<section id="d244258e92" identifier="/us/pl/114/143/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Integrated Public Alert and Warning System Modernization Act of 2015</shortTitle>”.</content></section>
<section id="d244258e102" identifier="/us/pl/114/143/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>INTEGRATED PUBLIC ALERT AND WARNING SYSTEM MODERNIZATION.</heading><subsection class="firstIndent0 fontsize10" id="y6df7e2c8-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Title V of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s311/etseq">6 U.S.C. 311 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y6df8a619-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="526">“SEC. 526. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8a61a-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Disasters.</p><p class="leftAlign firstIndent0 fontsize8" id="x6df8a61b-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Terrorism.</p><p class="leftAlign firstIndent0 fontsize8" id="x6df8a61c-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s3210">6 USC 3210</ref>.</p></sidenote><heading class="fontsize12">INTEGRATED PUBLIC ALERT AND WARNING SYSTEM MODERNIZATION.</heading><subsection class="firstIndent0 fontsize10" id="y6df8a61d-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>To provide timely and effective warnings regarding natural disasters, acts of terrorism, and other man-made disasters or threats to public safety, the Administrator shall—</chapeau><paragraph class="fontsize10" id="y6df8a61e-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>modernize the integrated public alert and warning system of the United States (in this section referred to as the ‘public alert and warning system’) to help ensure that under all conditions the President and, except to the extent the public alert and warning system is in use by the President, Federal agencies and State, tribal, and local governments can alert and warn the civilian population in areas endangered by natural disasters, acts of terrorism, and other man-made disasters or threats to public safety; and</content></paragraph>
<paragraph class="fontsize10" id="y6df8a61f-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>implement the public alert and warning system to disseminate timely and effective warnings regarding natural disasters, acts of terrorism, and other man-made disasters or threats to public safety.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6df8a620-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Implementation Requirements</inline>.—</heading><chapeau>In carrying out subsection (a), the Administrator shall—</chapeau><paragraph class="fontsize10" id="y6df8a621-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>establish or adopt, as appropriate, common alerting and warning protocols, standards, terminology, and operating procedures for the public alert and warning system;</content></paragraph>
<paragraph class="fontsize10" id="y6df8a622-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>include in the public alert and warning system the capability to adapt the distribution and content of communications on the basis of geographic location, risks, and multiple communication systems and technologies, as appropriate and to the extent technically feasible;<page identifier="/us/stat/130/328">130 STAT. 328</page></content></paragraph>
<paragraph class="fontsize10" id="y6df8a623-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>include in the public alert and warning system the capability to alert, warn, and provide equivalent information to individuals with disabilities, individuals with access and functional needs, and individuals with limited-English proficiency, to the extent technically feasible;</content></paragraph>
<paragraph class="fontsize10" id="y6df8a624-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>ensure that training, tests, and exercises are conducted for the public alert and warning system, including by—</chapeau><subparagraph class="fontsize10" id="y6df8a625-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>incorporating the public alert and warning system into other training and exercise programs of the Department, as appropriate;</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8a626-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>establishing and integrating into the National Incident Management System a comprehensive and periodic training program to instruct and educate Federal, State, tribal, and local government officials in the use of the Common Alerting Protocol enabled Emergency Alert System; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8a627-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8a628-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>conducting, not less than once every 3 years, periodic nationwide tests of the public alert and warning system;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6df8a629-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>to the extent practicable, ensure that the public alert and warning system is resilient and secure and can withstand acts of terrorism and other external attacks;</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd3a-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>conduct public education efforts so that State, tribal, and local governments, private entities, and the people of the United States reasonably understand the functions of the public alert and warning system and how to access, use, and respond to information from the public alert and warning system through a general market awareness campaign;</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd3b-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd3c-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd3d-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>consult, coordinate, and cooperate with the appropriate private sector entities and Federal, State, tribal, and local governmental authorities, including the Regional Administrators and emergency response providers;</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd3e-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd3f-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd40-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><content>consult and coordinate with the Federal Communications Commission, taking into account rules and regulations promulgated by the Federal Communications Commission; and</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd41-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><content>coordinate with and consider the recommendations of the Integrated Public Alert and Warning System Subcommittee established under section 2(b) of the Integrated Public Alert and Warning System Modernization Act of 2015.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6df8cd42-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">System Requirements</inline>.—</heading><chapeau>The public alert and warning system shall—</chapeau><paragraph class="fontsize10" id="y6df8cd43-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>to the extent determined appropriate by the Administrator, incorporate multiple communications technologies;</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd44-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>be designed to adapt to, and incorporate, future technologies for communicating directly with the public;</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd45-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><chapeau>to the extent technically feasible, be designed—</chapeau><subparagraph class="fontsize10" id="y6df8cd46-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to provide alerts to the largest portion of the affected population feasible, including nonresident visitors and tourists, individuals with disabilities, individuals with access and functional needs, and individuals with limited-English proficiency; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8cd47-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>to improve the ability of remote areas to receive alerts;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6df8cd48-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>promote local and regional public and private partnerships to enhance community preparedness and response;</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd49-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>provide redundant alert mechanisms where practicable so as to reach the greatest number of people; and<page identifier="/us/stat/130/329">130 STAT. 329</page></content></paragraph>
<paragraph class="fontsize10" id="y6df8cd4a-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>to the extent feasible, include a mechanism to ensure the protection of individual privacy.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6df8cd4b-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Use of System</inline>.—</heading><content>Except to the extent necessary for testing the public alert and warning system, the public alert and warning system shall not be used to transmit a message that does not relate to a natural disaster, act of terrorism, or other man-made disaster or threat to public safety.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6df8cd4c-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Performance Reports</inline>.—</heading><paragraph class="fontsize10" id="y6df8cd4d-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd4e-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd4f-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of the Integrated Public Alert and Warning System Modernization Act of 2015, and annually thereafter through 2018, the Administrator shall make available on the public website of the Agency a performance report, which shall—</chapeau><subparagraph class="fontsize10" id="y6df8cd50-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>establish performance goals for the implementation of the public alert and warning system by the Agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8cd51-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>describe the performance of the public alert and warning system, including—</chapeau><clause class="fontsize10" id="y6df8cd52-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the type of technology used for alerts and warnings issued under the system;</content></clause>
<clause class="fontsize10" id="y6df8cd53-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the measures taken to alert, warn, and provide equivalent information to individuals with disabilities, individuals with access and function needs, and individuals with limited-English proficiency; and</content></clause>
<clause class="fontsize10" id="y6df8cd54-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the training, tests, and exercises performed and the outcomes obtained by the Agency;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y6df8cd55-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>identify significant challenges to the effective operation of the public alert and warning system and any plans to address these challenges;</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8cd56-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>identify other necessary improvements to the system; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8cd57-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd58-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote><content>provide an analysis comparing the performance of the public alert and warning system with the performance goals established under subparagraph (A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6df8cd59-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Congress</inline>.—</heading><content>The Administrator shall submit to the Committee on Homeland Security and Governmental Affairs and the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure and the Committee on Homeland Security of the House of Representatives each report required under paragraph (1).”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y6df8cd5a-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Integrated Public Alert and Warning System Subcommittee</inline>.—</heading><paragraph class="fontsize10" id="y6df8cd5b-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd5c-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Emergency Management Agency (in this subsection referred to as the “Administrator”) shall establish a subcommittee to the National Advisory Council established under section 508 of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s318">6 U.S.C. 318</ref>) to be known as the Integrated Public Alert and Warning System Subcommittee (in this subsection referred to as the “Subcommittee”).</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd5d-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>Notwithstanding section 508(c) of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s318/c">6 U.S.C. 318(c)</ref>), the Subcommittee shall be composed of the following members (or their designees):</chapeau><page identifier="/us/stat/130/330">130 STAT. 330</page>
<subparagraph class="fontsize10" id="y6df8cd5e-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The Deputy Administrator for Protection and National Preparedness of the Federal Emergency Management Agency.</content></subparagraph>

<subclause class="fontsize10" id="y6df8cd72-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/2/I/iii/IX" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IX">(IX) </num><content>consumer or privacy advocates; and</content></subclause>
<subclause class="fontsize10" id="y6df8cd73-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/2/I/iii/X" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="X">(X) </num><content>organizations representing individuals with limited-English proficiency.</content></subclause>

<clause class="fontsize10" id="y6df8cd74-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/2/I/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>Qualified representatives of such other stakeholders and interested and affected parties as the Administrator considers appropriate.</content></clause>

<paragraph class="fontsize10" id="y6df8cd7a-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Consultation with nonmembers</inline>.—</heading><chapeau>The Subcommittee and the program offices for the integrated public alert and warning system for the United States shall consult with individuals and entities that are not represented on the Subcommittee to consider new and developing technologies that may be beneficial to the public alert and warning system, including—</chapeau><subparagraph class="fontsize10" id="y6df8cd7b-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Defense Advanced Research Projects Agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8cd7c-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>entities engaged in federally funded research; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8cd7d-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>academic institutions engaged in relevant work and research.</content></subparagraph>

<paragraph class="fontsize10" id="y6df8cd7e-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Recommendations</inline>.—</heading><chapeau>The Subcommittee shall—</chapeau><subparagraph class="fontsize10" id="y6df8cd7f-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>develop recommendations for an integrated public alert and warning system; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8cd80-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in developing the recommendations under subparagraph (A), consider—</chapeau><clause class="fontsize10" id="y6df8cd81-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>recommendations for common alerting and warning protocols, standards, terminology, and operating procedures for the public alert and warning system; and</content></clause>
<clause class="fontsize10" id="y6df8cd82-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>recommendations to provide for a public alert and warning system that—</chapeau><subclause class="fontsize10" id="y6df8cd83-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>has the capability to adapt the distribution and content of communications on the basis of geographic location, risks, or personal user preferences, as appropriate;</content></subclause>
<subclause class="fontsize10" id="y6df8cd84-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>has the capability to alert and warn individuals with disabilities and individuals with limited-English proficiency;</content></subclause>
<subclause class="fontsize10" id="y6df8cd85-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>to the extent appropriate, incorporates multiple communications technologies;</content></subclause>
<subclause class="fontsize10" id="y6df8cd86-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>is designed to adapt to, and incorporate, future technologies for communicating directly with the public;</content></subclause>
<subclause class="fontsize10" id="y6df8cd87-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><content>is designed to provide alerts to the largest portion of the affected population feasible, including nonresident visitors and tourists, and improve the ability of remote areas to receive alerts;</content></subclause>
<subclause class="fontsize10" id="y6df8cd88-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii/VI" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">(VI) </num><content>promotes local and regional public and private partnerships to enhance community preparedness and response; and</content></subclause>
<subclause class="fontsize10" id="y6df8cd89-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/6/B/ii/VII" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VII">(VII) </num><content>provides redundant alert mechanisms, if practicable, to reach the greatest number of people regardless of whether they have access to, or use, any specific medium of communication or any particular device.</content></subclause>

<paragraph class="fontsize10" id="y6df8cd8a-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><subparagraph class="fontsize10" id="y6df8cd8b-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/b/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd8c-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd8d-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Subcommittee submission</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act, the Subcommittee shall submit to the National Advisory Council a report containing any recommendations required to be developed <page identifier="/us/stat/130/332">130 STAT. 332</page>

<subsection class="firstIndent0 fontsize10" id="y6df8cd94-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>There are authorized to be appropriated to carry out this Act and the amendments made by this Act such sums as may be necessary for each of fiscal years 2016, 2017, and 2018.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6df8cd95-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6df8cd96-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s3210">6 USC 3210 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Limitations on Statutory Construction</inline>.—</heading><paragraph class="fontsize10" id="y6df8cd97-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><content>In this subsection, the term “<term>participating commercial mobile service provider</term>” has the meaning given that term under <ref href="/us/cfr/t47/s10.10/f">section 10.10(f) of title 47, Code of Federal Regulations</ref>, as in effect on the date of enactment of this Act.</content></paragraph>
<paragraph class="fontsize10" id="y6df8cd98-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><chapeau>Nothing in this Act, including an amendment made by this Act, shall be construed—</chapeau><subparagraph class="fontsize10" id="y6df8cd99-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>to affect any authority—</chapeau><clause class="fontsize10" id="y6df8cd9a-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>of the Department of Commerce;</content></clause>
<clause class="fontsize10" id="y6df8cd9b-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>of the Federal Communications Commission; or</content></clause>

Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121/etseq">42 U.S.C. 5121 et seq.</ref>);</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y6df8cd9d-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to provide the Secretary of Homeland Security with authority to require any action by the Department of Commerce, the Federal Communications Commission, or any nongovernmental entity;</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8f3ae-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to apply to, or to provide the Administrator of the Federal Emergency Management Agency with authority over, any participating commercial mobile service provider;</content></subparagraph>
<subparagraph class="fontsize10" id="y6df8f3af-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>to alter in any way the wireless emergency alerts service established under the Warning, Alert, and Response Network Act (<ref href="/us/usc/t47/s1201/etseq">47 U.S.C. 1201 et seq.</ref>) or any related orders issued by the Federal Communications Commission after October 13, 2006; or<page identifier="/us/stat/130/333">130 STAT. 333</page></content></subparagraph>
<subparagraph class="fontsize10" id="y6df8f3b0-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/143/s2/d/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>to provide the Federal Emergency Management Agency with authority to require a State or local jurisdiction to use the integrated public alert and warning system of the United States.</content></subparagraph>
