<section id="d249723e88" identifier="/us/pl/114/114/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x087e8b3e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s301">21 USC 301 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Microbead-Free Waters Act of 2015</shortTitle>”.</content></section>
<section id="d249723e103" identifier="/us/pl/114/114/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROHIBITION AGAINST SALE OR DISTRIBUTION OF RINSE-OFF COSMETICS CONTAINING PLASTIC MICROBEADS.</heading><subsection class="firstIndent0 fontsize10" id="y087f277f-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 301 of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s331">21 U.S.C. 331</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y087f2780-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="ddd">“(ddd)</num><paragraph class="inline" id="y087f2781-e86f-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>The manufacture or the introduction or delivery for introduction into interstate commerce of a rinse-off cosmetic that contains intentionally-added plastic microbeads.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y087f4e92-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x087f4e93-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>In this paragraph—</chapeau><subparagraph class="fontsize10" id="y087f4e94-e86f-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the term ‘<term>plastic microbead</term>’ means any solid plastic particle that is less than five millimeters in size and is intended to be used to exfoliate or cleanse the human body or any part thereof; and</content></subparagraph>
<subparagraph class="fontsize10" id="y087f4e95-e86f-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the term ‘<term>rinse-off cosmetic</term>’ includes toothpaste.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y087f4e96-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x087f4e97-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective dates.</p><p class="leftAlign firstIndent0 fontsize8" id="x087f4e98-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s331">21 USC 331 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.</heading><paragraph class="fontsize10" id="y087f4e99-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The amendment made by subsection (a) applies—</chapeau><subparagraph class="fontsize10" id="y087f4e9a-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>with respect to manufacturing, beginning on July 1, 2017, and with respect to introduction or delivery for introduction into interstate commerce, beginning on July 1, 2018; and</content></subparagraph>
<subparagraph class="fontsize10" id="y087f4e9b-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>notwithstanding subparagraph (A), in the case of a rinse-off cosmetic that is a nonprescription drug, with respect to manufacturing, beginning on July 1, 2018, and with respect to the introduction or delivery for introduction into interstate commerce, beginning on July 1, 2019.</content></subparagraph>

<paragraph class="fontsize10" id="y087f4e9c-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/b/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Nonprescription drug</inline>.—</heading><content>For purposes of this subsection, the term “<term>nonprescription drug</term>” means a drug not subject to section 503(b)(1) of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s353/b/1">21 U.S.C. 353(b)(1)</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y087f4e9d-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x087f4e9e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s331">21 USC 331 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Preemption of State Laws</inline>.—</heading><content>No State or political subdivision of a State may directly or indirectly establish under any authority or continue in effect restrictions with respect to the manufacture or introduction or delivery for introduction into interstate <page identifier="/us/stat/129/3130">129 STAT. 3130</page>
commerce of rinse-off cosmetics containing plastic microbeads (as defined in section 301(ddd) of the Federal Food, Drug, and Cosmetic Act, as added by subsection (a)) that are not identical to the restrictions under such section 301(ddd) that have begun to apply under subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y087f4e9f-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/114/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x087f4ea0-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t21/s331">21 USC 331 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this Act (or the amendments made by this Act) shall be construed to apply with respect to drugs that are not also cosmetics (as such terms are defined in section 201 of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s321">21 U.S.C. 321</ref>)).</content></subsection>
