<section id="d250404e88" identifier="/us/pl/114/109/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3fdf321-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s3301">31 USC 3301 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Federal Improper Payments Coordination Act of 2015</shortTitle>”.</content></section>
<section id="d250404e103" identifier="/us/pl/114/109/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AVAILABILITY OF THE DO NOT PAY INITIATIVE TO THE JUDICIAL AND LEGISLATIVE BRANCHES AND STATES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe3fe4142-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 5 of the Improper Payments Elimination and Recovery Improvement Act of 2012 (<ref href="/us/usc/t31/s3321">31 U.S.C. 3321 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ye3fe4143-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)(3)—</chapeau><subparagraph class="fontsize10" id="ye3fe4144-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the paragraph heading, by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">by agencies</headingText></quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="ye3fe4145-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>For purposes</quotedText>” and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="indentUp0 fontsize10" id="ye3fe4146-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>For purposes”</content></subparagraph>

<subparagraph class="fontsize10" id="ye3fe4147-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentUp0 fontsize10" id="ye3fe6858-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3fe6859-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p><p class="leftAlign firstIndent0 fontsize8" id="xe3fe685a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Other entities</inline>.—</heading><content>States and any contractor, subcontractor, or agent of a State, and the judicial and legislative branches of the United States (as defined in paragraphs (2) and (3), respectively, of <ref href="/us/usc/t18/s202/e">section 202(e) of title 18, United States Code</ref>), shall have access to, and use of, the Do Not Pay Initiative for the purpose of verifying payment or award eligibility for payments (as defined in section 2(g)(3) of the Improper Payments Information Act of 2002 (<ref href="/us/usc/t31/s3321">31 U.S.C. 3321 note</ref>)) when, with respect to a State, the Director of the Office of Management and Budget determines that the Do Not Pay Initiative is appropriately established for that State and any contractor, subcontractor, or agent of the State, and, with respect to the judicial and legislative branches of the United States, when the Director of the Office of Management and Budget determines that the Do Not Pay Initiative is appropriately established for the judicial branch or the legislative branch, as applicable.</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="ye3fe685b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Consistency with privacy act of 1974</inline>.—</heading><content>To ensure consistency with the principles of <ref href="/us/usc/t5/s552a">section 552a of title 5, United States Code</ref> (commonly known as the ‘Privacy Act of 1974’), the Director of the Office of Management and Budget may issue guidance that establishes privacy and other requirements that shall be incorporated into <page identifier="/us/stat/129/2226">129 STAT. 2226</page>
Do Not Pay Initiative access agreements with States, including any contractor, subcontractor, or agent of a State, and the judicial and legislative branches of the United States.”</content></subparagraph>
</quotedContent>; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye3fe685c-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (d)(2)—</chapeau><subparagraph class="fontsize10" id="ye3fe685d-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (B), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” after the semicolon;</content></subparagraph>
<subparagraph class="fontsize10" id="ye3fe685e-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye3fe685f-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s2/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subparagraph (C) the following:<quotedContent><subparagraph class="indentUp0 fontsize10" id="ye3fe6860-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>may include States and their quasi-government entities, and the judicial and legislative branches of the United States (as defined in paragraphs (2) and (3), respectively, of <ref href="/us/usc/t18/s202/e">section 202(e) of title 18, United States Code</ref>) as users of the system in accordance with subsection (b)(3).”</content></subparagraph>

<section id="d250404e250" identifier="/us/pl/114/109/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>IMPROVING THE SHARING AND USE OF DATA BY GOVERNMENT AGENCIES TO CURB IMPROPER PAYMENTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xe3feb681-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Improper Payments Elimination and Recovery Improvement Act of 2012 (<ref href="/us/usc/t31/s3321">31 U.S.C. 3321 note</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ye3feb682-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in section 5(a)(2), by <amendingAction type="delete">striking</amendingAction> subparagraph (A) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="fontsize10" id="ye3feb683-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>The death records maintained by the Commissioner of Social Security.”</content></subparagraph>

<paragraph class="fontsize10" id="ye3feb684-e86f-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/109/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="ye3fedd95-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658141"><num class="fontsize12" value="7">“SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3fedd96-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t31/s3321">31 USC 3321 note</ref>.</p></sidenote><heading class="fontsize12">IMPROVING THE USE OF DATA BY GOVERNMENT AGENCIES FOR CURBING IMPROPER PAYMENTS.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="ye3fedd97-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3fedd98-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xe3fedd99-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedure.</p><p class="leftAlign firstIndent0 fontsize8" id="xe3fedd9a-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Prompt Reporting of Death Information by the Department of State and the Department of Defense</inline>.—</heading><content>Not later than 1 year after the date of enactment of this section, the Secretary of State and the Secretary of Defense shall establish a procedure under which each Secretary shall, promptly and on a regular basis, submit information relating to the deaths of individuals to each agency for which the Director of the Office of Management and Budget determines receiving and using such information would be relevant and necessary.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="ye3fedd9b-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Guidance to Agencies Regarding Data Access and Use for Improper Payments Purposes</inline>.—</heading><paragraph class="fontsize10" id="ye3fedd9c-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3fedd9d-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xe3fedd9e-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this section, the Director of the Office of Management and Budget, in consultation with the Council of the Inspectors General on Integrity and Efficiency, the heads of other relevant Federal, State, and local agencies, and Indian tribes and tribal organizations, as appropriate, shall issue guidance regarding implementation of the Do Not Pay Initiative under section 5 to—</chapeau><subparagraph class="fontsize10" id="ye3fedd9f-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Department of the Treasury; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye3fedda0-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>each agency or component of an agency—</chapeau><clause class="fontsize10" id="ye3fedda1-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>that operates or maintains a database of information described in section 5(a)(2); or</content></clause>
<clause class="fontsize10" id="ye3fedda2-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xe3fedda3-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>for which the Director determines improved data matching would be relevant, necessary, or beneficial.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye3fedda4-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>The guidance issued under paragraph (1) shall—</chapeau><subparagraph class="fontsize10" id="ye3fedda5-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>address the implementation of subsection (a); and<page identifier="/us/stat/129/2227">129 STAT. 2227</page></content></subparagraph>
<subparagraph class="fontsize10" id="ye3fedda6-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>include the establishment of deadlines for access to and use of the databases described in section 5(a)(2) under the Do Not Pay Initiative.”</content></subparagraph>

<section id="d250404e388" identifier="/us/pl/114/109/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DATA ANALYTICS.</heading><content class="firstIndent0 fontsize10" id="xe3ff04b7-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 5 of the Improper Payments Elimination and Recovery Improvement Act of 2012 (<ref href="/us/usc/t31/s3321">31 U.S.C. 3321 note</ref>), <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="ye3ff2bc8-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Report on Improper Payments Data Analysis</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of the Federal Improper Payments Coordination Act of 2015, the Secretary of the Treasury shall submit to Congress a report which shall include a description of—</chapeau><paragraph class="fontsize10" id="ye3ff2bc9-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>data analytics performed as part of the Do Not Pay Business Center operated by the Department of the Treasury for the purpose of detecting, preventing, and recovering improper payments through preaward, postaward prepayment, and postpayment analysis, which shall include a description of any analysis or investigations incorporating—</chapeau><subparagraph class="fontsize10" id="ye3ff2bca-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>review and data matching of payments and beneficiary enrollment lists of State programs carried out using Federal funds for the purposes of identifying eligibility duplication, residency ineligibility, duplicate payments, or other potential improper payment issues;</content></subparagraph>
<subparagraph class="fontsize10" id="ye3ff2bcb-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>review of multiple Federal agencies and programs for which comparison of data could show payment duplication; and</content></subparagraph>
<subparagraph class="fontsize10" id="ye3ff2bcc-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>review of other information the Secretary of the Treasury determines could prove effective for identifying, preventing, or recovering improper payments, which may include investigation or review of information from multiple Federal agencies or programs;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye3ff2bcd-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the metrics used in determining whether the analytic and investigatory efforts have reduced, or contributed to the reduction of, improper payments or improper awards; and</content></paragraph>
<paragraph class="fontsize10" id="ye3ff2bce-e86f-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the target dates for implementing the data analytics operations performed as part of the Do Not Pay Business Center”</content></paragraph>
