<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb93dd2c3-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Transnational Drug Trafficking Act of 2015.</p><p class="leftAlign firstIndent0 fontsize8" id="xb93dd2c4-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote>
<section id="d243437e92" identifier="/us/pl/114/154/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Transnational Drug Trafficking Act of 2015</shortTitle>”.</content></section>
<section id="d243437e102" identifier="/us/pl/114/154/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>POSSESSION, MANUFACTURE OR DISTRIBUTION FOR PURPOSES OF UNLAWFUL IMPORTATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb93df9d5-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 1009 of the Controlled Substances Import and Export Act (<ref href="/us/usc/t21/s959">21 U.S.C. 959</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yb93df9d6-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/154/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (b) and (c) as subsections (c) and (d), respectively; and</content></paragraph>
<paragraph class="fontsize10" id="yb93df9d7-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/154/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>It shall</quotedText>” and all that follows and <amendingAction type="insert">inserting</amendingAction> the following: <quotedContent>“It shall be unlawful for any person to manufacture or distribute a controlled substance in schedule I or II or flunitrazepam or a listed chemical intending, knowing, or having reasonable cause to believe that such substance or chemical will be unlawfully imported into the United States or into waters within a distance of 12 miles of the coast of the United States.<subsection class="indentDown1 firstIndent0 fontsize10" id="yb93e20e8-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><chapeau>It shall be unlawful for any person to manufacture or distribute a listed chemical—</chapeau><paragraph class="fontsize10" id="yb93e20e9-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>intending or knowing that the listed chemical will be used to manufacture a controlled substance; and</content></paragraph>
<paragraph class="fontsize10" id="yb93e20ea-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>intending, knowing, or having reasonable cause to believe that the controlled substance will be unlawfully imported into the United States.”</content></paragraph>

<section id="d243437e154" identifier="/us/pl/114/154/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>TRAFFICKING IN COUNTERFEIT GOODS OR SERVICES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb93e47fb-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t18/ch113">Chapter 113 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yb93e47fc-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/154/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in section 2318(b)(2), by <amendingAction type="delete">striking</amendingAction> “<quotedText>section 2320(e)</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>section 2320(f)</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yb93e47fd-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/154/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in section 2320—</chapeau><subparagraph class="fontsize10" id="yb93e47fe-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/154/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> paragraph (4) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="yb93e6f0f-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>traffics in a drug and knowingly uses a counterfeit mark on or in connection with such drug,”</content></paragraph>

<subparagraph class="fontsize10" id="yb93e6f10-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/154/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subsection (b)(3), in the matter preceding subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>counterfeit drug</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>drug that uses a counterfeit mark on or in connection with the drug</quotedText>”; and<page identifier="/us/stat/130/388">130 STAT. 388</page></content></subparagraph>
<subparagraph class="fontsize10" id="yb93e6f11-e866-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/154/s3/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in subsection (f), by <amendingAction type="delete">striking</amendingAction> paragraph (6) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="yb93e6f12-e866-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb93e6f13-e866-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><content>the term ‘<term>drug</term>’ means a drug, as defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s321">21 U.S.C. 321</ref>).”</content></paragraph>
