<section id="d243674e98" identifier="/us/pl/114/150/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Department of Homeland Security Headquarters Consolidation Accountability Act of 2015</shortTitle>”.</content></section>
<section id="d243674e108" identifier="/us/pl/114/150/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>INFORMATION ON DEPARTMENT OF HOMELAND SECURITY HEADQUARTERS CONSOLIDATION PROJECT.</heading><subsection class="firstIndent0 fontsize10" id="y48a39149-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x48a3914a-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x48a3914b-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p><p class="leftAlign firstIndent0 fontsize8" id="x48a3914c-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Plans.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 120 days after the date of enactment of this Act, the Secretary, in coordination with the Administrator, shall submit to the appropriate committees of Congress information on the implementation of the enhanced plan for the Department headquarters consolidation project within the National Capital Region, approved by the Office of Management and Budget and included in the budget of the President for fiscal year 2016 (as submitted to Congress under <ref href="/us/usc/t31/s1105/a">section 1105(a) of title 31, United States Code</ref>), that includes the following:</chapeau><paragraph class="fontsize10" id="y48a3914d-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>A proposed occupancy plan for the consolidation project that includes specific information about which Department-wide operations, component operations, and support offices will be located at the site, the aggregate number of full time equivalent employees projected to occupy the site, the seat-to-staff ratio at the site, and schedule estimates for migrating operations to the site.</content></paragraph>
<paragraph class="fontsize10" id="y48a3914e-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x48a3914f-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>A comprehensive assessment of the difference between the current real property and facilities needed by the Department in the National Capital Region in order to carry out the mission of the Department and the future needs of the Department.</content></paragraph>
<paragraph class="fontsize10" id="y48a39150-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>A current plan for construction of the headquarters consolidation at the St. Elizabeths campus that includes—</chapeau><subparagraph class="fontsize10" id="y48a39151-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x48a39152-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Cost estimates.</p></sidenote><content>the estimated costs and schedule for the current plan, which shall conform to relevant Federal guidance for cost and schedule estimates, consistent with the recommendation of the Government Accountability Office in the September 2014 report entitled “Federal Real Property: DHS and GSA Need to Strengthen the Management of DHS Headquarters Consolidation” (GAO–14–648); and<page identifier="/us/stat/130/367">130 STAT. 367</page></content></subparagraph>
<subparagraph class="fontsize10" id="y48a39153-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any estimated cost savings associated with reducing the scope of the consolidation project and increasing the use of existing capacity developed under the project.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y48a39154-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>A current plan for the leased portfolio of the Department in the National Capital Region that includes—</chapeau><subparagraph class="fontsize10" id="y48a39155-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an end-state vision that identifies which Department-wide operations, component operations, and support offices do not migrate to the St. Elizabeths campus and continue to operate at a property in the leased portfolio;</content></subparagraph>
<subparagraph class="fontsize10" id="y48a39156-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>for each year until the consolidation project is completed, the number of full-time equivalent employees who are expected to operate at each property, component, or office;</content></subparagraph>
<subparagraph class="fontsize10" id="y48a39157-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the anticipated total rentable square feet leased per year during the period beginning on the date of enactment of this Act and ending on the date on which the consolidation project is completed; and</content></subparagraph>
<subparagraph class="fontsize10" id="y48a39158-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/4/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>timing and anticipated lease terms for leased space under the plan referred to in paragraph (3).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y48a39159-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x48a3915a-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote><chapeau>An analysis that identifies the costs and benefits of leasing and construction alternatives for the remainder of the consolidation project that includes—</chapeau><subparagraph class="fontsize10" id="y48a3915b-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a comparison of the long-term cost that would result from leasing as compared to consolidating functions on Government-owned space; and</content></subparagraph>
<subparagraph class="fontsize10" id="y48a3915c-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the identification of any cost impacts in terms of premiums for short-term lease extensions or holdovers due to the uncertainty of funding for, or delays in, completing construction required for the consolidation.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y48a3915d-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Comptroller General Review</inline>.—</heading><paragraph class="fontsize10" id="y48a3915e-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Review required</inline>.—</heading><content>The Comptroller General of the United States shall review the cost and schedule estimates submitted under subsection (a) to evaluate the quality and reliability of the estimates.</content></paragraph>
<paragraph class="fontsize10" id="y48a3915f-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x48a39160-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x48a39161-e867-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Assessment</inline>.—</heading><content>Not later than 90 days after the submittal of the cost and schedule estimates under subsection (a), the Comptroller General shall report to the appropriate committees of Congress on the results of the review required under paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y48a39162-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this Act:</chapeau><paragraph class="fontsize10" id="y48a39163-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/c/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The term “<term>Administrator</term>” means the Administrator of General Services.</content></paragraph>
<paragraph class="fontsize10" id="y48a39164-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/c/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The term “<term>appropriate committees of Congress</term>” means the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</content></paragraph>
<paragraph class="fontsize10" id="y48a39165-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/c/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The term “<term>Department</term>” means the Department of Homeland Security.</content></paragraph>
<paragraph class="fontsize10" id="y48a39166-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/c/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The term “<term>National Capital Region</term>” has the meaning given the term under <ref href="/us/usc/t10/s2674/f/2">section 2674(f)(2) of title 10, United States Code</ref>.<page identifier="/us/stat/130/368">130 STAT. 368</page></content></paragraph>
<paragraph class="fontsize10" id="y48a39167-e867-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/150/s2/c/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>The term “<term>Secretary</term>” means the Secretary of Homeland Security.</content></paragraph>
