<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6eec8dcc-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Fallen Heroes Flag Act of 2016.</p></sidenote>
<section id="d243190e88" identifier="/us/pl/114/156/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6eec8dcd-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1801">2 USC 1801 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Fallen Heroes Flag Act of 2016</shortTitle>”.</content></section>
<section id="d243190e103" identifier="/us/pl/114/156/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6eecdbee-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act—</chapeau><paragraph class="fontsize10" id="y6eecdbef-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>Capitol-flown flag</term>” means a flag of the United States flown over the Capitol in honor of the deceased individual for whom the flag is requested;</content></paragraph>
<paragraph class="fontsize10" id="y6eecdbf0-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the terms “chaplain”, “firefighter”, “law enforcement officer”, “member of a rescue squad or ambulance crew”, and “public agency” have the meanings given such terms in section 1204 of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t42/s3796b">42 U.S.C. 3796b</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y6eecdbf1-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>the term “<term>immediate family member</term>”, with respect to an individual, means—</chapeau><subparagraph class="fontsize10" id="y6eecdbf2-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the spouse, parent, brother, sister, or child of the individual or a person to whom the individual stands in loco parentis; or</content></subparagraph>
<subparagraph class="fontsize10" id="y6eecdbf3-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any other person related to the individual by blood or marriage;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6eecdbf4-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the term “<term>public safety officer</term>” means an individual serving a public agency in an official capacity, with or without compensation, as a law enforcement officer, as a firefighter, or as a chaplain; and</content></paragraph>
<paragraph class="fontsize10" id="y6eecdbf5-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the term “<term>Representative</term>” includes a Delegate or Resident Commissioner to the Congress.</content></paragraph>

<section id="d243190e150" identifier="/us/pl/114/156/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6eecdbf6-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1881a">2 USC 1881a</ref>.</p></sidenote><heading>PROVIDING CAPITOL-FLOWN FLAGS FOR FAMILIES OF FALLEN HEROES.</heading><subsection class="firstIndent0 fontsize10" id="y6eed0307-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>At the request of an immediate family member of a firefighter, law enforcement officer, member of a rescue squad or ambulance crew, or public safety officer who died in the line of duty, the Representative or Senator of the family may provide to the family a Capitol-flown flag, together with the certificate described in subsection (c).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6eed0308-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">No Cost to Family</inline>.—</heading><content>A Capitol-flown flag provided under this section shall be provided at no cost to the family.<page identifier="/us/stat/130/392">130 STAT. 392</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6eed0309-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Certificate</inline>.—</heading><content>The certificate described in this subsection is a certificate which is signed by the Speaker of the House of Representatives and the Representative, or the President pro tempore of the Senate and the Senator, providing the Capitol-flown flag, as applicable, and which contains an expression of sympathy for the family involved from the House of Representatives or the Senate, as applicable.</content></subsection>

<section id="d243190e191" identifier="/us/pl/114/156/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6eed030a-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1881b">2 USC 1881b</ref>.</p></sidenote><heading>REGULATIONS AND PROCEDURES.</heading><subsection class="firstIndent0 fontsize10" id="y6eed2a1b-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6eed2a1c-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 30 days after the date of enactment of this Act, the Architect of the Capitol shall issue regulations for carrying out this Act, including regulations to establish procedures (including any appropriate forms, guidelines, and accompanying certificates) for requesting a Capitol-flown flag.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6eed2a1d-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/156/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Review</inline>.—</heading><content>The regulations issued under subsection (a) shall take effect upon approval by the Committee on House Administration of the House of Representatives and the Committee on Rules and Administration of the Senate.</content></subsection>

<section id="d243190e222" identifier="/us/pl/114/156/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6eed2a1e-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1881c">2 USC 1881c</ref>.</p></sidenote><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><content style="-uslm-lc:I658120">  There are authorized to be appropriated for each of fiscal years 2017 through 2022 such sums as may be necessary to carry out this Act, to be derived from amounts appropriated in each such fiscal year for the operation of the Architect of the Capitol, except that the aggregate amount appropriated to carry out this Act for all such fiscal years may not exceed $40,000.</content></section>
<section id="d243190e234" identifier="/us/pl/114/156/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6eed2a1f-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1881d">2 USC 1881d</ref>.</p></sidenote><heading>EFFECTIVE DATE.</heading><content style="-uslm-lc:I658120">  This Act shall take effect on the date of enactment of this Act, except that a Capitol-flown flag may not be provided under section 3 until the regulations issued under section 4(a) take effect in accordance with section 4(b).</content></section>
