<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3893c2e-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evidence-Based Policymaking Commission Act of 2016.</p></sidenote>
<section id="d244521e88" identifier="/us/pl/114/140/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Evidence-Based Policymaking Commission Act of 2016</shortTitle>”.</content></section>
<section id="d244521e98" identifier="/us/pl/114/140/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ESTABLISHMENT.</heading><content style="-uslm-lc:I658120">  There is established in the executive branch a commission to be known as the “Commission on Evidence-Based Policymaking” (in this Act referred to as the “Commission”).</content></section>
<section id="d244521e105" identifier="/us/pl/114/140/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>MEMBERS OF THE COMMISSION.</heading><subsection class="firstIndent0 fontsize10" id="ye389ff7f-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Number and Appointment</inline>.—</heading><chapeau>The Commission shall be comprised of 15 members as follows:</chapeau><paragraph class="fontsize10" id="ye389ff80-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe389ff81-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><chapeau>Three shall be appointed by the President, of whom—</chapeau><subparagraph class="fontsize10" id="ye389ff82-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>one shall be an academic researcher, data expert, or have experience in administering programs;</content></subparagraph>
<subparagraph class="fontsize10" id="ye389ff83-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>one shall be an expert in protecting personally-identifiable information and data minimization; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye389ff84-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>one shall be the Director of the Office of Management and Budget (or the Director’s designee).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye389ff85-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>Three shall be appointed by the Speaker of the House of Representatives, of whom—</chapeau><subparagraph class="fontsize10" id="ye389ff86-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>two shall be academic researchers, data experts, or have experience in administering programs; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye389ff87-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>one shall be an expert in protecting personally-identifiable information and data minimization.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye389ff88-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>Three shall be appointed by the Minority Leader of the House of Representatives, of whom—</chapeau><subparagraph class="fontsize10" id="ye389ff89-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>two shall be academic researchers, data experts, or have experience in administering programs; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye389ff8a-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>one shall be an expert in protecting personally-identifiable information and data minimization.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye389ff8b-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>Three shall be appointed by the Majority Leader of the Senate, of whom—</chapeau><subparagraph class="fontsize10" id="ye389ff8c-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>two shall be academic researchers, data experts, or have experience in administering programs; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye389ff8d-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>one shall be an expert in protecting personally-identifiable information and data minimization.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye389ff8e-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>Three shall be appointed by the Minority Leader of the Senate, of whom—<page identifier="/us/stat/130/318">130 STAT. 318</page></chapeau><subparagraph class="fontsize10" id="ye389ff8f-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>two shall be academic researchers, data experts, or have experience in administering programs; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye389ff90-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>one shall be an expert in protecting personally-identifiable information and data minimization.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye389ff91-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Expertise</inline>.—</heading><content>In making appointments under this section, consideration should be given to individuals with expertise in economics, statistics, program evaluation, data security, confidentiality, or database management.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye389ff92-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe389ff93-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Chairperson and Co-Chairperson</inline>.—</heading><content>The President shall select the chairperson of the Commission and the Speaker of the House of Representatives shall select the co-chairperson.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye389ff94-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe389ff95-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Timing of Appointments</inline>.—</heading><content>Appointments to the Commission shall be made not later than 45 days after the date of enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye389ff96-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Terms; Vacancies</inline>.—</heading><content>Each member shall be appointed for the duration of the Commission. Any vacancy in the Commission shall not affect its powers, and shall be filled in the manner in which the original appointment was made.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye389ff97-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Compensation</inline>.—</heading><content>Members of the Commission shall serve without pay.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye389ff98-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s3/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Travel Expenses</inline>.—</heading><content>Each member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under <ref href="/us/usc/t5/ch57/schI">subchapter I of chapter 57 of title 5, United States Code</ref>, while away from their homes or regular places of business in the performance of services for the Commission.</content></subsection>
</section>
<section id="d244521e272" identifier="/us/pl/114/140/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DUTIES OF THE COMMISSION.</heading><subsection class="firstIndent0 fontsize10" id="ye38ae9f9-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe38ae9fa-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xe38ae9fb-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Study of Data</inline>.—</heading><chapeau>The Commission shall conduct a comprehensive study of the data inventory, data infrastructure, database security, and statistical protocols related to Federal policymaking and the agencies responsible for maintaining that data to—</chapeau><paragraph class="fontsize10" id="ye38ae9fc-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>determine the optimal arrangement for which administrative data on Federal programs and tax expenditures, survey data, and related statistical data series may be integrated and made available to facilitate program evaluation, continuous improvement, policy-relevant research, and cost-benefit analyses by qualified researchers and institutions while weighing how integration might lead to the intentional or unintentional access, breach, or release of personally-identifiable information or records;</content></paragraph>
<paragraph class="fontsize10" id="ye38ae9fd-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>make recommendations on how data infrastructure, database security, and statistical protocols should be modified to best fulfill the objectives identified in paragraph (1); and</content></paragraph>
<paragraph class="fontsize10" id="ye38ae9fe-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>make recommendations on how best to incorporate outcomes measurement, institutionalize randomized controlled trials, and rigorous impact analysis into program design.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye38ae9ff-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Clearinghouse</inline>.—</heading><chapeau>In undertaking the study required by subsection (a), the Commission shall—</chapeau><paragraph class="fontsize10" id="ye38aea00-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>consider whether a clearinghouse for program and survey data should be established and how to create such a clearinghouse; and</content></paragraph>
<paragraph class="fontsize10" id="ye38aea01-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe38aea02-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><chapeau>evaluate—</chapeau><subparagraph class="fontsize10" id="ye38aea03-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>what administrative data and survey data are relevant for program evaluation and Federal policy-making and should be included in a potential clearinghouse;<page identifier="/us/stat/130/319">130 STAT. 319</page></content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea04-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>which survey data the administrative data identified in subparagraph (A) may be linked to, in addition to linkages across administrative data series, including the effect such linkages may have on the security of those data;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea05-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>what are the legal and administrative barriers to including or linking these data series;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea06-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>what data-sharing infrastructure should be used to facilitate data merging and access for research purposes;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea07-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>how a clearinghouse could be self-funded;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea08-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>which types of researchers, officials, and institutions should have access to data and what the qualifications of the researchers, officials, and institutions should be;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea09-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>what limitations should be placed on the use of data provided;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea0a-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>how to protect information and ensure individual privacy and confidentiality;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea0b-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>how data and results of research can be used to inform program administrators and policymakers to improve program design;</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea0c-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/J" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">(J) </num><content>what incentives may facilitate interagency sharing of information to improve programmatic effectiveness and enhance data accuracy and comprehensiveness; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye38aea0d-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/b/2/K" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="K">(K) </num><content>how individuals whose data are used should be notified of its usages.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye38aea0e-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe38aea0f-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xe38aea10-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Upon the affirmative vote of at least three-quarters of the members of the Commission, the Commission shall submit to the President and Congress a detailed statement of its findings and conclusions as a result of the activities required by subsections (a) and (b), together with its recommendations for such legislation or administrative actions as the Commission considers appropriate in light of the results of the study.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38aea11-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Deadline</inline>.—</heading><content>The report under subsection (c) shall be submitted not later than the date that is 15 months after the date a majority of the members of the Commission are appointed pursuant to section 3.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38aea12-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/e" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this section, the term “<term>administrative data</term>” means data—</chapeau><paragraph class="fontsize10" id="ye38aea13-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s4/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>held by an agency or a contractor or grantee of an agency (including a State or unit of local government); and</content></paragraph>

<section id="d244521e430" identifier="/us/pl/114/140/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>OPERATION AND POWERS OF THE COMMISSION.</heading><subsection class="firstIndent0 fontsize10" id="ye38b8655-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe38b8656-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Executive Branch Assistance</inline>.—</heading><chapeau>The heads of the following agencies shall advise and consult with the Commission on matters within their respective areas of responsibility:</chapeau><paragraph class="fontsize10" id="ye38b8657-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Bureau of the Census.</content></paragraph>
<paragraph class="fontsize10" id="ye38b8658-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The Internal Revenue Service.</content></paragraph>
<paragraph class="fontsize10" id="ye38b8659-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The Department of Health and Human Services.</content></paragraph>

<paragraph class="fontsize10" id="ye38b865d-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>The Department of Education.</content></paragraph>
<paragraph class="fontsize10" id="ye38b865e-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>The Department of Justice.</content></paragraph>
<paragraph class="fontsize10" id="ye38b865f-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>The Office of Management and Budget.</content></paragraph>
<paragraph class="fontsize10" id="ye38b8660-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>The Bureau of Economic Analysis.</content></paragraph>
<paragraph class="fontsize10" id="ye38b8661-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>The Bureau of Labor Statistics.<page identifier="/us/stat/130/320">130 STAT. 320</page></content></paragraph>
<paragraph class="fontsize10" id="ye38b8662-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/a/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>Any other agency, as determined by the Commission.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye38b8663-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe38b8664-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><content>The Commission shall meet not later than 30 days after the date upon which a majority of its members have been appointed and at such times thereafter as the chairperson or co-chairperson shall determine.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38b8665-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Rules of Procedure</inline>.—</heading><content>The chairperson and co-chairperson shall, with the approval of a majority of the members of the Commission, establish written rules of procedure for the Commission, which shall include a quorum requirement to conduct the business of the Commission.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38b8666-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Hearings</inline>.—</heading><content>The Commission may, for the purpose of carrying out this Act, hold hearings, sit and act at times and places, take testimony, and receive evidence as the Commission considers appropriate.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38b8667-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Contracts</inline>.—</heading><content>The Commission may contract with and compensate government and private agencies or persons for any purpose necessary to enable it to carry out this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38b8668-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Mails</inline>.—</heading><content>The Commission may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38b8669-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s5/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Gifts</inline>.—</heading><content>The Commission may accept, use, and dispose of gifts or donations of services or property.</content></subsection>

<section id="d244521e570" identifier="/us/pl/114/140/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>FUNDING.</heading><subsection class="firstIndent0 fontsize10" id="ye38bad7a-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Subject to subsection (b) and the availability of appropriations—</chapeau><paragraph class="fontsize10" id="ye38bad7b-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>at the request of the Director of the Census, the agencies identified as “Principal Statistical Agencies” in the report, published by the Office of Management and Budget, entitled “Statistical Programs of the United States Government, Fiscal Year 2015” shall transfer funds, as specified in advance in appropriations Acts and in a total amount not to exceed $3,000,000, to the Bureau of the Census for purposes of carrying out the activities of the Commission as provided in this Act; and</content></paragraph>
<paragraph class="fontsize10" id="ye38bad7c-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Bureau of the Census shall provide administrative support to the Commission, which may include providing physical space at, and access to, the headquarters of the Bureau of the Census, located in Suitland, Maryland.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye38bad7d-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on New Funding</inline>.—</heading><content>No additional funds are authorized to be appropriated to carry out this Act. This Act shall be carried out using amounts otherwise available for the Bureau of the Census or the agencies described in subsection (a)(1).</content></subsection>

<section id="d244521e603" identifier="/us/pl/114/140/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>PERSONNEL.</heading><subsection class="firstIndent0 fontsize10" id="ye38bd48e-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe38bd48f-e868-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Appointment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The Commission shall have a Director who shall be appointed by the chairperson with the concurrence of the co-chairperson. The Director shall be paid at a rate of pay established by the chairperson and co-chairperson, not to exceed the annual rate of basic pay payable for level V of the Executive Schedule (<ref href="/us/usc/t5/s5316">section 5316 of title 5, United States Code</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38bd490-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Staff</inline>.—</heading><content>The Director may appoint and fix the pay of additional staff as the Director considers appropriate.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye38bd491-e868-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/140/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Experts and Consultants</inline>.—</heading><content>The Commission may procure temporary and intermittent services under <ref href="/us/usc/t5/s3109/b">section 3109(b) of title 5, United States Code</ref>, at rates for individuals which do not exceed the daily equivalent of the annual rate of basic pay for a comparable position paid under the General Schedule.<page identifier="/us/stat/130/321">130 STAT. 321</page></content></subsection>
</section>
<section id="d244521e648" identifier="/us/pl/114/140/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>TERMINATION.</heading><content style="-uslm-lc:I658120">  The Commission shall terminate not later than 18 months after the date of enactment of this Act.</content></section>
