<section id="d334390e94" identifier="/us/pl/114/210/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Making Electronic Government Accountable By Yielding Tangible Efficiencies Act of 2016</shortTitle>” or the “<shortTitle role="act">MEGABYTE Act of 2016</shortTitle>”.</content></section>
<section id="d334390e107" identifier="/us/pl/114/210/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>OMB DIRECTIVE ON MANAGEMENT OF SOFTWARE LICENSES.</heading><subsection class="firstIndent0 fontsize10" id="yad58416b-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="yad58416c-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>Director</term>” means the Director of the Office of Management and Budget; and</content></paragraph>
<paragraph class="fontsize10" id="yad58416d-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the term “<term>executive agency</term>” has the meaning given that term in <ref href="/us/usc/t5/s105">section 105 of title 5, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yad58416e-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">OMB Directive</inline>.—</heading><chapeau>The Director shall issue a directive to require the Chief Information Officer of each executive agency to develop a comprehensive software licensing policy, which shall—</chapeau><paragraph class="fontsize10" id="yad58416f-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>identify clear roles, responsibilities, and central oversight authority within the executive agency for managing enterprise software license agreements and commercial software licenses; and</content></paragraph>
<paragraph class="fontsize10" id="yad584170-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>require the Chief Information Officer of each executive agency to—</chapeau><subparagraph class="fontsize10" id="yad584171-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xad584172-e85d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Inventory.</p></sidenote><content>establish a comprehensive inventory, including 80 percent of software license spending and enterprise licenses in the executive agency, by identifying and collecting information about software license agreements using automated discovery and inventory tools;</content></subparagraph>
<subparagraph class="fontsize10" id="yad584173-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>regularly track and maintain software licenses to assist the executive agency in implementing decisions throughout the software license management life cycle;</content></subparagraph>
<subparagraph class="fontsize10" id="yad584174-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xad584175-e85d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analyze.</p></sidenote><content>analyze software usage and other data to make cost-effective decisions;</content></subparagraph>
<subparagraph class="fontsize10" id="yad584176-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>provide training relevant to software license management;</content></subparagraph>
<subparagraph class="fontsize10" id="yad584177-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>establish goals and objectives of the software license management program of the executive agency; and</content></subparagraph>
<subparagraph class="fontsize10" id="yad584178-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/b/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>consider the software license management life cycle phases, including the requisition, reception, deployment and maintenance, retirement, and disposal phases, to implement effective decisionmaking and incorporate existing standards, processes, and metrics.<page identifier="/us/stat/130/825">130 STAT. 825</page></content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yad584179-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report on Software License Management</inline>.—</heading><paragraph class="fontsize10" id="yad58417a-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xad58417b-e85d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="xad58417c-e85d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Beginning in the first fiscal year beginning after the date of enactment of this Act, and in each of the following 5 fiscal years, the Chief Information Officer of each executive agency shall submit to the Director a report on the financial savings or avoidance of spending that resulted from improved software license management.</content></paragraph>
<paragraph class="fontsize10" id="yad58417d-e85d-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/210/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xad58417e-e85d-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Availability</inline>.—</heading><content>The Director shall make each report submitted under paragraph (1) publically available.</content></paragraph>
