<paragraph class="fontsize10" id="yc4915d65-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Cost-effective energy efficiency measure</inline>.—</heading><content>The term “<term>cost-effective energy efficiency measure</term>” means any building product, material, equipment, or service, and the installing, implementing, or operating thereof, that provides energy savings in an amount that is not less than the cost of such installing, implementing, or operating.</content></paragraph>
<paragraph class="fontsize10" id="yc4915d66-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Cost-effective water efficiency measure</inline>.—</heading><content>The term “<term>cost-effective water efficiency measure</term>” means any building product, material, equipment, or service, and the installing, implementing, or operating thereof, that provides water savings in an amount that is not less than the cost of such installing, implementing, or operating.</content></paragraph>

<paragraph class="fontsize10" id="yc4915d68-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4915d69-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xc4915d6a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="xc4915d6b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xc4915d6c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Administrator, in consultation with the Secretary of Energy and after providing the public with an opportunity for notice and comment, shall develop model commercial leasing provisions and best practices in accordance with this subsection.</content></paragraph>
<paragraph class="fontsize10" id="yc4915d6d-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Commercial leasing</inline>.—</heading><subparagraph class="fontsize10" id="yc4915d6e-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The model commercial leasing provisions developed under this subsection shall, at a minimum, align the interests of building owners and tenants with regard to investments in cost-effective energy efficiency measures and cost-effective water efficiency measures to encourage building owners and tenants to collaborate to invest in such measures.</content></subparagraph>
<subparagraph class="fontsize10" id="yc4915d6f-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Use of model provisions</inline>.—</heading><content>The Administrator may use the model commercial leasing provisions developed under this subsection in any standard leasing document that designates a Federal agency (or other client of the Administrator) as a landlord or tenant.</content></subparagraph>
<subparagraph class="fontsize10" id="yc4915d70-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Publication</inline>.—</heading><content>The Administrator shall periodically publish the model commercial leasing provisions developed under this subsection, along with explanatory materials, to encourage building owners and tenants in the private sector to use such provisions and materials.</content></subparagraph>

<paragraph class="fontsize10" id="yc4915d71-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Realty services</inline>.—</heading><content>The Administrator shall develop policies and practices to implement cost-effective energy efficiency measures and cost-effective water efficiency measures for the realty services provided by the Administrator to Federal agencies (or other clients of the Administrator), including periodic training of appropriate Federal employees and contractors on how to identify and evaluate those measures.</content></paragraph>
<paragraph class="fontsize10" id="yc4915d72-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s102/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4915d73-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">State and local assistance</inline>.—</heading><content>The Administrator, in consultation with the Secretary of Energy, shall make available model commercial leasing provisions and best practices developed under this subsection to State, county, and municipal governments for use in managing owned and leased building space in accordance with the goal of encouraging investment in all cost-effective energy efficiency measures and cost-effective water efficiency measures.</content></paragraph>

<section id="d250238e337" identifier="/us/pl/114/11/tI/s103" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><heading>SEPARATE SPACES WITH HIGH-PERFORMANCE ENERGY EFFICIENCY MEASURES.</heading><subsection class="firstIndent0 fontsize10" id="yc491d2a4-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tI/s103/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subtitle B of title IV of the Energy Independence and Security Act of 2007 (<ref href="/us/usc/t42/s17081/etseq">42 U.S.C. 17081 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="yc49295f5-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="424">“SEC. 424. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc49295f6-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s17084">42 USC 17084</ref>.</p></sidenote><heading class="fontsize12">SEPARATE SPACES WITH HIGH-PERFORMANCE ENERGY EFFICIENCY MEASURES.</heading><subsection class="firstIndent0 fontsize10" id="yc49295f7-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yc49295f8-e86f-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">High-performance energy efficiency measure</inline>.—</heading><content>The term ‘<term>high-performance energy efficiency measure</term>’ means a technology, product, or practice that will result in substantial operational cost savings by reducing energy consumption and utility costs.</content></paragraph>
<paragraph class="fontsize10" id="yc492bd09-e86f-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Separate spaces</inline>.—</heading><content>The term ‘<term>separate spaces</term>’ means areas within a commercial building that are leased or otherwise occupied by a tenant or other occupant for a period of time pursuant to the terms of a written agreement.<page identifier="/us/stat/129/184">129 STAT. 184</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc492bd0a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Study</inline>.—</heading><paragraph class="fontsize10" id="yc492bd0b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc492bd0c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this section, the Secretary, acting through the Assistant Secretary of Energy Efficiency and Renewable Energy, shall complete a study on the feasibility of—</chapeau><subparagraph class="fontsize10" id="yc492bd0d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>significantly improving energy efficiency in commercial buildings through the design and construction, by owners and tenants, of separate spaces with high-performance energy efficiency measures; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc492bd0e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>encouraging owners and tenants to implement high-performance energy efficiency measures in separate spaces.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc492bd0f-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Scope</inline>.—</heading><chapeau>The study shall, at a minimum, include—</chapeau><subparagraph class="fontsize10" id="yc492bd10-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>descriptions of—</chapeau><clause class="fontsize10" id="yc492bd11-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>high-performance energy efficiency measures that should be considered as part of the initial design and construction of separate spaces;</content></clause>
<clause class="fontsize10" id="yc492bd12-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>processes that owners, tenants, architects, and engineers may replicate when designing and constructing separate spaces with high-performance energy efficiency measures;</content></clause>
<clause class="fontsize10" id="yc492bd13-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>policies and best practices to achieve reductions in energy intensities for lighting, plug loads, heating, cooling, cooking, laundry, and other systems to satisfy the needs of the commercial building tenant;</content></clause>
<clause class="fontsize10" id="yc492bd14-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>return on investment and payback analyses of the incremental cost and projected energy savings of the proposed set of high-performance energy efficiency measures, including consideration of available incentives;</content></clause>
<clause class="fontsize10" id="yc492bd15-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>models and simulation methods that predict the quantity of energy used by separate spaces with high-performance energy efficiency measures and that compare that predicted quantity to the quantity of energy used by separate spaces without high-performance energy efficiency measures but that otherwise comply with applicable building code requirements;</content></clause>
<clause class="fontsize10" id="yc492bd16-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>measurement and verification platforms demonstrating actual energy use of high-performance energy efficiency measures installed in separate spaces, and whether such measures generate the savings intended in the initial design and construction of the separate spaces;</content></clause>
<clause class="fontsize10" id="yc492bd17-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>best practices that encourage an integrated approach to designing and constructing separate spaces to perform at optimum energy efficiency in conjunction with the central systems of a commercial building; and</content></clause>
<clause class="fontsize10" id="yc492bd18-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">“(viii) </num><content>any impact on employment resulting from the design and construction of separate spaces with high-performance energy efficiency measures; and</content></clause>
</subparagraph>

<subsection class="firstIndent0 fontsize10" id="yc493cd97-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Tenant Star</inline>.—</heading><content>The Administrator of the Environmental Protection Agency, in consultation with the Secretary of Energy, shall develop a voluntary program within the Energy Star program established by section 324A of the Energy Policy and Conservation Act (<ref href="/us/usc/t42/s6294a">42 U.S.C. 6294a</ref>), which may be known as ‘Tenant Star’, to promote energy efficiency in separate spaces leased by tenants or otherwise occupied within commercial buildings.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc493cd98-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Expanding Survey Data</inline>.—</heading><chapeau>The Secretary of Energy, acting through the Administrator of the Energy Information Administration, shall—</chapeau><paragraph class="fontsize10" id="yc493cd99-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>collect, through each Commercial Buildings Energy Consumption Survey of the Energy Information Administration that is conducted after the date of enactment of this section, data on—</chapeau><subparagraph class="fontsize10" id="yc493cd9a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>categories of building occupancy that are known to consume significant quantities of energy, such as occupancy by data centers, trading floors, and restaurants; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc493cd9b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>other aspects of the property, building operation, or building occupancy determined by the Administrator of the Energy Information Administration, in consultation with the Administrator of the Environmental Protection Agency, to be relevant in lowering energy consumption;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc493cd9c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>with respect to the first Commercial Buildings Energy Consumption Survey conducted after the date of enactment of this section, to the extent full compliance with the requirements of paragraph (1) is not feasible, conduct activities to develop the capability to collect such data and begin to collect such data; and</content></paragraph>
<paragraph class="fontsize10" id="yc493cd9d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc493cd9e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><content>make data collected under paragraphs (1) and (2) available to the public in aggregated form and provide such data, <page identifier="/us/stat/129/186">129 STAT. 186</page>
and any associated results, to the Administrator of the Environmental Protection Agency for use in accordance with subsection (d).</content></paragraph>

<subparagraph class="fontsize10" id="yc493cda4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>establish building occupancy categories eligible for Tenant Star recognition based on the data collected under subsection (c) and any other appropriate data sources; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc493cda5-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>consider other forms of recognition for commercial building tenants or other occupants that lower energy consumption in separate spaces.</content></subparagraph>

50 percent of the rated first hour delivery of hot water certified by the manufacturer.</content></clause>
<clause class="fontsize10" id="yc495c97e-e86f-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Grid-enabled water heater</inline>.—</heading><chapeau>The term ‘<term>grid-enabled water heater</term>’ means an electric resistance water heater that—</chapeau><subclause class="fontsize10" id="yc495c97f-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>has a rated storage tank volume of more than 75 gallons;</content></subclause>
<subclause class="fontsize10" id="yc495c980-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>is manufactured on or after April 16, 2015;</content></subclause>
<subclause class="fontsize10" id="yc495c981-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><chapeau>has—</chapeau><item class="fontsize10" id="yc495c982-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><chapeau>an energy factor of not less than 1.061 minus the product obtained by multiplying—</chapeau><subitem class="fontsize10" id="yc495c983-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="AA">“(AA) </num><content>the rated storage volume of the tank, expressed in gallons; and</content></subitem>
<subitem class="fontsize10" id="yc495c984-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658131"><num class="fontsize10" style="-uslm-lc:emspace2" value="BB">“(BB) </num><content>0.00168; or</content></subitem>
</item>
<item class="fontsize10" id="yc495c985-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>an equivalent alternative standard prescribed by the Secretary and developed pursuant to paragraph (5)(E);</content></item>
</subclause>
<subclause class="fontsize10" id="yc495c986-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>is equipped at the point of manufacture with an activation lock; and</content></subclause>
<subclause class="fontsize10" id="yc495c987-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">“(V) </num><chapeau>bears a permanent label applied by the manufacturer that—</chapeau><item class="fontsize10" id="yc495c988-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>is made of material not adversely affected by water;</content></item>
<item class="fontsize10" id="yc495c989-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>is attached by means of non-water-soluble adhesive; and</content></item>
<item class="fontsize10" id="yc495c98a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>advises purchasers and end-users of the intended and appropriate use of the product with the following notice printed in 16.5 point Arial Narrow Bold font:<quotedContent><p class="indentDown4 firstIndent0 fontsize10" id="xc495c98b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">“ ‘IMPORTANT INFORMATION: This water heater is intended only for use as part of an electric thermal storage or demand response program. It will not provide adequate hot water unless enrolled in such a program and activated by your utility company or another program operator. Confirm the availability of a program in your local area before purchasing or installing this product.’.</p></quotedContent></content></item>
</subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc495c98c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content>The manufacturer or private labeler shall provide the activation key for a grid-enabled water heater only to a utility or other company that operates an electric thermal storage or demand response program that uses such a grid-enabled water heater.</content></subparagraph>
<subparagraph class="fontsize10" id="yc495c98d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><clause class="fontsize10" id="yc495c98e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Manufacturers</inline>.—</heading><content>The Secretary shall require each manufacturer of grid-enabled water heaters to report to the Secretary annually the quantity of grid-enabled water heaters that the manufacturer ships each year.</content></clause>
<clause class="fontsize10" id="yc495c98f-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc495c990-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Operators</inline>.—</heading><content>The Secretary shall require utilities and other demand response and thermal storage program operators to report annually the quantity of grid-enabled water heaters activated for their programs using forms of the Energy Information Agency or using such other mechanism that the Secretary determines appropriate after an opportunity for notice and comment.<page identifier="/us/stat/129/188">129 STAT. 188</page></content></clause>
<clause class="fontsize10" id="yc495c991-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Confidentiality requirements</inline>.—</heading><content>The Secretary shall treat shipment data reported by manufacturers as confidential business information.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc495c992-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Publication of information</inline>.—</heading><clause class="fontsize10" id="yc495c993-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In 2017 and 2019, the Secretary shall publish an analysis of the data collected under subparagraph (C) to assess the extent to which shipped products are put into use in demand response and thermal storage programs.</content></clause>
<clause class="fontsize10" id="yc495c994-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc495c995-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xc495c996-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xc495c997-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Prevention of product diversion</inline>.—</heading><content>If the Secretary determines that sales of grid-enabled water heaters exceed by 15 percent or greater the quantity of such products activated for use in demand response and thermal storage programs annually, the Secretary shall, after opportunity for notice and comment, establish procedures to prevent product diversion for non-program purposes.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc495c998-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Compliance</inline>.—</heading><clause class="fontsize10" id="yc495c999-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Subparagraphs (A) through (D) shall remain in effect until the Secretary determines under this section that—</chapeau><subclause class="fontsize10" id="yc495c99a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>grid-enabled water heaters do not require a separate efficiency requirement; or</content></subclause>
<subclause class="fontsize10" id="yc495c99b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>sales of grid-enabled water heaters exceed by 15 percent or greater the quantity of such products activated for use in demand response and thermal storage programs annually and procedures to prevent product diversion for non-program purposes would not be adequate to prevent such product diversion.</content></subclause>
</clause>
<clause class="fontsize10" id="yc495c99c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Effective date</inline>.—</heading><content>If the Secretary exercises the authority described in clause (i) or amends the efficiency requirement for grid-enabled water heaters, that action will take effect on the date described in subsection (m)(4)(A)(ii).</content></clause>
<clause class="fontsize10" id="yc495c99d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Consideration</inline>.—</heading><content>In carrying out this section with respect to electric water heaters, the Secretary shall consider the impact on thermal storage and demand response programs, including any impact on energy savings, electric bills, peak load reduction, electric reliability, integration of renewable resources, and the environment.</content></clause>
<clause class="fontsize10" id="yc495c99e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><content>In carrying out this paragraph, the Secretary shall require that grid-enabled water heaters be equipped with communication capability to enable the grid-enabled water heaters to participate in ancillary services programs if the Secretary determines that the technology is available, practical, and cost-effective.”</content></clause>

<subparagraph class="fontsize10" id="yc495f0b8-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>to otherwise enable a grid-enabled water heater to operate at its designed specification and capabilities with knowledge that such water heater is not used as part of an electric thermal storage or demand response program; or</content></subparagraph>
<subparagraph class="fontsize10" id="yc495f0b9-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>to knowingly remove or render illegible the label of a grid-enabled water heater described in section 325(e)(6)(A)(ii)(V).”</content></subparagraph>

<subparagraph class="fontsize10" id="yc4975056-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B)</num><clause class="inline" id="yc4975057-e86f-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><chapeau>Subject to clause (ii), the space is benchmarked under a nationally recognized, online, free benchmarking program, with public disclosure, unless the space is a space <page identifier="/us/stat/129/190">129 STAT. 190</page>
for which owners cannot access whole building utility consumption data, including spaces—</chapeau><subclause class="fontsize10" id="yc4975058-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>that are located in States with privacy laws that provide that utilities shall not provide such aggregated information to multitenant building owners; and</content></subclause>
<subclause class="fontsize10" id="yc4975059-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>for which tenants do not provide energy consumption information to the commercial building owner in response to a request from the building owner.</content></subclause>

<clause class="indentUp0 fontsize10" id="yc497505a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>A Federal agency that is a tenant of the space shall provide to the building owner, or authorize the owner to obtain from the utility, the energy consumption information of the space for the benchmarking and disclosure required by this subparagraph.”</content></clause>

<subsection class="firstIndent0 fontsize10" id="yc497505b-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Study</inline>.—</heading><paragraph class="fontsize10" id="yc497505c-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc497505d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xc497505e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Collaboration.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 2 years after the date of enactment of this Act, the Secretary of Energy, in collaboration with the Administrator of the Environmental Protection Agency, shall complete a study—</chapeau><subparagraph class="fontsize10" id="yc497505f-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>on the impact of—</chapeau><clause class="fontsize10" id="yc4975060-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>State and local performance benchmarking and disclosure policies, and any associated building efficiency policies, for commercial and multifamily buildings; and</content></clause>
<clause class="fontsize10" id="yc4975061-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>programs and systems in which utilities provide aggregated information regarding whole building energy consumption and usage information to owners of multitenant commercial, residential, and mixed-use buildings;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc4975062-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>that identifies best practice policy approaches studied under subparagraph (A) that have resulted in the greatest improvements in building energy efficiency; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc4975063-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>that considers—</chapeau><clause class="fontsize10" id="yc4975064-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>compliance rates and the benefits and costs of the policies and programs on building owners, utilities, tenants, and other parties;</content></clause>
<clause class="fontsize10" id="yc4975065-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>utility practices, programs, and systems that provide aggregated energy consumption information to multitenant building owners, and the impact of public utility commissions and State privacy laws on those practices, programs, and systems;</content></clause>
<clause class="fontsize10" id="yc4975066-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>exceptions to compliance in existing laws where building owners are not able to gather or access whole building energy information from tenants or utilities;</content></clause>
<clause class="fontsize10" id="yc4975067-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><chapeau>the treatment of buildings with—</chapeau><subclause class="fontsize10" id="yc4975068-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/iv/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>multiple uses;</content></subclause>
<subclause class="fontsize10" id="yc4975069-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/iv/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>uses for which baseline information is not available; and</content></subclause>
<subclause class="fontsize10" id="yc497506a-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/iv/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>uses that require high levels of energy intensities, such as data centers, trading floors, and televisions studios;</content></subclause>
</clause>
<clause class="fontsize10" id="yc497506b-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>implementation practices, including disclosure methods and phase-in of compliance;</content></clause>
<clause class="fontsize10" id="yc497506c-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>the safety and security of benchmarking tools offered by government agencies, and the resiliency of those tools against cyber attacks; and<page identifier="/us/stat/129/191">129 STAT. 191</page></content></clause>
<clause class="fontsize10" id="yc497506d-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/b/1/C/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>international experiences with regard to building benchmarking and disclosure laws and data aggregation for multitenant buildings.</content></clause>

<subsection class="firstIndent0 fontsize10" id="yc4975070-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Creation and Maintenance of Database</inline>.—</heading><paragraph class="fontsize10" id="yc4975071-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4975072-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xc4975073-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xc4975074-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of this Act and following opportunity for public notice and comment, the Secretary of Energy, in coordination with other relevant agencies, shall maintain, and if necessary create, a database for the purpose of storing and making available public energy-related information on commercial and multifamily buildings, including—</chapeau><subparagraph class="fontsize10" id="yc4975075-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>data provided under Federal, State, local, and other laws or programs regarding building benchmarking and energy information disclosure;</content></subparagraph>
<subparagraph class="fontsize10" id="yc4975076-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>information on buildings that have disclosed energy ratings and certifications; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc4975077-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/c/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>energy-related information on buildings provided voluntarily by the owners of the buildings, only in an anonymous form unless the owner provides otherwise.</content></subparagraph>

<paragraph class="fontsize10" id="yc4975078-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Complementary programs</inline>.—</heading><content>The database maintained pursuant to paragraph (1) shall complement and not duplicate the functions of the Environmental Protection Agency’s Energy Star Portfolio Manager tool.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yc4975079-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Input From Stakeholders</inline>.—</heading><content>The Secretary of Energy shall seek input from stakeholders to maximize the effectiveness of the actions taken under this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc497507a-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/11/tIII/s301/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, and every 2 years thereafter, the Secretary of Energy shall submit to the Committee on Energy and Commerce of the House of Representatives and Committee on Energy and Natural Resources of the Senate a report on the progress made in complying with this section.</content></subsection>
