<section id="d338406e89" identifier="/us/pl/114/165/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf8914940-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3201">25 USC 3201 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Native American Children’s Safety Act</shortTitle>”.</content></section>
<section id="d338406e104" identifier="/us/pl/114/165/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CRIMINAL RECORDS CHECKS.</heading><content class="firstIndent0 fontsize10" id="xf891be71-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 408 of the Indian Child Protection and Family Violence Prevention Act (<ref href="/us/usc/t25/s3207">25 U.S.C. 3207</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yf892cfe2-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">By Tribal Social Services Agency for Foster Care Placements in Tribal Court Proceedings</inline>.—</heading><paragraph class="fontsize10" id="yf892cfe3-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="yf892cfe4-e864-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Covered individual</inline>.—</heading><chapeau>The term ‘<term>covered individual</term>’ includes—</chapeau><clause class="fontsize10" id="yf892cfe5-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>any individual 18 years of age or older; and</content></clause>
<clause class="fontsize10" id="yf892cfe6-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any individual who the tribal social services agency determines is subject to a criminal records check under paragraph (2)(A).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892cfe7-e864-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Foster care placement</inline>.—</heading><chapeau>The term ‘<term>foster care placement</term>’ means any action removing an Indian child from a parent or Indian custodian for temporary placement in a foster home or institution or the home of a guardian or conservator if—</chapeau><clause class="fontsize10" id="yf892cfe8-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the parent or Indian custodian cannot have the child returned on demand; and</content></clause>
<clause class="fontsize10" id="yf892cfe9-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii)</num><subclause class="inline" id="yf892cfea-e864-11f0-bc57-ad3ac4b1618c"><num value="I">(I) </num><content>parental rights have not been terminated; or</content></subclause>
<subclause class="indentUp0 fontsize10" id="yf892cfeb-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>parental rights have been terminated but the child has not been permanently placed.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892cfec-e864-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Indian custodian</inline>.—</heading><chapeau>The term ‘<term>Indian custodian</term>’ means any Indian—</chapeau><clause class="fontsize10" id="yf892cfed-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>who has legal custody of an Indian child under tribal law or custom or under State law; or</content></clause>
<clause class="fontsize10" id="yf892f6fe-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to whom temporary physical care, custody, and control has been transferred by the parent of the child.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892f6ff-e864-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Parent</inline>.—</heading><chapeau>The term ‘<term>parent</term>’ means—</chapeau><clause class="fontsize10" id="yf892f700-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>any biological parent of an Indian child; or<page identifier="/us/stat/130/416">130 STAT. 416</page></content></clause>
<clause class="fontsize10" id="yf892f701-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any Indian who has lawfully adopted an Indian child, including adoptions under tribal law or custom.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892f702-e864-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Tribal court</inline>.—</heading><chapeau>The term ‘<term>tribal court</term>’ means a court—</chapeau><clause class="fontsize10" id="yf892f703-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>with jurisdiction over foster care placements; and</content></clause>
<clause class="fontsize10" id="yf892f704-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>that is—</chapeau><subclause class="fontsize10" id="yf892f705-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>a Court of Indian Offenses;</content></subclause>
<subclause class="fontsize10" id="yf892f706-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>a court established and operated under the code or custom of an Indian tribe; or</content></subclause>
<subclause class="fontsize10" id="yf892f707-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>any other administrative body of an Indian tribe that is vested with authority over foster care placements.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892f708-e864-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><heading class="fontsize10"><inline class="smallCaps">Tribal social services agency</inline>.—</heading><content>The term ‘<term>tribal social services agency</term>’ means the agency of an Indian tribe that has the primary responsibility for carrying out foster care licensing or approval (as of the date on which the proceeding described in paragraph (2)(A) commences) for the Indian tribe.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf892f709-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Criminal records check before foster care placement</inline>.—</heading><subparagraph class="fontsize10" id="yf892f70a-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (3), no foster care placement shall be finally approved and no foster care license shall be issued until the tribal social services agency—</chapeau><clause class="fontsize10" id="yf892f70b-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>completes a criminal records check of each covered individual who resides in the household or is employed at the institution in which the foster care placement will be made; and</content></clause>
<clause class="fontsize10" id="yf892f70c-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>concludes that each covered individual described in clause (i) meets such standards as the Indian tribe shall establish in accordance with subparagraph (B).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892f70d-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Standards of placement</inline>.—</heading><chapeau>The standards described in subparagraph (A)(ii) shall include—</chapeau><clause class="fontsize10" id="yf892f70e-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>requirements that each tribal social services agency described in subparagraph (A)—</chapeau><subclause class="fontsize10" id="yf892f70f-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>perform criminal records checks, including fingerprint-based checks of national crime information databases (as defined in <ref href="/us/usc/t28/s534/f/3">section 534(f)(3) of title 28, United States Code</ref>);</content></subclause>
<subclause class="fontsize10" id="yf892f710-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>check any abuse registries maintained by the Indian tribe; and</content></subclause>
<subclause class="fontsize10" id="yf892f711-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf892f712-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote>check any child abuse and neglect registry maintained by the State in which the covered individual resides for information on the covered individual, and request any other State in which the covered individual resided in the preceding 5 years, to enable the tribal social services agency to check any child abuse and neglect registry maintained by that State for such information; and</content></subclause>
</clause>
<clause class="fontsize10" id="yf892f713-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any other additional requirement that the Indian tribe determines is necessary and permissible within the existing authority of the Indian tribe, such as the creation of voluntary agreements with State <page identifier="/us/stat/130/417">130 STAT. 417</page>
entities in order to facilitate the sharing of information related to the performance of criminal records checks.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892f714-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Results</inline>.—</heading><content>Except as provided in paragraph (3), no foster care placement shall be ordered in any proceeding described in subparagraph (A) if an investigation described in clause (i) of that subparagraph reveals that a covered individual described in that clause has been found by a Federal, State, or tribal court to have committed any crime listed in clause (i) or (ii) of section 471(a)(20)(A) of the Social Security Act (<ref href="/us/usc/t42/s671/a/20/A">42 U.S.C. 671(a)(20)(A)</ref>).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf892f715-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Emergency placement</inline>.—</heading><content>Paragraph (2) shall not apply to an emergency foster care placement, as determined by a tribal social services agency.</content></paragraph>
<paragraph class="fontsize10" id="yf892f716-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Recertification of foster homes or institutions</inline>.—</heading><subparagraph class="fontsize10" id="yf892f717-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf892f718-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xf892f719-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote>In general.—</heading><content>Not later than 2 years after the date of enactment of this subsection, each Indian tribe shall establish procedures to recertify homes or institutions in which foster care placements are made.</content></subparagraph>
<subparagraph class="fontsize10" id="yf892f71a-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The procedures described in subparagraph (A) shall include, at a minimum, periodic intervals at which the home or institution shall be subject to recertification to ensure—</chapeau><clause class="fontsize10" id="yf892f71b-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the safety of the home or institution for the Indian child; and</content></clause>
<clause class="fontsize10" id="yf892f71c-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>that each covered individual who resides in the home or is employed at the institution is subject to a criminal records check in accordance with this subsection, including any covered individual who—</chapeau><subclause class="fontsize10" id="yf892f71d-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>resides in the home or is employed at the institution on the date on which the procedures established under subparagraph (A) commences; and</content></subclause>
<subclause class="fontsize10" id="yf892f71e-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>did not reside in the home or was not employed at the institution on the date on which the investigation described in paragraph (2)(A)(i) was completed.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892f71f-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Guidance issued by the secretary</inline>.—</heading><content>The procedures established under subparagraph (A) shall be subject to any regulation or guidance issued by the Secretary that is in accordance with the purpose of this subsection.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yf892f720-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.—</heading><chapeau>Not <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xf892f721-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xf892f722-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote>later than 2 years after the date of enactment of this subsection and after consultation with Indian tribes, the Secretary shall issue guidance regarding—</chapeau><subparagraph class="fontsize10" id="yf892f723-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>procedures for a criminal records check of any covered individual who—</chapeau><clause class="fontsize10" id="yf892f724-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>resides in the home or is employed at the institution in which the foster care placement is made after the date on which the investigation described in paragraph (2)(A)(i) is completed; and</content></clause>
<clause class="fontsize10" id="yf892f725-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>was not the subject of an investigation described in paragraph (2)(A)(i) before the foster care placement was made;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yf892f726-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>self-reporting requirements for foster care homes or institutions in which any covered individual described in subparagraph (A) resides if the head of the household or the operator of the institution has knowledge that the covered individual—<page identifier="/us/stat/130/418">130 STAT. 418</page></chapeau><clause class="fontsize10" id="yf892f727-e864-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>has been found by a Federal, State, or tribal court to have committed any crime listed in clause (i) or (ii) of section 471(a)(20)(A) of the Social Security Act (<ref href="/us/usc/t42/s671/a/20/A">42 U.S.C. 671(a)(20)(A)</ref>); or</content></clause>
