<section id="d249054e187" identifier="/us/pl/114/119/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535a519b-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935">42 USC 16935</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x535a78ac-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y535a9fbd-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Megan Nicole Kanka, who was 7 years old, was abducted, sexually assaulted, and murdered in 1994, in the State of New Jersey by a violent predator living across the street from her home. Unbeknownst to Megan Kanka and her family, he had been convicted previously of a sex offense against a child.</content></paragraph>
<paragraph class="fontsize10" id="y535a9fbe-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>In 1996, Congress adopted Megan’s Law (<ref href="/us/pl/104/145">Public Law 104–145</ref>) as a means to encourage States to protect children by identifying the whereabouts of sex offenders and providing the means to monitor their activities.</content></paragraph>
<paragraph class="fontsize10" id="y535a9fbf-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>In 2006, Congress passed the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/pl/109/248">Public Law 109–248</ref>) to protect children and the public at large by establishing a comprehensive national system for the registration and notification to the public and law enforcement officers of convicted sex offenders.</content></paragraph>
<paragraph class="fontsize10" id="y535a9fc0-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Law enforcement reports indicate that known child-sex offenders are traveling internationally.<page identifier="/us/stat/130/16">130 STAT. 16</page></content></paragraph>
<paragraph class="fontsize10" id="y535a9fc1-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>The commercial sexual exploitation of minors in child sex trafficking and pornography is a global phenomenon. The International Labour Organization has estimated that 1,8000,000 children worldwide are victims of child sex trafficking and pornography each year.</content></paragraph>
<paragraph class="fontsize10" id="y535a9fc2-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Child sex tourism, where an individual travels to a foreign country and engages in sexual activity with a child in that country, is a form of child exploitation and, where commercial, child sex trafficking.</content></paragraph>

<section id="d249054e241" identifier="/us/pl/114/119/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535a9fc3-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935a">42 USC 16935a</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x535b3c04-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y535b3c05-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Center</inline>.—</heading><content>The term “<term>Center</term>” means the Angel Watch Center established pursuant to section 4(a).</content></paragraph>
<paragraph class="fontsize10" id="y535b3c06-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Convicted</inline>.—</heading><content>The term “<term>convicted</term>” has the meaning given the term in section 111 of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16911">42 U.S.C. 16911</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y535b3c07-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Covered sex offender</inline>.—</heading><content>Except as otherwise provided, the term “<term>covered sex offender</term>” means an individual who is a sex offender by reason of having been convicted of a sex offense against a minor.</content></paragraph>
<paragraph class="fontsize10" id="y535b3c08-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Destination country</inline>.—</heading><content>The term “<term>destination country</term>” means a destination or transit country.</content></paragraph>
<paragraph class="fontsize10" id="y535b3c09-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Interpol</inline>.—</heading><content>The term “<term>INTERPOL</term>” means the International Criminal Police Organization.</content></paragraph>
<paragraph class="fontsize10" id="y535b3c0a-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Jurisdiction</inline>.—</heading><chapeau>The term “<term>jurisdiction</term>” means—</chapeau><subparagraph class="fontsize10" id="y535b3c0b-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a State;</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c0c-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the District of Columbia;</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c0d-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Commonwealth of Puerto Rico;</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c0e-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Guam;</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c0f-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>American Samoa;</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c10-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>the Northern Mariana Islands;</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c11-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>the United States Virgin Islands; and</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c12-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/6/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>to the extent provided in, and subject to the requirements of, section 127 of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16927">42 U.S.C. 16927</ref>), a Federally recognized Indian tribe.</content></subparagraph>

<paragraph class="fontsize10" id="y535b3c13-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Minor</inline>.—</heading><content>The term “<term>minor</term>” means an individual who has not attained the age of 18 years.</content></paragraph>
<paragraph class="fontsize10" id="y535b3c14-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">National sex offender registry</inline>.—</heading><content>The term “<term>National Sex Offender Registry</term>” means the National Sex Offender Registry established by section 119 of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16919">42 U.S.C. 16919</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y535b3c15-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Sex offender under sorna</inline>.—</heading><content>The term “<term>sex offender under SORNA</term>” has the meaning given the term “<term>sex offender</term>” in section 111 of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16911">42 U.S.C. 16911</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y535b3c16-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><heading class="fontsize10"><inline class="smallCaps">Sex offense against a minor</inline>.—</heading><subparagraph class="fontsize10" id="y535b3c17-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/10/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The term “<term>sex offense against a minor</term>” means a specified offense against a minor, as defined in section 111 of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16911">42 U.S.C. 16911</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y535b3c18-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/10/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Other offenses</inline>.—</heading><content>The term “<term>sex offense against a minor</term>” includes a sex offense described in section 111(5)(A) of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16911/5/A">42 U.S.C. 16911(5)(A)</ref>) that is a specified offense against a minor, as defined in paragraph (7) of <page identifier="/us/stat/130/17">130 STAT. 17</page>
such section, or an attempt or conspiracy to commit such an offense.</content></subparagraph>
<subparagraph class="fontsize10" id="y535b6329-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s3/10/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Foreign convictions; offenses involving consensual sexual conduct</inline>.—</heading><content>The limitations contained in subparagraphs (B) and (C) of section 111(5) of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16911/5">42 U.S.C. 16911(5)</ref>) shall apply with respect to a sex offense against a minor for purposes of this Act to the same extent and in the same manner as such limitations apply with respect to a sex offense for purposes of the Adam Walsh Child Protection and Safety Act of 2006.</content></subparagraph>

<section id="d249054e443" identifier="/us/pl/114/119/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535b632a-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935b">42 USC 16935b</ref>.</p></sidenote><heading>ANGEL WATCH CENTER.</heading><subsection class="firstIndent0 fontsize10" id="y535d5efb-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d5efc-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall establish within the Child Exploitation Investigations Unit of U.S. Immigrations and Customs Enforcement a Center, to be known as the “Angel Watch Center”, to carry out the activities specified in subsection (e).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y535d5efd-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Incoming Notification</inline>.—</heading><paragraph class="fontsize10" id="y535d5efe-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Center may receive incoming notifications concerning individuals seeking to enter the United States who have committed offenses of a sexual nature.</content></paragraph>
<paragraph class="fontsize10" id="y535d5eff-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Notification</inline>.—</heading><chapeau>Upon receiving an incoming notification under paragraph (1), the Center shall—</chapeau><subparagraph class="fontsize10" id="y535d5f00-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>immediately share all information received relating to the individual with the Department of Justice; and</content></subparagraph>
<subparagraph class="fontsize10" id="y535d5f01-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>share all relevant information relating to the individual with other Federal, State, and local agencies and entities, as appropriate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y535d5f02-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Collaboration</inline>.—</heading><content>The Secretary of Homeland Security shall collaborate with the Attorney General to establish a process for the receipt, dissemination, and categorization of information relating to individuals and specific offenses provided herein.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y535d5f03-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d5f04-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Collaboration.</p><p class="leftAlign firstIndent0 fontsize8" id="x535d5f05-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Leadership</inline>.—</heading><content>The Center shall be headed by the Assistant Secretary of U.S. Immigration and Customs Enforcement, in collaboration with the Commissioner of U.S. Customs and Border Protection and in consultation with the Attorney General and the Secretary of State.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y535d5f06-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Members</inline>.—</heading><chapeau>The Center shall consist of the following:</chapeau><paragraph class="fontsize10" id="y535d5f07-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The Assistant Secretary of U.S. Immigration and Customs Enforcement.</content></paragraph>
<paragraph class="fontsize10" id="y535d5f08-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The Commissioner of U.S. Customs and Border Protection.</content></paragraph>
<paragraph class="fontsize10" id="y535d5f09-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Individuals who are designated as analysts in U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection.</content></paragraph>
<paragraph class="fontsize10" id="y535d5f0a-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Individuals who are designated as program managers in U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y535d5f0b-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Activities</inline>.—</heading><paragraph class="fontsize10" id="y535d5f0c-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d5f0d-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In carrying out this section, the Center shall, using all relevant databases, systems and sources of information, not later than 48 hours before scheduled departure, or as soon as practicable before scheduled departure—</chapeau><page identifier="/us/stat/130/18">130 STAT. 18</page>
<subparagraph class="fontsize10" id="y535d5f0e-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d5f0f-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>determine if individuals traveling abroad are listed on the National Sex Offender Registry;</content></subparagraph>
<subparagraph class="fontsize10" id="y535d5f10-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d5f11-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><content>review the United States Marshals Service’s National Sex Offender Targeting Center case management system or other system that provides access to a list of individuals who have provided advanced notice of international travel to identify any individual who meets the criteria described in subparagraph (A) and is not in a system reviewed pursuant to this subparagraph; and</content></subparagraph>
<subparagraph class="fontsize10" id="y535d5f12-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d5f13-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p><p class="leftAlign firstIndent0 fontsize8" id="x535d5f14-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>provide a list of individuals identified under subparagraph (B) to the United States Marshals Service’s National Sex Offender Targeting Center to determine compliance with title I of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16901/etseq">42 U.S.C. 16901 et seq.</ref>).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y535d5f15-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d5f16-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Provision of information to center</inline>.—</heading><content>Twenty-four hours before the intended travel, or thereafter, not later than 72 hours after the intended travel, the United States Marshals Service’s National Sex Offender Targeting Center shall provide, to the Angel Watch Center, information pertaining to any sex offender described in subparagraph (C) of paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="y535d8627-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Advance notice to destination country</inline>.—</heading><subparagraph class="fontsize10" id="y535d8628-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Center may transmit relevant information to the destination country about a sex offender if—</chapeau><clause class="fontsize10" id="y535d8629-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the individual is identified by a review conducted under paragraph (1)(B) as having provided advanced notice of international travel; or</content></clause>
<clause class="fontsize10" id="y535d862a-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>after completing the activities described in paragraph (1), the Center receives information pertaining to a sex offender under paragraph (2).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y535d862b-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exceptions</inline>.—</heading><chapeau>The Center may immediately transmit relevant information on a sex offender to the destination country if—</chapeau><clause class="fontsize10" id="y535d862c-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Center becomes aware that a sex offender is traveling outside of the United States within 24 hours of intended travel, and simultaneously completes the activities described in paragraph (1); or</content></clause>
<clause class="fontsize10" id="y535d862d-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Center has not received a transmission pursuant to paragraph (2), provided it is not more than 24 hours before the intended travel.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y535d862e-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Corrections</inline>.—</heading><chapeau>Upon receiving information that a notification sent by the Center regarding an individual was inaccurate, the Center shall immediately—</chapeau><clause class="fontsize10" id="y535d862f-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>send a notification of correction to the destination country notified;</content></clause>
<clause class="fontsize10" id="y535d8630-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>correct all data collected pursuant to paragraph (6); and</content></clause>
<clause class="fontsize10" id="y535d8631-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>if applicable, notify the Secretary of State for purposes of the passport review and marking processes described in <ref href="/us/pl/110/457/s240">section 240 of Public Law 110–457</ref>.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y535d8632-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The notification under this paragraph may be transmitted through such means as are determined appropriate by the Center, including through U.S. Immigration and Customs Enforcement attaches.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y535d8633-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Memorandum of agreement</inline>.—</heading><content>Not later than 6 months after the date of enactment of this Act, the Secretary <page identifier="/us/stat/130/19">130 STAT. 19</page>
of Homeland Security shall enter into a Memorandum of Agreement with the Attorney General to facilitate the activities of the Angel Watch Center in collaboration with the United States Marshals Service’s National Sex Offender Targeting Center, including the exchange of information, the sharing of personnel, access to information and databases in accordance with paragraph (1)(B), and the establishment of a process to share notifications from the international community in accordance with subsection (b)(1).</content></paragraph>
<paragraph class="fontsize10" id="y535d8634-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Passport application review</inline>.—</heading><subparagraph class="fontsize10" id="y535d8635-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d8636-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Center shall provide a written determination to the Department of State regarding the status of an individual as a covered sex offender (as defined in <ref href="/us/pl/110/457/s240">section 240 of Public Law 110–457</ref>) when appropriate.</content></subparagraph>
<subparagraph class="fontsize10" id="y535d8637-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d8638-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective date</inline>.—</heading><content>Subparagraph (A) shall take effect upon certification by the Secretary of State, the Secretary of Homeland Security, and the Attorney General that the process developed and reported to the appropriate congressional committees under section 9 has been successfully implemented.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y535d8639-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Collection of data</inline>.—</heading><chapeau>The Center shall collect all relevant data, including—</chapeau><subparagraph class="fontsize10" id="y535d863a-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a record of each notification sent under paragraph (3);</content></subparagraph>
<subparagraph class="fontsize10" id="y535d863b-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the response of the destination country to notifications under paragraph (3), where available;</content></subparagraph>
<subparagraph class="fontsize10" id="y535d863c-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/6/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>any decision not to transmit a notification abroad, to the extent practicable;</content></subparagraph>
<subparagraph class="fontsize10" id="y535d863d-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/6/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the number of transmissions made under subparagraphs (A),(B), and (C) of paragraph (3) and the countries to which they are transmitted, respectively;</content></subparagraph>
<subparagraph class="fontsize10" id="y535d863e-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/6/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>whether the information was transmitted to the destination country before scheduled commencement of sex offender travel; and</content></subparagraph>
<subparagraph class="fontsize10" id="y535d863f-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/6/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>any other information deemed necessary and appropriate by the Secretary of Homeland Security.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y535d8640-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Complaint review</inline>.—</heading><subparagraph class="fontsize10" id="y535d8641-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Center shall—</chapeau><clause class="fontsize10" id="y535d8642-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>establish a mechanism to receive complaints from individuals affected by erroneous notifications under this section;</content></clause>
<clause class="fontsize10" id="y535d8643-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>ensure that any complaint is promptly reviewed; and</content></clause>
<clause class="fontsize10" id="y535d8644-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>in the case of a complaint that involves a notification sent by another Federal Government entity, notify the individual of the contact information for the appropriate entity and forward the complaint to the appropriate entity for prompt review and response pursuant to this section.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y535d8645-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Response to complaints</inline>.—</heading><chapeau>The Center shall, as applicable—</chapeau><clause class="fontsize10" id="y535d8646-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>provide the individual with notification in writing that the individual was erroneously subjected to international notification;</content></clause>
<clause class="fontsize10" id="y535d8647-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>take action to ensure that a notification or information regarding the individual is not erroneously <page identifier="/us/stat/130/20">130 STAT. 20</page>
transmitted to a destination country in the future; and</content></clause>
<clause class="fontsize10" id="y535d8648-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>submit an additional written notification to the individual explaining why a notification or information regarding the individual was erroneously transmitted to the destination country and describing the actions that the Center has taken or is taking under clause (ii).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y535d8649-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Public awareness</inline>.—</heading><content>The Center shall make publicly available information on how an individual may submit a complaint under this section.</content></subparagraph>
<subparagraph class="fontsize10" id="y535d864a-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Reporting requirement</inline>.—</heading><chapeau>The Secretary of Homeland Security shall submit an annual report to the appropriate congressional committees (as defined in section 9) that includes—</chapeau><clause class="fontsize10" id="y535d864b-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/7/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the number of instances in which a notification or information was erroneously transmitted to the destination country of an individual under paragraph (3); and</content></clause>

<paragraph class="fontsize10" id="y535d864d-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d864e-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Annual review process</inline>.—</heading><content>The Center shall establish, in coordination with the Attorney General, the Secretary of State, and INTERPOL, an annual review process to ensure that there is appropriate coordination and collaboration, including consistent procedures governing the activities authorized under this Act, in carrying out this Act.</content></paragraph>
<paragraph class="fontsize10" id="y535d864f-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/e/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Information required</inline>.—</heading><content>The Center shall make available to the United States Marshals Service’s National Sex Offender Targeting Center information on travel by sex offenders in a timely manner.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y535d8650-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/f" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this section, the term “<term>sex offender</term>” means—</chapeau><paragraph class="fontsize10" id="y535d8651-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a covered sex offender; or</content></paragraph>
<paragraph class="fontsize10" id="y535d8652-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s4/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>an individual required to register under the sex offender registration program of any jurisdiction or included in the National Sex Offender Registry, on the basis of an offense against a minor.</content></paragraph>
</subsection>
</section>
<section id="d249054e920" identifier="/us/pl/114/119/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535d8653-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935c">42 USC 16935c</ref>.</p></sidenote><heading>NOTIFICATION BY THE UNITED STATES MARSHALS SERVICE.</heading><subsection class="firstIndent0 fontsize10" id="y535ee5e4-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The United States Marshals Service’s National Sex Offender Targeting Center may—</chapeau><paragraph class="fontsize10" id="y535ee5e5-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>transmit notification of international travel of a sex offender to the destination country of the sex offender, including to the visa-issuing agent or agents in the United States of the country;</content></paragraph>
<paragraph class="fontsize10" id="y535ee5e6-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>share information relating to traveling sex offenders with other Federal, State, local, and foreign agencies and entities, as appropriate;</content></paragraph>
<paragraph class="fontsize10" id="y535ee5e7-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>receive incoming notifications concerning individuals seeking to enter the United States who have committed offenses of a sexual nature and shall share the information received immediately with the Department of Homeland Security; and</content></paragraph>
<paragraph class="fontsize10" id="y535ee5e8-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>perform such other functions at the Attorney General or the Director of the United States Marshals Service may direct.<page identifier="/us/stat/130/21">130 STAT. 21</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y535ee5e9-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Consistent Notification</inline>.—</heading><content>In making notifications under subsection (a)(1), the United States Marshals Service’s National Sex Offender Targeting Center shall, to the extent feasible and appropriate, ensure that the destination country is consistently notified in advance about sex offenders under SORNA identified through their inclusion in sex offender registries of jurisdictions or the National Sex Offender Registry.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y535ee5ea-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Information Required</inline>.—</heading><chapeau>For purposes of carrying out this Act, the United States Marshals Service’s National Sex Offender Targeting Center shall—</chapeau><paragraph class="fontsize10" id="y535ee5eb-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>make the case management system or other system that provides access to a list of individuals who have provided advanced notice of international travel available to the Angel Watch Center;</content></paragraph>
<paragraph class="fontsize10" id="y535ee5ec-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535ee5ed-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>provide the Angel Watch Center a determination of compliance with title I of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16901/etseq">42 U.S.C. 16901 et seq.</ref>) for the list of individuals transmitted under section 4(e)(1)(C);</content></paragraph>
<paragraph class="fontsize10" id="y535ee5ee-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>make available to the Angel Watch Center information on travel by sex offenders in a timely manner; and</content></paragraph>
<paragraph class="fontsize10" id="y535ee5ef-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535ee5f0-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>consult with the Department of State regarding operation of the international notification program authorized under this Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y535ee5f1-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Corrections</inline>.—</heading><chapeau>Upon receiving information that a notification sent by the United States Marshals Service’s National Sex Offender Targeting Center regarding an individual was inaccurate, the United States Marshals Service’s National Sex Offender Targeting Center shall immediately—</chapeau><paragraph class="fontsize10" id="y535ee5f2-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>send a notification of correction to the destination country notified;</content></paragraph>
<paragraph class="fontsize10" id="y535ee5f3-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>correct all data collected in accordance with subsection (f); and</content></paragraph>
<paragraph class="fontsize10" id="y535ee5f4-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>if applicable, send a notification of correction to the Angel Watch Center.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y535ee5f5-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>The notification under this section may be transmitted through such means as are determined appropriate by the United States Marshals Service’s National Sex Offender Targeting Center, including through the INTERPOL notification system and through Federal Bureau of Investigation Legal attaches.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y535ee5f6-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Collection of Data</inline>.—</heading><chapeau>The Attorney General shall collect all relevant data, including—</chapeau><paragraph class="fontsize10" id="y535ee5f7-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a record of each notification sent under subsection (a);</content></paragraph>
<paragraph class="fontsize10" id="y535ee5f8-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the response of the destination country to notifications under paragraphs (1) and (2) of subsection (a), where available;</content></paragraph>
<paragraph class="fontsize10" id="y535ee5f9-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/f/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>any decision not to transmit a notification abroad, to the extent practicable;</content></paragraph>
<paragraph class="fontsize10" id="y535ee5fa-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/f/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the number of transmissions made under paragraphs (1) and (2) of subsection (a) and the countries to which they are transmitted;</content></paragraph>
<paragraph class="fontsize10" id="y535ee5fb-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/f/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>whether the information was transmitted to the destination country before scheduled commencement of sex offender travel; and</content></paragraph>
<paragraph class="fontsize10" id="y535ee5fc-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/f/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>any other information deemed necessary and appropriate by the Attorney General.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y535ee5fd-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Complaint Review</inline>.—</heading><paragraph class="fontsize10" id="y535ee5fe-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The United States Marshals Service’s National Sex Offender Targeting Center shall—<page identifier="/us/stat/130/22">130 STAT. 22</page></chapeau><subparagraph class="fontsize10" id="y535ee5ff-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>establish a mechanism to receive complaints from individuals affected by erroneous notifications under this section;</content></subparagraph>
<subparagraph class="fontsize10" id="y535ee600-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>ensure that any complaint is promptly reviewed; and</content></subparagraph>
<subparagraph class="fontsize10" id="y535ee601-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in the case of a complaint that involves a notification sent by another Federal Government entity, notify the individual of the contact information for the appropriate entity and forward the complaint to the appropriate entity for prompt review and response pursuant to this section.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y535ee602-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Response to complaints</inline>.—</heading><chapeau>The United States Marshals Service’s National Sex Offender Targeting Center shall, as applicable—</chapeau><subparagraph class="fontsize10" id="y535ee603-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>provide the individual with notification in writing that the individual was erroneously subjected to international notification;</content></subparagraph>
<subparagraph class="fontsize10" id="y535ee604-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>take action to ensure that a notification or information regarding the individual is not erroneously transmitted to a destination country in the future; and</content></subparagraph>
<subparagraph class="fontsize10" id="y535ee605-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>submit an additional written notification to the individual explaining why a notification or information regarding the individual was erroneously transmitted to the destination country and describing the actions that the United States Marshals Service’s National Sex Offender Targeting Center has taken or is taking under subparagraph (B).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y535ee606-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Public awareness</inline>.—</heading><content>The United States Marshals Service’s National Sex Offender Targeting Center shall make publicly available information on how an individual may submit a complaint under this section.</content></paragraph>
<paragraph class="fontsize10" id="y535ee607-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Reporting requirement</inline>.—</heading><chapeau>The Attorney General shall submit an annual report to the appropriate congressional committees (as defined in section 9) that includes—</chapeau><subparagraph class="fontsize10" id="y535ee608-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of instances in which a notification or information was erroneously transmitted to the destination country of an individual under subsection (a); and</content></subparagraph>
<subparagraph class="fontsize10" id="y535ee609-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/g/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the actions taken to prevent similar errors from occurring in the future.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y535ee60a-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/h" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">(h) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this section, the term “<term>sex offender</term>” means—</chapeau><paragraph class="fontsize10" id="y535ee60b-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/h/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a sex offender under SORNA; or</content></paragraph>
<paragraph class="fontsize10" id="y535ee60c-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s5/h/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a person required to register under the sex offender registration program of any jurisdiction or included in the National Sex Offender Registry.</content></paragraph>

<section id="d249054e1190" identifier="/us/pl/114/119/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>INTERNATIONAL TRAVEL.</heading><subsection class="firstIndent0 fontsize10" id="y535f5b3d-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s6/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Requirement That Sex Offenders Provide International Travel Related Information To Sex Offender Registries</inline>.—</heading><chapeau>Section 114 of the Adam Walsh Child Protection and Safety Act of 2006 (<ref href="/us/usc/t42/s16914">42 U.S.C. 16914</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y535f5b3e-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y535f5b3f-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s6/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (7) as paragraph (8); and;</content></subparagraph>

flight numbers for air travel, destination country and address or other contact information therein, means and purpose of travel, and any other itinerary or other travel-related information required by the Attorney General.”</content></paragraph>

<paragraph class="fontsize10" id="y535f5b42-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y535f5b43-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Time and Manner</inline>.—</heading><content>A sex offender shall provide and update information required under subsection (a), including information relating to intended travel outside the United States required under paragraph (7) of that subsection, in conformity with any time and manner requirements prescribed by the Attorney General.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y535f5b44-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s6/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendments to <ref href="/us/usc/t18/s2250">Section 2250 of Title 18, United States Code</ref></inline>.—</heading><chapeau><ref href="/us/usc/t18/s2250">Section 2250 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y535f5b45-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (b) and (c) as subsections (c) and (d), respectively;</content></paragraph>

<paragraph class="fontsize10" id="y535f8259-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>knowingly fails to provide information required by the Sex Offender Registration and Notification Act relating to intended travel in foreign commerce; and</content></paragraph>
<paragraph class="fontsize10" id="y535f825a-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>engages or attempts to engage in the intended travel in foreign commerce;</content></paragraph>
<continuation class="fontsize10" id="x535f825b-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">shall be fined under this title, imprisoned not more than 10 years, or both.”</continuation></subsection>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y535f825d-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535f825e-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935d">42 USC 16935d</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><content>In carrying out this Act, and the amendments made by this Act, the Attorney General may use the resources and capacities of any appropriate agencies of the Department of Justice, including the Office of Sex Offender Sentencing, Monitoring, Apprehending, Registering, and Tracking, the United States Marshals Service, INTERPOL Washington-U.S. National Central Bureau, the Federal Bureau of Investigation, the Criminal Division, and the United States Attorneys’ Offices.</content></subsection>

<section id="d249054e1358" identifier="/us/pl/114/119/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x535f825f-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935e">42 USC 16935e</ref>.</p></sidenote><heading>RECIPROCAL NOTIFICATIONS.</heading><content style="-uslm-lc:I658120">  It is the sense of Congress that the Secretary of State, in consultation with the Attorney General and the Secretary of Homeland Security, should seek reciprocal international agreements or arrangements to further the purposes of this Act and the Sex Offender Registration and Notification Act (<ref href="/us/usc/t42/s16901/etseq">42 U.S.C. 16901 et seq.</ref>). Such agreements or arrangements may establish mechanisms and undertakings to receive and transmit notices concerning international travel by sex offenders, through the Angel Watch Center, the INTERPOL notification system, and such other means as may be appropriate, including notification by the United States to other countries relating to the travel of sex offenders from the United States, reciprocal notification by other countries to the United States relating to the travel of sex offenders to the United States, and mechanisms to correct and, as applicable, remove from any other records, any inaccurate information transmitted through such notifications.<page identifier="/us/stat/130/24">130 STAT. 24</page></content></section>
<section id="d249054e1375" identifier="/us/pl/114/119/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>UNIQUE PASSPORT IDENTIFIERS FOR COVERED SEX OFFENDERS.</heading><subsection class="firstIndent0 fontsize10" id="y535ff790-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s8/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Amendment to <ref href="/us/pl/110/457">Public Law 110–457</ref></inline>.—</heading><content><ref href="/us/pl/110/457/tII">Title II of Public Law 110–457</ref> <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y53606cc1-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="240">“SEC. 240. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x53606cc2-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s212b">22 USC 212b</ref>.</p></sidenote><heading class="fontsize12">UNIQUE PASSPORT IDENTIFIERS FOR COVERED SEX OFFENDERS.</heading><subsection class="firstIndent0 fontsize10" id="y53606cc3-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Immediately after receiving a written determination from the Angel Watch Center that an individual is a covered sex offender, through the process developed for that purpose under section 9 of the International Megan’s Law to Prevent Child Exploitation and Other Sexual Crimes Through Advanced Notification of Traveling Sex Offenders, the Secretary of State shall take appropriate action under subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y53606cc4-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Authority To Use Unique Passport Identifiers</inline>.—</heading><paragraph class="fontsize10" id="y53606cc5-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided under paragraph (2), the Secretary of State shall not issue a passport to a covered sex offender unless the passport contains a unique identifier, and may revoke a passport previously issued without such an identifier of a covered sex offender.</content></paragraph>
<paragraph class="fontsize10" id="y53606cc6-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Authority to reissue</inline>.—</heading><content>Notwithstanding paragraph (1), the Secretary of State may reissue a passport that does not include a unique identifier if an individual described in subsection (a) reapplies for a passport and the Angel Watch Center provides a written determination, through the process developed for that purpose under section 9 of the International Megan’s Law to Prevent Child Exploitation and Other Sexual Crimes Through Advanced Notification of Traveling Sex Offenders, to the Secretary of State that the individual is no longer required to register as a covered sex offender.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y53606cc7-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Defined Terms</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="y53606cc8-e86e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>the term ‘<term>covered sex offender</term>’ means an individual who—</chapeau><subparagraph class="fontsize10" id="y53606cc9-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is a sex offender, as defined in section 4(f) of the International Megan’s Law to Prevent Child Exploitation and Other Sexual Crimes Through Advanced Notification of Traveling Sex Offenders; and</content></subparagraph>
<subparagraph class="fontsize10" id="y53606cca-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is currently required to register under the sex offender registration program of any jurisdiction;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y53606ccb-e86e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the term ‘<term>unique identifier</term>’ means any visual designation affixed to a conspicuous location on the passport indicating that the individual is a covered sex offender; and</content></paragraph>
<paragraph class="fontsize10" id="y53606ccc-e86e-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the term ‘<term>passport</term>’ means a passport book or passport card.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y53606ccd-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>The Secretary of State, the Secretary of Homeland Security, and the Attorney General, and their agencies, officers, employees, and agents, shall not be liable to any person for any action taken under this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y53606cce-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Disclosure</inline>.—</heading><content>In furtherance of this section, the Secretary of State may require a passport applicant to disclose that they are a registered sex offender.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y53606ccf-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x53606cd0-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Certification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>This section shall take effect upon certification by the Secretary of State, the Secretary of Homeland Security, and the Attorney General, that the process developed and reported to the appropriate congressional committees under section 9 of the International Megan’s Law to Prevent Child Exploitation <page identifier="/us/stat/130/25">130 STAT. 25</page>
and Other Sexual Crimes Through Advanced Notification of Traveling Sex Offenders has been successfully implemented.”</content></subsection>

<section id="d249054e1517" identifier="/us/pl/114/119/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x53606cd1-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x53606cd2-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935f">42 USC 16935f</ref>.</p></sidenote><heading>IMPLEMENTATION PLAN.</heading><subsection class="firstIndent0 fontsize10" id="y5360baf3-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 90 days after the date of enactment of this Act, the Secretary of Homeland Security, the Secretary of State, and the Attorney General shall develop a process by which to implement section 4(e)(5) and the provisions of <ref href="/us/pl/110/457/s240">section 240 of Public Law 110–457</ref>, as added by section 8 of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5360baf4-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5360baf5-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reporting Requirement</inline>.—</heading><content>Not later than 90 days after the date of enactment of this Act, the Secretary of Homeland Security, the Secretary of State, and the Attorney General shall jointly submit a report to, and shall consult with, the appropriate congressional committees on the process developed under subsection (a), which shall include a description of the proposed process and a timeline and plan for implementation of that process, and shall identify the resources required to effectively implement that process.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5360baf6-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">“Appropriate Congressional Committees” Defined</inline>.—</heading><chapeau>In this section, the term “<term>appropriate congressional committees</term>” means—</chapeau><paragraph class="fontsize10" id="y5360baf7-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Foreign Relations of the Senate;</content></paragraph>
<paragraph class="fontsize10" id="y5360baf8-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Foreign Affairs of the House of Representatives;</content></paragraph>
<paragraph class="fontsize10" id="y5360baf9-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate;</content></paragraph>
<paragraph class="fontsize10" id="y5360bafa-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the Committee on Homeland Security of the House of Representatives;</content></paragraph>
<paragraph class="fontsize10" id="y5360bafb-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the Committee on the Judiciary of the Senate;</content></paragraph>
<paragraph class="fontsize10" id="y5360bafc-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>the Committee on the Judiciary of the House of Representatives;</content></paragraph>
<paragraph class="fontsize10" id="y5360bafd-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>the Committee on Appropriations of the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="y5360bafe-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/119/s9/c/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>the Committee on Appropriations of the House of Representatives.</content></paragraph>

<section id="d249054e1605" identifier="/us/pl/114/119/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5360e20f-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x5360e210-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935g">42 USC 16935g</ref>.</p></sidenote><heading>TECHNICAL ASSISTANCE.</heading><content style="-uslm-lc:I658120">  The Secretary of State, in consultation with the Attorney General and the Secretary of Homeland Security, may provide technical assistance to foreign authorities in order to enable such authorities to participate more effectively in the notification program system established under this Act.</content></section>
<section id="d249054e1619" identifier="/us/pl/114/119/s11" style="-uslm-lc:I658142"><num class="fontsize12" value="11">SEC. 11. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x5360e211-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s16935h">42 USC 16935h</ref>.</p></sidenote><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><content style="-uslm-lc:I658120">  There are authorized to be appropriated to carry out this Act $6,000,000 for each of fiscal years 2017 and 2018.</content></section>
