<subparagraph class="fontsize10" id="y9f25707b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the Committee on Transportation and Infrastructure of the House of Representatives.</content></subparagraph>

<subparagraph class="fontsize10" id="y9f25bea4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>at least 2 members shall be individuals with professional or business experience (including agriculture) in the private sector.”</content></subparagraph>

<section id="d250042e1086" identifier="/us/pl/114/110/s9" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>DEPARTMENT OF TRANSPORTATION INSPECTOR GENERAL AUTHORITY.</heading><content class="firstIndent0 fontsize10" id="x9f2792a9-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Subchapter II of chapter 13, as redesignated by section 3(a)(2), <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 1325, as redesignated by section 3(a)(6), the following:<quotedContent><section class="centered fontsize12" id="y9f27e0ca-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658164"><num class="fontsize12" value="1326">“§ 1326.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f27e0cb-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s1326">49 USC 1326</ref>.</p></sidenote> Authority of the Inspector General</heading><subsection class="firstIndent0 fontsize10" id="y9f27e0cc-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Inspector General of the Department of Transportation, in accordance with the mission of the Inspector General to prevent and detect fraud and abuse, shall have authority to review only the financial management, property management, and business operations of the Surface Transportation Board, including internal accounting and administrative control systems, to determine the Board’s compliance with applicable Federal laws, rules, and regulations.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9f27e0cd-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau>In carrying out this section, the Inspector General shall—</chapeau><paragraph class="fontsize10" id="y9f27e0ce-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>keep the Chairman of the Board, the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Transportation and Infrastructure of the House of Representatives fully and currently informed about problems relating to administration of the internal accounting and administrative control systems of the Board;</content></paragraph>
<paragraph class="fontsize10" id="y9f27e0cf-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>issue findings and recommendations for actions to address the problems referred to in paragraph (1); and</content></paragraph>
<paragraph class="fontsize10" id="y9f27e0d0-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f27e0d1-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><content>submit periodic reports to the Committee on Commerce, Science, and Transportation of the Senate, and the Committee on Transportation and Infrastructure of the House of Representatives that describe any progress made in implementing actions to address the problems referred to in paragraph (1).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y9f27e0d2-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Access to Information</inline>.—</heading><content>In carrying out this section, the Inspector General may exercise authorities granted to the Inspector General under subsections (a) and (b) of section 6 of the Inspector General Act of 1978 (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9f27e0d3-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><paragraph class="fontsize10" id="y9f27e0d4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><content>There are authorized to be appropriated to the Secretary of Transportation for use by the Inspector <page identifier="/us/stat/129/2233">129 STAT. 2233</page>

<clause class="fontsize10" id="y9f287d28-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f287d29-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Records.</p></sidenote><content>The development of the evidentiary record shall be completed not later than 155 days after the date on  which discovery is completed under clause (i).</content></clause>
<clause class="fontsize10" id="y9f287d2a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>The closing brief shall be submitted not later than 60 days after the date on which the development of the evidentiary record is completed under clause (ii).</content></clause>
<clause class="fontsize10" id="y9f287d2b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>A final Board decision shall be issued not later than 180 days after the date on which the evidentiary record is completed under clause (ii).<page identifier="/us/stat/129/2234">129 STAT. 2234</page></content></clause>

<subsection class="firstIndent0 fontsize10" id="y9f28f265-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/110/s12/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Limitations on Investigations of the Board’s Initiative</inline>.—</heading><content>Section 11701, as amended by subsection (a), is further amended by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y9f296796-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f296797-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><chapeau>In any investigation commenced on the Board’s own initiative, the Board shall—</chapeau><paragraph class="fontsize10" id="y9f296798-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f296799-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notice.</p></sidenote><content>not later than 30 days after initiating the investigation, provide written notice to the parties under investigation, which shall state the basis for such investigation;</content></paragraph>
<paragraph class="fontsize10" id="y9f29679a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>only investigate issues that are of national or regional significance;</content></paragraph>
<paragraph class="fontsize10" id="y9f29679b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>permit the parties under investigation to file a written statement describing any or all facts and circumstances concerning a matter which may be the subject of such investigation;</content></paragraph>
<paragraph class="fontsize10" id="y9f29679c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f29679d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x9f29679e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><chapeau>make available to the parties under investigation and Board members—</chapeau><subparagraph class="fontsize10" id="y9f29679f-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>any recommendations made as a result of the investigation; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2967a0-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a summary of the findings that support such recommendations;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9f2967a1-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>to the extent practicable, separate the investigative and decisionmaking functions of staff;</content></paragraph>
<paragraph class="fontsize10" id="y9f2967a2-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>dismiss any investigation that is not concluded by the Board with administrative finality within 1 year after the date on which it was commenced; and</content></paragraph>
<paragraph class="fontsize10" id="y9f2967a3-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><chapeau>not later than 90 days after receiving the recommendations and summary of findings under paragraph (4)—</chapeau><subparagraph class="fontsize10" id="y9f2967a4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>dismiss the investigation if no further action is warranted; or</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2967a5-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>initiate a proceeding to determine if a provision under this part has been violated.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y9f2967a6-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e)</num><paragraph class="inline" id="y9f2967a7-e86f-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2967a8-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>Any parties to an investigation against whom a violation is found as a result of an investigation begun on the Board’s own initiative may, not later than 60 days after the date of the order of the Board finding such a violation, institute an action in the United States court of appeals for the appropriate judicial circuit for de novo review of such order in accordance with chapter 7 of title 5.<page identifier="/us/stat/129/2235">129 STAT. 2235</page></content></paragraph>

<section id="d250042e1672" identifier="/us/pl/114/110/s13" style="-uslm-lc:I658142"><num class="fontsize12" value="13">SEC. 13. </num><heading>ARBITRATION OF CERTAIN RAIL RATES AND PRACTICES DISPUTES.</heading><subsection class="firstIndent0 fontsize10" id="y9f2a5213-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/110/s13/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Chapter 117 <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y9f2b6384-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658165"><num class="fontsize12" value="11708">“§ 11708.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2b6385-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s11708">49 USC 11708</ref>.</p></sidenote> Voluntary arbitration of certain rail rates and practices disputes</heading><subsection class="firstIndent0 fontsize10" id="y9f2b6386-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2b6387-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x9f2b6388-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Regulations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 1 year after the date of the enactment of the Surface Transportation Board Reauthorization Act of 2015, the Board shall promulgate regulations to establish a voluntary and binding arbitration process to resolve rail rate and practice complaints subject to the jurisdiction of the Board.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9f2b6389-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Covered Disputes</inline>.—</heading><chapeau>The voluntary and binding arbitration process established pursuant to subsection (a)—</chapeau><paragraph class="fontsize10" id="y9f2b638a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2b638b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><chapeau>shall apply to disputes involving—</chapeau><subparagraph class="fontsize10" id="y9f2b638c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>rates, demurrage, accessorial charges, misrouting, or mishandling of rail cars; or</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b638d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a carrier’s published rules and practices as applied to particular rail transportation;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9f2b638e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>shall not apply to disputes—</chapeau><subparagraph class="fontsize10" id="y9f2b638f-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to obtain the grant, denial, stay, or revocation of any license, authorization, or exemption;</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b6390-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>to prescribe for the future any conduct, rules, or results of general, industry-wide applicability;</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b6391-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>to enforce a labor protective condition; or</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b6392-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>that are solely between 2 or more rail carriers; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9f2b6393-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>shall not prevent parties from independently seeking or utilizing private arbitration services to resolve any disputes the parties may have.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9f2b6394-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Arbitration Procedures</inline>.—</heading><paragraph class="fontsize10" id="y9f2b6395-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Board—</chapeau><subparagraph class="fontsize10" id="y9f2b6396-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>may make the voluntary and binding arbitration process established pursuant to subsection (a) available only to the relevant parties;</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b6397-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>may make the voluntary and binding arbitration process available only—</chapeau><clause class="fontsize10" id="y9f2b6398-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>after receiving the written consent to arbitrate from all relevant parties; and</content></clause>
<clause class="fontsize10" id="y9f2b6399-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii)</num><subclause class="inline" id="y9f2b639a-e86f-11f0-a1e4-69761a48a15a"><num value="I">(I) </num><content>after the filing of a written complaint; or<page identifier="/us/stat/129/2236">129 STAT. 2236</page></content></subclause>
<subclause class="indentUp0 fontsize10" id="y9f2b639b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>through other procedures adopted by the Board in a rulemaking proceeding;</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9f2b639c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>with respect to rate disputes, may make the voluntary and binding arbitration process available only to the relevant parties if the rail carrier has market dominance (as determined under section 10707); and</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b639d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2b639e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>may initiate the voluntary and binding arbitration process not later than 40 days after the date on which a written complaint is filed or through other procedures adopted by the Board in a rulemaking proceeding.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9f2b639f-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>Initiation of the voluntary and binding arbitration process shall preclude the Board from separately reviewing a complaint or dispute related to the same rail rate or practice in a covered dispute involving the same parties.</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63a0-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Rates</inline>.—</heading><content>In resolving a covered dispute involving the reasonableness of a rail carrier’s rates, the arbitrator or panel of arbitrators, as applicable, shall consider the Board’s methodologies for setting maximum lawful rates, giving due consideration to the need for differential pricing to permit a rail carrier to collect adequate revenues (as determined under section 10704(a)(2)).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9f2b63a1-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Arbitration Decisions</inline>.—</heading><chapeau>Any decision reached in an arbitration process under this section—</chapeau><paragraph class="fontsize10" id="y9f2b63a2-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>shall be consistent with sound principles of rail regulation economics;</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63a3-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>shall be in writing;</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63a4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>shall contain findings of fact and conclusions;</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63a5-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>shall be binding upon the parties; and</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63a6-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>shall not have any precedential effect in any other or subsequent arbitration dispute.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9f2b63a7-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2b63a8-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Timelines</inline>.—</heading><paragraph class="fontsize10" id="y9f2b63a9-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Selection</inline>.—</heading><content>An arbitrator or panel of arbitrators shall be selected not later than 14 days after the date of the Board’s decision to initiate arbitration.</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63aa-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Evidentiary process</inline>.—</heading><chapeau>The evidentiary process of the voluntary and binding arbitration process shall be completed not later than 90 days after the date on which the arbitration process is initiated unless—</chapeau><subparagraph class="fontsize10" id="y9f2b63ab-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a party requests an extension; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b63ac-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the arbitrator or panel of arbitrators, as applicable, grants such extension request.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9f2b63ad-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Decision</inline>.—</heading><content>The arbitrator or panel of arbitrators, as applicable, shall issue a decision not later than 30 days after the date on which the evidentiary record is closed.</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63ae-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Extensions</inline>.—</heading><content>The Board may extend any of the timelines under this subsection upon the agreement of all parties in the dispute.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9f2b63af-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Arbitrators</inline>.—</heading><paragraph class="fontsize10" id="y9f2b63b0-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Unless otherwise agreed by all of the parties, an arbitration under this section shall be conducted by an arbitrator or panel of arbitrators, which shall be selected from a roster, maintained by the Board, of persons with rail transportation, economic regulation, professional or business experience, including agriculture, in the private sector.</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63b1-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Independence</inline>.—</heading><content>In an arbitration under this section, the arbitrators shall perform their duties with diligence, good <page identifier="/us/stat/129/2237">129 STAT. 2237</page>
faith, and in a manner consistent with the requirements of impartiality and independence.</content></paragraph>
<paragraph class="fontsize10" id="y9f2b63b2-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Selection</inline>.—</heading><subparagraph class="fontsize10" id="y9f2b63b3-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If the parties cannot mutually agree on an arbitrator, or the lead arbitrator of a panel of arbitrators, the parties shall select the arbitrator or lead arbitrator from the roster by alternately striking names from the roster until only 1 name remains meeting the criteria set forth in paragraph (1).</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b63b4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Panel of arbitrators</inline>.—</heading><chapeau>If the parties agree to select a panel of arbitrators, instead of a single arbitrator, the panel shall be selected under this subsection as follows:</chapeau><clause class="fontsize10" id="y9f2b63b5-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>The parties to a dispute may mutually select 1 arbitrator from the roster to serve as the lead arbitrator of the panel of arbitrators.</content></clause>
<clause class="fontsize10" id="y9f2b8ac6-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>If the parties cannot mutually agree on a lead arbitrator, the parties shall select a lead arbitrator using the process described in subparagraph (A).</content></clause>
<clause class="fontsize10" id="y9f2b8ac7-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>In addition to the lead arbitrator selected under this subparagraph, each party to a dispute shall select 1 additional arbitrator from the roster, regardless of whether the other party struck out the arbitrator’s name under subparagraph (A).</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9f2b8ac8-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Cost</inline>.—</heading><content>The parties shall share the costs incurred by the Board and arbitrators equally, with each party responsible for paying its own legal and other associated arbitration costs.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9f2b8ac9-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Relief</inline>.—</heading><paragraph class="fontsize10" id="y9f2b8aca-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to the limitations set forth in paragraphs (2) and (3), an arbitral decision under this section may award the payment of damages or rate prescriptive relief.</content></paragraph>
<paragraph class="fontsize10" id="y9f2b8acb-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Practice disputes</inline>.—</heading><content>The damage award for practice disputes may not exceed $2,000,000.</content></paragraph>
<paragraph class="fontsize10" id="y9f2b8acc-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Rate disputes</inline>.—</heading><subparagraph class="fontsize10" id="y9f2b8acd-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Monetary limit</inline>.—</heading><content>The damage award for rate disputes, including any rate prescription, may not exceed $25,000,000.</content></subparagraph>
<subparagraph class="fontsize10" id="y9f2b8ace-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Time limit</inline>.—</heading><content>Any rate prescription shall be limited to not longer than 5 years from the date of the arbitral decision.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y9f2b8acf-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2b8ad0-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Board Review</inline>.—</heading><chapeau>If a party appeals a decision under this section to the Board, the Board may review the decision under this section to determine if—</chapeau><paragraph class="fontsize10" id="y9f2b8ad1-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the decision is consistent with sound principles of rail regulation economics;</content></paragraph>
<paragraph class="fontsize10" id="y9f2b8ad2-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>a clear abuse of arbitral authority or discretion occurred;</content></paragraph>
<paragraph class="fontsize10" id="y9f2b8ad3-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the decision directly contravenes statutory authority; or</content></paragraph>
<paragraph class="fontsize10" id="y9f2b8ad4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>the award limitation under subsection (g) was violated.”</content></paragraph>

<section id="d250042e2187" identifier="/us/pl/114/110/s15" style="-uslm-lc:I658142"><num class="fontsize12" value="15">SEC. 15. </num><heading>REPORTS.</heading><subsection class="firstIndent0 fontsize10" id="y9f2bd8ff-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/110/s15/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Report on Rate Case Methodology</inline>.—</heading><chapeau>Not later than 1 year after the date of the enactment of this Act, the Surface Transportation Board shall submit a report to the congressional committees referred to in section 14(b) that—</chapeau><paragraph class="fontsize10" id="y9f2bd900-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/110/s15/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>indicates whether current large rate case methodologies are sufficient, not unduly complex, and cost effective;</content></paragraph>
<paragraph class="fontsize10" id="y9f2bd901-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/110/s15/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>indicates whether alternative methodologies exist, or could be developed, to streamline, expedite, and address the complexity of large rate cases; and</content></paragraph>
<paragraph class="fontsize10" id="y9f2bd902-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/110/s15/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>only includes alternative methodologies, which exist or could be developed, that are consistent with sound economic principles.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y9f2bd903-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/110/s15/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9f2bd904-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="x9f2bd905-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s1304">49 USC 1304 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Quarterly Reports</inline>.—</heading><content>Beginning not later than 60 days after the date of the enactment of this Act, the Surface Transportation Board shall submit quarterly reports to the congressional committees referred to in section 14(b) that describes the Surface Transportation Board’s progress toward addressing the issues raised in each unfinished regulatory proceeding, regardless of whether the proceeding is subject to a statutory or regulatory deadline.</content></subsection>
