<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e734bbf-e871-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Green Mountain Lookout Heritage Protection Act.</p></sidenote>
<section id="d354977e88" identifier="/us/pl/113/99/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Green Mountain Lookout Heritage Protection Act</shortTitle>”.</content></section>
<section id="d354977e98" identifier="/us/pl/113/99/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CLARIFICATION OF LEGAL AUTHORITY OF GREEN MOUNTAIN LOOKOUT.</heading><subsection class="firstIndent0 fontsize10" id="y9e7372d0-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Legal Authority of Lookout</inline>.—</heading><content>Section 4(b) of the Washington State Wilderness Act of 1984 (<ref href="/us/pl/98/339">Public Law 98–339</ref>; <ref href="/us/stat/98/300">98 Stat. 300</ref>; <ref href="/us/usc/t16/s1131">16 U.S.C. 1131 note</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> the following: “<quotedText>, and except that with respect to the lands described in section 3(5), the designation of such lands as a wilderness area shall not preclude the operation and maintenance of Green Mountain Lookout.</quotedText>”</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9e7372d1-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by this section shall take effect as if included in the enactment of the Washington State Wilderness Act of 1984.</content></subsection>

<section id="d354977e141" identifier="/us/pl/113/99/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PRESERVATION OF GREEN MOUNTAIN LOOKOUT LOCATION.</heading><content style="-uslm-lc:I658120">  The <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9e7372d2-e871-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote>Secretary of Agriculture, acting through the Chief of the Forest Service, may not move Green Mountain Lookout from its current location on Green Mountain in the Mount Baker-Snoqualmie National Forest unless the Secretary determines that moving Green Mountain Lookout is necessary to preserve the Lookout or to ensure the safety of individuals on or around Green Mountain. If the Secretary makes such a determination, the Secretary shall move the Green Mountain Lookout to a location outside of the lands described in section 3(5) of the Washington State Wilderness Act of 1984 and designated as a wilderness area in section 4(b) of such Act.</content></section>
<section id="d354977e153" identifier="/us/pl/113/99/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>ALASKA NATIVE VETERAN ALLOTMENT.</heading><subsection class="firstIndent0 fontsize10" id="y9e740f13-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y9e740f14-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Application</inline>.—</heading><content>The term “<term>application</term>” means the Alaska Native Veteran Allotment application numbered AA–084021–B.</content></paragraph>
<paragraph class="fontsize10" id="y9e740f15-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Federal land</inline>.—</heading><chapeau>The term “<term>Federal land</term>” means the 80 acres of Federal land that is—</chapeau><subparagraph class="fontsize10" id="y9e740f16-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>described in the application; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9e740f17-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>depicted as Lot 2 in U.S. Survey No. 13957, Alaska, that was officially filed on October 9, 2009.<page identifier="/us/stat/128/1144">128 STAT. 1144</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9e740f18-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9e740f19-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps"> Issuance of Patent</inline>.—</heading><chapeau>Notwithstanding section 41 of the Alaska Native Claims Settlement Act (<ref href="/us/usc/t43/s1629g">43 U.S.C. 1629g</ref>) and subject to subsection (c), the Secretary shall—</chapeau><paragraph class="fontsize10" id="y9e740f1a-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>approve the application; and</content></paragraph>
<paragraph class="fontsize10" id="y9e740f1b-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>issue a patent for the Federal land to the person that submitted the application.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9e740f1c-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Terms and Conditions</inline>.—</heading><paragraph class="fontsize10" id="y9e740f1d-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The patent issued under subsection (b) shall—</chapeau><subparagraph class="fontsize10" id="y9e740f1e-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>only be for the surface rights to the Federal land; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9e740f1f-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>be subject to the terms and conditions of any certificate issued under section 41 of the Alaska Native Claims Settlement Act (<ref href="/us/usc/t43/s1629g">43 U.S.C. 1629g</ref>), including terms and conditions providing that—</chapeau><clause class="fontsize10" id="y9e740f20-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/c/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the patent is subject to valid existing rights, including any right of the United States to income derived, directly or indirectly, from a lease, license, permit, right-of-way, or easement on the Federal land; and</content></clause>
<clause class="fontsize10" id="y9e740f21-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/c/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the United States shall reserve an interest in deposits of oil, gas, and coal on the Federal land, including the right to explore, mine, and remove the minerals on portions of the Federal land that the Secretary determines to be prospectively valuable for development.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9e740f22-e871-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/113/99/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Additional terms and conditions</inline>.—</heading><content>The Secretary may require any additional terms and conditions for the issuance of the patent under subsection (a) that the Secretary determines to be appropriate to protect the interests of the United States.</content></paragraph>
