<section id="d250766e94" identifier="/us/pl/114/105/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Federal Perkins Loan Program Extension Act of 2015</shortTitle>”.</content></section>
<section id="d250766e104" identifier="/us/pl/114/105/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>EXTENSION OF FEDERAL PERKINS LOAN PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y78ec2be3-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Authority to Make Loans</inline>.—</heading><paragraph class="fontsize10" id="y78ec2be4-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Section 461 of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1087aa">20 U.S.C. 1087aa</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="y78ec2be5-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>of stimulating and assisting in the establishment and maintenance of funds at institutions of higher education for the making of low-interest loans to students in need thereof</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>assisting in the maintenance of funds at institutions of higher education for the making of loans to undergraduate students in need</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y78ec2be6-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (b) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y78ec52f7-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x78ec52f8-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Extension dates.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Authority to Make Loans</inline>.—</heading><paragraph class="fontsize10" id="y78ec52f9-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><subparagraph class="fontsize10" id="y78ec52fa-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Loans for new undergraduate federal perkins loan borrowers</inline>.—</heading><content>Through September 30, 2017, an institution of higher education may make a loan under this part to an eligible undergraduate student who, on the date of disbursement of a loan made under this part, has no outstanding balance of principal or interest on a loan made under this part from the student loan fund established under this part by the institution, but only if the institution has awarded all Federal Direct Loans, as referenced under subparagraphs (A) and (D) of section 455(a)(2), for which such undergraduate student is eligible.</content></subparagraph>
<subparagraph class="fontsize10" id="y78ec52fb-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Loans for current undergraduate federal perkins loan borrowers</inline>.—</heading><content>Through September 30, 2017, an institution of higher education may make a loan under this part to an eligible undergraduate student who, on the date of disbursement of a loan made under this part, has an outstanding balance of principal or interest on a loan made under this part from the student loan fund established under this part by the institution, but only if the institution has awarded all Federal Direct Stafford <page identifier="/us/stat/129/2220">129 STAT. 2220</page>
Loans as referenced under section 455(a)(2)(A) for which such undergraduate student is eligible.</content></subparagraph>
<subparagraph class="fontsize10" id="y78ec52fc-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Loans for certain graduate borrowers</inline>.—</heading><content>Through September 30, 2016, with respect to an eligible graduate student who has received a loan made under this part prior to October 1, 2015, an institution of higher education that has most recently made such a loan to the student for an academic program at such institution may continue making loans under this part from the student loan fund established under this part by the institution to enable the student to continue or complete such academic program.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y78ec52fd-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">No additional loans</inline>.—</heading><content>An institution of higher education shall not make loans under this part after September 30, 2017.</content></paragraph>
<paragraph class="fontsize10" id="y78ec52fe-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition on additional appropriations</inline>.—</heading><content>No funds are authorized to be appropriated under this Act or any other Act to carry out the functions described in paragraph (1) for any fiscal year following fiscal year 2015.”</content></paragraph>

<subparagraph class="fontsize10" id="y78ec52ff-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (c).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y78ec5300-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x78ec5301-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x78ec5302-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t20/s1087aa">20 USC 1087aa note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Notwithstanding the amendments made under paragraph (1) of this subsection, an eligible graduate borrower who received a disbursement of a loan under part E of title IV of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1087aa/etseq">20 U.S.C. 1087aa et seq.</ref>) after June 30, 2016 and before October 1, 2016, for the 2016–2017 award year, may receive a subsequent disbursement of such loan by June 30, 2017, for which the borrower received an initial disbursement after June 30, 2016 and before October 1, 2016.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y78ec5303-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Distribution of Assets From Student Loan Funds</inline>.—</heading><chapeau>Section 466 of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1087ff">20 U.S.C. 1087ff</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y78ec5304-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y78ec5305-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>After September 30, 2003, and not later than March 31, 2004</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Beginning October 1, 2017</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y78ec5306-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>September 30, 2003</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>September 30, 2017</quotedText>”;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y78ec5307-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y78ec5308-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>After October 1, 2012</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Beginning October 1, 2017</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y78ec5309-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>September 30, 2003</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>September 30, 2017</quotedText>”; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y78ec530a-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>in subsection (c)(1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>October 1, 2004</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>October 1, 2017</quotedText>”.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y78ec530b-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x78ec530c-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t20/s1226a">20 USC 1226a note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional Extensions Not Permitted</inline>.—</heading><content>Section 422 of the General Education Provisions Act (<ref href="/us/usc/t20/s1226a">20 U.S.C. 1226a</ref>) shall not apply to further extend the duration of the authority under paragraph (1) of section 461(b) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1087aa/b">20 U.S.C. 1087aa(b)</ref>), as amended by subsection (a)(1) of this section, beyond September 30, 2017, on the basis of the extension under such subsection.</content></subsection>

<section id="d250766e363" identifier="/us/pl/114/105/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DISCLOSURE REQUIRED PRIOR TO DISBURSEMENT.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x78eca12d-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 463A(a) of the Higher Education Act of 1965 (<ref href="/us/usc/t20/s1087cc–1/a">20 U.S.C. 1087cc–1(a)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y78eca12e-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (12), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” after the semicolon;<page identifier="/us/stat/129/2221">129 STAT. 2221</page></content></paragraph>
<paragraph class="fontsize10" id="y78eca12f-e870-11f0-a1e4-69761a48a15a" identifier="/us/pl/114/105/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (13), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> a semicolon; and</content></paragraph>

<paragraph class="indentUp0 fontsize10" id="y78eca133-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">“(15) </num><content>a notice and explanation that repayment and forgiveness benefits available to borrowers of loans made under part D are not available to borrowers participating in the loan program under this part;</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y78eca134-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">“(16) </num><content>a notice and explanation regarding a borrower’s option to consolidate a loan made under this part into a Federal Direct Loan under part D, including any benefit of such consolidation;</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y78eca135-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="17">“(17) </num><content>with respect to new undergraduate Federal Perkins loan borrowers, as described in section 461(b)(1)(A), a notice and explanation providing a comparison of the interest rates of loans under this part and part D and informing the borrower that the borrower has reached the maximum annual borrowing limit for which the borrower is eligible as referenced under subparagraphs (A) and (D) of section 455(a)(2); and</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="y78eca136-e870-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="18">“(18) </num><content>with respect to current undergraduate Federal Perkins loan borrowers, as described in section 461(b)(1)(B), a notice and explanation providing a comparison of the interest rates of loans under this part and part D and informing the borrower that the borrower has reached the maximum annual borrowing limit for which the borrower is eligible on Federal Direct Stafford Loans as referenced under section 455(a)(2)(A).”</content></paragraph>
