<section id="d336685e92" identifier="/us/pl/114/184/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Recovering Missing Children Act</shortTitle>”.</content></section>
<section id="d336685e102" identifier="/us/pl/114/184/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DISCLOSURE OF CERTAIN RETURN INFORMATION RELATING TO MISSING OR EXPLOITED CHILDREN INVESTIGATIONS.</heading><subsection class="firstIndent0 fontsize10" id="yf5051c84-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 6103(i)(1) of the Internal Revenue Code of 1986<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5054395-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t26/s6103">26 USC 6103</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yf5054396-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or pertaining to the case of a missing or exploited child,</quotedText>” after “<quotedText>may be a party,</quotedText>” in subparagraph (A)(i);</content></paragraph>
<paragraph class="fontsize10" id="yf5054397-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or to such a case of a missing or exploited child,</quotedText>” after “<quotedText>may be a party,</quotedText>” in subparagraph (A)(iii); and</content></paragraph>
<paragraph class="fontsize10" id="yf5054398-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(or any criminal investigation or proceeding, in the case of a matter relating to a missing or exploited child)</quotedText>” after “<quotedText>concerning such act</quotedText>” in subparagraph (B)(iii).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yf5054399-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Disclosure to State and Local Law Enforcement Agencies</inline>.—</heading><paragraph class="fontsize10" id="yf505439a-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Section 6103(i)(1) of the Internal Revenue Code of 1986 <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="fontsize10" id="yf5056aab-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Disclosure to state and local law enforcement agencies in the case of matters pertaining to a missing or exploited child</inline>.—</heading><clause class="fontsize10" id="yf5056aac-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In the case of an investigation pertaining to a missing or exploited child, the head of any Federal agency, or his designee, may disclose any return or return information obtained under subparagraph (A) to officers and employees of any State or local law enforcement agency, but only if—</chapeau><subclause class="fontsize10" id="yf5056aad-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>such State or local law enforcement agency is part of a team with the Federal agency in such investigation, and</content></subclause>
<subclause class="fontsize10" id="yf5056aae-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>such information is disclosed only to such officers and employees who are personally and directly engaged in such investigation.</content></subclause>
</clause>
<clause class="fontsize10" id="yf5056aaf-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on use of information</inline>.—</heading><content>Information disclosed under this subparagraph shall <page identifier="/us/stat/130/537">130 STAT. 537</page>
be solely for the use of such officers and employees in locating the missing child, in a grand jury proceeding, or in any preparation for, or investigation which may result in, a judicial or administrative proceeding.</content></clause>
<clause class="fontsize10" id="yf5056ab0-e861-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Missing child</inline>.—</heading><content>For purposes of this subparagraph, the term ‘<term>missing child</term>’ shall have the meaning given such term by section 403 of the Missing Children’s Assistance Act (<ref href="/us/usc/t42/s5772">42 U.S.C. 5772</ref>).</content></clause>
<clause class="fontsize10" id="yf5056ab1-e861-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5056ab2-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definition.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Exploited child</inline>.—</heading><content>For purposes of this subparagraph, the term ‘<term>exploited child</term>’ means a minor with respect to whom there is reason to believe that a specified offense against a minor (as defined by section 111(7) of the Sex Offender Registration and Notification Act (<ref href="/us/usc/t42/s16911/7">42 U.S.C. 16911(7)</ref>)) has or is occurring.”</content></clause>

<paragraph class="fontsize10" id="yf5056ab3-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Conforming amendments</inline>.—</heading><subparagraph class="fontsize10" id="yf5056ab4-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/b/2/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5056ab5-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t26/s6103">26 USC 6103</ref>.</p></sidenote><content>Section 6103(a)(2) of such Code <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>subsection (i)(7)(A)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>subsection (i)(1)(C) or (7)(A)</quotedText>”.</content></subparagraph>
<subparagraph class="fontsize10" id="yf5056ab6-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/b/2/B" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Section 6103(p)(4) of such Code <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>(i)(3)(B)(i)</quotedText>” in the matter preceding subparagraph (A) and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(i)(1)(C), (3)(B)(i),</quotedText>”.</content></subparagraph>
<subparagraph class="fontsize10" id="yf5056ab7-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/b/2/C" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Section 7213(a)(2) of such Code <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>(i)(3)(B)(i)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(i)(1)(C), (3)(B)(i),</quotedText>”.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yf5056ab8-e861-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/184/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf5056ab9-e861-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t26/s6103">26 USC 6103 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by this section shall apply to disclosures made after the date of the enactment of this Act.</content></subsection>
