<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d242962e85" identifier="/us/pl/114/158/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>INURNMENT OF CREMATED REMAINS IN ARLINGTON NATIONAL CEMETERY OF CERTAIN PERSONS WHOSE SERVICE IS DEEMED TO BE ACTIVE SERVICE.</heading><subsection class="firstIndent0 fontsize10" id="y242be54e-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s1/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t38/s2410">Section 2410 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y242be54f-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline" id="y242be550-e866-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>The Secretary of the Army shall ensure that, under such regulations as the Secretary may prescribe, the cremated remains of any person described in paragraph (2) are eligible for above ground inurnment in Arlington National Cemetery with military honors in accordance with section 1491 of title 10.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y242be551-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>A person described in this paragraph is a person whose service has been determined to be active duty service pursuant to section 401 of the GI Bill Improvement Act of 1977 (<ref href="/us/pl/95/202">Public Law 95–202</ref>; <ref href="/us/usc/t38/s106">38 U.S.C. 106 note</ref>) as of the date of the enactment of this paragraph.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y242c0c62-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x242c0c63-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s2410">38 USC 2410 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><paragraph class="fontsize10" id="y242c0c64-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s1/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The amendment made by subsection (a) shall apply with respect to—</chapeau><subparagraph class="fontsize10" id="y242c0c65-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s1/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the remains of a person that are not formally interred or inurned as of the date of the enactment of this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y242c0c66-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s1/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a person who dies on or after the date of the enactment of this Act.</content></subparagraph>

<paragraph class="fontsize10" id="y242c0c67-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s1/b/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Formally interred or inurned defined</inline>.—</heading><content>In this subsection, the term “<term>formally interred or inurned</term>” means interred or inurned in a cemetery, crypt, mausoleum, columbarium, niche, or other similar formal location.</content></paragraph>

<section id="d242962e172" identifier="/us/pl/114/158/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REPORT ON CAPACITY OF ARLINGTON NATIONAL CEMETERY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x242c3378-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not later than 180 days after the date of the enactment of this Act, the Secretary of the Army shall submit to the Committees on Veterans’ Affairs and the Committees on Armed Services of the House of Representatives and the Senate a report on the interment and inurnment capacity of Arlington National Cemetery, including—</chapeau><paragraph class="fontsize10" id="y242c3379-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x242c337a-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Estimate.</p><p class="leftAlign firstIndent0 fontsize8" id="x242c337b-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the estimated date that the Secretary determines the cemetery will reach maximum interment and inurnment capacity; and<page identifier="/us/stat/130/395">130 STAT. 395</page></content></paragraph>
<paragraph class="fontsize10" id="y242c337c-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x242c337d-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x242c337e-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><chapeau>in light of the unique and iconic meaning of the cemetery to the United States, recommendations for legislative actions and nonlegislative options that the Secretary determines necessary to ensure that the maximum interment and inurnment capacity of the cemetery is not reached until well into the future, including such actions and options with respect to—</chapeau><subparagraph class="fontsize10" id="y242c337f-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>redefining eligibility criteria for interment and inurnment in the cemetery; and</content></subparagraph>
<subparagraph class="fontsize10" id="y242c3380-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/158/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>considerations for additional expansion opportunities beyond the current boundaries of the cemetery.</content></subparagraph>
