website Uniform Resource Locators not embedded in the link, with the disclosure option to be selected by the food manufacturer;</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0cf-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>provide alternative reasonable disclosure options for food contained in small or very small packages;</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0d0-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><chapeau>in the case of small food manufacturers, provide—</chapeau><clause class="fontsize10" id="yce98f0d1-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0d2-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Implementation date.</p><p class="leftAlign firstIndent0 fontsize8" id="xce98f0d3-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>an implementation date that is not earlier than 1 year after the implementation date for regulations promulgated in accordance with this section; and</content></clause>
<clause class="fontsize10" id="yce98f0d4-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>on-package disclosure options, in addition to those available under subparagraph (D), to be selected by the small food manufacturer, that consist of—</chapeau><subclause class="fontsize10" id="yce98f0d5-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>a telephone number accompanied by appropriate language to indicate that the phone <page identifier="/us/stat/130/836">130 STAT. 836</page>
number provides access to additional information; and</content></subclause>
<subclause class="fontsize10" id="yce98f0d6-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0d7-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web site.</p></sidenote><content>an Internet website maintained by the small food manufacturer in a manner consistent with subsection (d), as appropriate; and</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yce98f0d8-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><chapeau>exclude—</chapeau><clause class="fontsize10" id="yce98f0d9-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>food served in a restaurant or similar retail food establishment; and</content></clause>
<clause class="fontsize10" id="yce98f0da-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>very small food manufacturers.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yce98f0db-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Safety</inline>.—</heading><content>For the purpose of regulations promulgated and food disclosures made pursuant to paragraph (2), a bioengineered food that has successfully completed the pre-market Federal regulatory review process shall not be treated as safer than, or not as safe as, a non-bioengineered counterpart of the food solely because the food is bioengineered or produced or developed with the use of bioengineering.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yce98f0dc-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Study of Electronic or Digital Link Disclosure</inline>.—</heading><paragraph class="fontsize10" id="yce98f0dd-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0de-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 1 year after the date of enactment of this subtitle, the Secretary shall conduct a study to identify potential technological challenges that may impact whether consumers would have access to the bioengineering disclosure through electronic or digital disclosure methods.</content></paragraph>
<paragraph class="fontsize10" id="yce98f0df-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Public comments</inline>.—</heading><content>In conducting the study under paragraph (1), the Secretary shall solicit and consider comments from the public.</content></paragraph>
<paragraph class="fontsize10" id="yce98f0e0-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Factors</inline>.—</heading><chapeau>The study conducted under paragraph (1) shall consider whether consumer access to the bioengineering disclosure through electronic or digital disclosure methods under this subtitle would be affected by the following factors:</chapeau><subparagraph class="fontsize10" id="yce98f0e1-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The availability of wireless Internet or cellular networks.</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0e2-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The availability of landline telephones in stores.</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0e3-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Challenges facing small retailers and rural retailers.</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0e4-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>The efforts that retailers and other entities have taken to address potential technology and infrastructure challenges.</content></subparagraph>
<subparagraph class="fontsize10" id="yce98f0e5-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>The costs and benefits of installing in retail stores electronic or digital link scanners or other evolving technology that provide bioengineering disclosure information.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yce98f0e6-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce98f0e7-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xce98f0e8-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional disclosure options</inline>.—</heading><content>If the Secretary determines in the study conducted under paragraph (1) that consumers, while shopping, would not have sufficient access to the bioengineering disclosure through electronic or digital disclosure methods, the Secretary, after consultation with food retailers and manufacturers, shall provide additional and comparable options to access the bioengineering disclosure.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yce9916f9-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Disclosure</inline>.—</heading><chapeau>In promulgating regulations under this section, the Secretary shall ensure that—</chapeau><paragraph class="fontsize10" id="yce9916fa-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>on-package language accompanies—</chapeau><subparagraph class="fontsize10" id="yce9916fb-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the electronic or digital link disclosure, indicating that the electronic or digital link will provide access to an Internet website or other landing page by stating only ‘Scan here for more food information’, or equivalent language that only reflects technological changes; or<page identifier="/us/stat/130/837">130 STAT. 837</page></content></subparagraph>
<subparagraph class="fontsize10" id="yce9916fc-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>any telephone number disclosure, indicating that the telephone number will provide access to additional information by stating only ‘Call for more food information.’;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yce9916fd-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the electronic or digital link will provide access to the bioengineering disclosure located, in a consistent and conspicuous manner, on the first product information page that appears for the product on a mobile device, Internet website, or other landing page, which shall exclude marketing and promotional information;</content></paragraph>
<paragraph class="fontsize10" id="yce9916fe-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3)</num><subparagraph class="inline" id="yce9916ff-e85c-11f0-a1e4-69761a48a15a"><num value="A">(A) </num><content>the electronic or digital link disclosure may not collect, analyze, or sell any personally identifiable information about consumers or the devices of consumers; but</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="yce991700-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>if information described in subparagraph (A) must be collected to carry out the purposes of this subtitle, that information shall be deleted immediately and not used for any other purpose;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yce991701-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>the electronic or digital link disclosure also includes a telephone number that provides access to the bioengineering disclosure; and</content></paragraph>
<paragraph class="fontsize10" id="yce991702-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>the electronic or digital link disclosure is of sufficient size to be easily and effectively scanned or read by a digital device.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yce991703-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">State Food Labeling Standards</inline>.—</heading><content>Notwithstanding section 295, no State or political subdivision of a State may directly or indirectly establish under any authority or continue in effect as to any food in interstate commerce any requirement relating to the labeling or disclosure of whether a food is bioengineered or was developed or produced using bioengineering for a food that is the subject of the national bioengineered food disclosure standard under this section that is not identical to the mandatory disclosure requirement under that standard.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yce991704-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Consistency With Certain Laws</inline>.—</heading><chapeau>The Secretary shall consider establishing consistency between—</chapeau><paragraph class="fontsize10" id="yce991705-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the national bioengineered food disclosure standard established under this section; and</content></paragraph>
<paragraph class="fontsize10" id="yce991706-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the Organic Foods Production Act of 1990 (<ref href="/us/usc/t7/s6501/etseq">7 U.S.C. 6501 et seq.</ref>) and any rules or regulations implementing that Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yce991707-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Enforcement</inline>.—</heading><paragraph class="fontsize10" id="yce991708-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Prohibited act</inline>.—</heading><content>It shall be a prohibited act for a person to knowingly fail to make a disclosure as required under this section.</content></paragraph>
<paragraph class="fontsize10" id="yce991709-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Recordkeeping</inline>.—</heading><content>Each person subject to the mandatory disclosure requirement under this section shall maintain, and make available to the Secretary, on request, such records as the Secretary determines to be customary or reasonable in the food industry, by regulation, to establish compliance with this section.</content></paragraph>
<paragraph class="fontsize10" id="yce99170a-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Examination and audit</inline>.—</heading><subparagraph class="fontsize10" id="yce99170b-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary may conduct an examination, audit, or similar activity with respect to any records required under paragraph (2).</content></subparagraph>
<subparagraph class="fontsize10" id="yce99170c-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Notice and hearing</inline>.—</heading><content>A person subject to an examination, audit, or similar activity under subparagraph (A) shall be provided notice and opportunity for a hearing on the results of any examination, audit, or similar activity.<page identifier="/us/stat/130/838">130 STAT. 838</page></content></subparagraph>
<subparagraph class="fontsize10" id="yce99170d-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Audit results</inline>.—</heading><content>After the notice and opportunity for a hearing under subparagraph (B), the Secretary shall make public the summary of any examination, audit, or similar activity under subparagraph (A).</content></subparagraph>

<paragraph class="fontsize10" id="yce99170e-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Recall authority</inline>.—</heading><content>The Secretary shall have no authority to recall any food subject to this subtitle on the basis of whether the food bears a disclosure that the food is bioengineered.</content></paragraph>

<section class="centered fontsize12" id="yce99170f-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="294">“SEC. 294. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce991710-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t7/s1639c">7 USC 1639c</ref>.</p></sidenote><heading class="fontsize12">SAVINGS PROVISIONS.</heading><subsection class="firstIndent0 fontsize10" id="yce991711-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce991712-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Trade</inline>.—</heading><content>This subtitle shall be applied in a manner consistent with United States obligations under international agreements.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yce991713-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Other Authorities</inline>.—</heading><chapeau>Nothing in this subtitle—</chapeau><paragraph class="fontsize10" id="yce991714-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>affects the authority of the Secretary of Health and Human Services or creates any rights or obligations for any person under the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s301/etseq">21 U.S.C. 301 et seq.</ref>); or</content></paragraph>
<paragraph class="fontsize10" id="yce991715-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>affects the authority of the Secretary of the Treasury or creates any rights or obligations for any person under the Federal Alcohol Administration Act (<ref href="/us/usc/t27/s201/etseq">27 U.S.C. 201 et seq.</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yce991716-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Other</inline>.—</heading><content>A food may not be considered to be ‘not bioengineered’, ‘non-GMO’, or any other similar claim describing the absence of bioengineering in the food solely because the food is not required to bear a disclosure that the food is bioengineered under this subtitle.</content></subsection>

<subtitle id="yce991717-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658178"><num class="fontsize14 bold" value="F">“Subtitle F—</num><heading class="fontsize14 bold">Labeling of Certain Food</heading><section class="centered fontsize12" id="yce991718-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="295">“SEC. 295. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce991719-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t7/s1639i">7 USC 1639i</ref>.</p></sidenote><heading class="fontsize12">FEDERAL PREEMPTION.</heading><subsection class="firstIndent0 fontsize10" id="yce99171a-e85c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition of Food</inline>.—</heading><content>In this subtitle, the term ‘<term>food</term>’ has the meaning given the term in section 201 of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s321">21 U.S.C. 321</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yce99171b-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Federal Preemption</inline>.—</heading><content>No State or a political subdivision of a State may directly or indirectly establish under any authority or continue in effect as to any food or seed in interstate commerce any requirement relating to the labeling of whether a food (including food served in a restaurant or similar establishment) or seed is genetically engineered (which shall include such other similar terms as determined by the Secretary of Agriculture) or was developed or produced using genetic engineering, including any requirement for claims that a food or seed is or contains an ingredient that was developed or produced using genetic engineering.</content></subsection>

<section class="centered fontsize12" id="yce99171c-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="296">“SEC. 296. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xce99171d-e85c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t7/s1639j">7 USC 1639j</ref>.</p></sidenote><heading class="fontsize12">EXCLUSION FROM FEDERAL PREEMPTION.</heading><content class="indentUp0 firstIndent0 fontsize10" style="-uslm-lc:I658120">  “Nothing in this subtitle, subtitle E, or any regulation, rule, or requirement promulgated in accordance with this subtitle or subtitle E shall be construed to preempt any remedy created by a State or Federal statutory or common law right.”</content></section>
