<section id="d340472e92" identifier="/us/pl/114/136/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Edward ‘Ted’ Kaufman and Michael Leavitt Presidential Transitions Improvements Act of 2015</shortTitle>”.</content></section>
<section id="d340472e102" identifier="/us/pl/114/136/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PRESIDENTIAL TRANSITION IMPROVEMENTS.</heading><subsection class="firstIndent0 fontsize10" id="yaaad3ca4-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Presidential Transition Act of 1963 (<ref href="/us/usc/t3/s102">3 U.S.C. 102 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yaaad3ca5-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> sections 4, 5, and 6 as sections 5, 6, and 7, respectively; and</content></paragraph>
<paragraph class="fontsize10" id="yaaad3ca6-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after section 3 the following:<quotedContent><section class="centered fontsize12" id="yaaae4e17-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658141"><num class="fontsize12" value="4">“SEC. 4. </num><heading class="fontsize12">TRANSITION SERVICES AND ACTIVITIES BEFORE ELECTION.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae4e18-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="yaaae4e19-e86b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term ‘<term>Administrator</term>’ means the Administrator of General Services;</content></paragraph>
<paragraph class="fontsize10" id="yaaae4e1a-e86b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the term ‘<term>agency</term>’ means an Executive agency, as defined in <ref href="/us/usc/t5/s105">section 105 of title 5, United States Code</ref>;</content></paragraph>
<paragraph class="fontsize10" id="yaaae4e1b-e86b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the term ‘<term>eligible candidate</term>’ has the meaning given that term in section 3(h)(4); and</content></paragraph>
<paragraph class="fontsize10" id="yaaae4e1c-e86b-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>the term ‘<term>Presidential election</term>’ means a general election held to determine the electors of President and Vice President under section 1 or 2 of <ref href="/us/usc/t3">title 3, United States Code</ref>.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae4e1d-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">General Duties</inline>.—</heading><chapeau>The President shall take such actions as the President determines necessary and appropriate to plan and coordinate activities by the Executive branch of the Federal Government to facilitate an efficient transfer of power to a successor President, including by—</chapeau><paragraph class="fontsize10" id="yaaae4e1e-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>establishing and operating a White House transition coordinating council in accordance with subsection (d); and</content></paragraph>
<paragraph class="fontsize10" id="yaaae4e1f-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>establishing and operating an agency transition directors council in accordance with subsection (e).</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae4e20-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae4e21-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Designation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Federal Transition Coordinator</inline>.—</heading><chapeau>The Administrator shall designate an employee of the General Services Administration who is a senior career appointee to—</chapeau><paragraph class="fontsize10" id="yaaae4e22-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>carry out the duties and authorities of the General Services Administration relating to Presidential transitions under this Act or any other provision of law;<page identifier="/us/stat/130/302">130 STAT. 302</page></content></paragraph>
<paragraph class="fontsize10" id="yaaae4e23-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>serve as the Federal Transition Coordinator with responsibility for coordinating transition planning across agencies, including through the agency transition directors council established under subsection (e);</content></paragraph>
<paragraph class="fontsize10" id="yaaae7534-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>ensure agencies comply with all statutory requirements relating to transition planning and reporting; and</content></paragraph>
<paragraph class="fontsize10" id="yaaae7535-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>act as a liaison to eligible candidates.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae7536-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">White House Transition Coordinating Council</inline>.—</heading><paragraph class="fontsize10" id="yaaae7537-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae7538-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>Not later than 6 months before the date of a Presidential election, the President shall establish a White House transition coordinating council for purposes of facilitating the Presidential transition.</content></paragraph>
<paragraph class="fontsize10" id="yaaae7539-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau>The White House transition coordinating council shall—</chapeau><subparagraph class="fontsize10" id="yaaae753a-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>provide guidance to agencies and the Federal Transition Coordinator regarding preparations for the Presidential transition, including succession planning and preparation of briefing materials;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae753b-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>facilitate communication and information sharing between the transition representatives of eligible candidates and senior employees in agencies and the Executive Office of the President; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae753c-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>prepare and host interagency emergency preparedness and response exercises.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaaae753d-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>The members of the White House transition coordinating council shall include—</chapeau><subparagraph class="fontsize10" id="yaaae753e-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>senior employees of the Executive branch selected by the President, which may include the Chief of Staff to the President, any Cabinet officer, the Director of the Office of Management and Budget, the Administrator, the Director of the Office of Personnel Management, the Director of the Office of Government Ethics, and the Archivist of the United States;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae753f-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Federal Transition Coordinator;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7540-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the transition representative for each eligible candidate, who shall serve in an advisory capacity; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7541-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>any other individual the President determines appropriate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaaae7542-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Chairperson</inline>.—</heading><content>The Chairperson of the White House transition coordinating council shall be a senior employee in the Executive Office of the President, designated by the President.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae7543-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Agency Transition Directors Council</inline>.—</heading><paragraph class="fontsize10" id="yaaae7544-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae7545-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Establishment.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><chapeau>The President shall establish and operate an agency transition directors council, which shall—</chapeau><subparagraph class="fontsize10" id="yaaae7546-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>ensure the Federal Government has an integrated strategy for addressing interagency challenges and responsibilities around Presidential transitions and turnover of noncareer appointees;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7547-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>coordinate transition activities between the Executive Office of the President, agencies, and the transition team of eligible candidates and the President-elect and Vice-President-elect; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7548-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>draw on guidance provided by the White House transition coordinating council and lessons learned from previous Presidential transitions in carrying out its duties.<page identifier="/us/stat/130/303">130 STAT. 303</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaaae7549-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau>As part of carrying out the responsibilities under paragraph (1), the agency transition directors council shall—</chapeau><subparagraph class="fontsize10" id="yaaae754a-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>assist the Federal Transition Coordinator in identifying and carrying out the responsibilities of the Federal Transition Coordinator relating to a Presidential transition;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae754b-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provide guidance to agencies in gathering briefing materials and information relating to the Presidential transition that may be requested by eligible candidates;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae754c-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>ensure materials and information described in subparagraph (B) are prepared not later than November 1 of a year during which a Presidential election is held;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae754d-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>ensure agencies adequately prepare career employees who are designated to fill non-career positions under subsection (f) during a Presidential transition; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae754e-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>consult with the President’s Management Council, or any successor thereto, in carrying out the duties of the agency transition directors council.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaaae754f-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>The members of the agency transition directors council shall include—</chapeau><subparagraph class="fontsize10" id="yaaae7550-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Federal Transition Coordinator and the Deputy Director for Management of the Office of Management and Budget, who shall serve as Co-Chairpersons of the agency transition directors council;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7551-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>other senior employees serving in the Executive Office of the President, as determined by the President;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7552-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a senior representative from each agency described in <ref href="/us/usc/t31/s901/b/1">section 901(b)(1) of title 31, United States Code</ref>, the Office of Personnel Management, the Office of Government Ethics, and the National Archives and Records Administration whose responsibilities include leading Presidential transition efforts within the agency;</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7553-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>a senior representative from any other agency determined by the Co-Chairpersons to be an agency that has significant responsibilities relating to the Presidential transition process; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7554-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>during a year during which a Presidential election will be held, a transition representative for each eligible candidate, who shall serve in an advisory capacity.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaaae7555-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae7556-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Meetings</inline>.—</heading><chapeau>The agency transition directors council shall meet—</chapeau><subparagraph class="fontsize10" id="yaaae7557-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>subject to subparagraph (B), not less than once per year; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaaae7558-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>during the period beginning on the date that is 6 months before a Presidential election and ending on the date on which the President-elect is inaugurated, on a regular basis as necessary to carry out the duties and authorities of the agency transition directors council.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae7559-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae755a-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Interim Agency Leadership for Transitions</inline>.—</heading><paragraph class="fontsize10" id="yaaae755b-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae755c-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Designation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Oversight and implementation of transition</inline>.—</heading><content>Not later than 6 months before the date of a Presidential election, the head of each agency shall designate a senior career employee of the agency and a senior career employee of each major component and subcomponent of the agency to oversee and implement the activities of the agency, component, or subcomponent relating to the Presidential transition.<page identifier="/us/stat/130/304">130 STAT. 304</page></content></paragraph>
<paragraph class="fontsize10" id="yaaae755d-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae755e-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Acting officers</inline>.—</heading><content>Not later than September 15 of a year during which a Presidential election occurs, and in accordance with <ref href="/us/usc/t5/ch33/schIII">subchapter III of chapter 33 of title 5, United States Code</ref>, for each noncareer position in an agency that the head of the agency determines is critical, the head of the agency shall designate a qualified career employee to serve in the position in an acting capacity if the position becomes vacant.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae755f-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Memorandums of Understanding</inline>.—</heading><paragraph class="fontsize10" id="yaaae7560-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaaae7561-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than November 1 of a year during which a Presidential election occurs, the President (acting through the Federal Transition Coordinator) shall, to the maximum extent practicable, negotiate a memorandum of understanding with the transition representative of each eligible candidate, which shall include, at a minimum, the conditions of access to employees, facilities, and documents of agencies by transition staff.</content></paragraph>
<paragraph class="fontsize10" id="yaaae7562-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Existing resources</inline>.—</heading><content>To the maximum extent practicable, the memorandums of understanding negotiated under paragraph (1) shall be based on memorandums of understanding from previous Presidential transitions.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae7563-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Equity in Assistance</inline>.—</heading><content>Any information or other assistance provided to eligible candidates under this section shall be offered on an equal basis and without regard to political affiliation.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yaaae7564-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="yaaae7565-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The President, acting through the Federal Transition Coordinator, shall submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate reports describing the activities undertaken by the President and agencies to prepare for the transfer of power to a new President.</content></paragraph>

<paragraph class="fontsize10" id="yaaafd51c-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the term “<term>political appointee</term>” means an individual serving in an appointment to a political position; and</content></paragraph>
<paragraph class="fontsize10" id="yaaafd51d-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/a/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>the term “<term>political position</term>” means—</chapeau><subparagraph class="fontsize10" id="yaaafd51e-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/a/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a position described under sections 5312 through 5316 of <ref href="/us/usc/t5">title 5, United States Code</ref> (relating to the Executive Schedule);</content></subparagraph>
<subparagraph class="fontsize10" id="yaaafd51f-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/a/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a noncareer appointment in the Senior Executive Service, as defined under paragraph (7) of <ref href="/us/usc/t5/s3132/a">section 3132(a) of title 5, United States Code</ref>; or</content></subparagraph>
<subparagraph class="fontsize10" id="yaaafd520-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/a/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>a position in the executive branch of the Government of a confidential or policy-determining character under schedule C of <ref href="/us/cfr/t5/pt213/sptC">subpart C of part 213 of title 5, Code of Federal Regulations</ref>.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yaaafd521-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Reporting on Current or Recent Political Appointees Appointed to Covered Civil Service Positions</inline>.—</heading><paragraph class="fontsize10" id="yaaafd522-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Annual report</inline>.—</heading><chapeau>Except as provided in paragraph (2), the Director of the Office of Personnel Management shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives an annual report regarding requests by agencies to appoint political appointees or former political appointees to covered civil service positions. Each report shall cover one calendar year and shall—</chapeau><subparagraph class="fontsize10" id="yaaafd523-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>for each request by an agency that a political appointee be appointed to a covered civil service position during the period covered by the report, provide—</chapeau><clause class="fontsize10" id="yaaafd524-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the date on which the request was received by the Office of Personnel Management;</content></clause>
<clause class="fontsize10" id="yaaafd525-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>subject to subsection (c), the name of the individual and the political position held by the individual, including title, office, and agency;</content></clause>
<clause class="fontsize10" id="yaaafd526-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the date on which the individual was first appointed to a political position in the agency in which the individual is serving as a political appointee;</content></clause>
<clause class="fontsize10" id="yaaafd527-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the grade and rate of basic pay for the individual as a political appointee;</content></clause>
<clause class="fontsize10" id="yaaafd528-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>the proposed covered civil service position, including title, office, and agency, and the proposed grade and rate of basic pay for the individual;</content></clause>
<clause class="fontsize10" id="yaaafd529-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>whether the Office of Personnel Management approved or denied the request; and</content></clause>
<clause class="fontsize10" id="yaaafd52a-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/A/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>the date on which the individual was appointed to a covered civil service position, if applicable; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yaaafd52b-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>for each request by an agency that a former political appointee be appointed to a covered civil service position during the period covered by the report, provide—</chapeau><clause class="fontsize10" id="yaaafd52c-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the date on which the request was received by the Office of Personnel Management;</content></clause>
<clause class="fontsize10" id="yaaafd52d-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>subject to subsection (c), the name of the individual and the political position held by the individual, including title, office, and agency;</content></clause>
<clause class="fontsize10" id="yaaafd52e-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the date on which the individual was first appointed to any political position;</content></clause>
<clause class="fontsize10" id="yaaafd52f-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>the grade and rate of basic pay for the individual as a political appointee;<page identifier="/us/stat/130/307">130 STAT. 307</page></content></clause>
<clause class="fontsize10" id="yaaafd530-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>the date on which the individual ceased to serve in a political position;</content></clause>
<clause class="fontsize10" id="yaaafd531-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>the proposed covered civil service position, including title, office, and agency, and the proposed grade and rate of basic pay for the individual;</content></clause>
<clause class="fontsize10" id="yaaafd532-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>whether the Office of Personnel Management approved or denied the request; and</content></clause>
<clause class="fontsize10" id="yaaafd533-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/1/B/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>the date on which the individual was first appointed to a covered civil service position, if applicable.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaaafd534-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Quarterly report in certain years</inline>.—</heading><content>In the last year of the term of a President, or, if applicable, the last year of the second consecutive term of a President, the report required under paragraph (1) shall be submitted quarterly and shall cover each quarter of the year, except that the last quarterly report shall also cover January 1 through 20 of the following year.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yaaafd535-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Names and Titles of Certain Appointees</inline>.—</heading><chapeau>If determined appropriate by the Director of the Office of Personnel Management, a report submitted under subsection (b) may exclude the name or title of a political appointee or former political appointee—</chapeau><paragraph class="fontsize10" id="yaaafd536-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>who—</chapeau><subparagraph class="fontsize10" id="yaaafd537-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>was requested to be appointed to a covered civil service position; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaaafd538-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>was not appointed to a covered civil service position; or</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaaaffc49-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>relating to whom a request to be appointed to a covered civil service position is pending at the end of the period covered by that report.</content></paragraph>

<section id="d340472e1108" identifier="/us/pl/114/136/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>REPORT ON REGULATIONS PROMULGATED NEAR THE END OF PRESIDENTIAL TERMS.</heading><subsection class="firstIndent0 fontsize10" id="yaab0bf9a-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yaab0bf9b-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>The term “<term>covered presidential transition period</term>” means each of the following:</chapeau><subparagraph class="fontsize10" id="yaab0bf9c-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The 120-day period ending on January 20, 2001.</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bf9d-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The 120-day period ending on January 20, 2009.</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bf9e-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>The 120-day period ending on January 20, 2017.</content></subparagraph>

<paragraph class="fontsize10" id="yaab0bf9f-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The term “<term>covered regulation</term>” means a final significant regulatory action promulgated by an Executive department.</content></paragraph>
<paragraph class="fontsize10" id="yaab0bfa0-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>The term “<term>significant regulatory action</term>” means any regulatory action that is likely to result in a rule that may—</chapeau><subparagraph class="fontsize10" id="yaab0bfa1-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>have an annual effect on the economy of $100,000,000 or more or adversely affect in a material way the economy, a sector of the economy, productivity, competition, jobs, the environment, public health or safety, or State, local, or tribal governments or communities;</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bfa2-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>create a serious inconsistency or otherwise interfere with an action taken or planned by another agency;</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bfa3-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>materially alter the budgetary impact of entitlements, grants, user fees, or loan programs or the rights and obligations of recipients thereof; or</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bfa4-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>raise novel legal or policy issues.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yaab0bfa5-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The term “<term>Executive department</term>” has the meaning given that term under <ref href="/us/usc/t5/s101">section 101 of title 5, United States Code</ref>.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yaab0bfa6-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><page identifier="/us/stat/130/308">130 STAT. 308</page>
<paragraph class="fontsize10" id="yaab0bfa7-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Comptroller General of the United States shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a report regarding covered regulations promulgated during each covered presidential transition period.</content></paragraph>
<paragraph class="fontsize10" id="yaab0bfa8-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Contents of report</inline>.—</heading><chapeau>The report required under paragraph (1) shall, to the extent feasible, for each covered presidential transition period—</chapeau><subparagraph class="fontsize10" id="yaab0bfa9-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaab0bfaa-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time periods.</p></sidenote><content>compare the number, scope, and impact of, and type of rulemaking procedure used for, covered regulations promulgated during the covered presidential transition period to the number, scope, and impact of, and type of rulemaking procedure used for, covered regulations promulgated during the 120-day periods ending on January 20 of each year after 1996, other than 2001, 2009, and 2017;</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bfab-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaab0bfac-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determine the statistical significance of any differences identified under subparagraph (A) and whether and to what extent such differences indicate any patterns;</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bfad-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaab0bfae-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>evaluate the size, scope, and effect of the covered regulations promulgated during the covered presidential transition period; and</content></subparagraph>
<subparagraph class="fontsize10" id="yaab0bfaf-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaab0bfb0-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><chapeau>assess the extent to which the regularly required processes for the promulgation of covered regulations were followed during the covered presidential transition period, including compliance with the requirements under—</chapeau><clause class="fontsize10" id="yaab0bfb1-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s5/b/2/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content><ref href="/us/usc/t5/ch8">chapter 8 of title 5, United States Code</ref> (commonly known as the “Congressional Review Act”);</content></clause>

<section id="d340472e1285" identifier="/us/pl/114/136/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>ANALYSIS OF THREATS AND VULNERABILITIES.</heading><subsection class="firstIndent0 fontsize10" id="yaab0e6c6-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xaab0e6c7-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xaab0e6c8-e86b-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than February 15, 2016, the Secretary of Homeland Security shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committees on Oversight and Government Reform and Homeland Security of the House of Representatives a report analyzing the threats and vulnerabilities facing the United States during a presidential transition, which—</chapeau><paragraph class="fontsize10" id="yaab0e6c9-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>shall identify and discuss vulnerabilities related to border security and threats related to terrorism, including from weapons of mass destruction;</content></paragraph>
<paragraph class="fontsize10" id="yaab0e6ca-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>shall identify steps being taken to address the threats and vulnerabilities during a presidential transition; and</content></paragraph>
<paragraph class="fontsize10" id="yaab0e6cb-e86b-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/136/s6/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>may include recommendations for actions by components and agencies within the Department of Homeland Security.<page identifier="/us/stat/130/309">130 STAT. 309</page></content></paragraph>
