<section id="d249375e98" identifier="/us/pl/114/117/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Grants Oversight and New Efficiency Act</shortTitle>” or the “<shortTitle role="act">GONE Act</shortTitle>”.</content></section>
<section id="d249375e111" identifier="/us/pl/114/117/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>IDENTIFYING AND CLOSING OUT EXPIRED FEDERAL GRANT AWARDS.</heading><subsection class="firstIndent0 fontsize10" id="y9e05c469-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Expired Federal Grant Award Report</inline>.—</heading><paragraph class="fontsize10" id="y9e05c46a-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e05c46b-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall instruct the head of each agency, in coordination with the Secretary, to submit to Congress and the Secretary a report, not later than December 31 of the first calendar year beginning after the date of the enactment of this Act, that—</chapeau><subparagraph class="fontsize10" id="y9e05c46c-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e05c46d-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">List.</p></sidenote><content>lists each Federal grant award held by such agency;</content></subparagraph>
<subparagraph class="fontsize10" id="y9e05c46e-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>provides the total number of Federal grant awards, including the number of grants—</chapeau><clause class="fontsize10" id="y9e05c46f-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>by time period of expiration;</content></clause>
<clause class="fontsize10" id="y9e05c470-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>with zero dollar balances; and</content></clause>
<clause class="fontsize10" id="y9e05c471-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>with undisbursed balances;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9e05c472-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>for an agency with Federal grant awards, describes the challenges leading to delays in grant closeout; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9e05c473-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>for the 30 oldest Federal grant awards of an agency, explains why each Federal grant award has not been closed out.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9e05c474-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Use of data systems</inline>.—</heading><content>An agency may use existing multiagency data systems in order to submit the report required under paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="y9e05c475-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Explanation of missing information</inline>.—</heading><content>If the head of an agency is unable to submit all of the information required to be included in the report under paragraph (1), the report shall include an explanation of why the information was not available, including any shortcomings with and plans to improve existing grant systems, including data systems.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9e05c476-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e05c477-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Notice From Agencies</inline>.—</heading><paragraph class="fontsize10" id="y9e05c478-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 1 year after the date on which the head of an agency submits the report required under subsection (a), the head of such agency shall provide notice to the Secretary specifying whether the head of the agency has closed out grant awards associated with all of <page identifier="/us/stat/130/7">130 STAT. 7</page>
the Federal grant awards in the report and which Federal grant awards in the report have not been closed out.</content></paragraph>
<paragraph class="fontsize10" id="y9e05c479-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e05c47a-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Notice to congress</inline>.—</heading><content>Not later than 90 days after the date on which all of the notices required pursuant to paragraph (1) have been provided or March 31 of the calendar year following the calendar year described in subsection (a)(1), whichever is sooner, the Secretary shall compile the notices submitted pursuant to paragraph (1) and submit to Congress a report on such notices.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9e05c47b-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e05c47c-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x9e05c47d-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Risk assessment.</p><p class="leftAlign firstIndent0 fontsize8" id="x9e05c47e-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Inspector General Review</inline>.—</heading><content>Not later than 1 year after the date on which the head of an agency provides notice to Congress under subsection (b)(2), the Inspector General of an agency with more than $500,000,000 in annual grant funding shall conduct a risk assessment to determine if an audit or review of the agency’s grant closeout process is warranted.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9e05c47f-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e05c480-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="x9e05c481-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x9e05c482-e86e-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report on Accountability and Oversight</inline>.—</heading><content>Not later than 6 months after the date on which the second report is submitted pursuant to subsection (b)(2), the Director of Office of Management and Budget, in consultation with the Secretary, shall submit to Congress a report on recommendations, if any, for legislation to improve accountability and oversight in grants management, including the timely closeout of a Federal grant award.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9e05c483-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y9e05c484-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/e/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term “<term>agency</term>” has the meaning given that term in <ref href="/us/usc/t5/s551">section 551 of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y9e05c485-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/e/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Closeout</inline>.—</heading><content>The term “<term>closeout</term>” means a closeout of a Federal grant award conducted in accordance with <ref href="/us/cfr/t2/pt200">part 200 of title 2, Code of Federal Regulations</ref>, including sections 200.16 and 200.343 of such title, or any successor thereto.</content></paragraph>
<paragraph class="fontsize10" id="y9e05c486-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/e/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Federal grant award</inline>.—</heading><chapeau>The term “<term>Federal grant award</term>” means a Federal grant award (as defined in <ref href="/us/cfr/t2/s200.38/a/1">section 200.38(a)(1) of title 2, Code of Federal Regulations</ref>, or any successor thereto), including a cooperative agreement, in an agency cash payment management system held by the United States Government for which—</chapeau><subparagraph class="fontsize10" id="y9e05c487-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/e/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the grant award period of performance, including any extensions, has been expired for more than 2 years; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9e05c488-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/e/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>closeout has not yet occurred in accordance with <ref href="/us/cfr/t2/s200.343">section 200.343 of title 2, Code of Federal Regulations</ref>, or any successor thereto.<page identifier="/us/stat/130/8">130 STAT. 8</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9e05c489-e86e-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/117/s2/e/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Health and Human Services.</content></paragraph>
