<section id="d341809e94" identifier="/us/pl/114/116/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Child Nicotine Poisoning Prevention Act of 2015</shortTitle>”.</content></section>
<section id="d341809e104" identifier="/us/pl/114/116/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc330d80d-e86e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Commerce and trade.</p><p class="leftAlign firstIndent0 fontsize8" id="xc330d80e-e86e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Exports and imports.</p><p class="leftAlign firstIndent0 fontsize8" id="xc330d80f-e86e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s1472a">15 USC 1472a</ref>.</p></sidenote><heading>SPECIAL PACKAGING FOR LIQUID NICOTINE CONTAINERS.</heading><subsection class="firstIndent0 fontsize10" id="yc3317450-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content>Notwithstanding section 2(f)(2) of the Federal Hazardous Substances Act (<ref href="/us/usc/t15/s1261/f/2">15 U.S.C. 1261(f)(2)</ref>) and section 3(a)(5) of the Consumer Product Safety Act (<ref href="/us/usc/t15/s2052/a/5">15 U.S.C. 2052(a)(5)</ref>), any nicotine provided in a liquid nicotine container sold, offered for sale, manufactured for sale, distributed in commerce, or imported into the United States shall be packaged in accordance with the standards provided in <ref href="/us/cfr/t16/s1700.15">section 1700.15 of title 16, Code of Federal Regulations</ref>, as determined through testing in accordance with the method described in <ref href="/us/cfr/t16/s1700.20">section 1700.20 of title 16, Code of Federal Regulations</ref>, and any subsequent changes to such sections adopted by the Commission.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc3317451-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Savings Clause</inline>.—</heading><paragraph class="fontsize10" id="yc3317452-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Nothing in this Act shall be construed to limit or otherwise affect the authority of the Secretary of Health and Human Services to regulate, issue guidance, or take action regarding the manufacture, marketing, sale, distribution, importation, or packaging, including child-resistant packaging, of nicotine, liquid nicotine, liquid nicotine containers, electronic cigarettes, electronic nicotine delivery systems or other similar products that contain or dispense liquid nicotine, or any other nicotine-related products, including—</chapeau><subparagraph class="fontsize10" id="yc3317453-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>authority under the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s301/etseq">21 U.S.C. 301 et seq.</ref>) and the Family Smoking Prevention and Tobacco Control Act (<ref href="/us/pl/111/31">Public Law 111–31</ref>) and the amendments made by such Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc3317454-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>authority for the rulemaking entitled “Deeming Tobacco Products to Be Subject to the Federal Food, Drug, and Cosmetic Act, as Amended by the Family Smoking Prevention and Tobacco Control Act; regulations on the Sale and Distribution of Tobacco Products and the Required Warning Statements for Tobacco Products” (April 2014) (FDA–2014–N–0189), the rulemaking entitled “Nicotine Exposure Warnings and Child-Resistant Packaging for Liquid Nicotine, Nicotine-Containing E-Liquid(s), and Other Tobacco Products” (June 2015) (FDA–2015–N–1514), <page identifier="/us/stat/130/4">130 STAT. 4</page>
and subsequent actions by the Secretary regarding packaging of liquid nicotine containers.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc3317455-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>If the Secretary of Health and Human Services adopts, maintains, enforces, or imposes or continues in effect any packaging requirement for liquid nicotine containers, including a child-resistant packaging requirement, the Secretary shall consult with the Commission, taking into consideration the expertise of the Commission in implementing and enforcing this Act and the Poison Prevention Packaging Act of 1970 (<ref href="/us/usc/t15/s1471/etseq">15 U.S.C. 1471 et seq.</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc3317456-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>Notwithstanding section 3(a)(5) of the Consumer Product Safety Act (<ref href="/us/usc/t15/s2052/a/5">15 U.S.C. 2052(a)(5)</ref>) and section 2(f)(2) of the Federal Hazardous Substances Act (<ref href="/us/usc/t15/s1261/f/2">15 U.S.C. 1261(f)(2)</ref>), the requirement of subsection (a) shall be treated as a standard for the special packaging of a household substance established under section 3(a) of the Poison Prevention Packaging Act of 1970 (<ref href="/us/usc/t15/s1472/a">15 U.S.C. 1472(a)</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc3317457-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yc3317458-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Commission</inline>.—</heading><content>The term “<term>Commission</term>” means the Consumer Product Safety Commission.</content></paragraph>
<paragraph class="fontsize10" id="yc3317459-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Liquid nicotine container</inline>.—</heading><subparagraph class="fontsize10" id="yc331745a-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d/2/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Notwithstanding section 2(f)(2) of the Federal Hazardous Substances Act (<ref href="/us/usc/t15/s1261/f/2">15 U.S.C. 1261(f)(2)</ref>) and section 3(a)(5) of the Consumer Product Safety Act (<ref href="/us/usc/t15/s2052/a/5">15 U.S.C. 2052(a)(5)</ref>), the term “<term>liquid nicotine container</term>” means a package (as defined in section 2 of the Poison Prevention Packaging Act of 1970 (<ref href="/us/usc/t15/s1471">15 U.S.C. 1471</ref>))—</chapeau><clause class="fontsize10" id="yc331745b-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>from which nicotine in a solution or other form is accessible through normal and foreseeable use by a consumer; and</content></clause>
<clause class="fontsize10" id="yc331745c-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>that is used to hold soluble nicotine in any concentration.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc331745d-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d/2/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusion</inline>.—</heading><content>The term “<term>liquid nicotine container</term>” does not include a sealed, pre-filled, and disposable container of nicotine in a solution or other form in which such container is inserted directly into an electronic cigarette, electronic nicotine delivery system, or other similar product, if the nicotine in the container is inaccessible through customary or reasonably foreseeable handling or use, including reasonably foreseeable ingestion or other contact by children.</content></subparagraph>

<paragraph class="fontsize10" id="yc331745e-e86e-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/114/116/s2/d/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Nicotine</inline>.—</heading><content>The term “<term>nicotine</term>” means any form of the chemical nicotine, including any salt or complex, regardless of whether the chemical is naturally or synthetically derived.<page identifier="/us/stat/130/5">130 STAT. 5</page></content></paragraph>

<section id="d341809e286" identifier="/us/pl/114/116/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc331745f-e86e-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s1472a">15 USC 1472a note</ref>.</p></sidenote><heading>EFFECTIVE DATE.</heading><content style="-uslm-lc:I658120">  This Act shall take effect on the date that is 180 days after the date of the enactment of this Act.</content></section>
