<section id="d244989e98" identifier="/us/pl/114/133/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x082c2d1d-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Eric Williams Correctional Officer Protection Act of 2015</shortTitle>”.</content></section>
<section id="d244989e113" identifier="/us/pl/114/133/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>OFFICERS AND EMPLOYEES OF THE BUREAU OF PRISONS AUTHORIZED TO CARRY OLEORESIN CAPSICUM SPRAY.</heading><subsection class="firstIndent0 fontsize10" id="y082c7b3e-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Chapter 303 of part III of <ref href="/us/usc/t18">title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y082cc95f-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658164"><num class="fontsize12" value="4049">“§ 4049.</num><heading class="fontsize12"> <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x082cc960-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s4049">18 USC 4049</ref>.</p></sidenote>Officers and employees of the Bureau of Prisons authorized to carry oleoresin capsicum spray</heading><subsection class="firstIndent0 fontsize10" id="y082cc961-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Director of the Bureau of Prisons shall issue, on a routine basis, oleoresin capsicum spray to—</chapeau><paragraph class="fontsize10" id="y082cc962-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>any officer or employee of the Bureau of Prisons who—</chapeau><subparagraph class="fontsize10" id="y082cc963-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is employed in a prison that is not a minimum or low security prison; and</content></subparagraph>
<subparagraph class="fontsize10" id="y082cc964-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>may respond to an emergency situation in such a prison; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y082cc965-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>to such additional officers and employees of prisons as the Director determines appropriate, in accordance with this section.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y082cc966-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Training Requirement</inline>.—</heading><paragraph class="fontsize10" id="y082cc967-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In order for an officer or employee of the Bureau of Prisons, including a correctional officer, to be eligible to receive and carry oleoresin capsicum spray pursuant to this section, the officer or employee shall complete a training course before being issued such spray, and annually thereafter, on the use of oleoresin capsicum spray.</content></paragraph>
<paragraph class="fontsize10" id="y082cc968-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Transferability of training</inline>.—</heading><content>An officer or employee of the Bureau of Prisons who completes a training course pursuant to paragraph (1) and subsequently transfers to employment at a different prison, shall not be required to complete an additional training course solely due such transfer.</content></paragraph>
<paragraph class="fontsize10" id="y082cc969-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Training conducted during regular employment</inline>.—</heading><content>An officer or employee of the Bureau of Prisons who completes a training course required under paragraph (1) shall do so during the course of that officer or employee’s regular employment, and shall be compensated at the same rate that the <page identifier="/us/stat/130/297">130 STAT. 297</page>
officer or employee would be compensated for conducting the officer or employee’s regular duties.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y082cc96a-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Use of Oleoresin Capsicum Spray</inline>.—</heading><chapeau>Officers and employees of the Bureau of Prisons issued oleoresin capsicum spray pursuant to subsection (a) may use such spray to reduce acts of violence—</chapeau><paragraph class="fontsize10" id="y082cc96b-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>committed by prisoners against themselves, other prisoners, prison visitors, and officers and employees of the Bureau of Prisons; and</content></paragraph>
<paragraph class="fontsize10" id="y082cc96c-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>committed by prison visitors against themselves, prisoners, other visitors, and officers and employees of the Bureau of Prisons.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y082cc96d-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Clerical Amendment</inline>.—</heading><content>The table of sections for chapter 303 of part III of <ref href="/us/usc/t18">title 18, United States Code</ref>, <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x082cc96e-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t18">18 USC </ref></p><p class="leftAlign firstIndent0 fontsize8" id="x082cc96f-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">prec. 4041.<?GPOvSpace 04?></p></sidenote><amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after the item relating to section 4048 the following:<quotedContent><toc>

<section id="d244989e273" identifier="/us/pl/114/133/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>GAO <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x082cc970-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p><p class="leftAlign firstIndent0 fontsize8" id="x082cc971-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x082cc972-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote>REPORT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x082d1693-e86c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not later than the date that is 3 years after the date on which the Director of the Bureau of Prisons begins to issue oleoresin capsicum spray to officers and employees of the Bureau of Prisons pursuant to <ref href="/us/usc/t18/s4049">section 4049 of title 18, United States Code</ref>, as added by this Act, the Comptroller General of the United States shall submit to Congress a report that includes the following:</chapeau><paragraph class="fontsize10" id="y082d1694-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>An evaluation of the effectiveness of issuing oleoresin capsicum spray to officers and employees of the Bureau of Prisons in prisons that are not minimum or low security prisons on—</chapeau><subparagraph class="fontsize10" id="y082d1695-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>reducing crime in such prisons; and</content></subparagraph>
<subparagraph class="fontsize10" id="y082d1696-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>reducing acts of violence committed by prisoners against themselves, other prisoners, prison visitors, and officers and employees of the Bureau of Prisons in such prisons.</content></subparagraph>

<paragraph class="fontsize10" id="y082d1697-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>An evaluation of the advisability of issuing oleoresin capsicum spray to officers and employees of the Bureau of Prisons in prisons that are minimum or low security prisons, including—</chapeau><subparagraph class="fontsize10" id="y082d1698-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s3/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the effectiveness that issuing such spray in such prisons would have on reducing acts of violence committed by prisoners against themselves, other prisoners, prison visitors, and officers and employees of the Bureau of Prisons in such prisons; and</content></subparagraph>
<subparagraph class="fontsize10" id="y082d1699-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s3/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the cost of issuing such spray in such prisons.<page identifier="/us/stat/130/298">130 STAT. 298</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y082d169a-e86c-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/133/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Recommendations to improve the safety of officers and employees of the Bureau of Prisons in prisons.</content></paragraph>
