<section id="d240210e92" identifier="/us/pl/114/19/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Construction Authorization and Choice Improvement Act</shortTitle>”.</content></section>
<section id="d240210e102" identifier="/us/pl/114/19/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>EXTENSION OF AUTHORIZATION FOR MAJOR MEDICAL FACILITY CONSTRUCTION PROJECT PREVIOUSLY AUTHORIZED.</heading><subsection class="firstIndent0 fontsize10" id="y1ab2ea9d-e861-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/19/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary of Veterans Affairs may carry out the replacement of the existing Department of Veterans Affairs Medical Center in Denver, Colorado, in fiscal year 2015, in an amount not to exceed $900,000,000.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab2ea9e-e861-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/19/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on Obligation of Funds</inline>.—</heading><content>Notwithstanding <ref href="/us/usc/t38/s8104/c">section 8104(c) of title 38, United States Code</ref>, or any other provision of law, funds may not be obligated or expended for the project described in subsection (a) in an amount that would cause the total amount obligated for that project to exceed the amount specified in the law for that project (or would add to total obligations exceeding such specified amount).</content></subsection>

<section id="d240210e129" identifier="/us/pl/114/19/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>CLARIFICATION OF DISTANCE REQUIREMENT FOR EXPANDED AVAILABILITY OF HOSPITAL CARE AND MEDICAL SERVICES FOR VETERANS THROUGH THE USE OF AGREEMENTS WITH NON-DEPARTMENT OF VETERANS AFFAIRS ENTITIES.</heading><subsection class="firstIndent0 fontsize10" id="y1ab311af-e861-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/19/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 101(b)(2) of the Veterans Access, Choice, and Accountability Act of 2014 (<ref href="/us/pl/113/146">Public Law 113–146</ref>; <ref href="/us/usc/t38/s1701">38 U.S.C. 1701 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y1ab311b0-e861-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/19/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (B), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(as calculated based on distance traveled)</quotedText>” after “<quotedText>40 miles</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y1ab311b1-e861-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/19/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subparagraph (D)(ii), by <amendingAction type="delete">striking</amendingAction> subclause (II), and <amendingAction type="insert">inserting</amendingAction> the following new subclause (II):<quotedContent><subclause class="indentUp3 fontsize10" id="y1ab338c2-e861-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><chapeau>faces an unusual or excessive burden in traveling to such a medical facility of the Department based on—</chapeau><item class="fontsize10" id="y1ab338c3-e861-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>geographical challenges;</content></item>
<item class="fontsize10" id="y1ab338c4-e861-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>environmental factors, such as roads that are not accessible to the general public, traffic, or hazardous weather;<page identifier="/us/stat/129/216">129 STAT. 216</page></content></item>
<item class="fontsize10" id="y1ab338c5-e861-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>a medical condition that impacts the ability to travel; or</content></item>
<item class="fontsize10" id="y1ab338c6-e861-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="dd">“(dd) </num><content>other factors, as determined by the Secretary.”</content></item>

<subsection class="firstIndent0 fontsize10" id="y1ab338c7-e861-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/19/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab338c8-e861-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s1701">38 USC 1701 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by subsection (a) shall take effect on the date of the enactment of this Act and apply with respect to care or services provided on or after such date.</content></subsection>
