<section id="d251521e110" identifier="/us/pl/113/98/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Children’s Hospital GME Support Reauthorization Act of 2013</shortTitle>”.</content></section>
<section id="d251521e120" identifier="/us/pl/113/98/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PROGRAM OF PAYMENTS TO CHILDREN’S HOSPITALS THAT OPERATE GRADUATE MEDICAL EDUCATION PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="yc3ae659f-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 340E of the Public Health Service Act (<ref href="/us/usc/t42/s256e">42 U.S.C. 256e</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yc3ae65a0-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>through 2005 and each of fiscal years 2007 through 2011</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>through 2005, each of fiscal years 2007 through 2011, and each of fiscal years 2014 through 2018</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="yc3ae65a1-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (f)—</chapeau><subparagraph class="fontsize10" id="yc3ae65a2-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in paragraph (1)(A)—</chapeau><clause class="fontsize10" id="yc3ae65a3-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in clause (iii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>”;</content></clause>
<clause class="fontsize10" id="yc3ae65a4-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in clause (iv), by <amendingAction type="delete">striking</amendingAction> the period and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></clause>
<clause class="fontsize10" id="yc3ae65a5-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="fontsize10" id="yc3ae65a6-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>for each of fiscal years 2014 through 2018, $100,000,000.”</content></subsection>

<subparagraph class="fontsize10" id="yc3ae65a7-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>in paragraph (2)—</chapeau><clause class="fontsize10" id="yc3ae65a8-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>”;</content></clause>
<clause class="fontsize10" id="yc3ae65a9-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in subparagraph (D), by <amendingAction type="delete">striking</amendingAction> the period and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></clause>
<clause class="fontsize10" id="yc3ae65aa-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/a/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentDown1 fontsize10" id="yc3ae65ab-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>for each of fiscal years 2014 through 2018, $200,000,000.”</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yc3ae65ac-e871-11f0-a1e4-69761a48a15a" identifier="/us/pl/113/98/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline>.—</heading><content>Section 340E(b)(3)(D) of the Public Health Service Act (<ref href="/us/usc/t42/s256e/b/3/D">42 U.S.C. 256e(b)(3)(D)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>Not later than the end of fiscal year 2011</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Not later than the end of fiscal year 2018</quotedText>”.</content></subsection>

<section id="d251521e264" identifier="/us/pl/113/98/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>SUPPORT OF GRADUATE MEDICAL EDUCATION PROGRAMS IN CERTAIN HOSPITALS.</heading><content class="firstIndent0 fontsize10" id="xc3aeb2cd-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 340E of the Public Health Service Act (<ref href="/us/usc/t42/s256e">42 U.S.C. 256e</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yc3af00ee-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Additional Provisions</inline>.—</heading><paragraph class="fontsize10" id="yc3af00ef-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary is authorized to make available up to 25 percent of the total amounts in excess of <page identifier="/us/stat/128/1141">128 STAT. 1141</page>
$245,000,000 appropriated under paragraphs (1) and (2) of subsection (f), but not to exceed $7,000,000, for payments to hospitals qualified as described in paragraph (2), for the direct and indirect expenses associated with operating approved graduate medical residency training programs, as described in subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="yc3af00f0-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Qualified hospitals</inline>.—</heading><subparagraph class="fontsize10" id="yc3af00f1-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>To qualify to receive payments under paragraph (1), a hospital shall be a free-standing hospital—</chapeau><clause class="fontsize10" id="yc3af00f2-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>with a Medicare payment agreement and that is excluded from the Medicare inpatient hospital prospective payment system pursuant to section 1886(d)(1)(B) of the Social Security Act and its accompanying regulations;</content></clause>
<clause class="fontsize10" id="yc3af00f3-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>whose inpatients are predominantly individuals under 18 years of age;</content></clause>
<clause class="fontsize10" id="yc3af00f4-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>that has an approved medical residency training program as defined in section 1886(h)(5)(A) of the Social Security Act; and</content></clause>
<clause class="fontsize10" id="yc3af00f5-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>that is not otherwise qualified to receive payments under this section or section 1886(h) of the Social Security Act.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc3af00f6-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Establishment of residency cap</inline>.—</heading><content>In the case of a freestanding children’s hospital that, on the date of enactment of this subsection, meets the requirements of subparagraph (A) but for which the Secretary has not determined an average number of full-time equivalent residents under section 1886(h)(4) of the Social Security Act, the Secretary may establish such number of full-time equivalent residents for the purposes of calculating payments under this subsection.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc3af00f7-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Payments</inline>.—</heading><content>Payments to hospitals made under this subsection shall be made in the same manner as payments are made to children’s hospitals, as described in subsections (b) through (e).</content></paragraph>
<paragraph class="fontsize10" id="yc3af00f8-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Payment amounts</inline>.—</heading><content>The direct and indirect payment amounts under this subsection shall be determined using per resident amounts that are no greater than the per resident amounts used for determining direct and indirect payment amounts under subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="yc3af00f9-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><content>A hospital receiving payments under this subsection shall be subject to the reporting requirements under subsection (b)(3).</content></paragraph>
<paragraph class="fontsize10" id="yc3af00fa-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Remaining funds</inline>.—</heading><subparagraph class="fontsize10" id="yc3af00fb-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If the payments to qualified hospitals under paragraph (1) for a fiscal year are less than the total amount made available under such paragraph for that fiscal year, any remaining amounts for such fiscal year may be made available to all hospitals participating in the program under this subsection or subsection (a).</content></subparagraph>
<subparagraph class="fontsize10" id="yc3af00fc-e871-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Quality bonus system</inline>.—</heading><content>For purposes of distributing the remaining amounts described in subparagraph (A), the Secretary may establish a quality bonus system, whereby the Secretary distributes bonus payments to hospitals participating in the program under this subsection <page identifier="/us/stat/128/1142">128 STAT. 1142</page>
or subsection (a) that meet standards specified by the Secretary, which may include a focus on quality measurement and improvement, interpersonal and communications skills, delivering patient-centered care, and practicing in integrated health systems, including training in community-based settings. In developing such standards, the Secretary shall collaborate with relevant stakeholders, including program accrediting bodies, certifying boards, training programs, health care organizations, health care purchasers, and patient and consumer groups.”</content></subparagraph>
